Organic Law 2/2006, of 3 May, of Education, sets Chapter III of its Title III to the training of teachers and recognizes in its article 102 the permanent formation as a right and an obligation of all the teachers and a responsibility of the educational authorities and the institutions themselves. The Ministry of Education and Science regulated, by means of Royal Decree 1693/1995, of 20 October, the creation and operation of the Centres of Teachers and Resources in its territorial area of management, establishing for these centres, the Consideration of specialized institutions for teacher training, which exercises educational levels prior to university education, which should promote the professional meeting of teachers in a framework of participation and collaboration in the exercise of what determines how your skills: plan and develop training (a) the development of the curriculum in educational institutions, the promotion of innovation and educational research and the dissemination and exchange of pedagogical and didactic experiences, the provision of information and advice to schools teachers and teachers on the use of teaching materials and curricular materials and participate in activities of social and cultural dynamization in collaboration with the educational centers. As provided for in the Royal Decree, the Order of 18 March 1996 developed and applied certain aspects of it relating to the process of creation, the governing bodies and their constitution and the functioning of the Teachers and Resources. Taking into account the changes experienced by the Spanish society and the educational system itself since the promulgation of the Order, as well as the principles underlying the recommendations for the construction of the European Space Higher education that make teacher training a process throughout the entire professional life, it is necessary to adapt the structures and ways of functioning of the Centers of Teachers and Resources to give answers to the new needs identified in relation to the training, so as to increase their ability to guide teachers to the challenges posed by the introduction of new teaching and to develop relevant functions for the promotion of educational quality and the professionalization of the teaching staff in the school. the levels before the university. For all this, in use of the authorization granted by the final disposition of Royal Decree 1693/1995 of 20 October, with the prior approval of the Minister of Public Administration, I have:

TITLE I

Structure of the Teacher and Resource Centers

First. -According to Article 3 of Royal Decree 1693/1995, it is for the Ministry of Education and Science to create, modify and abolish the Centres of Teachers and Resources in its territorial area. management.

Second. -The Centers of Teachers and Resources in the territorial area of management of the Ministry of Education and Science are the Center for Teachers and Resources of Ceuta and the Center of Teachers and Resources of Melilla. Thirdly, the Centres of Teachers and Resources will have a basic staff of seven permanent training advisers, with profiles to ensure that the education system needs the different needs of the education system. The functions and tasks, both common and specific, that correspond to all the Advisors are those described in the annex to this Order.

TITLE II

Governing Bodies

Fourth. -The Centers of Teachers and Resources will have the following governing bodies:

Unipersonal: The Director and the Secretary.

Collegiate: The Council of the Center and the pedagogical team.

CHAPTER I

Unipersonal Organs

Director

Fifth. -1. The Director of the Centre for Teachers and Resources shall take the charge by means of a selection by public tender of merit in which career officials belonging to the teaching bodies referred to in paragraphs 1 (a) may participate; 1.b); 1.c); 1.d); 1.e); 1.f); 1.g) and 1.h) of the seventh additional provision of the Organic Law 2/2006 of 3 May of Education. He shall be appointed for three years, on a secondment basis, on a proposal from the High Council to the General Secretariat for Education, through the Higher Education Institute of the Teacher, and shall exercise during that period the functions which he/she set out in Article 9 of Royal Decree 1693/1995.

2. The Director of the Centre for Teachers and Resources may, depending on the needs, also carry out the duties of the permanent training advisers. 3. By participating in new calls, the Director may renew his term of office for two consecutive periods of three years each. If they have completed, they will not be able to participate in the merit contests that are called for the following two years for the provision of vacant positions of Directors of Teachers ' Centers and Resources. Sixth. -1. The Director of the Centre for Teachers and Resources shall cease to function at the end of his term of office or any of the following:

Motivated resignation, accepted by the General Secretariat of Education, previous reports of the corresponding Provincial Directorate and the Higher Education Institute of the Teacher.

In the cases set out in the legislation applicable in general to the officials of the State Administration.

2. If the Director ceases to be in office before the end of the term of office, he shall assume his duties until the following call for tender of merit, a provisional director appointed by the Ministry of Education and Science, acting on a proposal from the relevant Provincial Directorate.

3. In the event of the Director's absence or illness, the chair of the collegiate bodies shall be the permanent training adviser who has the greatest seniority as a teaching officer among the members of the Council elected on behalf of the Pedagogical equipment. Seventh. -1. The Ministry of Education and Science will publish in the "Official State Gazette" the call for the public tender of merit for the provision of the places of leadership of the Faculty of Teachers and of the vacant resources, prior to study in the negotiating bodies with the trade union organisations. 2. At least the following information shall be given: The vacancies to be provided; the requirements to be met by the candidates; the documentation to be submitted; the scale, including, among other merits, the age as a career teacher, experience and training, together with the indications for the preparation of the project of the candidate and, where appropriate, the characteristics of the training course to be carried out by the candidates selected. Eighth. -1. The assessment of the merits of the Director candidates shall be carried out by the Council in full in accordance with the scale set out in the call. In addition, the Council will carry out an analysis and assessment of the action projects submitted by the candidates. 2. Those members of the plenary who have submitted their candidature or those who incur any of the causes of abstention laid down in the general rules of the European Union shall not participate in the assessment and proposal process. administrative procedure. Ninth. -Candidates for Director shall meet at least the following requirements:

(a) Belong to any of the Bodies referred to in point 1 of the fifth paragraph of this Order.

b) Find yourself in active service situation. (c) To have a final or provisional destination in the territorial area of direct management of the Ministry of Education and Science. d) Count with a minimum of five full years as a career teaching officer. For these purposes, the school year corresponding to the publication of the call shall be computed.

Tenth. -1. After the selective process is completed, the corresponding Provincial Directorate shall send a copy of the minutes of the session of the Council of the Centre for Teachers and Resources, together with the individual proposal for the appointment of the selected Director, to the General Secretary of Education, through the Higher Education Institute of the Teacher.

2. If the proposed Director is a counsellor, he shall be replaced in the latter position in accordance with the procedure laid down in paragraph 1 of this Order. Eleventh. -Under the Secretariat, once compliance with the requirements of the candidates has been checked, it will dictate the decision of the contest and make it public in the "Official State Gazette". Twelfth. -When the Higher Education Institute of the Professor or the Provincial Directorate considers that the proposal of Director does not conform to the provisions of this Order and/or the call of the public contest of merit, it will leave in suspense its processing and the Council of the Centre for Teachers and Resources shall be required to remedy the anomalies detected or to make the relevant claims. Thirteenth. -If, on the date of commencement of the Director's term of office, his appointment was not possible due to any of the situations referred to in the preceding paragraph, he shall be responsible for the management of the Centre for Teachers and Resources. Member of the Board of Directors of the Ministry of Education, appointed by the relevant Provincial Directorate, until such time as this situation is resolved.

Secretary

14th. -1. The Secretary shall be appointed, for a period of three years, by the appropriate Provincial Directorate, from among the permanent training advisers who have acceded to his place by public tender of merit, on a proposal from the Director of the Centre Teachers and Resources and prior report of the Council, and shall exercise during that period the functions established in Article 10 of Royal Decree 1693/1995, as well as those corresponding to the advice it carries out.

2. Its term of office may be extended for a further period of three years, on a proposal from the Director of the Centre for Teachers and Resources and after the Council's report. 3. In the absence of their duties, they will be performed by the senior advisor in the Faculty and Resources Center. Fifteenth. -Secretary will cease in his post:

a) When you cease as a permanent training advisor.

b) On request, duly motivated, accepted by the appropriate Provincial Directorate. (c) On a proposal from the Director of the Centre for Teachers and Resources, informed by the Council and accepted by the relevant Provincial Directorate, after hearing the person concerned. (d) At the end of each term of office, if the Director does not propose an extension. (e) When a new Director was appointed during the period of his appointments, a new Director would be proposed to replace him. (f) In the cases laid down in the legislation applicable in general to the officials of the State Administration.

CHAPTER II

Collegiate organs

sixteenth. -The Council of the Center for Teachers and Resources, whose functions shall be those laid down in Article 11 of Royal Decree 1693/1995, shall be composed of: (a) The Director of the Center for Teachers and Resources, which shall be its President.

b) The Secretary of the Center for Teachers and Resources, who will be also of this organ. c) Five members all elected by the representatives of the teachers ' cloisters of the holding centers with public funds located in the geographical scope of each Teacher and Resource Center, grouped according to the next distribution:

Two Counselors to elect by the representatives of the cloisters of teachers of the public centers that teach Child, Primary and Special Education, two Councillors for the public centers that teach Secondary Education Compulsory, Baccalaureate, Vocational Training, Artistic Teachings, Languages and Education of Adult Persons and a counsellor representing the cloisters of teachers of the private centres.

(d) Two members, permanent training advisers who have accessed their place by public tender of merit, chosen by means of a vote of the members of the pedagogical team.

e) A Counsellor, representing the Educational Administration, appointed by the relevant Provincial Director. f) A representative of the Government of the City of Ceuta or Melilla, respectively. (g) a representative of the University appointed by the Rector, when it is established by agreement with the latter.

17th. -1. The remaining members of the Council shall remain in the position of the members, except as may be the case for a cessation

(a) The Director and Registrar, as regulated in paragraphs 5 and 14, respectively, of this Order.

(b) The members elected from among the representatives of the cloisters of the teaching centers, three years. (c) The Advisory Board of Directors of Permanent Training, three years. (d) the representatives of the educational administration and those of the local or regional administration for renewable periods of one year. e) The representative of the University, during the term of the collaboration agreement, for renewable periods of one year.

2. Where special circumstances prevent the establishment of the new Council resulting from an electoral process within the prescribed period, the outgoing Council shall remain in office as long as those circumstances are maintained.

Eighteenth. -1. The following shall be caused by the cessation of the condition of Counsellor, prior to the end of his term of office:

(a) Generally: The reasoned waiver, accepted by the relevant Provincial Directorate, heard by the Council of the Faculty and Resources Centre.

In the cases set out in the legislation applicable in general to the officials of the State Administration.

b) Also, with specific character:

The Director and the Secretary of the Teachers and Resources Center, when they cease their positions.

Counselors representatives of the teachers 'cloisters of the teachers' centers, by transfer out of the geographical scope of the Center of Teachers and Resources. The permanent training advisers chosen by the pedagogical team, when they cease in their posts.

2. The casualties produced during the years of the Council's term of office shall be covered as follows:

(a) Those of the members 'representatives of the teachers' cloisters of the teachers ' centres, by the candidates who would have obtained the highest number of votes among the initially proclaimed and which correspond to the same level education of the unemployed. In the absence of these, the relevant provincial director shall appoint the representatives of the staff members to whom he or she considers most suitable, from among those assigned to the Centre for Teachers and Resources, always respecting the requirements (a) the general rules governing the composition of the Council. These Counselors will remain in office only during the term of the mandate that will be lacking for you to comply with the Replaced Counselor.

b) Those of the permanent education advisors, by choosing the members of the pedagogical team. These Directors will also remain in office until the Council has been renewed. (c) Those of the other members, by designation of the body or entity to which the cessor represented or by whom he replaces him in the position in the case of the Director and the Secretary of the Center for Teachers and Resources.

Nineteenth. -1. The Ministry of Education and Science shall convene the elections to members representing the teachers ' cloisters at the Faculty and Resources Centres every three years for the renewal of the members of the Ministry of Education and Science. The call will include the procedure to be followed in the electoral process, which will be controlled by a Commission created for the purpose with representation of the Faculty and Resources Centre, the schools of its territorial scope and the Corresponding Provincial Address.

2. Where no candidature has been submitted or all the posts of members representing the cloisters of the teaching centres are not covered, the relevant provincial director shall appoint the representatives of the the teachers ' cloisters which he considers to be most suitable, respecting what is established in terms of total number and representativeness. This designation will be for the same period of time as that of the elected members. 3. In addition to the appointment or ratification of the Council's constitution, the following members of the Centres for Teachers and Resources shall be appointed or ratified: Representatives of the permanent training advisers, representatives of the Educational administration, representatives of the local administration, and if appropriate, from the University. To this end, the relevant provincial director shall obtain from the corresponding bodies or entities the proposal of those representatives and appoint that of the educational administration. Twentieth. -1. After each renewal of the Council, the relevant provincial director shall communicate to the Centre for Teachers and Resources the total composition of the Council and the date of issue of the credentials to convene the first meeting. of the Council. It shall be the Economic Commission, for which the representatives of the staff members shall elect from among them the member who is to be a member of the Economic Commission, and the same procedure shall be followed by the permanent training advisers, 2. The Council may meet in plenary session or in committees, which shall be established at the beginning of its term of office or when subsequent circumstances so advise, according to the the procedure laid down in the Rules of Procedure. 3. The Council of the Centre for Teachers and Resources shall meet in plenary session at least once a quarter, provided that it is convened by its President or requested in writing, at least half of its members. It shall also meet on a six-monthly basis to approve the management account. 4. The Commissions shall meet in accordance with the timetable established at the time of their formation and when the circumstances so advise, the convocation shall be agreed upon by its President. Twenty-first. -1. The Economic Commission of the Council provided for in Article 8.6 of Royal Decree 1693/1995 shall be composed of the following members: the Director of the Centre for Teachers and Resources, who shall be its chairman, a representative of the members of the Board of Directors elected on behalf of the cloisters of the teaching centres and a permanent training adviser to the Council, acting as secretary of the Centre for Teachers and Resources. 2. The Economic Commission shall have among its members functions, in addition to those laid down in the Rules of Procedure, the review and, where appropriate, report on the draft budget of the Centre, drawn up by the pedagogical team, and its transfer to the Council for study and approval, the drawing up of the precise reports for the preparation of the six-monthly management account for approval by the Council and the regular monitoring to ensure that the implementation of the resources is in line with the forecasts of the annual budget. 3. The Commission shall meet the periodicity laid down in the Rules of Procedure of the Centre for Teachers and Resources and at least with a view to the adoption of the draft budget and the management accounts. half-yearly.

Pedagogical equipment

Twenty-second. The pedagogical team will be composed of the Director of the Faculty and Resources Center, which will be its president, and by the permanent training advisors of the same and will perform the functions assigned to him by the Article 12 of Royal Decree 1693/1995.

Twenty-third. -In relation to the activity of the Teacher and Resource Center, and for the proper performance of these functions, it will be the competence and the collegiate responsibility of the pedagogical team:

(a) The elaboration of the pedagogical project, in collaboration with the Council.

(b) The drawing up of the draft annual action plan for the academic year, to be provided for in the general guidelines of the Ministry of Education and Science, as well as the agreements of the Provincial Training Commission, along with the lines that are derived from the specific needs and demands of the teachers in their field of action. (c) Decisions relating to the organisation and allocation of responsibilities within the team itself, to be included in the Rules of Procedure. d) The elaboration of an annual memory of activities of the academic year. (e) the drawing up of the draft annual budget, in the first quarter of each calendar year, on the basis of the allocation of the Ministry of Education and Science and the estimates laid down in the provincial training plan.

TITLE III

Permanent Training Advisors

Twenty-fourth. -1. Periodically, the Ministry of Education and Science will convene a public tender of merit for the provision of vacancies of permanent training advisers, prior to communication to the negotiating bodies with the organizations. union.

2. This call will include, among other things, the following: the provision of seats for the staff of each Teacher and Resource Centre; the general and specific requirements to be met by the candidates; the scoring scale for the merit assessment which will include at least the following sections: training, innovation or research related to the profile of the advice to which it is chosen, training in other areas, knowledge and experience in training permanent teachers, work project, seniority, academic titles and experience in educational research. 3. If, once the contest has been resolved, vacant positions are left or the school year begins, they may be provided as a service commission during an academic year. Twenty-fifth. -Teachers who wish to participate in such a call must meet the following general requirements:

a) Find yourself in active service situation in the body corresponding to the place you are attending.

(b) To be permanently or provisionally destined for the territorial management of the Ministry of Education and Science. c) Count with a minimum of three years of teaching experience as a career official. (d) Credit a minimum of two years of dedication to the specific contents of the profiles of the advisory to which it is chosen.

Twenty-sixth. -1. The selection of applicants for permanent training advisers shall be carried out by a provincial commission established in accordance with the composition set out in the call.

2. The assessment of the merits of the candidates shall be carried out in accordance with the scale set out in the call. Twenty-seventh. -1. At the end of the first year, the successful candidates must submit to an assessment of the activity performed. If this assessment is positive, they will be incorporated as permanent training advisors to the Faculty and Resources Centre for a period of two more school years. At the end of this period, an evaluation of the developed work will be carried out. 2. Advisors who have been positively evaluated at the end of the three-year period may continue to take the advice for a further period of three years, provided that they have passed the relevant assessment. 3. For the duration of the consultation, the permanent training advisers shall be kept in a position of commission of services. 4. The aforementioned periods, in order to be able to reoccupy a permanent training advisor's place, must have been carried out directly with students for at least two years. Twenty-eighth. -Teachers who perform the advisory positions will be obliged to develop their working day, in sessions of tomorrow and/or late, according to the schedule and timetable proposed by the Center of Teachers and Resources and approved by the corresponding Provincial Directorate according to the criteria established by the Higher Education Institute of the Teacher. In any case, the timetable will be thirty-seven and a half hours a week, which, given the characteristics of the activity to be developed, will be distributed in thirty hours of stay and direct dedication to the Center of Teachers and Resources or to the educational institutions in their geographical area, and the remaining ones, counted in annual computation, to other tasks necessary for the performance of their functions. Twenty-ninth. -Permanent training advisors will have to plan and develop the offer of activities included in the plan of action of the Center of Teachers and Resources, for which they have attributed the functions assigned to them by the Royal Decree 1693/1995, in Article 13 thereof.

TITLE IV

Administrative dependency

Thirty. -Corresponding to the Provincial Directorates, through the Unit of Educational Programs, the coordination and the impetus to the development of the actions of the Ministry of Education and Science in relation to the Centers of Teachers and Resources in their field. They shall also exercise the powers specifically conferred upon them by the provisions in force, without prejudice to those other functions of management, planning, monitoring, control and advice which may be the responsibility of the Higher Institute of Teacher Training.

TITLE V

Pedagogical project

Thirty first. -1. The Centres for Teachers and Resources should draw up a pedagogical project setting out the principles of action and the procedures which guide, in the medium and long term, the annual proposals to ensure consistency. institutional as the adequacy to a specific area with its own identity.

2. Its elaboration, based on a proposal of the pedagogical team, will be carried out by the team and the Council, so that both organs will jointly promote the articulation of the same with the plan of action of which both correspond. 3. The Council of the Centre is responsible for the approval of the pedagogical project. 4. The pedagogical project will include:

(a) The analysis of the scope of action, where the characteristics of teachers and educational institutions are collected, as well as the resources of the area.

b) The theoretical framework and the model of counselling that corresponds to the Centers of Teachers and Resources. (c) the objectives and lines of action which, in the medium and long term, give a better response to the purpose of the institution and make it possible to define priorities at each moment and to establish sequences in the annual plans. d) The organizational structure that is most appropriate for the internal functioning to facilitate the performance of the Center for Teachers and Resources, and for the participation of the faculty to contribute to the strengthening of the institution's character. (e) The model of the institution's assessment.

The Internal Regime Regulation, approved by the Council, will be integrated into the pedagogical project.

TITLE VI

Interior Regime Regulation

Thirty second. -1. A Technical Commission, of which at least one representative of the pedagogical team, shall be a member of the Council, shall be a technical committee in each of the Faculty and Resources Centre for the preparation of the draft Rules of Procedure. Approved by the Council in plenary session, it will be raised, through the appropriate Provincial Directorate, to the Higher Education Institute of the Teacher, for authorization, once the relevant modifications have been made. Any subsequent amendment shall be carried out at the request of at least half of the members of the Council and shall follow the same procedure as for their approval.

2. The Rules of Procedure shall contain, inter alia:

a) The organizational structure of the pedagogical team, following stable operating guidelines that facilitate the continuity of the lines marked in the pedagogical project.

b) The articulation of tasks and relationships between the different collegiate bodies that ensure coordination between them and systematise their functioning, especially in relation to the processes of the elaboration of the project (a) the annual plan for action, the Rules of Procedure and the draft annual budget. (c) The criteria for the preparation of timetables in relation to the development of activities, general information, loan of resources and use of services. (d) the internal rules of the various governing bodies as well as those of an economic and administrative nature on the procedure for the organisation of training activities. (e) The criteria for the production and dissemination of publications. f) The stable mechanisms of relationship with the teaching centers of their field and with the faculty of the same, as well as with public and private institutions.

TITLE VII

Provincial training plan

Thirty-third. -1. In each of the cities of Ceuta and Melilla, respectively, a project of a provincial training plan will be developed, in order to concretize according to each educational context the general guidelines contained in the annual plan of teacher education of the Ministry of Education and Science as well as training needs in the provincial field.

2. The Provincial Director of Education, who has approved the draft provincial training plan, shall forward it to the Higher Education Institute of the Teacher, who, after obtaining the necessary reports or amendments, shall proceed to his or her approval. Thirty-fourth. -1. For the elaboration, development, monitoring and evaluation of the provincial training plan, the Provincial Training Commission shall be constituted in each Provincial Directorate, which shall be composed of the Provincial Director, who shall be its President; of the Education Programmes Unit, the Head of the Education Inspectorate, the Director of the Centre for Teachers and Resources and an Advisor to the Education Programmes Unit who will act as Secretary. A representative of the University will also be part of this Commission if there is a collaboration agreement with the University, as well as a representative of the Teaching Staff Board. The relevant provincial director may propose the inclusion in that Commission of a representative of the City Government, in accordance with the conventions established, and of the movements of pedagogical renewal with implementation in the corresponding territorial scope. 2. Different Technical Subcommittees or a Standing Committee may be established within each Provincial Training Commission, depending on the provincial needs. Thirty-fifth. -They will be functions of the Provincial Training Commission:

(a) To set out the objectives and priorities to be set out in the Department's annual guidelines, by articulating them in a medium-term framework.

b) To analyze and assess the needs of training in the provincial field and its adequacy to the needs of the educational system. (c) Design the provincial permanent training framework, in which the objectives and the preferred criteria are set and the institutional offers are articulated. (d) Define the criteria for establishing the training methods and strategies that are most appropriate to the objectives identified. (e) Establish unified criteria for the payment of the activities of the provincial training plan, in accordance with the rules in force, and the general budget proposal. (f) Develop reports on the degree of adequacy of the plans submitted by the Teachers and Resources Centre, educational institutions or other institutions with respect to the commitments made in the provincial plan and the annual plan of the Ministry of Education and Science. (g) To disseminate the provincial plan to promote the knowledge of the activities in which the teachers can participate. (h) Define the elements necessary for the monitoring and evaluation of the provincial plan.

TITLE VIII

Annual Report and Performance Plan

Thirty-sixth.-The Teachers and Resources Centres will develop, develop and evaluate an annual action plan that forms part of the provincial training plan, following the priorities and established annual guidelines by the Higher Education Institute of the Teacher. This plan must have the express approval of the Council which, to this end, will collaborate in the analysis of the field and in the assessment of the proposal for activities in relation to the agreements of the provincial training plan.

Thirty-seventh.-The end of the school year shall be a memory containing the data of the activities carried out and the evaluation of the action plan. This memory, approved by the Council, will be forwarded to the corresponding Provincial Directorate and to the Higher Education Institute. Thirty-eighth. -According to the twenty-third paragraph of this Order, the elaboration, development and evaluation of the action plan, as well as the elaboration of the corresponding memory, constitute a collective responsibility of the set of pedagogical equipment.

TITLE IX

Operation

Thirty-ninth.-The Ministry of Education and Science will provide the Centers of Teachers and Resources, through the Provincial Directorates, with the funds to meet the operating expenses, including derivatives of the completion of the training activities. The Provincial Directorate shall assign the relevant economic envelope to the Centre for Teachers and Resources in accordance with the available budgetary resources.

40th. -1. The draft annual budget, after approval by the Council of the Centre for Teachers and Resources, shall be forwarded to the relevant Provincial Directorate, on the understanding that it has been accepted if it has not been formulated within one month. repair to the same. If not, the relevant amendments shall be made. This budget shall consist of a statement of revenue and a statement of expenditure.
