The framework that delimits the additions of new troops in the year 2003, as a general rule for all staff in the service of the public sector, is defined in article 20 of law 52/2002, of 30 December, from the State budget for the year 2003, to provide notices of vacancies for new personal income will concentrate on sectors functions and professional categories that are considered priority or affecting the functioning of essential public services and that the number of places incoming should be, as maximum, equal to 100 per cent of the effective replacement rate. Within this limit, the public employment offer will include all the squares and positions filled by interim staff, appointed or hired in two previous years, except those on which there is a reservation of position or are in process of provision.
The limitation contained in the first paragraph shall not apply to the staff of the administration of Justice, for which the number of seats will be determined in accordance with the provisions in law 38/1988, of 28 December, demarcation and legal ground, nor to public administrations with educational skills for the development of the organic law 1/1990 , 3 October, General order of the system education, in relation to the determination of the number of vacancies for the access to the bodies of teaching staff.
In addition, to encourage the stability of employment call for those squares corresponding to different bodies, scales or categories which, being equipped with budgetary resources and included in their places of work or catalogs relationships, as well as in the workforce templates, are performed interim or temporarily before are allowed to on January 1, 2001.
Cited article 20 of law 52/2002, of 30 December, from the State budget for the year 2003, in paragraph first of its paragraph 3, establishes that the Government, with the limits that have been pointed out above, may authorize, through the public employment offer, prior favourable report from the Ministry of finance, on the proposal of the Ministry of public administration and on the initiative of the departments or public bodies competent in the matter the call of vacant again income relating to the staff of the civil administration of the State and its autonomous bodies, civilian personnel of the military administration and its autonomous bodies, statutory staff of the administration of the Social Security, personal Social Security, the administration of Justice, the armed forces and forces and bodies of State security personnel , and staff of public bodies, state tax administration agency, Council of Nuclear Security and data protection agency, and the public enterprise "State lotteries and betting", as well as from checkpoints and places that are held interim or temporarily prior to January 1, 2001.
Article 20 of law 52/2002, of 30 December, in the third paragraph of its paragraph three, also points out that the ministries of public administration and finance may jointly authorize the corresponding calls of squares or vacant posts of the public business entities and public bodies not mentioned above, respecting the rate of replacement of personnel established in General.
Concerned joint authorisation will also apply to state-owned companies for the management of public services dependent on the public entity Spanish radio & television broadcasting and television. Consequently, given the particular structure of public employment in this area, are included in the annex of the present Royal Decree squares whose need is estimated to be essential for each public enterprise or public body, anticipation, moreover, the exceptional call for spaces that respond to needs which have arisen, respecting the limit of the rate of replacement of personnel.
For this purpose the following priority areas will be considered: a) Consular Affairs, in order to continue strengthening the presence of the General Administration of the State abroad and meet the growing demand of granting of Spanish nationality.
(b) research and research support, with a view to continuity in the strengthening of these areas, initiated in the past year offering.
(c) national museums, in attention to comprehensive museums Plan, aimed at the elevation of the quality level of the service provided by these institutions, through the intensification of surveillance, the public and restoration activities.
(d) security air and sea, in order to ensure compliance with the growing demands that have to cope in these areas the civil aviation administration and the administration of the Merchant Navy.
(e) public finance and control of public expenditure, with the aim of intensifying inspection actions, fight against fraud, containment, and control of public expenditure.
(f) prisons, in attention to the evolution of the prison population and the needs arising from the Plan of redemption and creation of prisons (which provides for the opening of several new centres and modules in existing establishments, and the creation of social integration centres and units of access restricted in public hospitals).
(g) units of citizen, with the purpose of streamlining and improving the quality of care at: Dirección General de tráfico.
General Police direction, bound in police stations.
(h) environment, in order to promote environmental policy and, in particular, attention to hydraulic infrastructures, control of water quality and management of public hydraulic, maritime, terrestrial and national parks.
(i) National Institute of employment, on the occasion of increasing workloads resulting from the recent reform of the system of protection for unemployment and improvement of the employability.
At the same time, paragraphs two and three of the cited article 20 also maintain the criterion of not to proceed with the recruitment of temporary staff or to the appointment of interim officials, except in exceptional cases and to meet urgent and non-Deferrable needs, with joint approval of the ministries of public administration and finance, indicating that, in any case, these appointments be counted in order to comply with the maximum limit of 100 per cent of the rate of replacement of personnel. In addition, paragraph four expressly the requirement of prior authorisation-joint of the ministries of public administration and finance for the fixed or temporary hiring abroad, either in accordance with local legislation or to Spanish law.
Within this framework, it rests with the Government to authorize the public announcement of those places that can not be covered with the strength of staff in existence, and in accordance with the criteria set out above, aimed at the rationalization of the troops in the whole of the public sector and the reduction of the public deficit forecast.
In his virtue, a proposal from the Minister of public administration, with the favourable report from the Ministry of finance and prior deliberation of the Council of Ministers at its meeting of February 21, 2003, D I S P O N G O: article 1. Approval of the public employment offer.
1. in compliance with the provisions in article 18 of law 30/1984 of 2 August, measures for the reform of the public function, and in article 20 of the Law 52/2002, of 30 December, from the State budget for the year 2003, approves the offer of public employment for 2003 in the terms established in this Decree.
2 calls for selective's personal official checks and employment derived from the present public employment offer must be previously informed by the Department of the public function.
For these purposes, personal official requests must be sent before April 10 April 2003 to that Directorate-General.
3. the calls for selective evidence derived from this offer shall be published in the "official bulletin of the State" before June 7, 2003, except for calls for staff working in duly substantiated cases and previous authorization of the General Directorate of the public function.
4. with the aim of speeding up the selective evidence derived from this offer and that, in General, the new troops take possession of its squares in 2003, proposals should set a timetable for carrying out the selective tests allowing to finish them within the year 2003.
Therefore, exceptions that must be approved by the Department of the public function, selective tests referred to in the mentioned calendar should start before the month of August 2003, and thus it should be collected in the respective call.
Article 2. Quantification of the public employment offer.
The public employment offer includes human resource needs with budgetary allocations that may not be covered with existing staff personnel, in accordance with the criteria and according to the composition which is detailed in the articles and in the unique annex of the present Royal Decree.
Article 3. Human resource planning.
1. the planning of human resources in the General Administration of the State will move to the attention of priority areas, to the correct sizing of the volume of personnel in the public sector, the rationalization of the distribution of its human resources and to enhance the stability of employment.
2 calls for provision of jobs, readmissions to active duty and internal promotion processes will follow the guidelines contained in the preceding paragraph. The same goal will inspire troops relocation operations by the procedures laid down in the regulation General income of staff at the service of the General Administration of the State and Provision of jobs of work and professional promotion of the civil officials of the General Administration of the State, approved by Royal Decree 364/1995, of 10 March.
Article 4. Provision of jobs and mobility.
1 pursuant to the provisions of article 20.1. c) law 30/1984 of 2 August, of measures for the reform of the public function, in order to achieve a better distribution of troops, in the calls for tenders for the provision of jobs is may limit the participation of officials because their administrative situation and that provenance jobs and workplaces to provide belong to areas with higher needs of staff or personnel surplus. The global diagnosis of human resources will define the criteria that should govern the mobility.

Article 5. Internal promotion.
1. in 2003, and with the objective contained in the Administracion-sindicatos agreement for the period 2003 - 2004, for modernization and improvement of the public administration to encourage internal promotion, will be scheduled up to 3.727 squares for different groups of staff officer, with distribution by bodies and scales to be determined by the Ministry of public administration. These selective processes of internal promotion will be held in independent of the income calls.
Qualification groups, the distribution of seats is as follows: Group A: 329.
Group B: 345.
Group C: 2.793.
Group d: 260.
2 squares of Group C, 2,500 are on a four-year plan whose goal is to increase, by means of internal promotion, in 10,000 staff members of bodies and scales of this group who perform administrative functions; all this with the purpose of articulating the professional career of officials of the General Administration of the State more adequately to the needs of the Organization and capabilities of its employees. Applicants who participate in the selective processes derived from this quadrennial plan and exceed the selective tests, but, by not bringing enough merits, had not approved the selection process, shall be exempt from the tests in the following two calls, in accordance with the procedure which is established on the basis of the corresponding call.
3 in accordance with the provisions of paragraph 3 of article 22 of law 30/1984 of 2 August, of measures for the reform of the public function, horizontal promotion processes may be convened: to) so the staff fixed the area of administration of the single Convention and the professional groups 3 and 4, as well as the workforce included in other collective agreements of the General Administration of the State in equivalent situation play matching or substantially similar functions in the professional content and its technical level to the administrative General body and they are in possession of the required academic qualification, access to membership of that body. To this end will be allocated 200 seats of those included in the Group C.
(b) that the staff fixed the area of administration of the Convention only and professional groups 5 and 6, as well as staff of other conventions of the General Administration of the State in equivalent situation, performing functions substantially matching or similar in its professional content and its technical level to the the body General auxiliary and are in possession of the required academic qualification go to membership of that body. To this end, will be allocated 150 seats of those included in Group D.
4. in accordance with provisions of the twenty fifth additional provision of law 30/1984 of 2 August, in the processes of professional promotion of Group E to the body General Assistant of the administration of the State, on an exceptional basis and because of the affinity of existing functions, mechanisms of promotion is may articulate from the Professional category of the Group 7 of the single Convention Ordinance , or equivalent category and professional group envisaged in other collective agreements of workforce in the service of the General Administration of the State. To this end, will be allocated 100 spaces in Group D.
5 along the 2003, processes of horizontal promotion of workforce to staff officer status will be object of analysis and evaluation with the objective of defining what should be qualitative and quantitative content of these processes and how will develop in future periods. Among other issues, throughout 2003 you must define in which cases and with what criteria this type of horizontal promotion in different bodies and scales can be articulated.
6. in accordance with the provisions of article 22.2 of the law 30/1984 of 2 August, of measures for the reform of the public function, may be called selective processes of access by internal promotion to the scales of teachers and research scientists of the Superior Council of scientific research from the scales of cientifico-investigador personnel regulated by Royal Decree 1945 / 2000 1 December, as well as the scale of scientific headlines of the CSIC from the scale of specialized higher graduates of the organism itself.
Article 6. Workforce.
Workforce for selective tests listed in the annex of this Royal Decree shall refer to jobs that, as stated in article 15 of the law 30/1984 of 2 August, can be performed by staff.
Prior to the approval by the Ministry of public administrations of the call of selective tests for admission to staff vacancies listed in the annex of this Royal Decree, the departments or agencies issuing must prove the existence of budgetary allocation of the seats that are vacant.
Within the scope of the single Convention, vacant of necessary provision will cover in accordance with Chapter VI of the Convention only for the staff of the administration of the State.
Prior to the call by free turn, the Ministry of public administration be distributed among departments and agencies in attention to his character's priority sector or that the squares are occupied by staff acting for vacant, all the squares of a single Convention that are contained in the annex to the present Royal Decree.
In the selective processes of workforce from the present Royal Decree will be used preferably opposition system.
Article 7. Recruitment of workforce abroad.
The hiring of fixed or temporary staff abroad, in accordance with the local legislation or, in its case, Spanish law, require the prior joint authorization of ministries of public administration and finance, in accordance with the procedure established jointly by both departments, whenever there is a budgetary allocation of vacant.
In order to meet increased demand for services in the consular offices and continue to improve the activity on the outside of the General Administration of the State, the staff of the foreign service with 150 new workers will be strengthened.
Article 8. Labour recruitment in the public business entities and public bodies.
During 2003 fixed labor recruitment shall be limited to those vacancies that are considered essential for the normal functioning of public bodies and public business entities, and only exceptionally may enroll staff for new jobs in the case of the commissioning of new areas of activity that are considered priority.
The joint approval of the ministries of public administration and finance referred to in the third subparagraph of paragraph 3 of article 20 of the Law 52/2002, of 30 December, from the State budget for the year 2003, will be made in accordance with the following unique procedure, which consists of two phases:
1.a call for vacancies that respond to annual planning recruitment of public bodies and public institutions business.-prior study by the ministries of public administration and finance, forecasting needs of recruitment sent by the various agencies, and taking into account the limitations laid down in article 20 of law 52/2002 of 30 December, General State budget for the year 2003, the maximum number of squares that can be convened at this stage, for each public business entity or public entity, in the relationship contained as an annex to this Royal Decree is quantified.
2.a call for vacancies that meet needs caused activity during exercise-will be exceptional in nature and may only be authorized in the event of vacancies that were not initially planned to occur during the exercise. Only those positions which by their content and impact on the organization need to be covered with the utmost urgency to not undermine the normal activity of the entity may be authorized.
The call for these vacancies must be previously authorised by the Ministry of public administration and finance, according to the specific procedure established by these departments, and respecting, in any case, the limit of 100 percent of the replacement rate.
Also, irrespective of the provisions in the preceding paragraphs and in order to enable the proper optimization of human resources in the public sector, public bodies and public business entities may contract, permission joint ministries of public administration and finance, personal official or labor fixed from departments or public bodies falling within the scope of the offer of public employment defined in paragraph first paragraph three of the Article 20 of law 25/2002, of 30 December, from the State budget for the year 2003.
The Ministry of public administration will determine the procedure by which advertising and free competition in this type of recruitment shall be ensured.
Article 9. Temporary staff.
During 2003 shall not be taken to the hiring of temporary staff or to the appointment of interim officials, except in exceptional cases and to meet needs urgent and non-Deferrable, and prior authorization joint ministries of public administration and finance. In any case, as designates the law of the State budget for the year 2003, appointments will be in order to comply with the maximum limit of 100 per cent of the effective replacement rate.
The appointment of interim educational officials and the temporary recruitment of personnel of administration and services in public educational institutions, as well as temporary coverage capacity of staff in the service of the administration of Justice, will require in any case the joint approval of the ministries of public administration and finance.
Contracts to meet seasonal needs will be automatically completed to beat your time scale.
Article 10. Consolidation of temporary employment.
1. within the scope of the General Administration of the State and in accordance with the contents of the Administracion-sindicatos agreement for the period 2003-2004, for modernization and improvement of the public administration, is considered temporary unavailable consolidatable employment those jobs occupied by personnel acting continuously and before December 2, 1998, unless such persons replace with reservation of position holders.
2. the processes of consolidation of temporary employment of a structural and permanent nature may be performed either within the framework of the plan of employment or through calls to the effect, demanding in the latter case the authorization of the Ministry of public administration, prior favourable report from the Ministry of finance. These processes not be, in any case, increase in template.
Selective processes referred to in the preceding paragraph shall comply with at least the principles of equality, merit, ability, and advertising, in the context of the criteria and priorities which established the Ministry of public administration.
3. the employment relationships of who play on a temporary basis the squares that have become fixed in the framework of a process of consolidation will extend until the end the selective processes corresponding to the call of the squares that came to play. To do so, if necessary, can transform the relationship of initial employment in another interim nature, in the terms laid down in the Royal Decree 2720 / 1998, of December 18, or in the civil service regulations.
Article 11. Staff of the administration of Justice and bodies of teaching staff.
1. in response to the needs of staff in the service of the administration of Justice, arising from the requirements of development of law 38/1988, of 28 December, demarcation and legal ground, is authorized to the Ministry of Justice call for selective testing for entry in the body of court clerks, up to 150 seats; in the body of coroners, up to 31 passengers; on the scale of technical practitioners of the National Institute of Toxicology, to 95 seats; on the scale of technical specialists of the Institute National Toxicology, up to 25 seats; on the scale of Assistant of laboratory Institute national of Toxicology, up to 75 seats; in the officer corps, up to 181 seats, auxiliary body, to 717 squares; and in the body of agents, up to 510 seats, currently covered by interim staff.
These places correspond to the Ministry of Justice 150 seats of the body of court clerks, 6 places of the body from medical examiners, 95 seats of the scale of technical practitioners of the National Institute of Toxicology, 25 seats of the national of technical specialists of the Institute of Toxicology, 75 seats of the scale of laboratory assistant of the National Institute of Toxicology , 50 seats of the officer corps, 95 body of auxiliary spaces and 161 seats of the Corps of agents. They correspond to the autonomous communities that have received transfers of personal media the following squares: 25 seats of the body from medical examiners, 131 seats of the officer corps, 622 body of auxiliary spaces and 349 seats of the Corps of agents.
As established in article 10 of the order of 1 March 1996, on selection, proposal and appointment of temporary staff to cover vacancies bodies from coroners, officers, assistants and agents of the administration of Justice and those serving in the National Institute of Toxicology, personal interim holding any of these squares will cease when the plaza played covers by race official.
2. in response to the needs of teachers, derived from the requirements of development of the organic law 1/1990 of 3 October, General Organization of the educational system (LOGSE), is authorized to the Ministry of education, culture and sport call for selective testing for income, up to a maximum of 80 seats in the teacher Corps, covered now by personal acting.
Article 12. Certificate of lack of human resources.

Article 13. Disabled people.
Calls for selective tests on the supply of public employment in 2003 should include the reservation for persons with disability of the percentage of seats that correspond, in accordance with the applicable legislation. Selection bodies shall agree the adaptations necessary, temporary, or materials to ensure that people with disabilities perform selective tests in conditions of equality with the rest of the candidates.
In addition to the above and forward in order to achieve equality of opportunity, the selective processes should include the possibility that calls in which is set a reserve quota for disabled, once covers the squares of this quota, applicants who have passed the phase of opposition without obtaining square by this quota they can choose, on equal terms, to the squares of the general system, both in the case of access by internal as in the free turn promotion.
First additional provision. Offer of employment of local corporations.
Local corporations that pass their offers of public employment shall send them passing agreements to the administration of the State, in accordance with the provisions of article 56.1 of the Act 7/1985, of 2 April.
Second additional provision. Local administration staff with national rating.
In order to meet the needs of the local administration, the Ministry of public administrations may be called selective tests for access to the scale of civil servants of Local Administration with empowerment of national character in the following subscales: 25 seats for the Intervencion-tesoreria subscale, superior: 50 seats for the Intervencion-tesoreria subscale, entrance and 75 seats for the subscale of Secretaria-intervencion category.
Third additional provision. Participation in courts of selective evidence.
They may not be part of committees of selection or of courts of selective tests for entry in scales of officials or bodies or categories of staff who have the consideration of high office in accordance with law 12/1995, of 11 may, on incompatibilities of the members of the Government of the nation and of the high charges of the General Administration of the State.
Fourth additional provision. Website with information about selective processes.
In order to expand the dissemination of different calls for selective evidence derived from this offer of public employment, the various ministries and agencies which offer seats and have web page on the internet will include a dedicated to selective processes address, which will be collected in the most comprehensive manner possible each of the calls and acts arising from them incorporating, where this is possible and for convenience of candidates, relations of admitted and excluded candidates, as well as relations of approved in each of the exercises, with indication of his identity, name, last name, and in your case, province of examination. The questionnaires relating to the written tests of multiple response made in the selection process will also be included, if it is viable.
Sole final provision. Entry into force.
This Royal Decree shall enter into force the day following its publication in the "official bulletin of the State".
