Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data establishes that the creation, modification or deletion of the files of public administrations can only be done by means of general provision published in the Official Journal of the State or corresponding official journal. Furthermore, the first provision of that rule directs the public administrations responsible for files to approve the provision of the creation of the same or to adapt the existing provision to the provisions of the law itself.

Order MAM/30 4/2003, of February 11, regulated the automated files of personal data of the Ministry of the Environment, including files managed by the Hydrographic Confederation of the Guadalquivir. As a result of the implementation of the Administrative and Trade Union Agreement of 13 November 2002, Chapter XIX (c) 'Pension plan', the Order MAM/3783/2004 of 26 October, extending the relationship of automated files, was issued. of personal data of the Ministry of the Environment, including among others the pension plan file of the Hydrographic Confederation of the Guadalquivir.

Order ARM/1683/2011, of June 2, regulated the files with personal data managed by the then Ministry of the Environment, and Rural and Marine, repealing the Order MAM/30 4/2003, of February 11, with the exception of of the files contained in the Annex which they have as the responsible organ of the Hydrographic Confederations, until their specific regulatory regulations are developed.

On the other hand, the Order ARM/3123/2011, of 3 November, establishing the uniform and distinctive of the Scale of Environmental Agents of Autonomous Bodies of the Ministry of the Environment, establishes the necessity of the existence and use of a personal identification that accredits their status as agents of the authority in the performance of their functions and are easily recognizable and identifiable to the citizens. To this end, it provides that such officials shall have an identification card containing the number of professional identification (N.I.P.), personal and non-transferable, which shall be assigned to each active agent performing the surveillance functions. of the public domain.

Finally, the detailed analysis of the information that the Hydrographic Confederation of the Guadalquivir manages after the process of restructuring the Agency as a consequence of Royal Decree 1666/2008, of October 17, on transfer of the functions and services of the State Administration to the Autonomous Community of Andalusia in the field of water resources and water resources corresponding to the waters of the Guadalquivir basin which are fully covered by the territory of the autonomous community and of Royal Decree 1498/2011 of 21 October, for which, in The execution of the sentence, the personal and material resources transferred to the Autonomous Community of Andalusia by the Royal Decree 1666/2008 are integrated in the State Administration, makes it necessary to create new files of character data personnel and the deletion of others that may be included in the previous ones, in order to adapt them to the current needs of the Agency.

The purpose of this standard is to achieve better compliance with the rules on the protection of personal data, and in particular the legal mandate of Article 20 of the Organic Law 15/1999 of 13 December, as well as to facilitate the exercise of rights for citizens.

For all this to comply with the provisions of this article, prior to the report of the Ministerial Committee of Electronic Administration of the Ministry of Agriculture, Food and Environment and the Spanish Agency of Data Protection, I have:

Article 1. Ownership of the files.

The files contained in Annexes I, II and III of this order are the title of the Guadalquivir Hydrographic Confederation.

Article 2. Creating files.

In accordance with the provisions of Article 20 of Organic Law 15/1999 of 13 December 1999 on the Protection of Personal Data, and the effects provided for therein, and in compliance with Article 54 of the Royal Decree 1720/2007, of 21 December, approving the Regulation of the Development of Organic Law 15/1999 of 13 December, which establishes the extremes to be contained in that provision or agreement determining the minimum content of this rule, relate and describe in Annex I the newly created files with personal data, managed by the Hydrographic Confederation of the Guadalquivir.

Article 3. Modifying files.

The files listed in the Annex to Order MAM/30 4/2003 of 11 February 2003, which regulate the automated files of personal data of the Ministry of Agriculture, Food and Agriculture, are listed in Annex II. Environment, which have undergone modifications, providing their new characterization.

The contents of Annex II are given in accordance with the provisions of Article 20 of the Organic Law 15/1999 of 13 December, for the purposes specified therein, in compliance with Article 54 of the Royal Decree 1720/2007, of 21 December.

Article 4. Deleting files.

The files included in Annex III are deleted, in compliance with article 20.3 of the Organic Law 15/1999, of December 13.

Article 5. Communication and divestiture of data.

1. The personal data contained in the files regulated by this order may only be the object of communication and assignment in the terms provided for in Articles 11, 12 and 21 of the Organic Law 15/1999 of 13 December.

2. They may also be transferred, in general, to the National Statistics Institute for the performance of the functions attributed to it in Article 26 of Law 12/1989 of 9 May of the Public Statistical Service; to the statistical services of the ministerial departments, for the functions assigned to them by Article 33 of the same law; and to the statistical services of the autonomous communities under the conditions laid down in Article 40 (2) and (3) of the aforementioned law.

Single repeal provision. Regulatory repeal.

Order MAM/30 4/2003, dated 11 February, is hereby repealed, regulating the automatic files of personal data of the Ministry of the Environment, as well as the Order MAM/3783/2004, of 26 October, for which extends the relationship of automated files of personal data of the Ministry of the Environment.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".

Authorizations in DPH
