The changes that have taken place in recent years, both in Spanish society and in the position of Spain within the international community, make it necessary to expand and improve knowledge of the The main Community languages for the staff at the service of the Ministry of Economy and Finance. To this end, in 2005, a scholarship program was developed for the conduct of specialized studies of English, French and German in other European Union member countries, publishing that year and the following year. calls for grants. The Ministry of Economy and Finance, aware of the importance of this programme, considers it appropriate to extend the scope of potential beneficiaries, which makes it necessary to publish new regulatory bases in which, in addition to the procedure for granting grants to this extension, certain technical improvements are introduced in order to simplify it. In accordance with the above, and in accordance with Article 17 of Law 38/2003 of 17 November, General Grant, I have:

Single item. Regulatory bases.

The regulatory bases for the award of grants from the Ministry of Economy and Finance for the improvement of the English, French and German languages are approved in the Annex to this Order.

Single additional disposition. Delegation of powers.

The competent body for the award of scholarships is the Minister of Economy and Finance, in accordance with the provisions of Article 10 of Law 38/2003 of 17 November, General of Grants. Pursuant to Article 13 of Law 30/1992, of 26 November, of the Legal Regime of the Public Administrations and Common Administrative Procedure, the holder of the Secretariat for Economic and Financial Affairs is delegated the competence for the granting of the same.

Single repeal provision.

Order EHA/1525/2006, of 12 May, is hereby repealed, approving the regulatory bases for the award of scholarships Economy and Finance for the improvement of English, French and German.

Single end disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.

ANNEX

Regulatory bases for the award of grants from the Ministry of Economy and Finance for the improvement of the English, French and German languages

First. Purpose of the grants.

1. The purpose of the grants is to promote the improvement of the English, French and German languages of the employees of the Ministry of Economy and Finance, its Autonomous Bodies and the State Tax Administration Agency, through the courses or studies, taught in English, French or German, in universities, specialised centres or language schools in other EU Member States, during their annual leave.

2. Applicants will be able to submit any project of course or study to improve the languages indicated, although priority will be given to those whose content is directly related to one of the areas of activity of the Ministry of Economy and Finance, its Autonomous Bodies or the State Tax Administration Agency.

Second. Requirements of the applicants. 1. Scholarship applicants must meet the following requirements:

(a) To provide services, within the national territory, as a fixed official or job in the Ministry of Economy and Finance, its Autonomous Bodies or the State Tax Administration Agency.

b) Credit knowledge of the language corresponding to the course or study-spoken and written-in terms of the basis Sexta.1.2.b).

2. In the application for a grant, applicants will make a declaration that they meet the requirements that the condition of a beneficiary requires in Article 13 of Law 38/2003, of 17 November, General of Grants. Third. Number and allocation of grants.

1. The number of scholarships will be established in each Order of Call, which in turn will determine its distribution in two quotas: the first of them, for the employees of the Ministry of Economy and Finance and its Autonomous Bodies; and the second, for the employees of the State Tax Administration Agency.

2. The single allocation of grants shall be made up of the following

:

a) Allocation for round trip, which will not require justification, of 500 euros.

b) Allocation for accommodation and maintenance assistance, which will not require justification, of EUR 350 per week. (c) Amount of expenditure relating to the payment of courses or studies carried out by the beneficiary in universities, specialised centres or language schools, including tuition, fees and compulsory health insurance, up to a maximum of EUR 700 weekly.

Annually, in the corresponding call, the amounts corresponding to each of these allocations may be updated according to the evolution of the prices that give rise to their determination.

3. The language training course or study proposed by the applicant shall include a reading load of not less than 20 hours per week and may not last for less than two weeks and no longer than five weeks, Before the end of the year 15 October of the year the fellowships are called.

Fourth. Incompatibilities.

1. The enjoyment of the scholarships covered by this Order will be incompatible with the perception of compensation for service, derived from commissions of service to the country concerned, during the period of enjoyment.

2. The award of grants governed by this Order shall be incompatible with any other grant or aid granted by any public or public authorities or private authorities for the conduct of the same studies or courses of improvement that gives rise to the scholarship.

Fifth. Monitoring and control.

1. The beneficiaries of the grants shall be obliged to comply with the obligations laid down in Article 14 of the General Law on Grants in the form provided for in this Order and, in particular: (a) to submit to the audit (a) to verify, where appropriate, compliance with the conditions or requirements laid down for the grant of the grant;

Sixth. Procedure for the award of grants.

1. Submission of applications. 1.1 The interested parties must submit their application within 20 working days from the day following that of the publication in the Official Journal of the State of the corresponding Order of Call in the model which will appear as Annex to the same, which will be available on the web pages (http://www.meh.es and http://www.aeat.es) and intranet of the Ministry of Economy and Finance and the State Administration of Tax Administration.

1.2 The applicant shall present the following documentation with the application:

a) Memory in which the project of course or studies that you want to carry out (describing your objective, content and duration) is detailed, and in which you specify the university, study centre or language school in which you intend take the course, as well as the place of residence during the development of the scholarship.

In the event that the course or studies are intended to be conducted in a country whose official language is not English, French or German, the reasons for the choice of the applicant shall be specified in the memory. In the event that it is not motivated or that the motivation is insufficient, in the opinion of the Commission of Selection, the application will be dismissed. (b) Certificate certifying the level of language for which the grant is requested. In the event that this documentation is not presented or, in the case of the relevant Selection Board, the knowledge of the language is not sufficiently accredited, the applicant shall carry out and exceed the level tests. that you are proposing. (c) The applicant may also submit for assessment, as provided for in paragraph 2.2 of this base, the following documentation:

1.3 Applications shall be filed in any of the offices and registers provided for in Article 38.4 of Law No 30/1992 of 26 November of the Legal Regime of Public Administrations and of the Administrative Procedure By checking the appropriate box in the application, the Deputy Director General of Human Resources of the Ministry of Economy and Finance, in the event that the applicants are employed by the Ministry of Economy and Finance and their Autonomous Bodies or, to the Deputy Director of Human Resources of the State Agency Tax administration, in the event that the applicants are employed by that Agency. 2. Selection process.

2.1 The valuation of the applications will be made by: a) In the case of the applications of employees of the Ministry of Economy and Finance and its Autonomous Bodies, a Selection Commission formed by: President: An official of the Ministry of Economy and Finance.

Vocal: Two officials from the Ministry of Economy and Finance or its Autonomous Bodies and an official from the State Tax Administration Agency. Secretary: An official of the Ministry of Economy and Finance.

(b) In the case of applications from employees of the State Tax Administration Agency, a Selection Board formed by:

President: An official of the State Tax Administration Agency.

Vocal: Two officials from the State Tax Administration Agency and an official from the Ministry of Economy and Finance. Secretary: An official of the State Tax Administration Agency.

(c) The members of the aforementioned Selection Commissions shall be appointed by the holder of the Secretariat for Economic Affairs and Finance, on a proposal from the Director General of the State Tax Administration Agency in the case of the members from this Body. 2.2 The Selection Commissions shall evaluate the relevant requests and documentation in accordance with the following scale:

(a) Direct relation to the content of the course with some of the activity areas of the Ministry of Economy and Finance, its Autonomous Bodies or the State Tax Administration Agency; 10 points.

b) Use in the job performed by the applicant of the language whose improvement is intended; up to 10 points. c) Duration of the course; 4 points for each full week exceeding two weeks of compulsory course. (d) Entitlement issued by Spanish universities or approved universities, with a maximum of 10 points:

Doctorates and postgraduate studies: 10 points.

Degree of university degree or equivalent: 6 points. Degree of university diploma or equivalent: 3 points.

The candidates shall be presumed to have the qualification corresponding to the qualification group or professional group to which they are attached and shall be valued without the need for photocopies of the same.

In the event that the candidate has one or more qualifications in excess of that corresponding to his/her group, and accredits such a degree in the form previously detailed, only the higher titration will be assessed. 2.3 Valued the instances, the Selection Commissions will establish a ranking of the requests ordered from highest to lowest score, applying, in case of a tie, the criterion of seniority in the recognized Administration according to the provided for in Law 70/1978 of 26 December 1978 for the recognition of prior services in the Public Administration. The Selection Commissions shall draw up the motion for a resolution by selecting the candidates with the highest score. The number of fellowships proposed may not exceed the number of fellowships determined in accordance with the terms of the Tercery.1, except that one of these quotas shall be filled in for vacancies and the Secretariat for Economic and Financial Affairs shall have its own accumulation to the other quota. The draft resolution of each Selection Committee shall be submitted, through the General Secretariat of Human Resources of the Ministry of Economy and Finance, to the body responsible for its approval.

3. Resolution. The Deputy Secretary for Economic Affairs and Finance will decide by delegation to grant the grants within three months of the completion of the deadline for the submission of applications. Such a decision shall terminate the administrative procedure and may be brought before the Court of Appeal within one month from the date of its notification to the Deputy Secretary for Economic and Financial Affairs or, if necessary, an appeal against the the administrative procedure before the competent court within two months from the same date.

The Resolution of the award of the scholarships will be notified to the interested parties in accordance with the provisions of Articles 58 and 59 of Law 30/1992, of 26 November, of the Legal Regime of the Public Administrations and of the Procedure Common Administrative Board, and after a period of 10 working days from the date of such notification without the beneficiary expressly giving up and writing to it, it shall be understood to have been accepted. 4. The situation of the beneficiaries during their stay in the country of destination will be the active duty and the enjoyment of the scholarship will be made during the holiday period. 5 Payment of the grant. -The payment of the grant will be produced after the benefit and upon presentation by the beneficiary to the corresponding Selection Commission, within the maximum period of 20 calendar days from the end of the course or study, next documentation:

a) Certificate of the university, specialized center or language school that accredits the attendance and realization of the course or studies.

b) Original nominal credit documents for the expenditure incurred in respect of the concept provided for in the Tercer.2.c. (c) Certificate of being aware of its tax obligations. This certificate can be obtained, with a user certificate, on the website of the Tax Agency (www.aeat.es) under the option "Virtual Office", "Certifications", "Application and issuance of tax certifications", indicating, as type of certification, "Grant authorization".

Also, in the event that the successful tenderer is not discharged from the Central File of Third Parties, he/she must submit completed Annex 2 of Order PRE/1576/2002 of 19 June, which regulates the procedure for the payment of obligations of the General Administration of the State, which will be available on the web pages (http://www.meh.es and http://www.aeat.es) and intranet of the Ministry of Economy and Finance and the State Administration of Tax Administration. Seventh. Applicable regime. -In all the non-foreseen in these bases will be the provisions of the Law 38/2003, of 17 November, General of Grants, the Royal Decree 887/2006, of July 21, for which the Regulation of the General Law of the Grants and, in addition, in Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure and in any rule of administrative law which by its very nature could be applicable.
