The discretionary public transport services of passengers by road, provided with vehicles of less than ten seats, including that of the driver, and provided with documented transport authorisation by card of the class VT, they are subject to the system of administrative authorisation, subject to the tariff system and conditions of application laid down in Articles 18 and 19 of Law 16/1987 of 30 July 1987 on the Management of Land Transports, and 28 and 29 of their Regulation adopted by Royal Decree 1211/1990 of 28 September 1990. The increase in operating costs since the approval of the FOM/40/2004 Order of 14 January on tariff arrangements for these services, whose structure and amounts have been duly analysed, advises, the maximum rate, its updating and the subsequent revision of the application fees. In addition, it has been considered appropriate to establish a new differentiated rate for night services and Sunday and public holidays at national level, applicable from 23 hours to 6 hours on working days, and from the 0 hours until 24 hours on Sundays and public holidays. Even if the competition for the fixing of these tariffs is, in principle, the responsibility of the General Administration of the State in the light of the national scope of the enabling authorization for the provision of such services, the (a) the powers of the Autonomous Communities operated by the Organic Law 5/1987 of 30 July, allowing the latter to fix the rates corresponding to the services carried out by vehicles residing in their territorial area, taking into account the special circumstances in which they are present. In the procedure for drawing up this Order, the report of the National Council for Land Transport and the National Committee on Road Transport, required by Article 29.2 of the Regulation of the Law on the Management of the Land Transport. In its virtue, I have:

Article first. Maximum fares.

Inter-city public transport services on a discretionary basis for road passengers carried out by vehicles provided with documented authorisation of the VT class shall be made subject to the following charges maximum (including taxes):

Price per kilometer run or fraction: 0.42 euros.

Price per kilometer run or fraction for night and Sunday services and national holidays: 0.51 euros. This fee shall apply to night services which are provided between 23 hours and 6 hours on working days, and services provided from 0 hours to 24 hours on Sundays and public holidays. Price per hour of waiting: 11.25 euros. During the first hour of waiting, the user will have the right to have a 15-minute waiting time free of charge, after which the user will be counted for a fraction of fifteen minutes, at a rate of 2.81 euros each fraction. Minimum of perception: 2.36 euros. The minimum level of perception shall not be cumulable on routes to which the ordinary fare per kilometre travelled has been applied.

Article 2. Arrangements for procurement.

The services will be contracted by a complete car and the tours will be understood in a closed circuit to the point of departure for the shortest route, if the contrary is not expressly agreed. When you hire the service you will set the routes, places and weight of the luggage.

Article 3. Official model.

The vehicles covered by this Order shall be provided with a form containing the applicable tariffs, in an official model, the format and conditions of which are specified in the Annex to this Order, which shall be placed in visible place inside the vehicle.

Article 4. Luggage.

In any case, the user shall be entitled to the free carriage of his luggage, which, once the total number of places is used, shall not exceed 50 kilograms for vehicles of up to four places, and 60 kilograms For the purposes of higher capacity, provided that the volume of the luggage allows the holder to be placed in the carrier or to place them in the vehicle seat, without contravening the traffic and traffic rules and regulations. Where the total number of places is not used, these figures may be increased by 30 kilograms for each empty seat, provided that the shape, dimensions and nature of the luggage makes it possible to transport them inside the vehicle. Excess baggage over the above figures shall be paid at the rate of EUR 0,05 per 10 kilograms or fraction and kilometre travelled, with the carrier being free to admit when the excess exceeds 50 per 100 of the above figures. figures.

Article 5. Regional regulations.

The Autonomous Communities in which the system of delegations provided for in the Organic Law 5/1987 of 30 July 1987 will apply, may freely fix the tariff rate of the services referred to in this Order, Article 5 (d) of that Law applies to all services in the Autonomous Community, whichever is the place where they are completed.

Repeal provision. Regulatory repeal.

Order FOM/40/2004, of 14 January, is hereby repealed on the tariff regime for inter-city services of public passenger discretionary transport in passenger cars, as well as the provisions of equal or lower range object to the provisions of this Order.

The General Directorate of Transport by Road will dictate the instructions that, if any, are necessary for the execution of this Order.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

Official maximum rates for inter-city services of public passenger discretionary transport in passenger cars (VT class card), including taxes, authorised by Order of 22 December 2004

Price per vehicle/kilometer or fraction: 0.42 euros.

Price per vehicle/kilometer or fraction for night and Sunday services and national holidays: 0.51 euros (1). Minimum of perception: 2.36 euros. Price per hour of waiting: 11.25 euros.

Summary of application conditions:

A) During the first hour of waiting, the user shall have the right to have a 15-minute wait time free of charge, after which it shall be computed by fractions of fifteen minutes, at the rate of 2,81 euro each fraction.

B) The services shall be hired on the basis of a complete car rental and the routes shall be read in a closed circuit to the point of departure, for the shortest route, if the contrary is not expressly agreed. (c) In any case, the user shall be entitled to the free carriage of his luggage under the conditions laid down in the Order of 22 December 2004. (d) Perceptions expressed are of a maximum nature and may be reduced by mutual agreement, except for the minimum of perception, the amount of which shall be compulsory. (e) Irregularities or infringements observed by users must be brought to the attention of the Land Transport Inspection Services, which may be reflected in the existing claims book in the vehicle.
