The public body Ports of the State has submitted to the Ministry of Public Works, for its approval, the proposal to assess the land and water sheet of the service area of the Port of Las Palmas (including Salinetas and Arinaga) managed by the Port Authority of Las Palmas, which has the status of port of general interest and is of exclusive competence of the General Administration of the State in accordance with the provisions of Article 4 and Annex I of the Text Recast of the Law of Ports of the State and the Merchant Navy, approved by Royal Legislative Decree 2/2011, of 5 September, in conjunction with Article 149.1.20ª of the Constitution.

The determination of the value of the land and the waters of the service area of the port is necessary to calculate the amount of the occupation rate that will be stopped in favor of the Harbour Authority for the occupation of the domain port public by virtue of authorization or concession, since, according to the provisions of Article 175 of the Recast Text of the Law of State Ports and the Merchant Navy, the tax base of the charge is the value of the good of the domain public busy.

The proposal to evaluate the land and water sheet has been formulated by the Port Authority of Las Palmas, including, among the necessary background and studies, an economic-financial memory.

According to the provisions of Article 175 of the Refused Text of the Law of Ports of the State and the Merchant Navy, approved by the Royal Legislative Decree 2/2011 of 5 September, the value of the land is determine on the basis of market criteria. To this end, the service area shall be divided into functional areas, assigning to the land included in each of them a value by reference to other land of the municipal term or to the next municipal terms, with similar uses and conditions, in particular those qualified as logistic, commercial or industrial use, taking into consideration the appropriate use. In addition, in the case of areas intended for the handling of goods, it may also take into consideration the value of port areas which may be alternatives for the traffic of that port.

In the assessment of the land of each port area, it will also have to take into account the degree of general urbanization of the area, the characteristics of management established in the special plan of the port, its centrality in the service area, and its proximity, accessibility and connection with the different transport modes and infrastructures, in particular to the docking facilities and sheltered water areas.

As for the assessment of water, point (b) of the cited precept states that the value of the water spaces included in each of the functional areas in which the service zone of a port is divided will be determined by reference to the value of the land in the areas of the service area with similar purpose or use or, where appropriate, to the nearest land. The assessment shall take into account the conditions of shelter, depth and location of the waters, without exceeding the value of the reference grounds.

The land of the service area of the Port of Las Palmas (including Salinetas and Arinaga), which are in the file duly represented in the corresponding plane, have been divided into functional areas of the next mode:

-Functional area 1: Expansion grounds in La Isleta: Area located north of the port service area, in La Isleta, which borders the Protected Landscape of La Isleta and with the sea. It includes the new land of the port in the area of La Isleta, land that needs to be dismantled, making a movement of land for use as a zone of logistic activities. These are urbanizable soils, currently used to obtain the resources of fillers and materials for the execution of the works and port extensions.

-Functional area 2: Urbanization of the Franca Zone and La Isleta: contiguous area (south) of functional area 1, part of the land in La Isleta and another part of the Nido Peninsula. Recently urbanized land, located in the Franca area of the port of Las Palmas and in the 1st phase of urbanization of La Isleta. Intended for the implementation and development of activities related to port logistics: storage, processing of goods and distribution of goods.

-Functional Area 3: Darsena de la Esfinge-Dique/Muelle Reina Sofía: Comprises the grounds that make up the new darsena of the Sphinx and the Reina Sofía dam. The darsena of the Sphinx, is executed at the beginning of the dam Reina Sofía, whose exterior dock starts from the Peninsula of the Nest. Darsena with a multi-purpose function, associated with activities currently developed in this external area of the port: naval repairs and port logistics, inter-island traffic, liquid bulk and Ro-Ro traffic. It includes the Dique Reina Sofía itself in all its length and the docks attached to it (Queen Sofia North and Queen Sofia South pier), destined for solid granels and naval repairs, as well as the facilities of loading/unloading of fuel (Dukes of Alba).

-Functional area 4: Urbanization for logistic and complementary activities to the port: Comprises the land that borders the industrial estate of El Sebadal (exterior of the land service area of the port) and that structurally link the functional areas of La Isleta (1 and 2) and the Darsena of La Sphinx (3) with those of the Container Terminals (6) and of Naval Repairs (5). Land that has been urbanized with own typology of industrial polygon, closed block, with industrial ships and buildings that houses a lot of companies that offer diverse and complementary harbour services to the activity port, warehouses of all kinds, shops and small workshops linked to port logistics, etc..

-Functional Area 5: Naval Repairs: Land included north of the outer dock, located between the Queen Sofia Dique and the Container Terminals. Functional area with its own and exclusive land and port facilities for use as a shipyard, varada and ship repair area.

-Functional area 6: Container terminals and Polivalents: Terrain, large surfaces and esplanades that make up the central core of the port, which line up with the external dock through the docks of Gran Canaria, Virgen del Pino, Elder, Cambulroneros and León and Castillo Rising, and they are beautiful with the interior dock through the docks Grande, Primo de Rivera and León and Castillo Poniente. Formed by the set of land and large esplanades annexed to the previous docks, suitable for the development of large-scale commercial port activities (container traffic, general merchandise traffic, Ro-Ro traffic, etc.) and the management and administration services associated with them.

-Functional area 7: Fuels deposit area: Inland lands, adjacent to the outer area of the port, with the beginning of the vial that accesses the industrial estate of El Sebadal from the Plaza de Belén Maria, and interior to the port, in part with the Avd. of the Petroliferas, Miguel Curbelo Espino street and the access to the port by Belén Maria. Area dedicated to the facilities for the storage and supply of fuel to ships and all types of liquid bulk (Gas-oil and Fuel-oil).

-Functional area 8: Fishing dock and attached esplanades: Set of land and docks that link with the Maritime Highway GC-1 and the neighborhood of La Isleta, at the height of the Castle of La Luz, formed by the annexed esplanades and docks Fishing, from the Refuge and Pantalan from Cory. Historically linked functional area with the fishing activity and various port services to small vessels, converted in the last years in zone of multipurpose activities, with buildings of harbour services, mixed activities and complementary (offices, warehouses, workshops, etc.) of the main port.

-Functional area 9: The environment of the Sanapu Pier: Terrain that is located in the isthmus of Santa Catalina, adjacent to the Maritime Highway GC-1, formed by the esplanades attached to the Sanapu pier. Land that serves as a connecting link between the Area of the Fishing Dock and the environment of the Santa Catalina Pier.

-Functional area 10: Muelle de Santa Catalina and connection with the city: Area formed by the Muelle de Santa Catalina itself and the land of access and union with the city, with the surroundings of the park of Santa Catalina. Destined for port uses of type cruises, passengers and tourist, in addition to environments annexes of equipments of modal interchange of passengers, urban connection with the Park Santa Catalina and destined to uses of port-city interaction.

-Functional area 11: Large-Tertiary Equipment-Tertiary area: Terrain formed by an esplanade attached to the Wilson's Muelle, between the Santa Catalina Pier and the Sanapu Pier. The area in which a Shopping Centre is located, dedicated to non-port commercial and tertiary activities. Action related to the port-city interaction.

-Functional area 12: Playa de las Alcaravaneras, Club Nautico and sea edge of the East: Terrenes formed by the beach of the Alcaravaneras, facilities and grounds of the Nautical Club that link north to the Naval Base, and in addition to the stretch of maritime border of escorts located between the facilities of the Darsena de Embarnaciones Minors and the Castle of San Cristobal, extreme south of the land service area of the Port of Las Palas. The land located to the north of the Darsena de Embarnaciones Minors consists of a recreational and nautical-sports area that includes the beach of Las Alcaravaneras and part of the facilities of the Real Club Nautico.

-Functional area 13: Darsena of smaller vessels; area compatible with the nautical-sports activity: Terrenos comprising the north of the dock of the Minors of the Minors and the esplanade that borders the beach of the Alcaravaneras, in addition to the strip of land adjacent to the Avenida Marítima GC-1, where they are compatible activities of the nautical-sport use with those of recreational and leisure conditions.

-Functional area 14: Darsena of smaller vessels; area exclusive uses nautical-sports activity: Terrain of future expansion and expansion of the dock of smaller vessels, which includes the park-dock of protection and the Counter-ships located south of the dock of smaller vessels.

-Functional area 15: Darsena of smaller boats; area exclusive uses sailing. Land and parcels enclosed by the Functional Area 13 correspond to three plots, one in which the sailing school is located, in the west of the dock of smaller vessels, another in the strip of land adjacent to the Autoría Marítima GC-1 and another in the small darsena located south of the main small boat, where the facilities of the Latin sail are located. Due to their characteristics of ordination and uses they are not susceptible to use for other purposes other than those of nautical activities, particularly sailing.

-Functional area 16: Port of Salinetas: Land and dock located in the municipality of Telde, next to the industrial estate of Salinetas, which comprise the administrative concession for the exclusive use of the port for unloading fuels. It consists of the dock dock itself and edge strips with the access to the port (roads) and esplanade in the southern part.

-Functional area 17: Puerto de Arinaga-Zona Franca: Terrónos located in the municipality of Aguimes, a plot of rectangular shape, completely urbanized and located in the southeast corner of the industrial estate of Arinaga.

-Functional area 18: Port of Arinaga-Muelle: Comprises the dock and coat of coat. The surface attached to the dock (with just over 100 meters wide) is conditioned for the establishment of facilities linked to the commercial port use.

-Functional area 19: Port of Arinaga-expansion grounds: Comprises two zones. To the north, belonging to the municipality of Aguimes, adjacent to the free zone, is a large rectangular plot without completing the urbanization that borders the East with the salt of Arinaga and the coast line, and south of the port with a topographically irregular zone intended for possible future expansion of the port. Much of this area includes land that is located in the municipality of Santa Lucia. The rest of the land in this area south is a triangular plot that is included in the municipality of Aguimes.

In addition to the functional areas of the land of the service area, the land occupied by the six lighthouses managed by the Port Authority of Las Palmas are included in the valuation proposal, which are as follows:

-Faro de la Isleta (F1): Located in the Montaña del Faro, peninsula of the Isleta, northeast of Gran Canaria. It includes the grounds for access to the lighthouse (road that borders the northwest facade of the Faro Mountain) and for the facilities of the lighthouse itself. These facilities (asphalt, turret and other dependencies) are located in the protected area "Protected Landscape of Isleta".

-Faro de Taliarte (F2): Located on the east coast of Gran Canaria, next to the port of Taliarte. Grounds that form a walled rectangular solar where the lighthouse turret and other dependencies are located for maintenance.

-Faro de Arinaga (F3): Located in a watchtower on the southeast coast of Gran Canaria, between Arinaga and Playa del Cabron. It is located within the protected space ZEC, 34_GC; Arinaga. Includes the site where the new lighthouse turret and the facilities of the old lighthouse, remodeled for cultural-recreational use, are located.

-Färo de Maspalomas (F4): Located at the tip of Maspalomas, the southern end of Maspalomas beach. The grounds attached to the lighthouse include a paved exterior area (public square) and the lighthouse's outbuildings; tower and two-story-high quadrangular base building.

-Faro de Castillete (F5): Located on the southwest coast of Gran Canaria, near the Port of Mogán. They include the grounds of a small surface that are limited to the solar quadrangular where the tower of the lighthouse is located. This small plot is within the protected natural space ZEC 28_GC El Nublo.

-Faro de Sardina (F6): Located at one end of the northwest coast of Gran Canaria. It includes a walled square sun where the tower of the lighthouse and dependencies are located.

The water spaces included in the proposed valuation, which are in the file duly represented in the corresponding plan, are as follows:

-A1.LP-Zone I. 1-Darsena of smaller vessels: Comprises the inland waters of the Darsena of Minors, as well as those previewed in the extension of the nautical harbour infrastructures, to the street Carvajal and the intersection of the extension of the Muelle de León and Castillo Poniente with the limit of the inland waters of the port of Las Palmas.

-A2.LP -Zone I. 2-Nautical Club: Comprises the inland waters of the Marina Sports created in the facilities of the Nautical Club, delimited by the end of the contradique executed for that Navy and the vertex south of the Base Naval.

-A3.LP -Zone I. 3-Inland waters to the Muelle de León y Castillo: Comprises the inland waters between the Muelle de León and Castillo Poniente, Santa Catalina, Muelle Grande, Pesquero, del Refugio, Primo de Rivera, Pantalan de Cory, Sanapu, of Wilson, Naval Base, Club Nautico, and beach of the Alcaravaneras. Towards the south it is defined by the own boundary of the internal waters of the delimitation of the Space and Port Uses in force.

-A4.LP -Zone I. 4-Darsena between the levees Leon and Castillo and Reina Sofía: Comprises the interior waters enclosed between the Queen Sofia and the attached docks, the Muelle de León and the Rising Castle and the set of Muelles de Cambulroneros, from Elder, Virgen del Pino and Gran Canaria. Towards the north it borders the area of naval repairs and south with the own boundary of the inland waters of the delimitation of the Space and the Port Uses in force.

-A5.LP-Zone I. 5-Naval Repairs Zone: Comprises the inland waters bounded by the Queen Sofia North dock and the Naval Repairs facilities, and south with the interior waters of the Darsena between the levees de León and Castillo and Reina Sofía.

-A6.LP -Zone I. 6-Darsena between the Queen Sofia and the Sphinx: Comprises the interior waters bounded by the end of the Dique de La Sphinx in execution and the southern end of the dam Reina Sofía, and by the own springs and fillers of the new darsena.

-A7.LP-Zone II-Outer waters area of Las Palmas: Corresponds to the delimitation of the area of external waters II referred to in the delimitation of spaces and port uses. It includes the area defined by the parallels that pass through the Roque Ceniciento, in La Isleta, and by the Castle of San Cristóbal, the meridian located 1,300 meters east of the Roque del Palo, in front of the Peninsula of the Nido, and the winding line of coast, except for the Water Zone I defined.

Salinets Port

-A8.SA-Zone I-Indoor waters of Salinetas: It corresponds to the delimitation of the zone of inland waters I contemplated in the delimitation of the spaces and the port uses in force. It comprises the water sheet defined by the straight line linking the end of the spring with the tip of the coal and the winding line of the coast.

-A9.SA-Zone II-Salinetas Outer Water Zone.

It corresponds to the delimitation of the area of external waters II contemplated in the Delimitation of Space and Port Uses in force. It corresponds to the water sheet between the parallels that pass through the westernmost part of the Punta de La Salineta and by the Punta de Barranco Hondo, the meridian of length L = 15º 22.0, and the winding line of the coast, except the Water Zone I defined.

Port of Arinaga

-A10.ARI -Zone I-Arinaga inland waters area: Corresponds to the delimitation of the area of inland waters I contemplated in the Delimitation of Space and Port Uses in force. It comprises the water sheet defined by the straight line linking the end of the dam to the point of the coast where the municipalities of Aguimes and Santa Lucia of Tirajana limit, and the winding line of the coast.

-A11.ARI -Zone II-Arinaga area of external waters: It corresponds to the delimitation of zone of external waters II contemplated in the delimitation of the spaces and the port uses in force. Corresponds to the water sheet between a line parallel to 200 m. of the outer edge of the East dock, the perpendicular to this line drawn by the Southern and North limits of the dislinde of the Terrestrial Marine Public Domain included in the Land Service Zone and, the sinuous line of the coast, except the zone Water I defined.

The valuation proposal has been elaborated and processed in accordance with the provisions of the current article 177 of the Recast Text of the Law of State Ports and the Merchant Navy, approved by Royal Legislative Decree 2/2011, of 5 September, having submitted to the process of public information and to the reports of the Ministry of Finance and Public Administrations and the Public Body Ports of the State.

Valuation is duly substantiated in the proposal.

In its virtue, on the proposal of the Harbour Authority of Las Palmas, and in accordance with the provisions of article 177 of the Recast Text of the Law of Ports of the State and the Merchant Navy, approved by Royal Decree Legislative 2/2011, of 5 September, I have:

First. Approval of the assessment.

The "Valuation of the land and water sheet of the service area of the Port of Las Palmas (including Salinetas and Arinaga) and the land attached to the maritime signage of the island of Gran Canaria" is approved. One copy of the original document duly endorsed by the Ministry of Public Works, another in the Public Body Ports of the State and a third in the Port Authority of Las Palmas will be deposited.

Second. Land values and water sheet.

The values of each of the functional areas of the land service area, of the land attached to the maritime signage of the Island of Gran Canaria, as well as the waters, are as follows:
