The framework that delimits the additions of new members in the year 2004, with a general character for all staff at the service of the public sector, is defined in Article 20 of Law 61/2003, of December 30, of Budgets State Generals for the year 2004, providing that the calls for entry for new staff will be concentrated in the sectors, functions and professional categories which are considered to be a priority or which affect the functioning of the essential public services, and that the number of places of new entry must be, at most, equal to 100 percent of the rate of replacement. Within this

limit, the offer of public employment will include all places and posts performed by interim staff, appointed or employed in the previous two years, except those on which there is a reserve of post or are courses in provision processes.

The limitation contained in the first paragraph shall not apply to the staff of the Administration of Justice, for which the number of places shall be determined in accordance with the provisions of Law 38/1988 of 28 December 1988. Demarcation and the Judicial Plant, and public administrations with educational competencies for the development of the Organic Law 1/1990, of October 3, of General Ordination of the Educational System, and the Organic Law 10/2002, of 23 December, of Quality of Education, in relation to the identification of the number of places for access to the bodies of teaching staff.

In addition, in order to promote stability in employment, it is possible to call for those places corresponding to the different bodies, scales or categories, which, being budgeted and included in their relations of (a) job or catalogue, as well as in the staff templates, are either temporarily or temporarily performed before 1 January 2002.

Article 20 of Law 61/2003 of 30 December 2003, in the first paragraph of paragraph 3, provides that the Government, with the limits set out above, may authorise, through the offer of employment public, prior to the favorable report of the Ministry of Finance, at the proposal of the Ministry of Public Administrations and on the initiative of the departments or public bodies competent in the matter, the call for vacancies of new income which refer to the staff of the Civil Administration of the State and its autonomous bodies, civil personnel of the military administration and its autonomous agencies, personnel of the Administration of Social Security, statutory staff of Social Security, staff of the Administration of Justice, Armed Forces and Forces and Corps of State security, and staff of the public entities, the State Agency for Tax Administration, the Nuclear Security Council and the Spanish Data Protection Agency, and the public entity Lotteries and Apes of the State, as well as the posts and places which are currently or temporarily performed in the interim on 1 January 2002.

Article 20 of Law 61/2003, of December 30, in the third paragraph of paragraph 3, also states that the Ministries of Public and Finance Administrations may jointly authorize the corresponding (a) calls for vacancies or vacant posts of public entities and public entities not mentioned above, in compliance with the rate of replacement of the staff established in general.

The aforementioned joint authorization will also apply to the state companies for the management of public service broadcasting and television dependent on the Public Ente Radiotelevisión Española. As a result, given the particular structure of public employment in this area, the places whose need is considered essential for each public or public entity are included in the annex to this royal decree, and the provision is also provided for in the exceptional convocation of places which respond to oversold needs, always respecting the limit of the rate of replacement of staff.

For these purposes, the following priority sectors will be considered:

(a) External Service, in order to continue strengthening the presence of the General Administration of the State abroad and to meet the growing demand for consular actions by the Diplomatic Missions.

b) Research and support for the research, with a view to the continuity of the development of these areas, initiated in the offer of public employment for the year 2002.

c) State museums, in consideration of the comprehensive plan of museums, aimed at raising the quality level of the service provided by these institutions, through the intensification of surveillance activities, attention to the public and catering.

(d) Air and maritime safety, in order to ensure compliance with the growing demands to be met in these areas by the administration of civil aviation and the administration of the merchant navy.

e) Public finances and control of public expenditure, with the aim of intensifying inspection actions, combating fraud, containment and control of public expenditure.

(f) Prison institutions, in the light of the evolution of the recluse population and the needs arising from the Plan for the depreciation and creation of penitentiary centres (which provides for the opening of several new centres and modules). in existing establishments, and the creation of social insertion centres and restricted access units in public hospitals).

g) Units of attention to the citizen, with the aim of streamlining and improving the quality of this care in the General Directorate of Traffic, the Office of Foreign Affairs and the Directorate General of the Police, with destination in Police stations.

(h) Environment, with a view to strengthening environmental policy, and in particular attention to water infrastructure, water quality control and management of the public domain, water, sea, land and water. national parks.

(i) Public Service of State Employment, on the occasion of the increase in workloads resulting from the recent reform of the system of protection for unemployment and improvement of the occupation.

j) Social Security Management Entities, to maintain a stable volume of staff and improve the quality of the service.

In parallel, paragraphs 2 and 3 of Article 20 also maintain the criterion of not proceeding to the recruitment of temporary staff or the appointment of interim officials, except in exceptional cases and to cover urgent and non-deferred needs, with the joint authorization of the Ministries of Public Administrations and Finance, indicating that, in any event, these appointments will count for the purpose of meeting the maximum limit of 100 percent of the Rate of replacement of staff in the public employment offer for the year next in which the appointment occurs. In addition, paragraph 4 expressly states the requirement for joint prior authorization by the Ministries of Public Administration and Finance for the recruitment of fixed or temporary staff abroad, either on the basis of the local legislation or Spanish legislation.

In this context, it is up to the Government to authorize the public call for those places which cannot be met with the existing staff, and in accordance with the criteria set out above, which are addressed to the rationalisation of the staff in the public sector as a whole and the provision of public deficit reduction.

In addition, the criteria that will govern the planning of human resources, which will apply to all the personnel policies applied in the administration

are explicitly stated in this royal decree.

In its virtue, on the proposal of the Minister of Public Administrations, with the favorable report of the Ministry of Finance and after deliberation of the Council of Ministers at its meeting of February 6, 2004,

D I S P O N G O:

Article 1. Approval of the offer of public employment.

1. In compliance with the provisions of article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and in Article 20 of Law 61/2003, of December 30, of the General Budget of the State for the year 2004, approves the offer of public employment for 2004 in the terms set out in this royal decree.

2. Calls for selective testing of civil servants and employees arising from this offer of public employment should be reported in advance by the Directorate-General for the Civil Service. For these purposes, calls for official staff shall be sent before 10 March 2004 to that Directorate-General.

3. The calls for selective testing resulting from this offer should be published in the "Official State Gazette" before 7 May 2004, with the exception of calls for work staff in duly justified and prior cases. authorization of the Directorate-General for the Civil Service.

4. In accordance with the principles of effectiveness and annuality and with the aim of speeding up the selective tests resulting from this offer and of the fact that, in general, the new members take possession of their seats in the 2004 financial year, the calls for they must establish a timetable for the implementation of the selective tests which will enable them to be completed within the year 2004, so that they must be started before July, and must therefore be included in the relevant call. Therefore, with the exception of exceptions which must be authorised by the Directorate-General of the Civil Service, the selective processes must comply with the abovementioned timetable.

Article 2. Quantification of the public employment offer.

The public employment offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the Articles and in the Annex.

Article 3. Human resource planning.

1. The planning of human resources in the General Administration of the State will be directed to the attention of the priority sectors, to the correct dimensioning of the volume of public sector personnel, to the rationality of the distribution of its human resources and to enhance stability in employment, and will be guided by the criteria established in the diagnosis of the human resources situation of the General Administration of the State.

2. In accordance with the above paragraph, the criterion of selective replacement of casualties will be applied, which means that, while maintaining the current template volumes, the new revenues will be directed to the most deprived sectors, functions and territories. personnel. Thus, preference will be given in the replenishment to the priority sectors and the activities and essential functions of the organization, will be sought the improvement in the adequacy of the territorial distribution of the template, favoring the incorporation of new staff in the territories with greater needs, and the replacement will be oriented to the correct management of the public employees.

3. Also calls for provision of posts, rereceipts to active service and internal promotion processes will follow these guidelines. The same objective will inspire the operations of the relocation of personnel by the procedures provided for in the General Regulation of entry, provision of jobs and professional promotion, approved by Royal Decree 364/1995, of March 10.

4. In order to strengthen the establishment of the territories with the greatest needs, according to the territorial map of the distribution of personnel carried out in the diagnosis mentioned in paragraph 1, 80 percent of the new income places that are The bodies and scales of group D officials will be held in the peripheral services of Alicante, Almeria, Barcelona, Las Palmas and Madrid, as well as in the rest of the deficit territories.

5. Article 4. Provision of posts and mobility.

1. Article 5. Internal promotion.

1. In 2004, and with the objective set out in the Administrative-Trade Union Agreement to promote internal promotion, up to 4,346 places will be convened for the various groups of official personnel, with the distribution by bodies and scales to be determined by the Ministry of Public Administration. These selective internal promotion processes will be carried out in separate calls for entry.

By titration groups, the distribution of places is as follows:

Group A: 298.

Group B: 370.

Group C: 2,929.

Group D: 749.

2. Of the places in Group C, 2,500 are part of the second year of implementation of the four-year plan, the aim of which is to increase, by way of internal promotion, 10,000 members of the bodies and scales of this group performing functions. All of this with the aim of articulating the professional career of the officials of the General Administration of the State more adequately to the needs of the organization and the capabilities of its employees.

The applicants who participate in the selective processes derived from this four-year plan and pass the tests, but, failing to gather the sufficient merits, would not have approved the process, will be exempt from the realization of the tests on the following two calls.

3. In accordance with the provisions of Article 22.3 of Law 30/1984 of 2 August, horizontal promotion processes may be convened so that the fixed labour force indicated in each paragraph of this paragraph shall be subject to the status of an official of the the body or scale which corresponds, provided that it performs functions substantially coincident or analogous in its professional content and at its technical level to those of the body or scale that is called, is in possession of the academic qualification required and complies with the rest of the requirements laid down in the applicable rules.

(a) For the fixed staff of the Management Area of the Single Convention and of the professional groups 3 and 4, as well as the staff of other conventions of the General Administration of the State in equivalent situation:

1. 150 places in Group C for access to the General Administrative Corps.

2. 15 places for those included in group C for access to the Computer Auxiliary Technical Corps.

3. 15 places for those included in the group C for access to the Auxiliary Scale of Archives, Libraries and Museums of Autonomous Bodies of the Ministry of Education, Culture and Sport.

(b) For the fixed staff of the area of administration of the single agreement and of the professional groups 5 and 6, as well as the employment staff of other conventions of the General Administration of the State in an equivalent situation: 150 places of those included in group D for access to the General Auxiliary Corps.

(c) For the fixed staff of the Research and Laboratory area of the Single Convention and of the professional groups 3 and 4, as well as the staff of other conventions of the General Administration of the State in situation equivalent, which is destined for one of the public research bodies:

25 places for those included in the group C for access to the Research Assistant Scale of Public Research Bodies.

(d) For the fixed staff of the Research and Laboratory area of the Single Convention and the professional groups 5 and 6, as well as the staff of other conventions of the General Administration of the State in situation It is also intended to be used in some of the public research bodies: 25 places for those included in the group D for access to the Research Auxiliary Scale of Public Bodies of Research 4. In the process of professional promotion of the group E to the General Auxiliary Corps of the State Administration, with exceptional character and due to the affinity of existing functions, mechanisms of promotion can be articulated from the category (a) professional status of group 7 of the single convention, or from the equivalent professional group and group provided for in the other collective agreements of labour personnel at the service of the General Administration of the State. To this end, 125 places will be devoted to those included in group D, which will be used as a priority for the peripheral services of the Ministry of Public Administration (in the areas of foreign and border inspection posts), the Directorate-General of the Police and the Public Service of State Employment.

5. In the course of 2004, the processes of horizontal promotion of the status of work staff to official staff will be the subject of analysis and evaluation with the aim of defining what the qualitative and quantitative content of these processes and how they will be developed in future exercises. Among other issues, in the course of 2004, it will have to be defined in which cases and with which criteria this type of horizontal promotion will fit in bodies and scales other than those collected in this royal decree.

6. In accordance with the provisions of Article 22.2 of Law 30/1984 of 2 August of Measures for the Reform of the Civil Service, selective processes of access by internal promotion to the Scales of Professors of Research and of Scientific researchers of the Higher Council of Scientific Research from the scales of scientific and research personnel regulated in Royal Decree 1945/2000, of December 1, as well as to the Scale of the Council Superior of Scientific Research from the Escala de Graduates Superior of the own body.

7. In order to proceed with the management of the existing workforce, to satisfy the needs of the organization and to promote the professional promotion of its personnel, as established in the single agreement or other the collective agreement applicable, the administration will take to the organ that must agree its realization the proposal of call for internal promotion processes for the coverage of the job positions of the categories of ordinance and assistant of health services in which only fixed staff of the category of cleaning operator may participate; the conditions for the participation of this staff are negotiated at that time. Article 6. Labour staff.

The selective tests for work staff set out in the Annex shall relate to posts which, as referred to in Article 15 of Law No 30/1984 of 2 August, may be carried out by staff. work.

Prior to the authorization by the Ministry of Public Administrations of the call for selective tests for entry into the places of work staff listed in the Annex, the departments or bodies called they must prove that there is a budgetary allocation for places which are vacant.

Within the scope of the Single Convention, the vacant places of necessary provision shall be covered in accordance with the provisions of Chapter VI of the Single Convention.

Prior to the free call of the single convention places listed in the Annex, the Ministry of Public Administrations will distribute among the departments and agencies, in consideration of their character of priority sector, to ensure that the places are occupied by temporary staff, or that there are essential sectors of activity in the departments which are mainly employed by the workforce.

In the selective processes of labor personnel derived from this royal decree, the opposition system will be used preferably.

Article 7. Staff linked to the external service.

1. The hiring of permanent or temporary staff abroad, in accordance with local law, or, where appropriate, Spanish legislation, will require the prior joint authorization of the Ministries of Public and Finance, the procedure laid down jointly by the two departments, provided that there is a budgetary allocation for vacant posts.

With the purpose of strengthening the presence of the General Administration of the State abroad and addressing the growing demand for consular performances by the Diplomatic Missions, the foreign service template will be strengthened. with 150 new workers.

2. The implementation of a four-year plan for the incorporation of officials from the Diplomatic Career Corps is initiated, the aim of which is that, at the end of the period of validity, 140 new members have been incorporated into that body, without prejudice to the fact that the number of seats that are called during the implementation of this plan can be reviewed in order to adjust it to oversold needs.

Article 8. Fixed employment contracts in public entities and public entities.

During 2004, the hiring of fixed labor personnel will be limited to covering those vacancies that are considered essential for the normal functioning of public entities and public entities, and only with a Staff may be recruited for new jobs when it comes to the implementation of new areas of activity which are considered to be priorities.

The joint authorization of the Ministries of Public Administrations and Finance referred to in the third paragraph of Article 20 (3) of Law 61/2003 of 30 December 2004 on the General Budget of the State for the year 2004, will be performed according to the following singular procedure, consisting of two phases:

1. Call for places that respond to the annual planning of public entities and public entities: prior to the study by the Ministries of Public Administration and Finance of the (a) forecast of recruitment needs submitted by the various bodies, and taking into account the limitations laid down in Article 20 of Law 61/2003 of 30 December 2004 on the State Budget for the year 2004; quantifies the maximum number of places that may be convened at this stage, for each public entity business or public entity, in the relationship that is listed as an annex to this royal decree.

2. First call for places to meet needs over the course of the financial year: they shall be exceptional and may be authorised only if they are not available during the financial year initially planned. The convocation of these places must be previously authorized by the Ministries of Public Administrations and Finance, in accordance with the specific procedure established by these departments, and respecting in any case the limit of 100 per cent of the replacement rate.

Also, regardless of what was established in the preceding paragraphs and in order to enable the proper optimization of existing human resources in the public sector, public entities and entities Public or fixed staff from departments or public bodies included in the field of the supply of employment may be recruited, after joint authorization by the Ministries of Public and Finance, to public or fixed staff from departments or public bodies. Article 9. Temporary staff.

During 2004, temporary staff will not be recruited or interim officials will be appointed, except in exceptional cases and to cover urgent and non-deferred needs, and prior joint authorization of the Ministries of Public Administrations and Finance. Article 10. Temporary job consolidation.

1. In the field of the General Administration of the State and in line with the content of the Administrative and Trade Union Agreement of 15 November, temporary employment of a consolidated character is considered to be those jobs occupied by staff. on a continuous basis and since before 2 December 1998, unless such staff replace holders with a reserve of post.

2. The process of consolidation of temporary employment of a structural and permanent nature can be carried out both within the framework of the corresponding employment plans and through calls for action, requiring in the latter case the Approval of the Ministry of Public Administration, after a favourable report by the Ministry of Finance. These processes will not, in any case, increase the number of staff.

The selective processes referred to in the preceding paragraph shall in any event respect the principles of equality, merit, capacity and publicity, within the framework of the criteria and priorities established by the Ministry of Public Administrations.

3. The employment relationships of those who are temporarily employed in the places to be fixed in the framework of a consolidation process will be extended until the selective processes corresponding to the call for tenders are completed. the places they were playing. Article 11. Staff of the Administration of Justice and bodies of teachers.

Pursuant to Article 20 (3) of Law 61/2003 of 30 December 2003 on the General Budget of the State for the year 2004, and in the light of the needs of staff in the service of the Administration of Justice arising from the Requirements for the development of Law 38/1988, of 28 December, of Demarcation and of Judicial Plant, the Ministry of Justice is authorized to call for selective tests for entry into the following bodies, with the limit of the number of places that indicated: in the Superior Legal Body of Judicial Secretaries, up to 150 places; in the Body of Doctors Forensics, up to 52 places; in the Faculty of Faculty of the National Institute of Toxicology and Forensic Sciences, up to 95 places; in the Technical Corps of the National Institute of Toxicology and Forensic Sciences, up to 25 places; in the Laboratory Assistant of the National Institute of Toxicology and Forensic Sciences, up to 75 places; in the Body of Process and Administrative Management, up to 171 places; in the Body of Procedural and Administrative Processing, up to 404 places, and in the Judicial and Auxiliary Corps, up to 279 places.

Of these places, correspond to the Ministry of Justice 150 places of the Legal Superior Body of Judicial Secretaries; 5 places of the Body of Medical Physicians; 95 places of the Body of Facultative of the National Institute of Toxicology and Forensic Sciences; 25 places in the National Institute of Toxicology and Forensic Sciences ' Technical Corps; 75 places in the Laboratory of the Laboratory of the National Institute of Toxicology and Forensic Sciences; 20 Positions of the Management and Administrative Management Body; 100 seats in the Procedural Processing Body and Administrative, and 50 seats of the Judicial and Auxiliary Corps. Article 12. Certificate of insufficient human resources.

Article 13. People with disabilities.

The calls for selective tests corresponding to the public employment offer for the year 2004 should include the reserve of a quota of not less than five per cent of the vacancies to be covered between persons with disability whose degree of disability is equal to or greater than 33%, in accordance with Law 53/2003 of 10 December on the public employment of the disabled. The selection bodies will agree on the necessary adaptations, materials or temporary ones, to ensure that people with disabilities carry out selective tests on an equal footing with the other candidates.

In addition to the above and moving forward with the aim of achieving equal opportunities, selective processes should include the possibility of calls for the establishment of a reserve quota for the disabled, once the seats in this quota have been covered, applicants who have passed the opposition stage without obtaining a seat for that quota can, on an equal footing, qualify for the seats of the general system, both in the case of access by internal promotion as in the free admission.

A call for selection of work staff may be made, in which all the places will be reserved to be covered by mentally disabled people with a disability level equal to or greater than 33%. Local corporations that approve their offers of public employment must submit the agreements approving them to the State Administration, in accordance with the provisions of Article 56.1 of Law 7/1985 of 2 April.

Additional provision second. Local administration staff with national rating.

In order to address the needs of the local government, the Ministry of Public Administration may call for selective testing for access to the Local Administration Officers ' Scale with Enablement National character in the following subscales: 75 places for the Sub-scale of the Secretariat, entry category; 25 places for the Sub-scale of the Secretariat, higher category; 100 places for the Subscale of Interventional-Treasury, category of entry, and 125 seats for the Secretariat-Intervention Subscale.

Additional provision third. Participation in selective testing courts.

They will not be able to form part of selection commissions or selective testing courts for entry into bodies or scales of officials or in categories of labor personnel who have the high-capacity consideration in accordance with the law. In order to extend the dissemination of the various selective calls for tests resulting from this offer of public employment, the various ministries and bodies that offer places and have a website on the Internet include an address dedicated to selective processes, in which they will collect as complete as possible each of the calls and the acts that are derived from them, incorporating, where possible and for the convenience of the candidates, the relations of candidates admitted and excluded, as well as the relations of approved in each one of the exercises, with an indication of their identity, surname, name and, if applicable, province of examination. The questionnaires corresponding to the multiple-response written tests that have been carried out in the selective process shall also be included, if feasible.

Additional provision fifth. Selective process management starts.

1. The competence for the selection of the acting personnel of the bodies and scales assigned to the Ministry of Public Administrations under the Secretariat of State for Public Administration corresponds to the Director General of the Ministry of Public Administration. Public Service.

Within the framework of the provisions of Article 15 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, for reasons of effectiveness and prior favourable report of the Directorate-General for the Civil Service, the material management of such selective tests is entrusted to the ministries or bodies from which the posts which are to be covered by the Office are subject to the Interim officials.

2. The competition for the call for selective tests for permanent staff members of new income when they include places or vacancies belonging to different departments and agencies corresponds to the Ministry of Public Administration. The management of these selective tests resulting from offers of public employment, for reasons of efficiency, to various ministries or bodies, after the decision of the competent body or of which the competition is delegated, is entrusted with the determine the supply of the places to be convened and the ministry or body to which the management of each call is entrusted.

In the vacancies of the Ministry of Defense and its public bodies, the scale and reserve of places referred to in Articles 2 and 3 of Royal Decree 999/2002 of 27 September, as amended by the Royal Decree, will be carried out. Decree 999/2003 of 25 July 2003 on valuation as merits of the time of services provided in the Armed Forces as professional military of troops and marineria or volunteer reservist and the reservation of places for professional military in the access to the State Administration.

3. The material management entrusted to the two preceding paragraphs shall be carried out in the following activities: receipt of requests for participation in the selective tests; proposal of the resolutions declaring the approval of the lists of admitted and excluded persons and the place and date of commencement of the first financial year, as well as the list of candidates excluded, indicating the causes of exclusion; proposal of the members to form the courts Test qualifiers; management of the operational necessary for the material development of the exercises; receipt of the documents proving the conditions of capacity and conditions required in the calls referred to in Article 23 of the General Staff Regulations to the Service of the Administration General of the State and provision of jobs and professional promotion of civil servants of the State Administration, approved by Royal Decree 364/1995, of March 10, and any other management related to the activities of the selective process whose management is entrusted, provided that it does not alter the ownership of the competition and the substantive elements of its exercise.

The expenditure incurred by the management of these items shall be borne by the budgetary section of the ministry or body to which the management is entrusted.

The term of validity of the management procedures will be determined in the previous report of the Directorate General of the Civil Service in the event of paragraph 1 of this provision, and in the resolution of the Secretariat of State that determines the ministry or body to which the management is entrusted in the case of paragraph 2 of this provision.

The management mandate does not imply the transfer of the ownership of the powers or the substantive elements of their exercise. It is the responsibility of the competent body or in which the competent body has delegated acts or decisions of a legal nature to support or to integrate the particular material activity covered by this management mandate.

Additional provision sixth. Extraordinary horizontal promotion processes provided for in Article 22 (3) of Law 30/1984 of 2 August in the State Public Employment Service.

With extraordinary character and prior negotiation, it will be possible to convene, in accordance with the provisions of Article 22 (3) of Law 30/1984, of 2 August, horizontal promotion processes for the permanent employment staff The following shall be accessed as an official of the appropriate body or scale, provided that it performs functions substantially coincident or analogous in its professional content and at its technical level to those of the body or scale call, be in possession of the required academic qualification and meet the rest of the requirements set out in the applicable rules:

(a) For the fixed staff of the management area of the single agreement and of the professional groups 3 and 4, as well as the staff of other conventions of the General Administration of the State in equivalent situation, 109 places to be assigned to the State Employment Public Service,

b) For the fixed staff of the management area of the single agreement and of the professional groups 5 and 6, as well as the staff of other conventions of the General Administration of the State in equivalent situation, 342 places to be assigned to the State Employment Public Service.

Single end disposition. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
