The final provision of Royal Decree 5/1997 of 10 January, which regulates the unemployment allowance in favour of casual workers included in the Special Agricultural Social Security Scheme, established a (a) the provisions of Article 1 (1) of Regulation (EU) No No 1 of the European Parliament and of the Council of the European Parliament and of the Council of the European Parliament and of the Council of the European Parliament and of the Council [1] in favour of the agricultural workers, offering a guarantee of continuity under the conditions of the protection regime in which it was traditionally established. From the validity of this rule, continued use of this possibility of extension of the transitional regime has been made, which leads, given the dilated of this period of extension, to assess that a continuity in the concurrency of the circumstances that motivated him. This makes it more appropriate to establish a regulatory technique which, until such time as the Government can assess the stability of these rules, can assess, after consultation with the social partners, that the circumstances which led to the application of this regulation have fallen. The Council of State has given its opinion in successive opinions on the rules for the extension of the procedure. In the elaboration of this royal decree, the most representative business and trade union organizations have been consulted. In its virtue, on the proposal of the Minister of Labour and Social Affairs, in agreement with the Council of State and after deliberation by the Council of Ministers at its meeting on 30 December 2004,

Single item. Application of the transitional provisions of Royal Decree 5/1997 of 10 January.

The first, second, third and fourth transitional provisions of Royal Decree 5/1997 of 10 January governing the unemployment allowance in favour of casual workers included in the Special Agricultural Scheme Social Security will apply until the end of its validity is established by the express provision of the Government, after consultation with the social partners.

Single repeal provision. Regulatory repeal.

The final provision of Royal Decree 5/1997 of 10 January 1997 governing the unemployment allowance in favour of casual workers included in the Special Agricultural Safety Regime is hereby repealed. Social.

Final disposition first. Regulatory enablement.

The Minister of Labour and Social Affairs is empowered to lay down the rules necessary for the development and implementation of this royal decree.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official Gazette of the State" and will take effect from 1 January 2005.
