Royal Decree 1299/2006 of 10 November, approving the table of occupational diseases in the social security system and establishing criteria for their notification and registration.

The Declaration for Social Dialogue, signed in July 2004 by the government, trade union organizations and business organizations, established the general framework of priorities in the social field, in which special attention is given to the social security system.

Following an extensive process of dialogue, the parties to the declaration indicated on 13 July 2006 signed an Agreement on Social Security Measures, including the adoption of a new list of occupational diseases which, following Commission Recommendation 2003 /670/EC of 19 September 2003 on the European list of occupational diseases, will bring the existing list into line with the current productive reality, as well as the new production and organisational processes. It was also agreed to amend the notification and registration system, in order to bring about hidden occupational diseases and to prevent the underdevelopment of such diseases.

In fact, the information available indicates that the protection deficiencies for workers affected by this professional contingency are largely derived not only from the lack of updating of the list of occupational diseases, but in particular from the deficiencies of their notification, produced by a procedure that has been proven inefficient, without sufficient linkage with the medical professional who has the competence to qualify the contingency or with the other who can issue a diagnosis of suspicion. As a result, since these elements are considered to be decisive for the configuration of an effective system of notification and registration, it seems appropriate to include them in this standard.

As regards the updating of the picture of occupational diseases in the social security system, it must be borne in mind that the table currently in force was approved by Royal Decree 1995/1978 of 12 May, the date from which considerable progress has been made in the industrial processes, with the consequent introduction of new elements and substances and, at the same time, research and progress in the scientific field and in the field of medicine allow a better understanding of the mechanisms of emergence of certain diseases. This is the first time that we have been working.

Furthermore, the European Recommendation on occupational diseases recommends that Member States introduce into their legislative, regulatory or administrative provisions the list of diseases whose professional origin has been scientifically recognised, as set out in Annex I thereto, and which also seek to introduce the diseases listed in Annex II into those provisions, which are not listed in Annex I but whose origin and professional character could be established in the future.

Similarly, account must be taken of the existence of standards of legal status, such as Article 116 of the recast text of the General Law of Social Security, approved by the Royal Legislative Decree 1/1994, of 20 June, which entrusts the implementing and development provisions to the approval of the cadre of occupational diseases in the field of the General System of Social Security, extended to other special regimes whose protective action includes the contingency of professional illness. Together with it, Article 6 (g) of the Law 31/1995 of 8 November, on the Prevention of Occupational Risks, entrusts to the regulatory standards for the development of the procedure for the qualification of occupational diseases, as well as the requirements and procedures for the communication and information to the competent authority of the damages arising from the work, although the additional provision of the law itself refers to the regulations of Social Security in terms of the concept and legal regime established for the contingency of occupational disease.

All of this determines the need to modify the currently existing professional disease table, for updating and accommodating the aforementioned recommendation and to comply with the aforementioned provisions, which is carried out through this royal decree.

At the same time, and in order to guarantee to the maximum the declaration of all cases of occupational disease, as well as to facilitate its notification and communication, it is considered necessary to modify the mechanism of initiation currently in force, attributing to the managing body or collaborator that diagnoses the occupational disease its implementation, with the collaboration of the entrepreneur, with which the formalities are streamlined and simplified, freeing it, moreover, of the difficulties involved in the implementation of the mechanism of notification and communication of occupational diseases, outside of their entrepreneurial activity.

In the elaboration of this royal decree, the National Commission on Safety and Health at Work has been heard and the most representative trade union organizations and business associations have been consulted.

In its virtue, on the proposal of the Minister of Labour and Social Affairs, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting on November 10, 2006.

D I S P O N G O:

Article 1. Approval of the table of occupational diseases.

The table of occupational diseases set out in Annex 1 to this royal decree is approved, as well as the supplementary list of diseases whose professional origin is suspected, which is listed as Annex 2, and whose inclusion in Annex 1 could be envisaged in the future.

Article 2. Updating of the occupational diseases table.

1. The change in the table of occupational diseases referred to in the previous article will be carried out by the Ministry of Labour and Social Affairs and will require the prior report of the Ministry of Health and Consumer Affairs and the National Commission on Safety and Health at Work. The scientific report that supports the proposed amendment should be carried out by a joint technical committee of both ministries.

2. Diseases not listed in Annex 1 which are incorporated as occupational diseases into the European list shall be included by the Ministry of Labour and Social Affairs in the table of occupational diseases approved by this royal decree, following a report by the Ministry of Health and Consumer Affairs.

Article 3. Qualification of occupational diseases.

The qualification of the diseases as professionals corresponds to the respective managing body, without prejudice to their processing as such by the collaborating entities that assume the protection of the professional contingencies, in accordance with the competences and system of resources collected in the Royal Decree 1300/1995, of July 21, for which it develops, in the field of labor inabilities of the system of Social Security, Law 42/1994, of December 30, of fiscal, administrative and social measures, and norms of development.

It is also for the managing body to determine the occupational nature of the disease in relation to workers who are not in a high situation.

Article 4. Preparation and processing of the parts of occupational disease.

1. In the case of occupational disease, and without prejudice to the business obligations arising from Article 23 of Law 31/1995 of 8 November 1995 on the Prevention of Occupational Risks, the managing body or contributor who takes over the protection of professional contingencies shall draw up and deal with the relevant part of the occupational disease in the terms laid down by the implementing and development provisions.

2. The undertaking shall provide the managing body or contributor with the information it holds and which is required for the preparation of the party referred to in the previous paragraph.

Article 5. Communication of diseases that could be qualified as professionals.

When the medical practitioners of the National Health System, on the occasion of their professional actions, have knowledge of the existence of a disease listed in Annex 1 which could be classified as professional, or of those listed in Annex 2, and whose professional origin is suspected, they shall communicate it to the appropriate effects, through the competent body of each Autonomous Community and the cities with the Autonomy Statute, to the managing body, to the qualification effects provided for in Article 3 and, where appropriate, to the contributing entity of the Social security to take over the protection of professional contingencies. The same communication shall be made by the preventive service, where appropriate.

Additional disposition first. Model of part of occupational disease.

The Ministry of Labor and Social Affairs will approve the new model of a part of professional illness to have effects on the entry into force of this royal decree. At the same time, it shall regulate the procedure for processing, as well as its transmission by electronic means, in such a way as to ensure the fluidity of the information between the managing or contributing entity, the company, the labour administration, the Labour and Social Security Inspectorate, the prevention services, where appropriate, and other institutions concerned.

Additional provision second. Documentation, recording and analysis of occupational diseases.

In the Directorate-General for Social Security Management of the Ministry of Labour and Social Affairs, there will be an administrative unit responsible for collecting and analysing documentation on occupational diseases.

Such functions as registration and analysis and investigation of occupational diseases may be carried out in collaboration with the technical bodies of the Ministries of Labour and Social Affairs and Health and Consumer Affairs and the competent bodies of the autonomous communities, in the form that is determined in the implementing and development provisions and without prejudice to the competences that may correspond to other public administrations.

Single transient arrangement. Transitional application of the rules for the communication and processing of occupational diseases.

As long as the new model of a part of the occupational disease is not approved and the procedure for its processing is regulated, it will be applicable in respect to these matters the regulations in force.

Single repeal provision. Repealed rules.

As many provisions of equal or lower rank are repealed, they oppose the provisions of this royal decree. Royal Decree 1995/1978 of 12 May 1978, approving the table of occupational diseases in the social security system, and the list of occupational diseases listed in the Annex thereto, as well as the list of occupational diseases and the list of works at risk of producing them, are hereby repealed, which is annexed to Decree 3772/1972 of 23 December 1972 on the general regulation of the Special Agricultural Social Security System.

Final disposition first. Development of technical criteria.

The technical bodies of the Ministries of Labor and Social Affairs and Health and Consumer Affairs will draw up a guide to the symptoms and pathologies related to the agent causing the occupational disease, which will serve as a source of information and help for its diagnosis.

Final disposition second. Powers of development.

The Minister of Labor and Social Affairs is empowered to dictate the implementing and development provisions of this royal decree.

Final disposition third. Entry into force.

This royal decree will enter into force on 1 January 2007.
