With the publication of the Royal Decrees 55/2005, of 21 January, establishing the structure of university teaching and regulating the official university studies of Grade and 56/2005, of January 21, for which The official university studies of Posgrad are regulated, the transformation of the official university teaching is initiated in a process that is planned to be developed in a progressive way until the year 2010. The Government of the Autonomous Community of Catalonia, at its meeting on 15 March 2005, took, inter alia, the agreements to direct the Government of the State to require incompetence against the Royal Decrees 55/2005 of 21 January 2005. the structure of the university teaching is established and the official university studies of Grade and 56/2005, of 21 January, which regulate the official university studies of Postgraduate, are regulated, considering that both the the final provision of Royal Decree 55/2005 of 21 January, as Articles 5 and 6 of the Royal Decree 56/2005, of 21 January, they violate the competences of the autonomous community in the field of education. With regard to the first rule cited, the requirement of incompetence is specific to the request of the State Government to adopt the agreement to repeal the final provision of Royal Decree 55/2005 of 21 January, or, in the alternative, of new Article 6 (2) of Royal Decree 49/2004, of 19 January, on the approval of plans for studies and formal qualifications and validity throughout the national territory, as amended by the aforementioned final provision of the Royal Decree Decree 55/2005 of 21 January, in the sense that the process of communication to the the autonomous community of the modification of the plan of studies provided for in the new wording of Article 6, by the favorable report of the plan, prior to the Communication to the Council of University Coordination. As regards the second of the above rules, the requirement of incompetence is specific to the request of the State Government to adopt the agreement to repeal Articles 5 and 6 of Royal Decree 56/2005 of 21 January, or, subsist, redrafted to the same. With regard to the foregoing, the Government of the Autonomous Community understands that Article 5 of Royal Decree 56/2005, of 21 January, infringes its powers to the extent that that provision does not recognise the competence of the Community. to implement the postgraduate studies. In addition, the Government of the Autonomous Community of Catalonia considers that Article 6 of Royal Decree 56/2005 of 21 January has infringed its powers to the extent that it attributes to the National Agency for Quality Assessment and Accreditation, in collaboration with the autonomous communities, evaluation functions that do not correspond to them, and which articulate the evaluation process by the Agency. In response to these requests, the Council of Ministers, at its meeting on 22 April 2005, adopted the Agreements for which it undertook, respectively, to draw up new wording to the final provision of the Royal Decree. 55/2005, of 21 January 2005, and Articles 5 and 6.1 of Royal Decree 56/2005 of 21 January 2005, which takes effect in this standard. On the other hand, the existence of an error of wording contained in the additional eighth provision of Royal Decree 56/2005 of 21 January, which in its first line refers to the "foreign titles of Doctor", has been verified when in fact should read 'foreign postgraduate degrees', and the corresponding amendment should therefore be operated. In its virtue, on the proposal of the Minister of Education and Science, with the prior approval of the Minister of Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting on 16 December 2005,

D I S P O N G O:

Article 1. Amendment of the final provision of Royal Decree 55/2005, of 21 January, establishing the structure of university teaching and regulating the official university studies of Grade.

Article 6 (2) of Royal Decree 49/2004 of 19 January on the approval of curricula and official titles and validity throughout the national territory, which was amended by the first provision of Royal Decree 55/2005, of 21 January, read as follows:

" 2. If the amendment concerns a number equal to or less than 10% of the appropriations referred to in the preceding paragraph, it shall be notified favourably by the autonomous community and subsequently communicated to the Coordination Council. University, prior to its publication in the "Official Gazette of the State", for the purposes of the General Secretariat of the said Council to check its correspondence with the common and own general guidelines of the corresponding title. If the modification only affects content established discretionally by the university it must be communicated to the Council of University Coordination, for the purposes specified in the previous paragraph. The General Secretariat of the Council shall communicate these amendments to the respective Autonomous Community, as well as to the competent body of the Ministry of Education and Science. "

Article 2. Amendment of Articles 5, 6.1 and 1 of the eighth additional provision of Royal Decree 56/2005, of 21 January, governing the official university studies of Postgraduate.

One. Article 5 of the Royal Decree 56/2005 of 21 January, which regulates the official university studies of Posgrad, is worded as follows:

" Article 5. Approval of programs of Posgrad.

1. The implementation of the official post-graduate programs will be agreed upon by the corresponding autonomous community, in accordance with the provisions of Article 8.2 of the Organic Law of Universities. 2. As agreed in the previous paragraph, the communities They shall report to the University Coordination Council before 15 February each year on the post-graduate programmes of new implementation for the following academic year. These programmes and their corresponding titles will be published in the Official Gazette of the State. 3. The provision of studies leading to official Master's degrees referred to in Article 8.3 of this royal decree shall require the prior approval by the University Coordination Council. "

Two. Article 6.1 of the Royal Decree 56/2005 of 21 January, which regulates the official university studies of Posgrad, is worded as follows:

" Article 6. Evaluation of the programs of Posgrad.

1. Once implemented, the programs leading to the acquisition of the Master's or Doctor's degrees will be evaluated by the National Agency for Quality Assessment and Accreditation, or by the evaluation bodies that the Autonomous Communities will determine. "

Three. Paragraph 1 of the Additional Provision Eighth 1 of Royal Decree 56/2005 of 21 January, governing the official university studies of Post-grad, is hereby worded as follows:

" Additional disposal octave. Specific schemes.

1. Foreign post-graduate degrees may be equivalent for partial or total purposes to the corresponding Spanish, where this is established in an express manner in international agreements or agreements of a bilateral or multilateral nature in which the Spanish State is a party. "

Final disposition first. Competence title.

This royal decree is issued in accordance with the provisions of Article 149.1.30. of the Spanish Constitution and in the use of the authorization granted to the Government by Article 88.2 and the third final provision of the Organic Law 6/2001, 21 December, from Universities, and it is applicable throughout the national territory.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
