The current Electrotechnical Regulation for Low Voltage, adopted by Decree 2413/1973 of 20 September, was a considerable step forward in the field of technical rules and established a regulatory framework based on a framework regulation and additional instructions, which developed specific aspects, which were highly effective, so that many other regulations were made in a similar format.

However, the evolution of both the technical flow and the legal conditions has, at last and in the end, also resulted in this regulation, a departure from the bases with which it was drawn up, which is why its update.

Law 21/1992, of July 16, of Industry, establishes the new legal framework in which the regulations on industrial safety are obviously unwrapped. Article 12 (5) states that " State-wide industrial safety regulations shall be adopted by the Government of the Nation, without prejudice to the possibility that the Autonomous Communities, with legislative competence in respect of industry, may introduce additional requirements on the same materials in the case of installations located on their territory. "

On the other hand, the Treaty of Accession of Spain to the European Economic Community imposed compliance with the obligations arising from its treaty establishing and successive amendments.

The normative set established by the Spanish Association for Standardisation and Certification (AENOR), with origin in international electrotechnical standards, such as the International Electrotechnical Commission (IEC) or the European Committee for Electrotechnical Standardisation (CENELEC) makes available to the interested parties technical instruments endorsed by a wide experience and agreed by the sectors directly involved, which facilitates implementation homogeneous of the facilities and commercial exchanges.

The Regulation which is approved by this Royal Decree and its accompanying technical instructions maintains the scheme cited and, as far as possible, the order of the previous Regulation, in order to facilitate the transition.

The main novelty of the Regulation is the reference to standards, in so far as they are of an eminently technical nature and, in particular, characteristics of the materials. Given that these standards are largely the result of European EN and International CIS standards, technical solutions can be quickly achieved in line with the requirements of the most advanced countries, reflecting a high degree of consensus in the European Union. the sector.

To make it easier to update, in the text of the instructions only those rules are quoted by their reference numbers, without the year of editing. In an Instruction to this purpose the entire list of the rules is collected, this time with the year of editing, so that when new versions appear they can be made the respective changes in that list, being automatically updated in the device text, without any other intervention. At that time, the time limits for the transition between the versions can also be established, so that manufacturers and distributors of electrical equipment can give a reasonable time to products manufactured in accordance with the version of the overridden rule.

In line with European regulations, the requirements laid down by the Regulation itself are deemed to meet the minimum security objectives required at any time, in accordance with the state of the art, but Other runs are also supported whose equivalence to those security levels is demonstrated by the installation designer.

On the other hand, unlike the previous one, the Regulation now being adopted allows exceptions to be granted to their requirements in cases where their material impossibility is duly justified and measures are provided. compensation, which will avoid situations without output.

The figures of the authorized installers and companies are defined much more precisely, taking into account the different educational formations and experiences obtained in this field. A basic category is established, for the realization of the most common electrical installations, and a specialist category, with several modalities, taking care of the facilities that present relevant peculiarities.

New types of facilities are introduced: from agricultural and horticultural establishments to automation, technical management of energy and safety for buildings in buildings, according to the more modern techniques, passing through a new concept of facilities in swimming pools, where the stresses that provide intrinsic safety, caravans and caravan parks are introduced, among others.

The minimum number of circuits in homes is increased, which will result in greater comfort.

For the execution and commissioning of the facilities, in all cases, the elaboration of a technical documentation, in the form of a project or memory, according to the characteristics of those, and the registration in the corresponding Autonomous Community.

For the first time in such a regulation, the delivery to the holder of an installation of a documentation is required where it is reflected its fundamental characteristics, layout, instructions and precautions of use, etc. It was pointless not to proceed in this way with an installation of a building, while a book of instructions with any electrical apparatus of low economic value is systematically provided.

A table of inspections is established by control bodies, in the case of installations whose security offers particular relevance, without ignoring the fact that the holders of the same must keep them in good condition.

Finally, the competent management center in the field of industrial safety of the Ministry of Science and Technology is responsible for the development of a guide, as aid to the various agents affected for the best understanding of the regulatory requirements.

At the project stage, this provision has complied with the information procedure set out in Royal Decree 1337/1999 of 31 July, which regulates the referral of information in the field of standards and regulations. technical regulations and regulations relating to the services of the information society, in application of Council Directive 98 /34/EEC.

D I S P O N G O:

Single item. Approval of the electrotechnical regulation for low voltage.

The electrotechnical regulation for low voltage and its complementary technical instructions (ITC) BT 01 to BT 51, which are attached to this Royal Decree, is approved.

First transient disposition. Professional carnets.

The holders of approved fitters or authorised installers, to the date of the publication of this Royal Decree, shall have two years, from the date of entry into force of the attached Regulation, for to validate them by the relevant technical instructions provided for in the supplementary technical instruction ITC-BT 03, provided that they have not been withdrawn by sanction, by means of the presentation to the competent authority of the Autonomous Community of a memory in which the respective professional experience at the premises is accredited electrical equipment corresponding to the category or categories for which the validation is requested, and which have the technical and human resources required by ITC-BT 03. On the basis of the validation, the common procedure laid down in the Regulation shall be followed for the renewal of the carnets.

Second transient disposition. Training entities.

As long as the academic and professional qualifications corresponding to the minimum training required for the exercise of the installer activity are not determined by the educational administrations, this training may be accredited, without academic effects, through the corresponding certification issued by a public or private entity that has the capacity to carry out training activities in this field and has the corresponding authorization administrative.

The requirements of the training entities will be established by the corresponding Ministerial Order.

Transitional provision third. Facilities at the processing stage at the date of entry into force of the Regulation.

An extension of two years from the entry into force of the Annex Regulation shall be allowed for the implementation of those installations whose technical documentation has been submitted before the entry into force of the said Regulation. the competent authority of the Autonomous Community and in accordance with the provisions of the Electrotechnical Regulation for Low Voltage, approved by Decree 2413/1973 of 20 September 1973, its complementary technical instructions and all the provisions of the develop and modify.

Single repeal provision. Regulatory repeal.

At the entry into force of the Deputy Regulation, the Electrotechnical Regulation for low voltage, approved by Decree 2413/1973 of 20 September, its complementary technical instructions and all the provisions, will be repealed. who develop and modify them.

This Royal Decree is dictated under the jurisdiction of the sole final provision of Law 21/1992, of 16 July, of Industry, in particular, of the powers corresponding to the State in accordance with the Article 149.1.1. and 13. of the Constitution, concerning the regulation of the basic conditions that guarantee the equality of all Spaniards in the exercise of rights and in the fulfilment of constitutional duties, as well as bases and conditions for the overall planning of economic activity.

Final disposition second. Enable the Minister of Science and Technology.

The Minister of Science and Technology is empowered to provide, in the interests of technological development and at the request of an interested party, technical requirements, in general and provisional provided for in the Regulation or its accompanying technical instructions (ITCs), which enable a level of safety at least equivalent to the previous ones, as a result of the modification of the same.

Final disposition third. Entry into force.

The electrotechnical regulation for low voltage, attached to this Royal Decree, will enter into force, with a mandatory character, for all installations covered by its scope, the year of its publication in the "Official State Gazette". However, it may be applied, on a voluntary basis, from the date of such publication.

ELECTROTECHNICAL REGULATION FOR LOW VOLTAGE

Article 1. Object.

This Regulation is intended to lay down the technical conditions and guarantees to be met by electrical installations connected to a supply source within the limits of low voltage, with the aim of:

a) Preserve the security of people and goods.

b) Ensure the normal functioning of such facilities and prevent disturbances in other facilities and services.

c) Contribute to the technical reliability and economic efficiency of the facilities.

Article 2. Application field.

1. This Regulation shall apply to installations which distribute electrical energy, to electricity generators for own consumption and to the recipients, at the following nominal voltage limits:

a) Alternate current: equal to or less than 1,000 volts.

b) Continuous stream: equal to or less than 1,500 volts.

2. This Regulation shall

:

a) To new installations, to their modifications and to their extensions.

b) To existing installations prior to their entry into force that are subject to major modifications, major repairs and their extensions.

(c) To existing installations prior to their entry into force, as regards the inspection regime, but the technical criteria applicable to such inspections shall be those corresponding to the regulations with which they are approved.

Important modifications or repairs shall mean those affecting more than 50 per 100 of the installed power. Equally important modification is considered to affect complete lines of production processes with new circuits and frames, even with reduced power.

3. It shall also apply to existing installations before their entry into force, where their state, situation or characteristics entail a serious risk to persons or property, or major disturbances occur in the normal operation of other facilities, in the opinion of the competent authority of the Autonomous Community.

4. Installations and equipment for the exclusive use in mines, traction material, cars, vessels, aircraft, communication systems, military uses and other installations and equipment which are not covered by this Regulation are excluded from the application of this Regulation. subject to specific regulation.

5. The requirements of this Regulation and its accompanying technical instructions (hereinafter ITCs) are general in nature, and specific, other. The specific ones will replace, modify or complement the generals, depending on the cases.

6. The general requirements shall not apply, but only specific requirements, which shall be the subject of the relevant ITCs, to installations or equipment using "very low voltage" (up to 50 V in alternating current and up to 75 V in (a) continuous current), for example computer networks and the like, provided that their energy source is autonomous, does not feed on networks intended for other supplies, or that such facilities are absolutely independent of the low-level networks voltage with values above those set for such minor voltages.

Article 3. Electrical installation.

Electrical installation means any set of apparatus and associated circuits in anticipation of a particular purpose: production, conversion, transformation, transmission, distribution or use of electrical energy.

Article 4. Classification of the tensions. Frequency of networks.

1. For the purpose of applying the requirements of this Regulation, low voltage electrical installations are classified according to the nominal voltages assigned to them in the following form:

2. The nominal voltages usually used in alternating current distributions shall be:

a) 230 V between phases for three-conductor three-phase networks.

b) 230 V between phase and neutral, and 400 V between phases, for three-phase networks of 4 conductors.

3. Where one of the voltage normalised in this Regulation cannot be used at the premises, because they must be connected to or derived from another installation with a different voltage, the registration shall be conditional on the new installation being used in the future with the standard voltage that can be foreseen.

4. The frequency used in the network shall be 50 Hz.

5. Other voltages and frequencies may be used, subject to the reasoned approval of the competent authority of the Public Administration, where the need for such a situation is justified, no significant disturbance in the operation of other facilities and the level of security for persons and property is not impaired.

Article 5. Disturbances in the networks.

Low-voltage installations that could cause disturbances over telecommunications, power distribution networks or receivers must be equipped with the appropriate protective devices, according to lays down the provisions in force on this subject.

Article 6. Equipment and materials.

1. The materials and equipment used in the installations must be used in the form and for the purpose that they were manufactured. Those included in the field of application of the transposition regulation of the European Union Directives shall comply with the provisions laid down therein.

Not covered by such a regulation shall the technical criteria laid down in this Regulation apply. In particular, the equipment and materials shall be included with the necessary particulars for their correct installation and use, and must be marked with the following minimum particulars:

a) Identification of the manufacturer, legal representative or marketing officer.

b) Brand and model.

c) Tension and power (or intensity) allocated.

d) Any other indication concerning the specific use of the material or equipment, assigned by the manufacturer.

2. The competent bodies of the Autonomous Communities shall verify compliance with the technical requirements of the materials and equipment subject to this Regulation. Verification may be carried out by sampling.

Article 7. Match with other stresses.

If, in a low voltage electrical installation, circuits or elements subjected to stresses exceeding the limits defined in this Regulation are integrated, in the absence of any specific indication in this Regulation, comply with the rules laid down in the regulations governing the facilities for such tensions.

Article 8. Distribution networks.

1. Public or private service facilities for the purpose of the distribution of electrical energy shall be defined:

(a) By the values of the voltage between the pole or the polar conductor and the ground and between two phase or polar conductors, for the facilities attached directly to the ground.

b) By the value of the voltage between two phase or polar conductors, for installations not directly attached to the ground.

2. The permissible electric current intensities in the conductors shall be regulated according to the technical conditions of the distribution networks and the protection systems used in the systems.

Article 9. Outdoor lighting installations.

External lighting installations shall be regarded as having the purpose of lighting the roads or communication and the spaces between buildings which, by virtue of their characteristics or safety They must remain enlightened, permanently or circumstantial, whether or not they are in the public domain.

The conditions to be met by the outdoor lighting facilities shall be those corresponding to their peculiar weather conditions and, due to the risk involved, which part of their elements are easily accessible.

Article 10. Types of provisioning.

1. For the purposes of this Regulation, supplies are classified as normal and complementary.

A) Normal supplies are those made to each subscriber by a single distribution company for the entire power contracted by it and with a single point of delivery of the energy.

B) Supplementary or security supplies are the ones that, for security and continuity of supply, complement a normal supply. These supplies may be carried out by two different undertakings or by the same undertaking, where the use of energy, independent means of transport and distribution, or by the user through means of production, is available at the place of use. own. Complementary supply is considered to be the one which, even on the basis of the same transformer, has an independent distribution line from the same source of low voltage. They are classified in the supply of relief, supply of reserve and duplicate supply:

a) Relief supply is the one that is limited to a minimum receiving power equal to 15 per 100 of the total contracted for normal supply.

b) Reserve supply is the one dedicated to maintaining a restricted service of the indispensable operating elements of the receiving facility, with a minimum power of 25 per 100 of the total power contracted for the normal supply.

c) Duplicate supply is the one that is capable of maintaining a service greater than 50 per 100 of the total contracted power for the normal supply.

2. The facilities provided for additional supplies must be equipped with the devices necessary to prevent a coupling between the two supplies, except as prescribed in the accompanying technical instructions. The installation of these devices must be carried out in accordance with the supply companies. If that agreement is not established, the competent authority of the Autonomous Community shall decide as appropriate within a maximum period of 15 working days from the date on which the consultation is made.

3. In addition to those referred to in the accompanying technical instructions, the competent bodies of the Autonomous Communities may, in each case, fix industrial establishments or establishments engaged in any other activity which, by virtue of their unique characteristics and circumstances, have to provide for the provision of relief, reserve or duplicate supply.

4. If the supplying undertaking to supply the supplementary supply is refused to do so or no agreement has been reached with the user on the proposed technical-economic conditions, the competent authority of the Autonomous Community must where appropriate, within 15 working days from the date of the submission of the dispute.

Article 11. Special feature locales.

Additional technical instructions, based on the particular conditions which they present, shall be laid down in the relevant technical instructions in so called 'special characteristics', such as: Local and wet sites or sites where there is a wet atmosphere, gases or powders of non-flammable materials or fuels, very high or very low temperatures in relation to normal, those that are used for the preservation or repair of motor vehicles, which are affected by the production or distribution services of electrical energy; in installations where the so-called special stresses are used, those which are made on a temporary or temporary basis, the swimming pool facilities, other specifically mentioned in the JTIs and, in general, all where it is necessary to maintain electrical installations in circumstances other than those which can be estimated as normal risk for the use of low voltage electrical energy.

Article 12. Load ordering.

Additional technical instructions concerning the management of the foreseeable charges for each of the consumer groups of similar characteristics shall be laid down in the relevant technical instructions, such as: buildings mainly dedicated to housing, commercial buildings, offices and workshops for industries, based on the best use of electrical power distribution facilities.

Before starting the works, the building project holders must provide the company with all the information necessary to deduct the consumption and charges to be produced, in order to be able to adequate adequate time for the growth of their networks and the forecast of loads in their transformation centres.

Article 13. Local reservation.

The requirements of the regulations governing the transport, distribution, marketing, supply and authorisation procedures of the local authorities shall be followed in respect of the local reserve. electrical power installations.

Article 14. Particular specifications of the supplying companies.

Supply companies will be able to propose specifications on the construction and assembly of the affected, general power lines, meter installations and individual referrals, pointing to the specific technical conditions which are necessary to achieve greater homogeneity in the distribution networks and the facilities of the subscribers.

Such specifications must, in any event, comply with the provisions of the Regulation and must be approved by the competent bodies of the Autonomous Communities, if they are limited to their territorial scope, or by (a) the competent authority in the field of industrial safety of the Ministry of Science and Technology, if it is applied in more than one Autonomous Community, and the opinion of a competent body may be required for this purpose. The particular rules so approved must be published in the Official Gazette.

Article 15. Connection and link facilities.

1. The part of the distribution network installation that feeds the general protection box (s) or equivalent functional unit (s) is called the connection.

The connection will be the responsibility of the supplying company, which will assume the final inspection and verification.

2. It is liaison facilities that attach the general protection box, or general protective boxes, including these, with the user's internal or receiving facilities.

Article 16. Indoor or receiving facilities.

1. The main purpose of the internal or receiving facilities is the use of the electrical energy by a distribution network or by a source of its own energy. Within this concept it is necessary to include any receiving facility even if all or any of its parts are located in the open.

2. In any internal or receiving installation which is designed and carried out, the maximum balance shall be achieved in the loads supported by the different conductors forming part of the same, and this shall be subdivided in such a way that the disturbances caused by Any breakdowns which may occur at some point in the installation shall affect a minimum part of the installation. This subdivision shall also permit the location of the breakdowns and facilitate the control of the isolation of the part of the installation concerned.

3. The protection systems for indoor or reception facilities for low voltage shall prevent the effects of the over-intensities and the over-voltages which, for various reasons, may be foreseen in the systems and will protect their materials and equipment. the actions and effects of external actors. In addition, and for the purposes of general security, the conditions to be met by such facilities shall be determined to protect direct and indirect contacts.

4. In the use of electrical energy for reception facilities, safety measures shall be adopted, both for the protection of users and for the protection of networks, which are proportionate to the characteristics and power of the receiving devices used therein.

5. In addition to the provisions of this Regulation and other regulations applicable to the public at the same time, specific measures and forecasts must be complied with, depending on the risk involved in such operations. defective of the electrical installation.

Article 17. Receivers and grounding.

Without prejudice to the provisions concerning the technical requirements for the design of electrical equipment, as stipulated in Article 6, the installation of the receivers, as well as the system of protection by laying (b) land, must comply with the provisions of the relevant accompanying technical instructions.

Article 18. Execution and commissioning of the facilities.

1. As laid down in Article 12.3 of Law 21/1992 on Industry, the putting into service and use of electrical installations is subject to

following procedure:

(a) A technical documentation defining the characteristics of the installation must be made prior to the execution and, depending on its characteristics, as determined by the relevant ITC, the form of project or technical memory.

(b) The installation shall be verified by the installer, with the supervision of the work manager, where appropriate, in order to verify the correct execution and safe operation of the installation.

(c) In addition, where this is determined in the relevant ITC, the installation shall be the subject of an initial inspection by a control body.

(d) To the completion of the installation and the relevant verifications and, where appropriate, the initial inspection, the installer authorized executor of the installation shall issue an installation certificate, in which it shall be state that it has been carried out in accordance with the provisions of the Regulation and its accompanying technical instructions and in accordance with the technical documentation. Where appropriate, it shall identify and justify any variations in the performance of the product in relation to that provided for in that documentation.

(e) The certificate, together with the technical documentation and, where appropriate, the certificate of work address and the initial inspection, must be deposited with the competent authority of the Autonomous Community in order to register the referred to above, receiving the required copies necessary for the constancy of each person concerned and application for energy supply. The competent authorities shall provide that these documents may be submitted and recorded by computer or telematic procedures.

2. Electrical installations must be made only by authorised installers.

3. The supplying undertaking may not connect the receiving facility to the distribution network if the corresponding copy of the installation certificate duly completed by the competent authority of the Autonomous Community is not delivered.

4. By way of derogation from the preceding paragraph, where there are objective circumstances in respect of which the supply of electricity must be provided before the administrative processing of the installations can be completed, circumstances, duly justified and accompanied by guarantees for the maintenance of the safety of persons and property and of the non-disturbance of other facilities or equipment, shall be exposed to the competent authority of the Autonomous Community, which may authorise, by means of a reasoned decision, the provisional supply for strictly address those needs.

5. In the case of temporary facilities (congresses and exhibitions, with different stands, street fairs, celebrations, verbales, etc.), the competent authority of the Community may admit that the processing of the various partial installations is carried out in a joint manner. In the same way, it can be accepted that the technical documentation is replaced by a declaration, which was first completed by the Administration, in the case of installations systematically carried out on a repetitive basis.

Article 19. Information to users.

As an annex to the installation certificate to be delivered to the holder of any electrical installation, the installation company must make instructions for the correct use and maintenance of the installation certificate. Such instructions shall include, in any case, at least one single-filer scheme of the installation with the fundamental technical characteristics of the electrical equipment and materials installed, as well as a sketch of its layout.

Any modification or extension will require the elaboration of a complement to the above, as much as is necessary.

Article 20. Maintenance of facilities.

The operators must maintain their facilities in good working order, using them according to their characteristics and refrain from intervening in the facilities to modify them. If modifications are necessary, they must be made by an authorized installer.

Article 21. Inspections.

Without prejudice to the power which, in accordance with the provisions of Article 14 of Law 21/1992, of Industry, has the public authority competent to carry out, by itself, the inspection and control measures which the considers that compliance with the safety requirements and requirements laid down by this Regulation and its accompanying technical instructions, as provided for in Article 12.3 of that Law, shall be verified, where appropriate, by an approved inspection body in this regulatory field.

To this end, the corresponding complementary technical instruction will determine:

(a) The facilities and modifications, repairs or extensions of installations that shall be subject to initial inspection, prior to putting into service.

(b) The facilities to be inspected periodically.

(c) The criteria for the assessment of the inspections, as well as the measures to be taken as a result of the inspections.

(d) The time limits for periodic inspections.

Article 22. Authorized installers.

Low voltage electrical installations shall be run by low voltage authorised installers, authorised for the exercise of the activity as set out in the relevant supplementary technical instruction, without prejudice to their possible project and direction of work by qualified qualified technicians.

According to the provisions of Article 13.3 of Law 21/1992, of Industry, the authorizations granted by the corresponding competent bodies of the Autonomous Communities to the installers shall be state-wide.

Article 23. Compliance with the requirements.

1. Installations carried out in accordance with the requirements of this Regulation shall be deemed to provide the conditions of safety which, in accordance with the state of the art, are to be required in order to preserve persons and persons. goods, when used according to their destination.

2. The requirements laid down in this Regulation shall be subject to mandatory minima, in the sense of Article 12 (5) of Law 21/1992, of Industry.

3. Such minima shall be considered to be:

a) By direct application of the requirements of the relevant ITC, or

(b) By applying equivalent security techniques, such as those which, without causing distortions in the distribution systems of the supply companies, provide at least a level of security comparable to that of the previous. The application of equivalent safety techniques shall be duly justified by the designer of the installation and approved by the competent authority of the Autonomous Community.

Article 24. Exceptions.

Without prejudice to Article 6 (1), where it is materially impossible to comply with certain provisions of this Regulation, it is not possible to make use of Article 6 (3) (b) of this Regulation. prior to the procedure referred to in Article 18, the holder of the installation to be made must submit to the competent authority of the Autonomous Community a request for a derogation, stating the reasons for the and indicating the alternative security measures that are proposed, which in no way They may reduce the levels of protection laid down in the Regulation.

The competent authority may reject the request, require the modification of the alternative measures or grant the authorization of exception, which shall always be expressed, the administrative silence being understood as destimatorium.

Article 25. Equivalence of rules of the European Economic Area.

Without prejudice to Article 6, for the purposes of this Regulation and for the placing on the market of products originating in the Member States of the European Union or the European Economic Area, subject to the national industrial safety regulations, the competent public administration shall accept the validity of the certificates and marks in accordance with the rules and the minutes or protocols of tests which are required by those rules. regulations, issued by conformity assessment bodies officially recognised in the those States, provided that it is recognized by the competent public administration that the abovementioned agents provide technical, professional and independent guarantees and impartiality equivalent to those required by Spanish legislation; and that the legal provisions in force in the State on the basis of which conformity is assessed conduct a level of safety equivalent to that required by the relevant Spanish provisions.

Article 26. Reference standards.

1. Complementary technical instructions may provide for the application of UNE or other internationally recognised standards, in whole or in part, in order to facilitate adaptation to the state of the art at any time.

This reference shall be made, as a general rule, without indicating the year of issue of the rules in question.

In the corresponding supplementary technical instruction the listing of all the rules mentioned in the text of the instructions, identified by their titles and numbering, will be collected, which will include the year of editing.

2. Where one or more rules vary their year of issue, or subsequent amendments are made to them, they shall be updated in the list of standards by means of a decision of the competent management centre in the field of industrial safety. of the Ministry of Science and Technology, in which the date from which the use of the new edition of the standard will be valid and the date from which the use of the old edition of the standard will cease be, for regulatory purposes.

In the absence of an express resolution, it is understood that it also complies with the regulatory conditions for the edition of the standard subsequent to the one mentioned in the list of standards, provided that the same does not modify basic criteria and is limited to update tests or increase the intrinsic safety of the material concerned.

Article 27. Accidents.

For statistical purposes and in order to determine the main causes, as well as the possible corrections in the regulations, the corresponding system data of the most accidents must be significant. To this end, in the event of an accident causing damage or casualties, the supplying company must draw up a report containing the essential aspects of the accident. In the first fifteen days of each quarter, they will be required to submit to the Autonomous Communities and to the competent industrial safety management center of the Ministry of Science and Technology, a copy of all the reports.

Article 28. Infringements and penalties.

The infringements of the provisions of this Regulation shall be classified and punished in accordance with the provisions of Title V of Law 21/1992, of Industry.

Article 29. Technical Guide.

The Ministry of Science and Technology's leading industrial safety management centre will develop and keep up to date a non-binding technical guide for the practical implementation of the forecasts. of this Regulation and its accompanying technical instructions, which may provide for clarifications to concepts of a general nature included in this Regulation.
