Royal Decree 1434/1999 of 10 September establishing the recognition and inspection of recreational craft to ensure the safety of human life at sea and determine the conditions that (a) the competent authorities of the Member States of the European Union, the Member States and the Member States of the Member States of the European Union, and the Member States of the European Union; Current rules on safety and the prevention of pollution.

This legislation was collected to date, in respect of recreational craft, in lower-ranking provisions whose content has been largely offset.

This Order, conferring an appropriate regulatory framework for the safety of this type of vessels, collects the innovations produced in the determination of safety, rescue, fire, navigation and the prevention of dirty water to be carried on board recreational craft.

In its virtue, I have:

CHAPTER I

General provisions

Article 1. Object.

This Order has as its object:

(a) Establish the safety equipment to be carried on board, on a compulsory basis, recreational craft within its scope.

b) Determine the requirements that such security equipment must meet.

Article 2. Scope.

1. This Order will apply:

(a) To all recreational craft within the meaning of Article 2 of Royal Decree 1434/99 of 10 September, registered or intended to be registered in Spain, as well as to the registration vessels of other countries which, in accordance with current legislation, they wish to develop an activity for commercial purposes in maritime waters in which Spain exercises sovereignty, sovereign rights or jurisdiction.

(b) To equipment for safety, rescue, fire, navigation and the prevention of discharges, intended for them, as indicated in Chapters II, III, IV and V of this Order.

2. Excluded from the scope of this Order are:

a) The floating or beach artifacts, such as the following:

-Pirwaters, kayaks and canoes without motor.

-Patines with pedals or fitted with motor with power less than 3,5 kilowatts.

-Nautical Motos.

-Sailing tables.

-Sliding tables with motor, individual-use vessels, and other motor-like mills.

-Float floating facilities.

(b) Boat boats which have their own safety rules and are intended exclusively for competition.

(c) Experimental vessels provided that they are not placed on the market in the European Union.

d) Submersible vessels.

e) Air mattress vehicles.

f) Hydrogliders.

g) The original and each of the reproductions of old boats designed before 1950, built with original elements and so named by the builder.

3. In any case, the vessels referred to in point 2 whose length is equal to or greater than 2,5 metres, and which are not floating or beach artifacts of those referred to in point (a), shall require the prior authorisation of the Maritime Captaincy. for sailing in the areas referred to in Article 3. The Maritime Captaincy shall fix the areas for which navigation permits, depending on the characteristics of the vessel, and the safety equipment to be assembled by such vessels.

Article 3. Navigation areas for recreational craft.

1. The following Navigation Zones are set:

A) Ocean Navigation Zone. The following Zone corresponds to:

Zone "1". Unlimited navigation zone.

B) Navigation area at Alta Mar. Understand the following Navigation Zones:

Zone "2". Navigation in the area between the coast and the line parallel to the same drawn 60 miles.

Zone "3". Navigation in the area between the coast and the line parallel to the same drawn 25 miles.

C) Navigation area in coastal waters. Understand the following Navigation Zones:

Zone "4". Navigation in the area between the coast and the line parallel to the same drawn 12 miles.

Zone "5". Navigation in which the vessel does not move away more than 5 miles from an accessible shelter or beach.

Zone "6". Navigation in which the vessel does not move away more than 2 miles from an accessible shelter or beach.

D) Navigation area in protected waters. The following Zone corresponds to:

Zone "7". Navigation in protected coastal waters, harbours, radas, rias, sheltered bays and protected waters in general.

Article 4. Design categories.

1. The vessels registered after the entry into force of this Order, and which have been designed and constructed in accordance with the requirements of Royal Decree 297/1998, of 27 February, for which the requirements of the vessels of the recreational craft, semi-finished recreational craft and their components, shall be entitled to sail through the areas corresponding to their design category, depending on the safety equipment on board, but in no case in waves and wind situations greater than those defining the design category, according to the following table:

Vessels registered prior to the entry into force of this Order, and designed and constructed in accordance with the requirements of Royal Decree 297/1998, of 27 February, this is, vessels with the CE marking, will be able to sail within the area corresponding to the category of navigation assigned to them in their day, and the update of their safety equipment must be carried out within the time limit specified in the single transitional provision, except in cases where as a result the result of the various regulatory inspections is understood to be necessary to modify the area navigation.

3. The CE-marked vessels already registered may sail within the area corresponding to the category of navigation assigned to them in their day on the basis of their construction characteristics, and their updating must be carried out. safety equipment within the time limit set out in the single transitional provision, except where, as a result of the outcome of the various regulatory inspections, it is understood that the Navigation Zone should be amended.

4. Non-EC vessels registered as from the entry into force of this Order may sail within the Navigation Area assigned to them in the light of their constructive characteristics and the safety equipment on board.

5. At the time of renewal of the Certificate of Navigability, the Maritime Authority, taking into account the update of the safety equipment that the vessel has carried out, will assign the corresponding Navigation Zone according to its Design category.

Article 5. Security equipment.

1. All recreational craft which are registered as from the entry into force of this Order are obliged to carry on board the safety, rescue, fire, navigation and prevention of discharges which correspond to them. function of its Navigation Area, and as set out in Chapters II, III, IV and V.

2. The radio communications equipment on board the recreational craft shall comply with the provisions on Maritime Radiocommunications in force.

CHAPTER II

Save items

Article 6. Life rafts.

1. All vessels sailing within Navigation Zones 1, 2 and 3 shall bear one or more life rafts for the total number of persons allowed on board. The characteristics of the rafts/s (mark, model, serial number, number of persons) shall be indicated in the Certificate of Navigability.

2. The rafts shall be reviewed annually, the first revision being carried out each year of the entry into service of the raft, and, in any case, before the two years from the date of manufacture. The rafts shall be reviewed at a Service Station authorized by the Administration pursuant to paragraph 1 of the International Maritime Organization Resolution A. 761 (18) and according to the manufacturer's procedures and instructions.

The hydraulic test of the inflation cylinders shall be carried out at least every five years, from the date of manufacture. In any case, such test shall be carried out before each reloading after use or when an annual loss of gas greater than 5% or 250 gr is assessed after each annual review if this value is lower.

Every six years from manufacture, the raft will be subjected to an overpressure test of 25% of the service pressure indicated by the manufacturer, for 30 minutes, followed by a six-hour maintenance test to the service pressure, at the end of which the pressure drop must not exceed 30%. In any case, if, during an annual review, a special deterioration of the raft is observed, the owner shall proceed, after the owner has been informed, to carry out the indicated overpressure test. If the owner does not agree to the performance of this test, the corresponding Certificate of Navigability will not be extended.

3. The rafts may be of the following types:

a) SOLAS, approved by the General Directorate of the Merchant Navy.

b) SOLAS, approved by a notified body with the rudder wheel mark, in accordance with the provisions of Royal Decree 809/1999 of 14 May 1999 on the requirements to be met by marine equipment intended to be taken on board vessels.

(c) NOT SOLAS, for not complying with any of the SOLAS requirements, provided that they are approved by the General Directorate of the Merchant Navy, as equivalent and suitable for navigation in Zones 1, 2 and 3.

(d) ISO 9650 or other existing regulations, provided that they are approved by the General Directorate of the Merchant Navy, as suitable for navigation in Zones 2 and 3.

The rafts assigned to a vessel already registered prior to the entry into force of this Order, and as stated in its Certificate of Navigability, may remain on board that vessel, even if they do not comply with the any of the above requirements, as long as they are in good condition and have passed the prescriptive reviews. The emergency package will be the one for your Navigation Zone, as set out in the following section. In any case, such rafts may not be installed on board another vessel.

4. The SOLAS or equivalent rafts, in navigations in Zone 1, will carry an emergency package type A of SOLAS. The rafts in zones 2 and 3, will carry an emergency package type B of SOLAS.

Article 7. Life jackets.

1. Vessels sailing in Zone 1 shall bear at least one life jacket per authorized person, plus 10% of the total.

2. Vessels sailing in Zones 2 to 7 shall bear at least one life jacket per person authorised.

3. Life jackets will be provided for 100% children on board.

4. The inflatable life jackets will be reviewed annually at an authorized service station.

5. Life jackets may be of type:

a) SOLAS, approved by the General Directorate of the Merchant Navy.

b) SOLAS, approved by a notified body with the rudder wheel mark in accordance with Royal Decree 809/1999 of 14 May.

(c) 'EC', approved by a notified body in accordance with Royal Decree 1407/1992 of 20 November 1992 governing the conditions for the marketing and free movement of goods within the Community individual protection.

6. The buoyancy required in the CE marking vests is shown in the summary table in the following article.

Article 8. Lifeguards.

1. Vessels sailing in Zone 1 shall bear a minimum of two lifeguards, one of which shall bear light and rage.

2. Vessels sailing in Zones 2 to 4 shall carry a ring with light and tantrum.

3. Lifeguards may be of type:

a) SOLAS, approved by the General Directorate of the Merchant Navy.

b) SOLAS, approved by a notified body with the rudder wheel mark in accordance with the provisions of Royal Decree 809/1999 of 14 May 1999.

(c) "EC", approved by a notified body in accordance with Royal Decree 1407/1992 of 20 November.

Article 9. Distress signals.

1. Any recreational craft shall have the pyrotechnic distress signals indicated in the following table, depending on the navigation area that has been assigned to it.

2. All signs must be approved in accordance with the provisions of Royal Decree 809/1999 of 14 May 1999.

CHAPTER III

Navigation Equipment

Article 10. Navigation lights and markings.

1. Navigation lamps and markings shall comply with the Convention on the International Regulations to Prevent Collisions, 1972 and their subsequent amendments.

2. In the case of daytime navigation exclusively, up to 12 miles from the coast and/or on vessels less than 7 metres in length, and the navigation lights may be dispensed with, but a white light electric flashlight must be carried with spare.

3. Navigation lamps may be accepted if they have been approved by any country of the European Union. The vessels of Zones 5, 6 and 7 may carry unapproved lamps, including batteries, provided that they are in good condition and in daytime navigation only.

Article 11. Anchor lines.

1. All vessels must have a anchorage line the length of which shall not be less than five times the length of the craft.

2. The length of the chain length shall be at least equal to the length of the vessel, except for vessels less than 6 metres in length where the line of anchorage may be entirely constituted by stacha.

3. Chains or spliced stags are not permissible without shackling.

4. The following table shows the chain and stache diameters and the weight of the anchor each vessel must carry according to its length:

5. The chains must be of galvanised or equivalent steel, with the diameter indicated in the table and measured according to EN 24565.

6. The diameter of the stache is referred to nylon stachas; in any case, its breakage load will be greater than that of the chain.

7. The weight of the anchors indicated in the table corresponds to high-grip anchors (with a tolerance of 10%), so the weight should be increased by one-third in other types of anchors. The weight of the anchor may be divided into two anchors, the main anchor weight not less than 75% of the total weight.

8. For intermediate sling as indicated in the table, the values of the anchor weight and chain diameters and stacha shall be interpolated.

Article 12. Nautical material.

1. Recreational craft shall have the nautical material referred to in the following table, and shall meet the requirements set out in paragraph 2, in accordance with the navigation area assigned to it. The relationship of the table is not limited, with items that correspond to the Navigation Zone higher than your own.

2. Requirements:

a) Compas.

i. Vessels that sail in Zones 1 and 2 must carry a government compas with lighting and a compass of markings. In addition there shall be a detour tablet to be checked every five years.

ii. Vessels sailing in Zones 3 and 4 must carry a government compas.

iii. In all cases, disruptive actions on the compass, such as those derived from radio installations or electrical circuits, shall be avoided.

iv. The compas may be the magnetic compass or the compass for lifeboats regulated in Annex A. 1 to Royal Decree 809/1999 of 14 May.

b) Corredera. It shall be of propeller, electric or pressure, with totalizer. Alternatively a Global Positioning System (GPS) will be allowed.

c) Sextant. It will be accompanied by the necessary tables for astronomical navigation.

d) Letters and nautical books.

i. They shall carry the letters covering the seas for which they are navigated according to the respective categories and the portuans of the ports they use.

ii. The Faros Notebook and a Derrotero of the area in which they sail, the Anuario de Maréas (except in the Mediterranean), the Manual of First Aid, the Radio Regulations if they mount radio and the International Code of Signals, are obligatory. for navigations in Zone 1.

e) Fog of fog. It can be hand-operated or replaceable by gas-driven horn in pressure vessel. In this case, a membrane and a gas container shall be provided as a respect.

f) Campaign. For vessels of 15 metres or more, the weight of the bell shall be at least 5 kilograms. In slors less than 15 meters, the campaign is not mandatory but must be provided with means to produce some sound in an effective way.

g) Flag code. They must have at least the flags C and N. For Zone 1, their minimum dimensions shall be 60 x 50 centimetres.

h) Lantern stagnates. A bulb and a game of respect stacks will be available.

i) Radar reflector. It shall be placed on non-metallic hull vessels.

j) Signal code. If you mount radio communications devices.

3. The material referred to in paragraph 2, as referred to in Royal Decree 809/1999 of 14 May 1999, shall comply with the requirements laid down therein.

Article 13. Material of diverse weaponry.

1. Any recreational craft must carry on board the following equipment:

a) An emergency rudder rod in sailing vessels and in single-engine vessels if the government is at a distance, except if the engine is outboard or transmission in z.

b) A minimum of two mooring stags to the spring (if any), of length and strength appropriate to the length of the vessel.

c) A bichero.

d) A sufficient length oar and boga device, or a pair of zags for vessels of less than 8 metres in length.

e) On rigid and semi-irrigated pneumatic vessels, an inflator and a puncture repair set.

f) A boob:

i. Vessels with contracted crew must be provided with the kit prescribed in Royal Decree 258/1999 of 12 February laying down minimum conditions for the protection of health and medical care. Sea workers and Order PRE/930 /2002, of 23 April (Botiquines types A, B and C, according to distance from the coast and time of navigation).

ii. Vessels without a contract crew, approved for the Navigation Zone 5, shall have the type 4 kit, according to the Order of 4 December 1980 on boats and national merchant vessels.

iii. Vessels without contracted crew, authorised for Navigation Zones 3 and 4, shall have the Balsa type of rescue vessel (as referred to in point (i)).

iv. The vessels without contracted crew, authorized for Navigation Zone 2, must have the type C kit (according to the provisions mentioned in point i).

v. The vessels without a contract crew, authorized for Navigation Zone 1, must have at least the type C kit (according to the provisions referred to in point i), which shall be completed in accordance with the duration of the period of the trip, the places frequented and the number of people.

CHAPTER IV

Fire and achique media

Article 14. Portable fire extinguishers.

1. Recreational craft, including those provided with other extinguishing systems, must carry portable fire extinguishers in the quantity and type specified below.

(a) The fire extinguishers shall be installed at points of easy access and far away from any possible source of fire.

(b) When the craft is fitted with more than 50 volts, one of the fire extinguishers must be suitable for electrical fires.

c) The extinguishers shall be of a type approved by the General Directorate of the Merchant Navy for recreational craft or shall bear the rudder mark established by Royal Decree 809/1999 of 14 May 1999 and shall be subject to the revisions, and must be provided with an information card stating the date of the last revision and the name of the entity that made it. The extinguisher shall contain at least 2 kilograms of extinguishing product (dry powder, or equivalent quantity of another extinguishing product).

3. Fire extinguishers for the propellant installation.

(a) Ships fitted with one or more engines shall bear the extinguishers affected to the engine compartment, the number of which is indicated in the table, or a fixed fire-extinguishing facility which complies with the requirements of the next item.

(b) If the length is less than 10 metres, these fire extinguishers shall be used to comply with the requirements of paragraph 2.

c) For vessels with outboard engines of less than 20 kilowatts attached to Navigation Categories 6 and 7, the installation of extinguisher shall not be mandatory.

(d) Ships provided with a fixed fire extinguishing facility must have a portable fire extinguisher located in the vicinity of the engine compartment, sufficient to cover a quarter of the power without more than one extinguisher must be required.

Article 15. Fixed fire extinguishing means.

1. Without prejudice to the fixed fire extinguishing equipment, appropriate to the risk of fire, to be carried by each vessel, vessels with engines using classified group 1 fuel in accordance with Article 19 shall be provided with a fixed extinguishing facility in the engine compartment, which avoids opening the compartment in the event of fire.

2. The above installation will meet the following requirements:

a) No halogen gases are permissible as extinguishing agents.

b) The firing of the extinguishing device must be able to be performed manually from the outside of the compartment.

c) This extinction system will never be used in habitable places.

d) Only the automatic firing of the installation into small, non-accessible engine compartments (which does not accommodate a person) will be permitted.

Article 16. Detection of fires and gases.

1. Without prejudice to fire detection equipment or gases appropriate to the risk of fire, which must be carried by each vessel, vessels with fuel gas installations, in whole or in part within the hull, shall be required to carry out gas detection means (gas detector).

2. In the case of a fire or gas detection system, it shall meet the following requirements:

a) Your indication will be automatic.

(b) The indicators shall be centralised at the command post.

c) Your power supply will be direct.

d) Actioning both light and sound signals.

Article 17. Fire-fighting buckets.

All recreational craft must be provided with the buckets shown in the following table:

1. They will be light and easy to handle and will have a minimum capacity of 7 litres. The plastic material is accepted as long as it is of robust construction and its handles cannot be detached.

2. They may also be used for achique or for other services, but never for fuel or other flammable liquids.

Article 18. Extraction of gases.

Inland engines with electric start using fuel classified in group 1. according to Article 19, must have an anti-deflagrant electric fan (according to Standard ISO 8846) which is operated by aspiration and Discharge directly to the outside, and able to completely renew the air from the engine compartment and fuel tanks in less than four minutes. The electric circuit of the fan shall be independent of the engine starting circuit, in order to vent the compartment before the start. Next to the boot device there will be a plate visible in Spanish which will remember the need to vent the engine compartment for four minutes before starting the engines.

Article 19. Classification of fuels.

For the purposes of this Order, the fuels used on board the recreational craft are classified in two groups:

(a) Group 1. º, liquid fuels with a flash point of less than 55 ° C (a fuel that is liquid at atmospheric pressure and is used in spark ignition engines).

(b) Group 2. °, liquid fuels with a flash point of 55 ° C or more (a fuel that is liquid at atmospheric pressure and is used in compression ignition engines).

Article 20. Achique media.

1. Without prejudice to the means of achievement required for vessels bearing the CE marking, recreational craft shall at least be provided with the means of achique shown below, in accordance with the Navigation Zones:

(a) In Zones 1, 2 and 3, a pump driven by the main engine or other source of energy, another manual pump, and two buckets.

b) In Zones 4, 5 and 6, a bucket and a pump.

c) In Zone 7, a manual or electric pump. For L < = 6 m with buoyancy chambers, a chicador.

(d) In sailboats attached to Zones 1, 2, 3, 4, 5 and 6, at least one pump shall be manual and fixed, operable from the bathtub with all the hatches and access to the interior closed.

e) In vessels with separate bilge compartments, similar pumping means must be provided.

2. The capacity of the pumps must not be less than (at a pressure of 10 kPa):

a) 10 litres/min for L < = 6 m.

b) 15 litres/min for L > 6 m.

c) 30 litres/min for L > = 12 m.

For manual pumps, the capacity must be reached with 45 bagged per minute.

3. Pumps in enclosed spaces containing fuel engines or tanks in group 1 shall be anti-defagrants.

CHAPTER V

Prevention of discharges

Article 21. Application.

In addition to the provisions of Article 60 of Law 27/1992 of 24 November, the prevention of discharges of dirty water and pollutants will be governed by the provisions of this Chapter.

Article 22. Discharges of dirty water and pollutants.

Vessels shall be constructed and/or equipped in such a way as to prevent accidental discharges of dirty water and pollutants such as oil or fuels into the water.

Article 23. Health facility retention systems.

1. Any recreational craft provided with toilets shall be provided, without prejudice to the requirements laid down for vessels bearing the CE marking, holding tanks or installations which may contain tanks, intended to retain water (a) dirty water generated during the stay of the vessel in areas for which there are limitations of the discharge of this type of water, and with sufficient capacity for the number of persons on board. Toilets with a transportable storage tank system are acceptable if said tanks comply with the provisions of ISO 8099.

2. Fixed deposits or facilities:

a) They will be connected with the discharges of the toilets installed on the vessel, with connections as short and direct as possible, and they will be installed in accessible places. For vessels with more than one toilet, already registered, having difficulties, for reasons of space, for the connection of all toilets, at least one of the toilets shall be connected to the fixed tanks or installations.

b) Dispose of adequate means of ventilation.

c) Dispose of means to indicate that the stored dirty water content exceeds 3/4 of the capacity of the depot or facility.

(d) Your capacity shall be sufficient to retain the dirty water generated by the maximum number of persons authorised for the vessel, for at least two days at the rate of 4 litres per person per day.

3. The vessel with permanent installed deposits shall be provided with a universal grounding connection that allows the conduit of the reception facilities to be coupled to the discharge line of the vessel.

4. In addition, ducts intended for the discharge of human organic waste passing through the hull shall be fitted with valves which can be hermetically sealed to prevent inadvertent or intentional opening, such as seals or devices. mechanics.

Article 24. Discharge of dirty water.

1. Any discharge of dirty water from recreational craft in the following waters in which Spain exercises sovereignty, sovereign rights or jurisdiction is prohibited:

a) port areas,

b) protected waters and

c) other zones such as rias, bays, and the like.

2. The discharge of dirty water by recreational craft in other waters where Spain exercises sovereignty, sovereign rights or jurisdiction is authorised provided that one of the following conditions is met:

(a) that the vessel discharges at a distance greater than 4 nautical miles from the nearest land if the dirty water has been previously shredded and disinfected by a system that meets the conditions set out in paragraph 4, or at a distance greater than 12 nautical miles if they have not previously been shredded or disinfected. The dirty water which has been stored in the holding tanks shall not be unloaded instantly but at a moderate speed, with the vessel en route sailing at speed not less than 4 knots;

(b) the vessel is unloading in waters other than those referred to in paragraph 1 of this Article, using an on-board installation for the treatment of dirty water complying with the requirements of paragraph 5; and in addition, the effluent does not produce visible floating solids, nor does it cause discoloration in the surrounding waters;

(c) where the dirty water is mixed with waste or waste water for which different discharge requirements apply, the most stringent discharge requirements shall apply to them.

3. The above paragraph will not apply:

i) to the discharge of the dirty waters of a vessel when necessary to protect the safety of the vessel and the persons it carries on board, or to save lives at sea.

(ii) the discharge of dirty water resulting from damage to a vessel or its equipment, provided that any reasonable precautions to tackle or otherwise have been taken after the failure has occurred. reduce to a minimum such download.

4. The port and/or maritime authorities are authorized to seal, while the vessel remains in the port or protected areas, those pipelines where the dirty waters can be poured directly into the sea or those for which the contents of the dirty water retention deposit can be emptied into the sea.

5. If the vessel is equipped with an installation to crumble and disinfect the dirty water, this installation, so that it can be considered valid in place of the deposit of the article 23 and/or so that the expected discharges can be carried out in paragraph 2.a), it must have been accepted by the Spanish authorities in accordance with the procedures laid down in internationally recognised testing standards.

6. If the vessel is equipped with an installation for the treatment of the dirty water, this facility, so that it can be considered valid in place of the deposit of Article 23 and/or so that the discharges provided for in the paragraph 2.b), must have been certified or approved in accordance with the procedures laid down in any of the following regulatory instruments:

(a) Certified in accordance with the procedure established by Royal Decree 809/1999 of 14 May.

(b) Homologated by the Spanish Administration in accordance with the standards and test methods approved by the International Maritime Organization, or internationally recognized standards.

(c) Accepted, if applicable, by the Spanish Administration after having been approved or certified by other Administrations.

CHAPTER VI

Violations and penalties

Article 25. Infringements and penalties.

Failure to comply with the obligations set out in this Order will be sanctioned in accordance with the provisions of Chapter IV of Royal Decree 1434/1999 of 10 September, and Law 27/1992 of 24 November, of Ports of the State and the Merchant Navy.

Single additional disposition.

The referrals that this Order makes to the expression "SOLAS" shall be construed as referring to the International Convention for the Safety of Human Life in the Sea, 1974, as amended.

Single transient disposition.

The registered pleasure craft must complete, within six months of the date of entry into force of this Order, the safety elements which they carry on board with the other vessels which are required to be established in the same. For the related equipment in Chapter V, the time limit shall be nine months.

Single repeal provision.

Any provisions of equal or lower rank shall be repealed as opposed to the provisions of this Law and, in particular:
