Article 20.1 of the Organic Law 15/1999, of 13 December, on the Protection of Personal Data, states that the creation, modification or deletion of automated files of Public Administrations will only be possible be made by means of a general provision published in the Official Journal of the State or the corresponding official journal. This same requirement was already imposed in article 18 of the Organic Law 5/1992, of October 29, of Regulation of the Automated Treatment of Personal Data, which was repealed by the aforementioned Organic Law 15/1999. In accordance with the provisions of Article 18, the Order of 4 October 1999 was approved in order to update the list of automated files of personal data of the Ministry of Public Works. Among the automated files of personal data updated by the aforementioned Order of 4 October 1999, were included those of the Port Authority of the Balearic Islands, which had been created by Order of 27 July 1994. Although a number of orders have been approved after the Order of 4 October 1999, a number of orders have been approved for the purpose of updating the file relationship of the Department-Orders of 20 May 2002, 11 February 2003, 24 November 2003 and 13 May 2003. 2004-none of them has affected those of the Port Authority of the Balearic Islands. Through the Order that is now approved, the list of files of this port authority is updated again. This update consists of the creation of twenty-eight new files and the deletion of a single pre-existing file. Finally, it is to be noted that this Order was informed, during its processing, by the Spanish Data Protection Agency. In its virtue, I have:

First. Creation of files. -In Annex I of this Order the files of new creation are related that, corresponding to the Harbour Authority of the Balearic Islands, have to be incorporated into the set of automated files of personal data of the Ministry of Development.

Consist, in respect of each of these files, the responsible organ and service or unit to which the rights of access, rectification, cancellation and opposition can be exercised; the name of the file; the purpose of uses; persons or collectives on whom it is intended to obtain data of a personal nature or which are required to supply them; the procedure for collecting the data; the basic structure of the file; the intended disposals of such data, if any; and, finally, the security measures of the files. The security measures contained in the corresponding section of each file listed in this annex are those that are applicable in accordance with the current regulations governing the security of the files. automated containing personal data. Second. Deletion of files. -Annex II of this Order contains the deletion of the file of the Port Authority of the Balearic Islands, which was listed in the Annex to the Order of 27 July 1994, of the then Ministry of Public Works, Transport and the Environment.

Third. Entry into force. -This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
