The framework that delimits the additions of new members in the year 2003, with a general character for all staff at the service of the public sector, is defined in Article 20 of Law 52/2002, of December 30, of Budgets State Generals for the year 2003, providing that the calls for entry for new staff will be concentrated in the sectors, functions and professional categories which are considered to be a priority or which affect the functioning of the essential public services and that the number of places of new entry must be, at most, equal to 100 percent of the rate of replacement. Within this limit, the offer of public employment shall include all places and posts carried out by interim staff, appointed or employed in the two previous years, except those on which there is a reserve of post or are courses in provision processes.

The limitation contained in the first paragraph shall not apply to the staff of the Administration of Justice, for which the number of places shall be determined in accordance with the provisions of Law 38/1988 of 28 December 1988. Demarcation and the Judicial Plant, nor to public administrations with educational competences for the development of the Organic Law 1/1990, of 3 October, of General Ordination of the Educational System, in relation to the determination of the number of places for access to the bodies of teachers.

In addition, in order to promote stability in employment, it is possible to call for those places corresponding to the different bodies, scales or categories, which, being budgeted and included in their relations of (a) job or catalogues, as well as in the workforce, are either temporarily or temporarily performed before 1 January 2001.

Article 20 of Law 52/2002 of 30 December 2002 on the General Budget of the State for the year 2003, in the first subparagraph of paragraph 3, provides that the Government, with the limits that have been mentioned may authorize, through the offer of public employment, prior favorable report of the Ministry of Finance, on a proposal from the Ministry of Public Administrations and on the initiative of the departments or public bodies competent in the subject, the call for new entry vacancies which refer to the staff of the Civil administration of the State and its autonomous agencies, civilian personnel of the military administration and its autonomous agencies, staff of the Social Security Administration, statutory staff of the Social Security, staff of the Administration of Justice, Armed Forces and State Security Forces and Bodies, and staff of the public entities, the State Tax Administration Agency, the Nuclear Security Council and the Data Protection Agency, and the public entity "Lotteries and State Gambling", as well as the posts and squares that are located interim or temporary performance prior to 1 January 2001.

Article 20 of Law 52/2002 of 30 December 2002, in the third paragraph of paragraph 3, also states that the Ministries of Public Administrations and Finance may jointly authorize the corresponding (a) calls for vacancies or vacant posts of public entities and public entities not mentioned above, in compliance with the rate of replacement of the staff established in general.

The aforementioned joint authorization will also apply to the state companies for the management of public service broadcasting and television dependent on the Public Ente Radiotelevisión Española. As a result, given the particular structure of public employment in this area, the places whose need is considered essential for each public or public entity, providing for, is included in the Annex to this Royal Decree. In addition, the exceptional call for places which respond to the needs of oversold, always respecting the limit of the rate of replacement of staff.

For these purposes the following priority sectors will be considered:

(a) Consular Affairs, in order to continue strengthening the presence of the General Administration of the State abroad and to meet the growing demand for the granting of Spanish nationality.

b) Research and support for the research, with a view to the continuity in the empowerment of these areas, initiated in last year's offer.

c) State museums, in consideration of the comprehensive plan of museums, aimed at raising the quality level of the service provided by these institutions, through the intensification of surveillance activities, attention to the public and catering.

(d) Air and maritime safety, in order to ensure compliance with the growing demands to be met in these areas by the administration of civil aviation and the administration of the merchant navy.

(e) Public finances and control of public expenditure, with the aim of stepping up inspection measures, combating fraud, containment and control of public expenditure.

(f) Prison institutions, in the light of the evolution of the recluse population and the needs arising from the Plan for the depreciation and creation of penitentiary centres (which provides for the opening of several new centres and modules). in existing establishments, and the creation of social insertion centres and restricted access units in public hospitals).

g) Units of attention to the citizen, with the aim of streamlining and improving the quality of this care in:

General Directorate of Traffic.

Foreign Offices.

Directorate General of the Police, with destination in police stations.

(h) Environment, with a view to strengthening environmental policy and, in particular, attention to water infrastructure, water quality control and management of the public domain, water, sea, land and water. national parks.

(i) National Institute of Employment, on the occasion of the increase in workloads resulting from the recent reform of the system of protection for unemployment and improvement of the occupation.

In parallel, paragraphs 2 and 3 of Article 20 also maintain the criterion of not proceeding to the recruitment of temporary staff or the appointment of interim officials, except in exceptional cases and to cover urgent and non-deferred needs, with the joint authorization of the Ministries of Public Administrations and Finance, indicating that, in any event, these appointments will count for the purpose of meeting the maximum limit of 100 percent of the Rate of replacement of staff. In addition, paragraph 4 expressly states the requirement for joint prior authorization by the Ministries of Public Administration and Finance for the recruitment of fixed or temporary staff abroad, either on the basis of the local legislation or Spanish legislation.

In this context, it is up to the Government to authorize the public call for those places which cannot be met with the existing staff, and in accordance with the criteria set out above, which are addressed to the rationalisation of the staff in the public sector as a whole and the provision of public deficit reduction.

In its virtue, on the proposal of the Minister of Public Administrations, with the favorable report of the Ministry of Finance and after deliberation of the Council of Ministers at its meeting of 21 February 2003,

D I S P O N G O:

Article 1. Approval of the offer of public employment.

1. In compliance with the provisions of article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and in Article 20 of Law 52/2002, of December 30, of the General Budget of the State for the year 2003, approves the offer of public employment for 2003 in the terms set out in this Royal Decree.

2. Calls for selective testing of civil servants and employees arising from the present offer of public employment should be reported in advance by the Directorate-General for the Civil Service.

For these purposes, calls for official staff shall be sent before 10 April 2003 to that Directorate-General.

3. The calls for selective testing resulting from this offer should be published in the "Official State Gazette" before 7 June 2003, with the exception of calls for work staff in duly justified and prior cases. authorization of the Directorate-General for the Civil Service.

4. With the aim of speeding up the selective testing resulting from this offer and of the fact that the new members will take up their seats in the 2003 financial year, the calls for tenders should set out a timetable for implementation. of the selective tests which will enable them to be completed in 2003.

Therefore, with the exception of exceptions which must be authorised by the Directorate-General for the Civil Service, the selective tests referred to in the abovementioned timetable must be initiated before August 2003, and so must appear in the respective call.

Article 2. Quantification of the public employment offer.

The public employment offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the article and in the unique annex to this Royal Decree.

Article 3. Human resource planning.

1. The planning of human resources in the General Administration of the State will be directed to the attention of the priority sectors, to the correct dimensioning of the volume of the public sector, to the rationalization of the distribution of their human resources and to enhance stability in employment.

2. Calls for provision of posts, rereceipts to active service and internal promotion processes shall follow the guidelines set out in the previous paragraph. The same objective will inspire the operations of the relocation of personnel by the procedures provided for in the General Staff Regulations of the Personnel to the Service of the General Administration of the State and of the Provision of Jobs and Promotion of the Civil Servants of the General Administration of the State, approved by Royal Decree 364/1995 of 10 March.

Article 4. Provision of posts and mobility.

1. By virtue of the provisions of Article 20.1.c of Law 30/1984 of 2 August of Measures for the Reform of the Civil Service, in order to obtain a better distribution of the staff, in the calls for tenders for the provision of (a) the participation of officials may be limited to their administrative situation and to the fact that the posts of provenance and the posts to be provided belong to areas with the greatest need for staff or with staff surpluses. The global human resources diganostics will define the criteria that will govern mobility.

2. Rereceipts to the active service by temporary staff of officials in administrative situations which do not entail a reserve of employment shall, where appropriate, be produced in centres, agencies and territories in need of staff and preferably in posts occupied by interim staff.

3. The call for new entry into the General Auxiliary Corps of the State Administration will be aimed at addressing the most priority needs, especially in those territories with the greatest lack of personnel. on a decentralised basis, as provided for in Article 6 of Royal Decree 364/1995 of 10 March 1995.

Article 5. Internal promotion.

1. In 2003, and with the objective set out in the Administrative-Trade Union Agreement for the period 2003-2004, for the modernisation and improvement of public administration to promote internal promotion, up to 3,727 places will be convened for the various groups of official personnel, with the distribution by bodies and scales to be determined by the Ministry of Public Administration. These selective internal promotion processes will be carried out in separate calls for entry.

By titration groups, the distribution of places will be as follows:

Group A: 329.

Group B: 345.

Group C: 2,793.

Group D: 260.

2. Of the places in group C, 2,500 are part of a four-year plan whose objective is to increase, by way of internal promotion, in 10,000 members of the bodies and scales of this group that perform administrative functions; all this for the purpose of articulating the professional career of the officials of the General Administration of the State more adequately to the needs of the organization and the capabilities of its employees. Applicants who participate in the selective processes resulting from this four-year plan and pass the selective tests, but, failing to gather sufficient merits, have not approved the selective process, will be exempt from the completion of the (a) tests on the following two calls, in accordance with the procedure to be established on the basis of the relevant call.

3. In accordance with the provisions of Article 22 (3) of Law 30/1984 of 2 August of Measures for the Reform of the Civil Service, horizontal promotion processes may be convened:

(a) For the fixed staff of the management area of the single agreement and of the professional groups 3 and 4, as well as the labour staff included in other collective agreements of the General Administration of the State in the equivalent situation, which performs functions substantially coincident or analogous in their professional content and at their technical level to those of the General Administrative Body and which are in possession of the required academic qualification, access the Member condition of that body. To this end, 200 seats will be allocated for those included in group C.

(b) For the fixed staff of the management area of the single agreement and of the professional groups 5 and 6, as well as the staff of other conventions of the General Administration of the State in an equivalent situation, perform functions substantially coincident or analogous in their professional content and their technical level to those of the General Auxiliary Corps and are in possession of the required academic qualification, access to the condition of member of that body. To this end, 150 seats will be allocated for those included in group D.

4. In accordance with the provision of the additional twenty-fifth provision of Law 30/1984 of 2 August, in the professional promotion processes of the group E to the General Auxiliary Corps of the State Administration, with exceptional character and in reason for the affinity of existing functions, promotion mechanisms may be articulated from the professional category of ordinance of group 7 of the single convention, or from the equivalent category and professional group provided for in the other collective labour agreements at the service of the General Administration of the State. To this end, 100 seats will be allocated for those included in group D.

5. In the course of 2003, the process of horizontal promotion of the status of work staff to official staff will be the subject of analysis and evaluation with the aim of defining the qualitative and quantitative content of the work. these processes and how they will be developed in future exercises. Among other issues, in the course of 2003, it will have to be defined in which cases and with which criteria this type of horizontal promotion can be articulated in the different bodies and scales.

6. In accordance with the provisions of Article 22.2 of Law 30/1984 of 2 August of Measures for the Reform of the Civil Service, selective processes of access by internal promotion to the Scales of Professors of Research and of Scientific researchers from the Higher Council of Scientific Research from the scales of scientific and research personnel regulated in Royal Decree 1945/2000, of December 1, as well as the Escala de Cientícias Titulares of the CSIC from the Scale of specialised graduates of the body itself.

Article 6. Labour staff.

The selective tests corresponding to the work staff set out in the Annex to this Royal Decree must relate to posts which, in accordance with the provisions of Article 15 of Law 30/1984 of 2 August, may be performed by job staff.

Prior to the authorization by the Ministry of Public Administrations of the call for selective tests for admission to the places of work personnel listed in the annex of this Royal Decree, the Departments or (a) the establishment of a budgetary allocation for the places in which vacancies are to be found.

Within the scope of the Single Convention, the vacant seats of necessary provision will be covered in accordance with the provisions of Chapter VI of the Single Convention for the State Administration of Labor.

Prior to the call for free shift, the Ministry of Public Administrations will distribute among the Departments and agencies to the attention of their priority sector character or to the places occupied by temporary staff, all the places of a single convention listed in the Annex to this Royal Decree.

In the selective processes of labor personnel derived from this Royal Decree, the system of opposition will be used preferably.

Article 7. Recruitment of work staff abroad.

The hiring of temporary or temporary staff abroad, in accordance with local legislation or, where appropriate, Spanish legislation, will require the prior joint authorization of the Ministries of Public Administrations and In accordance with the procedure laid down jointly by the two departments, there will always be a budgetary allocation for vacant posts.

In order to meet the increase in demand for services in the consular offices and continue to improve the activity abroad of the General Administration of the State, the foreign service staff will be strengthened with 150 new workers.

Article 8. Recruitment of labour staff in public entities and public entities.

During 2003, the hiring of fixed labor personnel will be limited to covering those vacancies that are considered essential for the normal functioning of public entities and public entities, and only with a Staff may be recruited for new jobs when it comes to the implementation of new areas of activity which are considered to be priorities.

The joint authorization of the Ministries of Public Administrations and Finance referred to in the third subparagraph of Article 20 (3) of Law 52/2002 of 30 December 2002 on the General Budget of the State for the year 2003, will be performed according to the following singular procedure, consisting of two phases:

1.a Call for places to respond to the annual recruitment planning of public entities and public entities. -Prior to the study by the Ministries of Public Administrations and Finance of the (a) forecast of recruitment needs submitted by the various bodies, and taking into account the limitations laid down in Article 20 of Law 52/2002 of 30 December 2002 on the general budget of the State for the year 2003; quantifies the maximum number of places that may be convened at this stage, for each public entity business or public entity, in the relationship that is listed as an annex to this Royal Decree.

2.a Call for places to meet needs that have been overcome during the financial year. -They will be exceptional and can only be authorised if there are no vacancies during the exercise which were not initially planned. Only those posts which because of their content and impact on the organisation must be covered with the utmost urgency may be authorised in order not to undermine the normal activity of the institution.

The convocation of these places must be previously authorized by the Ministries of Public Administrations and Finance, in accordance with the specific procedure established by these Departments, and respecting in any case the limit of 100 per cent of the replacement rate.

Also, regardless of what was established in the preceding paragraphs and in order to enable the proper optimization of existing human resources in the public sector, public entities and entities The public may contract, after joint authorization from the Ministries of Public and Finance, official or permanent staff from departments or public bodies included in the field of the offer of employment public as defined in the first subparagraph of Article 20 (3) of Law 25/2002, 30 of December, of the General Budget of the State for the year 2003.

The Ministry of Public Administration will determine the procedure by which advertising and free competition will be guaranteed in this type of hiring.

Article 9. Temporary staff.

During 2003, temporary staff will not be recruited or interim officials will be appointed, except in exceptional cases and to cover urgent and non-deferred needs, and prior joint authorization of the Ministries of Public Administrations and Finance. In any case, as stated in the General Budget Law for the year 2003, the appointments will count for the purpose of meeting the maximum limit of 100 percent of the rate of replacement.

The appointment of interim teaching officers and the temporary recruitment of administration and service staff in public teaching centres, as well as the temporary coverage of staff places at the service of the In any event, the administration of Justice will require the joint authorization of the Ministries of Public and Finance.

Contracts to meet seasonal needs will automatically end when you beat your time limit.

Article 10. Temporary job consolidation.

1. In the field of the General Administration of the State and in line with the content of the Administrative Agreement for the period 2003-2004, for the modernization and improvement of public administration, it is considered temporary employment of a character (a) to consolidate those jobs occupied by interim staff on an ongoing basis and from before 2 December 1998, unless such staff replace holders with a reserve of post.

2. The process of consolidation of temporary employment of a structural and permanent nature can be carried out both within the framework of the corresponding employment plans and through calls for action, requiring in the latter case the Approval of the Ministry of Public Administration, after a favourable report by the Ministry of Finance. These processes will not, in any case, increase the number of staff.

The selective processes referred to in the preceding paragraph shall in any event respect the principles of equality, merit, capacity and publicity, within the framework of the criteria and priorities established by the Ministry of Public Administrations.

3. The employment relationships of those who are temporarily employed in the places to be fixed in the framework of a consolidation process will be extended until the selective processes corresponding to the call for tenders are completed. the places they were playing. To this end, if necessary, the initial employment relationship may be transformed into another interim employment relationship, in the terms of Royal Decree 2720/1998 of 18 December 1998 or in the rules of public service.

Article 11. Staff of the Administration of Justice and bodies of teachers.

1. In the light of the needs of the staff at the service of the Administration of Justice, arising from the requirements of the development of Law 38/1988, of December 28, of Demarcation and Judicial Plant, the Ministry of Justice is authorized call for selective tests for entry into the Body of Judicial Secretaries, up to 150 places; in the Corps of Medical Physicians, up to 31 places; on the Faculty of the National Institute of Toxicology, up to 95 places; on the National Institute of Toxicology's Technical Scale, up to 25 places; on the Scale of Laboratory auxiliaries of the National Institute of Toxicology, up to 75 places; in the Official Corps, up to 181 places, in the Auxiliary Corps, up to 717 places; and in the Body of Agents, up to 510 places, currently covered by staff interim.

Of these places correspond to the Ministry of Justice 150 places of the Body of Judicial Secretaries, 6 places of the Body of Medical Physicians, 95 places of the School of Technical Faculty of the National Institute of Toxicology, 25 The National Institute of Toxicology, 75 places of the National Toxicology Institute's Laboratory Auxiliary Scale, 50 seats in the Official Corps, 95 seats in the Auxiliary Corps, and 161 places on the National Institute of Toxicology Staff of the Body of Agents. They correspond to Autonomous Communities that have received transfers of personal means the following places: 25 places of the Body of Medical Physicians, 131 places of the Body of Officers, 622 places of the Body of Auxiliary and 349 places of the Body of Agents.

According to Article 10 of the Order of March 1, 1996, on the selection, proposal and appointment of interim officials to fill vacant positions of the Corps of Forensic, Official, Auxiliary and Agents the Administration of Justice and those who provide services at the National Institute of Toxicology, the interim staff who occupy one of these places will cease when the place they perform is covered by a career official.

2. The Ministry of Education, Culture and Sport has been authorised to provide the Ministry of Education, Culture and Sport with a view to the needs of teaching staff as a result of the requirements for the development of Organic Law 1/1990 of 3 October. Call for selective testing for admission, up to a maximum of 80 places, in the Corps of Teachers, currently covered by interim staff.

Article 12. Certificate of insufficient human resources.

In order to link the resource to services external to the administration to the global policy of human resources, it will be up to the personnel responsible of each department or agency to report the certificate of insufficiency of human resources prior to the contracting regulated in article 202 of the recast of the Law of Contracts of Public Administrations, approved by Royal Legislative Decree 2/2000, of June 16.

Article 13. People with disabilities.

The calls for selective tests corresponding to the public employment offer for 2003 should include the reserve for people with disabilities in the percentage of places that correspond, according to the rules applicable. The selection bodies will agree on the necessary adaptations, materials or temporary ones, to ensure that people with disabilities carry out selective tests on an equal footing with the other candidates.

In addition to the above and moving forward with the aim of achieving equal opportunities, selective processes should include the possibility of calls for the establishment of a reserve quota for the disabled, once the seats in this quota have been covered, applicants who have passed the opposition stage without obtaining a seat for that quota, can, on an equal footing, qualify for the general system, both in the case of access by internal promotion as in the free shift.

Additional disposition first. Offer of employment of local corporations.

Local corporations that approve their offers of public employment will have to forward the approval agreements of the same to the State Administration, in accordance with the provisions of Article 56.1 of Law 7/1985, of 2 of April.

Additional provision second. Local administration staff with national rating.

In order to address the needs of the local government, the Ministry of Public Administration may call for selective testing for access to the Local Administration Officers ' Scale with a National character in the following Subscales: 25 places for the Subscale of Interventional-Treasury, Superior Category: 50 places for the Subscale of Interventional-Treasury, Entry Category and 75 places for the Subscale of Secretariat-Intervention.

Additional provision third. Participation in selective testing courts.

They will not be able to form part of selection commissions or selective testing courts for entry into bodies or scales of officials or in categories of labor personnel who have the high-capacity consideration in accordance with the law. The provisions of Law 12/1995, of 11 May, on Incompatibilities of the Members of the Government of the Nation and of the High Charges of the General Administration of the State.

In order to extend the dissemination of the various selective calls for tests resulting from the present offer of public employment, the various ministries and bodies that offer places and have a website on the Internet include an address dedicated to selective processes, in which they will collect as complete as possible each of the calls and the acts that are derived from them, incorporating, where possible and for the convenience of the candidates, the relations of candidates admitted and excluded, as well as the relations of approved each of the exercises, with an indication of their national identity card, surname, name and, if applicable, province of examination. The questionnaires corresponding to the multiple-response written tests that have been carried out in the selective process shall also be included, if feasible.

Single end disposition. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
