Real Decreto 1/2001, of 12 January, fixed the organic template of the Fiscal Ministry. Subsequently, Law 23/2001, of 27 December, of the General Budget of the State for the year 2002, increases the economic endowment that allows to increase the number of places in the tax race, therefore the distribution of the same between the various organs of the Fiscal Ministry, as provided for in Article 18.2 and the final provision of Law 50/1981 of 30 December, which regulates the Organic Statute of the Fiscal Ministry.

This Royal Decree has been informed by the Attorney General of the State, heard by the Fiscal Council.

In its virtue, on the proposal of the Minister of Justice and after deliberation of the Council of Ministers at its meeting on 27 September 2002,

D I S P O N G O:

Article 1. Creation of Permanent Adscriptions.

The Permanent Adscriptions of the Fiscal Ministry are created, with the territorial scope that in each case is indicated, in the following locations:

1. Autonomous Community of the Canary Islands:

At the Public Prosecutor's Office of the Provincial Court of Santa Cruz de Tenerife, the Permanent Assembly of Arona, with the scope of its judicial party, is constituted.

2. Comunidad Valenciana:

At the Office of the Prosecutor of the Provincial Court of Alicante, the Permanent Adjudición of Torrevieja, with the scope of its judicial party, is constituted.

Article 2. Creation of squares.

Tax race 49 places corresponding to the second category are created, distributed among the following fiscalis:

Prosecutor of the Provincial Court of Almeria: a square.

Prosecutor's Office of the Provincial Court of Cadiz.

Permanent admission of Algeciras: a square.

Prosecutor's Office of the Provincial Court of Huelva: a square.

Prosecutor of the Provincial Court of Jaen.

Permanent Location of Ubeda: a square.

Public Prosecutor's Office of the Provincial Court of Malaga: three places.

Prosecutor of the Provincial Court of Seville: three places.

Prosecutor of the Superior Court of Justice of Aragon:

a square.

Prosecutor of the Superior Court of Justice of the Principality of Asturias. Permanent Adscription of Gijón: a square.

Prosecutor of the Superior Court of Justice of the Balearic Islands. Permanent affiliation of Mahon: a square.

Article 3. Tax career template.

1. The total number of employees in the tax race is made up of the following destinations:

(a) First category: 14 Prosecutors of the Chamber, of which the Deputy Prosecutor of the Supreme Court has the consideration of the President of the Chamber of the High Court.

b) Second category: 1,112 Prosecutors.

c) Third category: 571 Tax Lawyers.

2. The template of the Fiscal Ministry is as set out in the Annex to this provision.

Single repeal provision. Regulatory repeal.

The Royal Decree 1/2001, of 12 January, is hereby repealed, fixing the template of the Fiscal Ministry.

Final disposition first. Powers of development.

The Minister of Justice is authorized to lay down the rules and adopt the necessary provisions for the development and implementation of the provisions of this Royal Decree.

Final disposition second. Entry into force.

This Royal Decree will enter into force on the day following its publication in the "Official State Gazette".
