By this Order, Annex I is amended on "Administrative procedures that can be processed through the telematic register" of Order EHA/3636/2005 of 11 November, creating the Telematics Register of the Ministry of Economy and Finance. As a result of the entry into force of Law 26/2006 of 17 July on the provision of private insurance and reinsurance, three new procedures are incorporated: the submission of the application for the registration of exclusive insurance agents in the special administrative register of insurance intermediaries, reinsurance brokers and their senior positions; the application to exercise as a insurance and reinsurance broker in freedom to provide services or through permanent establishment in others States of the European Economic Area; and the application for authorisation for the transmission of significant holdings of insurance brokerage companies. Some of the existing procedures are also adapted to the amendments introduced by Law 26/2006 of 17 July. As provided for in Article 15.2 of that Act, the data contained in the register of exclusive insurance agents must be up to date and shall be forwarded by each insurance institution to the Directorate-General for Insurance and Fund Pensions by means of telematics for registration in the administrative register provided for in Article 52 thereof. Also as a result of Law 26/2006 of 17 July, the telematic procedure for the application of the Diploma of Insurance Mediator entitled and its corresponding form is deleted. With this amendment, it is possible that all the steps to be taken by insurance and reinsurance intermediaries can be dealt with in a telematic manner, thus complying with the provisions of Article 45 of Law 30/1992, of 26 of November, the Legal Regime of Public Administrations and the Common Administrative Procedure, which establishes the obligation on the part of the Public Administrations to promote the use and application of telematics techniques and means for the the development of its activities and the exercise of its powers. Consequently, after the Minister of Public Administration has approved, I have:

In Annex I "Administrative procedures for processing through the telematic register", paragraphs 5.7, 5.8 and 5.10 are amended and new paragraphs 5.9 and 5.28 are included, with the following wording: " 5.7 The presentation to the Directorate-General for Insurance and Pension Funds of the application for registration in the special administrative register of insurance intermediaries, reinsurance brokers and their senior positions, which is carried out by the Directorate-General for Insurance and Pension funds (except for the exclusive insurance agents). "

" 5.8 The presentation to the General Directorate of Insurance and Pension Funds of the application for registration of exclusive insurance agents in the special administrative register of insurance intermediaries, reinsurance brokers and his senior positions. " " 5.9 The presentation to the Directorate-General for Insurance and Pension Funds of the application for authorisation for the transfer of shares or units giving rise to the application of the scheme of significant shares in companies of insurance brokerage.
