The Ministry of Public Works has assigned powers to promote the training and academic and professional improvement of its official staff, as a basic activity in the process of constant updating and modernization in which the Spanish Public Administration is immersed. In this sense, the execution of the public actions entrusted to this Ministry, the permanent development of the applicable technologies for its realization and the problems of allocation of resources and organization that all this implies, has motivated the financing of a programme of cooperation with the Commission for Cultural, Educational and Scientific Exchange between Spain and the United States of America, in order to promote, through the fellowships Ministry of Development/Fulbright, the training and further training of senior staff in the various areas of the competence of this Department. Therefore, in accordance with the provisions of Article 17 of Law 38/2003 of 17 November, General Grant, I have:

First. Purpose and purpose. The purpose of this order is to establish the bases for the granting of financial aid "Ministry of Development/Fulbright", with the aim of contributing to the training and technical-professional improvement of the level staff of the Ministry of Public Works and its Autonomous Bodies, through the carrying out of studies and the development of concrete works in American universities and specialized centers.

Second. Training areas. -The training areas will be all those that can be applied in the development of public actions that are the responsibility of the Ministry of Public Works. Third. Administrative management of the grants. The administrative management of the grants will be the responsibility of the Commission for Cultural, Educational and Scientific Exchange (hereinafter the Commission) between Spain and the United States of America (Fulbright Program). provide the necessary collaboration for the conduct of studies, visits and relations of a professional nature. Fourth. Beneficiary requirements.-To qualify for the grants applicants must meet the following requirements:

1. To be a career civil servant of Group A or to be a professional staff of the professional group 1 and to be providing services in the Ministry of Development or in its Autonomous Bodies.

They will not be able to participate in the dual nationality, Spanish and North American, nor will they be eligible for these scholarships in the United States of America or those that have been there for the last 3 years. 2. Contar with a work experience in the General Administration of the State not less than two years at the time of applying for the grant. 3. Poseer an excellent knowledge of the English, spoken and written language.

Fifth. Grants for scholarships. -Grants will be provided by the following concepts, the amounts of which will be updated annually according to the variation of the consumer price index:

1. In order to cover the costs incurred as a result of the stay of the trainees in the United States, the Ministry shall grant, as a grant, an economic compensation which shall be between a minimum of eighteen thousand four hundred Forty-two euro with eighty-eight cents (18,442.88) and a maximum of fifty-nine thousand five euros with twenty-two cents (59.105,22), with the amounts to be collected as follows in these bases and which they collect different assumptions depending on the period of the grant, the minimum duration of which will be six months and the maximum of twelve months, and the number of direct family members (spouse and children) who, if any, accompany the intern and for the time during which they reside with him in the United States of America.

On the other hand, they may be increased, in the event that the grantee is accompanied by his or her direct family members, in the quantity resulting from the product of the number of months of their stay with that person, for the quantities that are set out below that they will be based on the number of members of your family who will effectively accompany you.

a) Accompanied by your spouse or by a child: 1,224 euros

b) Accompanied by spouse and son or, without being accompanied by his spouse, he was accompanied by several children: 1,529.97 euros. (c) Accompanied by spouse and several children: EUR 1,865,41.

2. The resulting amount, in each case, will be paid by the Ministry of Development to the grantee in a fractionated manner and in advance.

A first credit will be made upon receipt of the communication of the effective stay. The second book shall be carried out for the remainder of the financial compensation before 31 December of the year corresponding to the award of the grant. 3. Amount of tuition fees, fees and compulsory medical insurance of the University or specialized Center in which it is admitted, with the maximum amounts to be established in the call. 4. Assistance for project expenses, if applicable, up to a maximum of $3,500. 5. Amount of an academic orientation course, if appropriate. These tuition fees will be covered by the U.S. Government, as well as a Fulbright basic allowance to cover living expenses. 6. Subscription by the U.S. Government of sickness and accident insurance, excluding the treatment of pre-existing diseases and dental services.

It is mandatory to subscribe to sickness and accident insurance, equal to or similar to that of the recipient, with coverage of up to $100,000, for accompanying family members. The cost of this insurance will be borne by the grantee.

Sixth. Duration of the grant. The duration of the research projects or training and technical-vocational training programmes may not be less than six months and not more than 12 months. In any case, the scholarship must be incorporated before 30 September of the year of award of the grant. The scholarships are not renewable. Seventh. Call and formalisation of the application.

1. The procedure for granting the grants shall be initiated on its own initiative, by means of public notice, to be approved by the Deputy Secretary for Public Works, by delegation of the Minister, in accordance with Order FOM/3564/2004 of 19 October 2004, on delegation of powers in relation to the common services of the Ministry of Development and in the field of the Secretariat, and published in the "Official State Gazette", which will be expressly mentioned in Law 38/2003, of 17 November, General of grants and of this order.

Applicants must complete the electronic application directly. In order to complete the application, it will be necessary to print it by quadrupled on paper and deliver it, accompanied by all the documentation specified below, in the Commission or in the places set out in article 38.4 of the Law 30/1992, of 26 November, of the Legal Regime of the Public Administrations and of the Common Administrative Procedure, or send it by post, with the date of postmarks not later than the last working day, directing the documentation in the envelope of the consignment: "a/a: Fomento/Fulbright Program", to the addresses indicated below. Incomplete applications, in any of the formats, or the lack of the required documentation without explicit justification, may result in the cancellation of the application.

a) Project of studies that you want to develop in the United States (in Spanish, 5 folios or 4,000 words maximum). The explanation should follow the following scheme: Objective: Project description, chosen specialty and academic degree to which it aspires, if applicable.

Importance: Explanation of the importance of the project itself, for its own academic and professional development, and for Spain. Motivation: Reason that induces you to study in EE. USA.

b) Universities of preference (maximum one portfolio). Indicate three universities in which you could follow the studies of your choice-in order of preference-and the reason that leads you to select them.

c) Curriculum vitae, in Spanish. There is no need to provide other evidence of the academic background specified below. (d) Supporting documentation detailed below, ordered and identified as follows:

Certified copy of the full academic certificate.

A certified copy of the title or justification for requesting it. Three letters of reference, preferably in English, in the forms provided for this with the application. According to the instructions contained therein, the signatories, either university professors or persons chosen for their academic or professional relationship, must submit the originals to the applicant in a closed envelope. The Commission shall be responsible for making the appropriate photocopies of the original letters and shall reject those sent by fax or e-mail. Model of data verification consent, or in its defect, photocopy of the DNI or passport and a recent photograph, stapled to the original of the application. Photocopy of the family book in the event of having legally family members in charge of the beneficiary. Optional: Test of English as a Foreign Language (TOEFL). Photocopy of results with a minimum score of 237 on the Computer-based Test; 92 on the Internet-based Test; or 580 on the Paper-based Test. The examination shall be valid only if it has been carried out during the last two years prior to the date of closure of the call.

Eighth. Time limit for the submission of applications. -Applications shall be submitted within one month of the publication of the relevant call in the Official Gazette of the State.

Ninth. Selection process.

1. The selection of candidates shall be carried out by a Selection Committee, acting as an instructor, composed of the following members: President: The Technical Secretary-General or the person to replace him.

Vocals: The Deputy Director General of Human Resources. By the General Secretariat of Infrastructures, an official with the rank of Deputy Director General. In addition to a representative at the level of the Deputy Director-General for each of the Directorates-General of which candidates are present, they shall act as advisers to the Committee. Two representatives of the Board of Governors of the Commission. Secretary: The Head of the Selection and Training Area.

2. The selection will be carried out in two phases, each of them qualifying:

(a) First phase: If the applicant has not presented the TOEFL with the minimum required result, he/she must perform an English language test at the place to be determined. This phase shall be qualified as fit or unfit.

b) Second phase: Those who have passed the first phase, will have to conduct a personal interview with the Selection Committee, in which the submitted memories will be analyzed and will be valued according to the following criteria:

The oral presentation of the project and the defense of the memory to be made by the candidate (10 points).

The professional and academic merits of the aspirant (30 points). The applicability in Spain of the research project or the studies to be carried out (60 points).

To overcome this second phase, it will be necessary for the candidate to obtain a score equal to or greater than 50 points.

3. The Selection Committee shall draw up a list of the persons selected and proposals for the fellowships, as well as a list with the reserve persons, if any, and shall raise it with the Secretariat of the Ministry of Public Works. which, by delegation of the Minister in accordance with Order FOM/3564/2004 of 19 October 2004, will adopt the final resolution. This resolution shall be communicated to the Commission, which shall submit it to the Commission. William Fulbright Foreign Scholarship Board ', and notified to the person concerned, in the terms laid down in Article 58 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure. The maximum period for resolving and notifying the decision shall not exceed six months from the publication of the notice. The decision, which ends the administrative procedure, may be appealed for in replacement or be directly challenged in the context of the judicial-administrative judicial order, as provided for in Article 116 of Law No 30/1992, of 26 November. 4. The Subsecretariat of Promotion, after having been instructed to do so, may revoke the grant or interrupt the enjoyment of a grant if any alteration of the conditions taken into account for the granting of the aid occurs.

10th. Administrative situation of the trainee during his stay in the United States. The administrative situation of the grantees during his stay in the United States of America will be the active service of license for studies, in accordance with Article 86 of the Law 7/2007, of 12 April, of the Basic Staff Regulations, and Article 72 of the Law of Civil Servants of the State, articulated by Decree 315/1964 of 7 February.

11th. Scholarship obligations. -Will be obligations of the grantees:

1. To fulfil the various stages of the vocational training and training programme.

2. Complete the reports, forms and other documents sent to you by the Entities that collaborate in the management of the program. 3. Stay at the center where your project is developed. Any proposal of absence or change of center, modification of the work project, temporary transfer to Spain or return before the end of the scholarship, must be communicated to the Commission which will request the approval of the Ministry of Development. Grantees who are authorised by the Commission to remain temporarily outside the centre where they carry out their project may continue to receive the monthly allocations established during the authorised period, which may not exceed 15 days. 4. Any alteration of the period of stay in the United States by the grantees will entail the return of the funds advanced to this purpose, and not justified. 5. In the event that the grantee did not carry out the project that was approved, either by altering the object of the project, or because he will abandon the study of the project, whatever the cause, except force majeure, it must be returned in full. the amount equivalent to the total costs incurred by the grant for the benefit of the grant. 6. Present a final report-explanatory report on the work done and the results obtained, together with a report from the academic or professional main supervisor, as appropriate, and, where appropriate, an official copy of the academic certification. The memory must have a minimum extension of 10 folios, typed in double space. This documentation, original and photocopy, shall be submitted to the Commission within the maximum period of 60 days following the termination of the grant. The Commission shall forward the original of the said documentation to the Ministry. 7. The grantee is required to directly justify to the Ministry of Public Works the advance funds to permit his stay in the United States, in the terms of Article 30 of Law 38/2003, of 17 November, General of Grants. Such justification shall be understood as the presentation of a certificate from the centre in which the project is being carried out. The certificate shall show the period of total duration and the regularity in the performance of the certificate throughout the entire duration of the grant. The Commission shall justify the registration fees. The grantee will justify any other expenses incurred by the project that you have developed during the period of enjoyment of the scholarship. The Commission as an intermediary body shall report these expenses to the Ministry of Public Works at the end of each financial year. 8. The grantee who enjoys a minimum duration of six months and a maximum of nine months shall be obliged to reintegrate the amount equal to the total expenses that the grant has granted and the grant, in the case of not continuing in the State of service in the Public Administration for a minimum period of one year, counted from the date on which the trainee had to join his/her job in the Administration. 9. The grantee who enjoys a scholarship for a period of more than nine months shall be obliged to reintegrate the amount equivalent to the total expenses which the grant has granted and the grant, in the event that he does not continue to be active in the Public Administration for a minimum period of two years from the date on which the trainee had to join his/her job in the Administration. 10. The agreement of the governments of Spain and the United States, the main sponsors of the Fulbright Program, requires all beneficiaries, who travel to the United States with the J-1 visa, to return to their country of origin after their completion. a programme of studies, research or vocational training, committing not to establish permanent residence in the United States for the following two years. Exemption from this rule is only possible with the explicit approval of the two governments. 11. Subscribe to a health insurance and accident insurance policy with full coverage for the family member, if accompanied, including international and national travel. 12. In the publications which are derived from the period of training and professional technical improvement, it should be mentioned that they have been carried out with a grant Ministry Fomento-Fulbright.

12th. Failure to comply with the obligations laid down in the previous paragraph shall entail the timely adoption of measures by the Selection Committee on the basis of the classification of non-compliance with obligations as minor, serious or very serious. (a) to determine the amounts to be deducted from the beneficiary or, where appropriate, the amount to be reintegrated.

13th. Incompatibilities.-The enjoyment of the scholarships will be incompatible with any other type of scholarship or economic aid granted by the same or similar concepts. Applicants who have been awarded a Fulbright programme in the three years preceding the call for grants may not be eligible for such aid. Fourteenth. Repeal of the legislation. -Order FOM/227/2006, dated January 24, is hereby repealed, approving the regulatory bases for the award of scholarships "Ministry of Fomento-Fulbright".

15th. Entry into force. -This order shall enter into force on the day following that of its publication in the "Official State Gazette".
