EXPLANATORY STATEMENT

I

The private insurance activity has been undergoing an intense transformation reflected in the laws and regulations adopted in recent years, which have been aimed at incorporating Community law (a) to modernise the online sector of convergence with the other Member States of the European Economic Area and, as a last justification, to promote the development and expansion of the private insurance market.

This law is intended to continue with this process of legislative change, which is, as in previous occasions, driven by Community legislation.

The changes that are now being made arise from the need to adapt Law 30/1995, of 8 November, to the Management and Supervision of Private Insurance, to the new Community directives approved in the field of the sector insurance: Directive 2001 /17/EC of the European Parliament and of the Council of 19 March 2001 on the reorganisation and liquidation of insurance undertakings; Directive 2002/13/EC of the European Parliament and of the Council of 5 March 2002 on the amending Council Directive 73 /239/EEC as regards the requirements of the Directive the solvency margin of insurance undertakings other than life insurance, and finally Directive 2002/83/EC of the European Parliament and of the Council of 5 November 2002 on life assurance.

This last directive recasts the Community rules on life assurance, including Directive 2002/12/EC of the European Parliament and of the Council of 5 March 2002 amending Council Directive 79 /267/EEC in the (a) the requirements of the solvency margin of the life assurance undertakings.

On the other hand, Directive 2002/65/EC of the European Parliament and of the Council of 23 September 2002 on the distance marketing of financial services for consumers and amending the Council Directive 90 /619/EEC and Directives 97 /7/EC and 98 /27/EC introduces an amendment to Council Directive 90 /619/EEC of 8 November 1990 on the coordination of laws, regulations and administrative provisions relating to direct life insurance (Second Life Insurance Directive).

The incorporation into the Spanish legal system of the content of Directive 2001 /17/EC of 19 March 2001 on the reorganisation and winding-up of insurance companies involves the amendment of the legislation which within that it is intended to regulate the liquidation of the insurance institutions, as well as certain aspects of the special control measures that may be taken in respect of such entities.

purpose of the Directive is to establish coordinated rules at Community level, both for settlement procedures and for reorganisation measures, in order to ensure the proper functioning of the market. at the same time as improving the protection of creditors. This guarantees the mutual recognition of the reorganisation measures and the rules on settlement adopted by the Member States, while ensuring the necessary cooperation between those States, without any intention being given to them. to harmonise the national legislation applicable to such measures and procedures.

In this respect, it complements the existing insurance directives in which, while a single administrative authorisation of Community scope is provided for, no coordination rules are included in the case of adoption of procedures for settlement or reorganisation measures with respect to insurance institutions. It should be noted, as the directive itself points out, that insurance institutions are explicitly excluded, as is the case with other financial institutions, from the scope of Council Regulation (EC) 1346/2000 of 29 May 2000. on insolvency proceedings, in 2000.

Finally, it should be noted that the territorial scope of application of the provisions of the Directive covers the entire European Economic Area, in accordance with the Decision of the Joint Committee of the European Economic Area of 6 December amending Annex IX to the Agreement on the European Economic Area.

Directive 2002 /12/EC (currently repealed and the content of which has been incorporated into Directive 2002/83/EC) and Directive 2002/13/EC have amended the requirements of the solvency margin of the

life and insurance companies other than life insurance companies, respectively.

Its objective is to strengthen guarantees for policyholders by strengthening solvency margin requirements. The current solvency requirements, based on simple principles with a high degree of transparency, have presented certain weaknesses in specific cases, in particular in relation to those sensitive aspects from the point of view of the risk. As a result, there has been a need to rethink certain aspects; this review leads to the directives that are now being transposed.

With regard to the incorporation into the Spanish legal order of its content, it is necessary to modify the current regulations in relation to the requirements and solvency requirements of the entities In particular, the regulation of the guarantee fund, both in terms of the increase in its amount and its regular and automatic updating, and the preventive control measures to be taken to ensure the future solvency of the insurance companies which present difficulties, inter alia.

It must be borne in mind that with these directives on solvency margin, in its present conception, the regulation of a basic element of the supervision of the insurance institutions, which was introduced in the regulations, is closed. Spain, with a general character, by Royal Decree 3051/1982 of 15 October, and enshrined in Law 33/1984 of 2 August on the Management of Private Insurance and its implementing rules. The regulation of the solvency margin and the guarantee fund has since constituted an effective element to guarantee and monitor the solvency of the institutions, without prejudice to the fact that their current configuration is subject to a thorough review at Community level to bring more precisely the capital requirements to the risks actually borne by the institutions.

In any case, the complete incorporation of the content of the new solvency directives, in addition to the amendments of the precepts of Law 30/1995, of 8 November, of the Management and Supervision of the Private Insurance, require making the necessary adjustments to the regulatory standard, in so far as it is in it that certain aspects are regulated, such as those relating to the quantification and composition of the solvency margin.

IV

The amendments introduced by Directive 2002/65/EC of the European Parliament and of the Council of 23 September 2002 on the distance marketing of financial services in the Community insurance legislation (a) life and the need to establish a minimum legal framework for distance insurance contracts which will enable the reality of the market to be met and to serve as a basis for future transposition in its entirety of the said Directive, make various legal adaptations.

New wording is given to Article 60 of Law 30/1995, of 8 November, of the Management and Supervision of Private Insurance, on the duty of information to the taker, in order to adapt its content to the requirements of information and, in general, to the peculiarities required by the distance hiring of insurance and to the need to incorporate the concepts of distance communication and durable medium, understood as any instrument that allows to store the information so that it can be easily recovered and allows it to be reproduced unchanged, such as computer, CD, DVD and hard disk drives.

It is also necessary to amend Law 50/1980, of 8 October, of a Insurance Contract, in order to collect the new features introduced in the Community regulation of insurance by this directive, singularly the right of termination of the contract.

two amendments aim to be an effective manifestation of the protection of customers and of transparency in the relationship between insurer and taker.

The already mentioned Directive 2002/83/EC on life assurance, together with its primary purpose of codification of this area of Community regulation, has made certain adaptations of which it is necessary to incorporate to Spanish legislation concerning the non-requirement to provide the models of policies, technical bases and tariffs as a requirement for the granting of the administrative authorisation to insurers domiciled in third countries not members of the European Economic Area to establish branches in Spain.

In the area of the Law on Civil Liability and Insurance in the Circulation of Motor Vehicles, recast text approved by Decree 632/1968, of March 21, three modifications are made. The first concerns Article 3, in relation to the need to make certain aspects of the procedure more agile in order to penalise non-compliance with the obligation to ensure.

The second, to your article 8, in order to grant indemnification guarantee to the injured resident in Spain with independence from the State of habitual parking of the vehicle that circulating without insurance cause accident.

The third is the purpose of table VI of the system for the assessment of damages caused to persons in road accidents, which is listed as an annex to the Law on Civil and Safe Liability in the Movement of Vehicles to Motor, in respect of which the experience accumulated since its entry into force advises to introduce certain modifications.

In another order of things, an amendment to the Legal Statute of the Insurance Compensation Consortium is introduced in order to allow the compensation for this public entity of the personal damages as a result of extraordinary events occurring abroad when the policyholder has his habitual residence in Spain.

VIII

Public revenues currently perceived as a result of actions by the General Directorate of Insurance and Pension Funds need an inexcusable update in their regulatory regulations.

In the case of the so-called real estate valuation of insurance entities, regulated in a ministerial order of 1956, validated by a decree of 1966, it is necessary to adapt its regulation to its true nature of public price.

With regard to the rate per issue of the diploma of insurance mediator entitled, the establishment of forms of payment that will facilitate their realization to the citizens is a very important one.

On the other hand, Law 44/2002, of 22 November, of Measures of Reform of the Financial System, incorporates as novelty in the field of the mandatory surcharges in favor of the Consortium, the possibility of its fractionation in case of payment of the premium by the insured person. It is established in that law that the charge for the division to be applied must be set at the rates governing the compulsory surcharges.

Taking into account that the surcharge to finance the liquidating functions of insurance companies has a tax nature, this law comes to establish, with the appropriate regulatory range, the surcharge by fractionation apply.

The set of novelties introduced by this law is structured in four articles, two additional provisions, three transitional provisions, one derogating provision and three final provisions.

The article first takes account of the amendments to Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance, in the field of measures for the consolidation and liquidation of insurance institutions, solvency, duty of information to the taker and requirements for the establishment of branches of third countries not members of the European Economic Area.

The second article is reserved for the amendments introduced in Law 50/1980, of 8 October, of Insurance Contract, in order to incorporate the provisions on distance hiring.

The third article contains the three amendments in the recast text of the Law on Civil and Safe Liability in the Circulation of Motor Vehicles.

The fourth article amends Article 6 of the Legal Statute of the Insurance Compensation Consortium, as indicated.

The additional provision first incorporates the regulation of the rate by issue of the diploma of insurance mediator entitled and the additional provision second sets out the types of fractionation to be applied in the event that the the insurance institution chooses to split the surcharge intended to finance the liquidation functions of insurance institutions in conjunction with the premiums.

The transitional provisions refer to the adaptation in time to the amendments introduced in Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance in the field of the consolidation and liquidation of insurance companies, the new amounts of the guarantee fund of the insurance companies and the transitional arrangements for the consideration of the valuation of the real estate of insurance companies by the insurance companies General Directorate of Insurance and Pension Funds.

The single repeal provision specifically concerns the current regulation of the rates affected by the actions of the Directorate-General for Insurance and Pension Funds.

The final provision first incorporates a legislative delegation in the Government for the approval of the recast texts of the Law on Civil and Safe Liability in the Circulation of Motor Vehicles and the Legal Statute of the Insurance Compensation Consortium, and the extension of the deadline for the drafting of the recast of the Law on the Management and Supervision of Private Insurance provided for in the fourth final provision of Law 44/2002, of 20 November, of Measures Reform of the Financial System. The second final provision enables the Government for regulatory development. Finally, the third final provision provides for entry into force.

Article first. Amendments to Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance.

The following amendments are introduced in Law 30/1995, of 8 November, for the Management and Supervision of Private Insurance:

One. A new Article 16a is created in Law 30/1995 of 8 November of the Management and Supervision of Private Insurance, with the following wording:

" Article 16a. Coverage of preferential loans.

Insurance institutions shall have at all times invested in qualified assets as eligible for the coverage of technical provisions the amounts corresponding to those claims which, in accordance with the provided for in this law, may take precedence over those of the insured persons, beneficiaries and injured parties referred to in Article 73 of the Insurance Contract Act, and who are accounted for or should be liable to be liquid, expired and (a)

Two. Article 18 "Guarantee Fund" of Law 30/1995 of 8 November of the Management and Supervision of Private Insurance is amended, which is worded as follows:

" 1. The third part of the minimum amount of the solvency margin is the guarantee fund, which may not be less than EUR 3,000,000 for institutions operating in one of the classes of life, security, credit and any of those covering the the risk of civil liability, as well as for those engaged in exclusively reinsurer activities, and EUR 2,000,000 for the remainder.

2. For the mutual benefit of the passively and the cooperatives, the minimum guarantee fund shall be three quarters of the requirement for the other institutions.

When such entities do not operate in the fields of civil liability, credit, caution or exclusively reinsurer activities, and their annual amount of premiums or quotas does not exceed EUR 5 million for three years. For consecutive years, the guarantee fund may not be less than EUR 800 000 if they operate in the life field, EUR 200,000 if they operate in the classes of other damage to property, legal defence or death, and EUR 300,000 if they operate in the other. Where the institution exceeds the amount of EUR 5 million for three consecutive years, the minimum amount provided for in the preceding subparagraph shall apply with effect from the fourth year.

However, the mutual benefit of such a scheme shall be exempt from the minimum guarantee fund where they do not operate in the life-classes, civil liability, credit or caution or carry out exclusively reinsurer activities and its annual amount of premiums or contributions does not exceed EUR 750,000.

3. The amounts referred to in paragraph 1 shall be subject to an annual review starting on 20 September 2003 in order to take account of changes in the European consumer price index published by Eurostat.

The amounts will be automatically adjusted, increasing their initial amount in euro by the percentage of the percentage of that index during the period between 20 March 2002 and the date of revision, rounding up to a multiple of 100,000 euros. If the percentage change since the last update is less than five percent, no update will be made.

To facilitate their knowledge and implementation, these updates will be made public by resolution of the General Directorate of Insurance and Pension Funds. "

Three. Article 27 (3) (c) and (6) "Liquidation of insurance institutions", the current wording of which becomes paragraph 7 of Law No 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance, as follows: wording:

" 3. The legal regime for the appointment, performance and responsibility of the liquidators shall comply with the following rules:

[...] (c) The liquidators shall, in union with the directors, take stock of the institution's inventory and balance sheet and shall submit it, not later than one month after appointment, to the Directorate-General for Insurance and Funds Pensions or, if the settlement is intervened, to the financial controller.

They must inform creditors about the situation of the institution, in particular the policyholders as to whether the Directorate-General for Insurance and Pension Funds has determined the anticipated maturity of the duration of the insurance contracts which integrate the insurance institution's portfolio and the date of the insurance undertaking, and the manner in which they are to apply for the recognition of their claims, by means of individual notification to the known and appealing to the unknown through notices, approved in their case by the financial controller, to be published in the Official Gazette of the "Register of Trade", and in two newspapers, at least, of those with the highest circulation in the scope of the insurance undertaking.

When the known creditor has its registered office in a Member State of the European Economic Area other than Spain, the information above shall be provided in Spanish, although the document must bear in all the official languages of the European Union, the heading ' Convocation for the submission of appropriations. Applicable time limits "or" Call for submission of comments on appropriations. Applicable time limits ', as appropriate. However, where the creditor is an insurance credit, the information shall be provided in the official language or in one of the official languages of the Member State of his address.

Creditors with domicile in a Member State of the European Economic Area other than Spain may submit written claims for claims or observations to them in the official language or in one of the languages If the document is to bear the heading ` ` Presentation of credits '' or in its case ` ` Presentation of observations on the credits '' in Spanish. "

" 6. The corresponding administrative decision or the agreement in which it brings the case shall be recognised in the territory of the other Member States of the European Economic Area, in accordance with the provisions of its legislation, and shall take place. effects on them as soon as they do in Spain.

For these purposes, the Directorate-General for Insurance and Pension Funds, within ten days from the date of the date on which the decision is made or becomes aware of the agreement, shall inform the authorities of the monitor the other Member States of the European Economic Area on the existence of the procedure and its effects. In addition, the said body shall publish in the Official Journal of the European Communities an extract from that decision or agreement, which shall in any event indicate the competence of the Ministry of Economic Affairs on the procedure, the settlement procedure is contained in this law and its implementing rules, as well as the identification of the appointed liquidator or liquidators.

Liquidators will be able to carry out their activities in the territory of all the Member States of the European Economic Area, with the same functions and powers as in Spain. For these purposes, it shall be sufficient evidence to prove the status of liquidator a certification of the decision or a legalised copy of the agreement for which the appointment is made.

They may also grant proxy powers or request assistance, where this is necessary to carry out the settlement process in the territory of other Member States of the European Economic Area, and in In order to resolve the difficulties that the creditors resident in them might encounter. In any event, persons who attend or represent them must be of good repute and must meet the necessary conditions of qualification or professional experience in order to perform their duties, in accordance with Article 15 of this Law.

The provisions of this law and its implementing rules will be applicable to liquidation.

7. In any case not expressly regulated in this article, the liquidation and termination of insurance institutions shall be governed by the provisions of Articles 266 to 281 of the Law on Limited Companies, except for Articles 269 and 270. "

Four. Paragraph 3 is amended and a new paragraph 4 is created in Article 28 'Shares in respect of insurance undertakings subject to proceedings in respect of or in liquidation' of Law No 30/1995 of 8 November 1995 on the Management and Supervision of Insurance Private, with the following wording:

" 3. In the case of liquidation brought by the Ministry of Economic Affairs, the individual shares exercised by the creditors, before the commencement of the liquidation or during the liquidation, may continue until the delivery of a final judgment but his execution shall be suspended and the credit which, if appropriate, declares that judgment in his favour shall be settled jointly with those of the other creditors. However, after one year after the judgment has become final, the suspension shall be automatically lifted without the need for a declaration or a resolution in this respect, whichever state the liquidation was.

The provisions of the preceding paragraph do not apply to shares in the exercise of real rights over goods located outside the Spanish territory, which shall be governed by their specific legislation, or to the shares in the financial year of a real right of guarantee to be governed by a law other than the Spanish law.

4. The claims of insured persons, beneficiaries and injured parties referred to in Article 73 of the Insurance Contract Act shall be of absolute priority over all other claims against the insurance undertaking in respect of assets which, representing the technical provisions, are incorporated in the special register referred to in Article 16a.

In respect of claims against the insurance institution which do not enjoy the priority referred to in the preceding paragraph, the system of precedence laid down in Law 22/2003 of 9 July, Insolvency, rule, shall apply. which results in addition to subsidiary application in all of the non-regulated in this law.

The goods in respect of which the special control measure for the prohibition of disposal, as provided for in Article 39.2.a), has been adopted, even if such a measure has not been the subject of registration, shall be affected to satisfy the appropriations referred to in paragraph 1, excluding any other than those covered by the guarantee with a real right registered or an embargo entered into force prior to the date on which the measure is recorded in the registers; corresponding. This preference shall also apply to the claims of those who have concluded contracts with the insurance undertakings concerned by the provisions of Article 5.2 and the second paragraph of Article 39.7 of this Law. '

Five. A new Article 28a of Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance is added with the following wording:

" Article 28a. Consign processes.

1. Issued by the competent court of the competent court in respect of an insurance undertaking, that body shall immediately notify the Directorate-General for Insurance and Pension Funds, which shall be notified within 10 days. the following shall inform the supervisory authorities of the other Member States of the European Economic Area on the existence of the procedure and its effects.

The Directorate-General for Insurance and Pension Funds shall also publish in the Official Journal of the European Communities an extract from the abovementioned resolutions indicating in any case the body of the competent court and the application to the procedure of Spanish legislation.

2. In any case, the rules of private international law provided for in Law 22/2003 of 9 July, Conjuciones, should be observed.

In the case of known creditors having their domicile in a Member State of the European Economic Area other than Spain, they shall be informed of the way in which they have to apply for the recognition of their conformity with the provisions of the second paragraph of Article 27.3.c) of this law and may submit the written claims for claims or observations thereto in the manner referred to in the third paragraph of the same precept.

3. The Directorate-General for Insurance and Pension Funds may ask the judge for information on the status and development of the proceedings involving insurance undertakings. "

Six. The title of Section 3.a of Chapter III of Title II of Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance, which is referred to as 'Liquidation by the Insurance Compensation Consortium', is hereby amended. deletes the division in subsections of that section 3.a Seven. The first subparagraph of Article 37 (1) "Settlement procedure", of Law 30/1995, of 8 November, of the Management and Supervision of Private Insurance, is amended as follows:

" 1. Entrusted with the liquidation of the Insurance Compensation Consortium, all creditors shall be subject to the winding-up procedure by the latter and may not be requested by the creditors or the insurance institution for the declaration of competition, without (a) any action taken in the courts against that insurer, prior to the dissolution or during the liquidation period, continues to be processed until a final judgment or judgment has been obtained. However, the execution of the judgment, the preventive embargoes, the judicially agreed administrations and other precautionary measures taken by the judicial authority, the one of the order issuing the execution in the executive procedure, the judicial proceedings summarily and extrajudicial executives on mortgaged or pignorised goods found on Spanish territory, as well as the execution of the administrative provisions of the award will be suspended from the the liquidation of the Insurance Compensation Consortium and during the processing of the settlement procedure. '

Eight. The second indent of Article 39 (2) (d) "Measures of special control" of Law No 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance is amended as follows:

" (d) In addition, in all cases of the adoption of special control measures and in order to safeguard the interests of the insured persons, they may jointly or separately adopt any of the following measures:

[...] Prohibit the extension of insurance contracts concluded by the insurance undertaking in all or some of the classes. For these purposes, the insurance undertaking must inform the insured persons in writing of the prohibition of the extension of the contract within 15 calendar days after receipt of the notification of this special control measure; in this case, the provided for in the second paragraph of Article 22 of the Insurance Contract Law shall be reduced to 15 calendar days. Irrespective of the written communication to the policyholders, the decision adopting such a measure shall be published in the Official Gazette of the State and in the Official Journal of the European Communities. '

Nine. Paragraph (a) is amended and a new paragraph (f) is hereby set out in Article 39 (4) "Measures of special control", of Law No 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance, with the following wording:

" 4. The provisional replacement of the administrative bodies of the insurance undertaking shall be as follows:

(a) The administrative decision shall designate the person (s) to act as interim administrators and indicate whether they should

to do so jointly or severally. Such a decision, of an immediate executive nature, shall be published in the 'Official Gazette of the State' and shall be entered in the relevant public registers, including, where appropriate, those existing in the other Member States of the European Economic Area, determining the publication of the effectiveness of the resolution vis-à-vis third parties. The replacement of temporary administrators shall be subject to the same requirements and effects where it is necessary to do so. " " (f) Provisional administrators may carry out their action on the territory of all the Member States of the European Economic Area, and may exercise in them the same functions and powers as in Spain. For these purposes, it shall be sufficient to certify the status of administrator of a certification of the decision to which the appointment is agreed. They may also grant powers of representation or request assistance, where this is necessary to carry out the implementation in the territory of other Member States of the European Economic Area of the measures taken, and in particular, to resolve the difficulties that the creditors resident in them might encounter. In any case, persons who attend or represent them must be of good repute and must meet the necessary conditions of qualification or professional experience in order to perform their duties, in accordance with Article 15 of this Law. "

Ten. A new paragraph 9 is added to Article 39 "Special Control Measures" of Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance, with the following wording:

" 9. Adopted by the Directorate-General for Insurance and Pension Funds, as provided for in the preceding paragraphs, either of the measures referred to in paragraphs (a), (b) and (c), or in the second, fifth and eighth indents of paragraph 2 (d) (a) the date referred to in paragraph 3, as well as the prohibition on the distribution of dividends, active branches or returns, shall take effect, in accordance with the provisions of its legislation, in all Member States of the European Space European Economic. For these purposes and without prejudice to the provisions of paragraph 2 (a) and 51 (3), the Directorate-General for Insurance and Pension Funds shall inform the supervisory authorities of the other Member States. the European Economic Area of the agreement to be adopted for the measure and its effects within 10 days of its adoption.

Such measures shall be governed by the provisions of this law and its implementing rules. "

Once. A new Article 39a is hereby established in Law 30/1995 of 8 November 1995 on the Management and Supervision of Private Insurance, with the following wording:

" Article 39a. Measures to guarantee the future solvency of insurance institutions.

1. The Directorate-General for Insurance and Pension Funds may adopt the measures referred to in paragraph 2 of this Article where circumstances are met, deducted from checks carried out by the Administration, which may endanger the the future solvency of the institution or may pose a threat to the interests of the insured or the future performance of the obligations incurred, as a result of an inadequate selection of risks, the application of premium rates insufficient, the existence of significant deviations from the accident, the inadequacy of the policy of reinsurance or of any other cause which may in the future generate a serious situation of imbalance or financial weakness.

2. The guarantee measures for the future solvency of the insurance institutions may consist of:

(a) Require a financial recovery plan for the insurance institution to ensure and provide for its future solvency, which must be submitted for approval by the Directorate-General for Insurance and Pension Funds. Rules of use.

8. The General Budget Law of the State of each year may update the amount of the fee.

Additional provision second. Fractionation of the surcharge intended to finance the liquidation functions of insurance entities by the Insurance Compensation Consortium.

The choice by the insurer of the option to split the surcharge intended to finance the liquidation functions of insurance institutions together with the premiums will entail the obligations laid down in the Article 18 (2) of the Legal Statute of the Insurance Compensation Consortium, in accordance with the wording given to it by the third paragraph of Article 11 (3) of Law 44/2002 of 22 November of the System Reform Measures Financial.

The authorization to the Government for the elaboration of a recast text of the Law on the ordination and supervision of private insurance, in accordance with the fourth paragraph, first paragraph, of Law 44/2002, of 22 November, Measures of Reform of the Financial System, will include the incorporation of the modifications contained in this law, as well as those that are derived from the provisions of the Law of the Bankruptcy provided in the final decision of the Law 1/2000, of 7 of January, on Civil Procedure. The period of one year laid down in the fourth final provision of Law 44/2002 shall be computed from the entry into force of this law.

Final disposition second. Enabling for regulatory development.

The government is empowered, in the field of its powers, to develop the provisions of this law.

Final disposition third. Entry into force.

This Law shall enter into force on the day following that of its publication in the "Official Gazette of the State", without prejudice to the following:

(a) The amendments introduced in Law 30/1995 of 8 November of the management and supervision of private insurance, in the area of measures for the reorganisation and liquidation of insurance institutions, will enter into force on 19 December. April 2003.

(b) The amendments introduced in Law 30/1995 of 8 November 1995 on the management and supervision of private insurance in the area of solvency of insurance institutions shall enter into force on 1 January 2004.

c) The types of the fractionation surcharge referred to in the second provision of this law shall enter into force within three months of their publication in the "Official State Gazette".
