The Organic Law 2/2006 of 3 May of Education establishes in its Articles 91 to 99 the functions of the faculty of the different teachings that are regulated in it, as well as their respective conditions of qualification and training pedagogical and didactic. In the seventh additional provision, in turn, the functions of the different bodies in which the teaching public function is ordered are specified.

Royal Decree 1631/2006 of 29 December 2006 sets out the minimum lessons for compulsory secondary education, which must be part of the curriculum which the various educational administrations define for this stage of the system. In addition, Royal Decree 1467/2007 of 2 November 2007 regulates the structure of the Baccalaureate on the basis of the provisions of the Organic Law 2/2006 of 3 May, of Education and concrete the relation of subjects of its different modalities. In addition, the Government has established, after consulting the Autonomous Communities, the general planning of vocational training of the educational system in Royal Decree 1538/2006 of 15 December, the additional provision of which refers to the rules governing the definition of qualifications and specialties of teachers, teaching assignments and equivalence for the purposes of teaching. Different royal decrees have also regulated the minimum teachings to which the curricula of professional music and dance teachings, as well as those of special regime language teachings and teachings, should be adjusted. sports.

Established in the above mentioned norms the teaching needs in the different stages of the educational system, it is necessary to initiate the development of what is foreseen in the said additional provision seventh of the Organic Law 2/2006, of 3 of May, of Education, in relation to the specialties of the teaching bodies that have been attributed in the public teaching centers the respective teachings.

On the other hand, Royal Decree 1393/2007, of 29 October, establishing the ordination of official university teaching, has allowed the establishment of the Order of 27 December 2007 by Order ECI/3858/ requirements for the verification of official master's degrees in which the provisions of the Organic Law 2/2006, of 3 May, of Education on the pedagogical and didactic training required to exercise teaching in certain stages of the education system.

Thus, by virtue of the state competence recognized by the Spanish Constitution to establish the basis of the legal system of public administrations and the statutory regime of civil servants, for the regulation of the conditions for obtaining, issuing and approving academic and professional qualifications and for establishing basic standards for the development of Article 27 of the Constitution, and in order to ensure a common teaching of quality delivered by the most suitable teachers, it is appropriate to establish the teaching specialties of the officials who are responsible for teaching in compulsory secondary education, baccalaureate and vocational training, as well as defining the allocation of subjects and modules to be provided by the respective teachers at these stages of the educational system, as well as to determine the validity of the official master's degrees to accredit the pedagogical and didactic training required by the Organic Law 2/2006, of May 3, of Education, to exercise the teaching in certain teaching of the education system.

In the elaboration of this royal decree, the autonomous communities have been consulted through the Education Conference, and the Ministry of Public Administration has reported. It also has the report of the Higher Staff Commission and the opinion of the State School Board.

In its virtue, on the proposal of the Minister of Education, Social Policy and Sport, with the prior approval of the Minister of Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers at their meeting on November 8, 2008,

D I S P O N G O:

Article 1. Object of the rule.

1. This royal decree aims to establish the teaching specialties of the bodies of officials responsible for teaching in compulsory secondary education, baccalaureate and vocational training, as well as to define the assignment of of materials and modules to be provided by the respective teachers at these stages of the education system.

2. Likewise, this royal decree aims to determine the validity of the official masters of master's degrees in order to prove the pedagogical and didactic training required by the Organic Law 2/2006, of May 3, of Education to exercise the teaching in certain educational system teachings.

Article 2. Teaching specialisms.

1. The teaching specialties of the bodies of secondary school teachers and secondary school teachers are those listed in Annex I.

2. The teaching specialties of the professional training teachers ' body are those listed in Annex II.

3. In the Autonomous Communities which have an official language, the bodies of secondary school teachers and secondary school teachers shall also have their own special language. The corresponding administrations will determine the teaching assignment to these specialties by analogy with the provisions of this royal decree for the specialty of the Spanish language and literature.

Article 3. Assignment of subjects in compulsory secondary education and baccalaureate.

1. The officials of the bodies of secondary school teachers and teachers of secondary education shall provide the subjects of compulsory secondary education which are specified in each case in Annex III.

2. The officials of the bodies of secondary school teachers and secondary school teachers shall be required to provide the subjects of the baccalaureate, common and modality, which are determined in each case in Annex IV.

3. Officials of the body of secondary school and teachers of secondary education, of the specialties listed in Annex V, may be taught in the baccalaureate and in secondary education. (a) compulsory in accordance with the correspondences specified therein, provided that they fulfil the conditions set out therein and without prejudice to the preference which, in order to impart the relevant matters, have the teachers of the specialties referred to in Annexes III and IV.

4. Officials from the bodies of secondary school teachers and secondary school teachers in the field of educational guidance will carry out guidance tasks and may also be able to carry out teaching on the basis of provides for Article 5. In addition, their guidance functions may be extended to the stages of early childhood education and primary education, as provided for in paragraph 1 of the seventh additional provision of the Organic Law 2/2006 of 3 May of Education.

5. 6. Article 4. Assignment of modules in vocational training.

1. Officials from the bodies of secondary school, secondary school teachers and technical vocational training teachers will teach in the medium-grade and higher-grade training courses in the field of vocational education and training. with the allocation of modules contained, for the respective teaching specialties, in the actual regulatory decrees of the different degrees in accordance with the provisions of the Additional Disposition 10th, paragraph 1 of Royal Decree 1538/2006, of 15 December establishing the general planning of training professional in the education system. In addition, teachers of other teaching specialties, who meet the conditions of training laid down in the rules mentioned for teaching in the different modules in private centres, may do so in public centres without prejudice to the of the preference for these effects of the holders of the respective specialties.

2. The teaching assignment of vocational training courses covered by the Organic Law 1/1990 of 3 October of General Management of the Educational System shall be in accordance with the rules applicable to these teachings. In any case, the teaching assignment to specialties of the body of secondary school teachers will be extended to the teaching specialties of the body of secondary school professors who are established in this royal decree.

3. In the case of integrated vocational training centres, the provision of information and vocational guidance in the Royal Decree 1558/2005 of 23 December 2005 on the basic requirements for the training of vocational training centres will be in line with the integrated vocational training centres.

Article 5. Allocation of optional subjects and mandatory modules for initial vocational qualification programmes.

1. The educational administrations will determine the allocation of the optional subjects to be established in the compulsory secondary education and the baccalaureate to the teachers of the different teaching specialties.

2. The educational authorities shall also determine the teaching allocation corresponding to the modules referred to in Article 30.3 (a) and (b) of the Organic Law 2/2006 of 3 May of Education.

Article 6. Extending the attribution of teaching.

Educational Administrations will establish the necessary conditions to enable teachers with due qualification to deliver more than one subject to the same subject in the first courses of compulsory secondary education. group of students, in accordance with the provisions of Article 26.3 of Organic Law 2/2006, of May 3, of Education.

Article 7. Teaching in other teachings.

1. The officials of the bodies of secondary school teachers and teachers of secondary education in foreign language teachers may exceptionally be able to teach the languages of their respective languages at the stage of the Primary education, in application of the provisions of the seventh provision of the Organic Law 2/2006, of 3 May, of Education. The educational authorities shall regulate in their respective fields the exercise of this possibility, which shall in any case involve the willingness of the persons concerned and shall not have an effect on the stable establishment of the institutions.

2. In addition, teachers of the foreign language specialties of the abovementioned bodies may exercise their teaching at the basic level of the language teaching of special arrangements, when the basic level is organized in educational institutes. secondary.

Article 8. Teachers of other bodies.

1. Teaching in compulsory secondary education, in the baccalaureate and in vocational training, by officials from teaching bodies other than those of secondary school teachers, teachers of secondary education and technical teachers of vocational training, in application of the provisions of paragraph 1 of the seventh additional provision of the Organic Law 2/2006 of 3 May of Education, shall be specified in the rules governing the specialties of the respective bodies.

2. Where the form of the Arts of the Baccalaureate is taught in artistic teaching centres, the corresponding subjects may be assigned to the faculty of the respective bodies of artistic teachings which have the appropriate training in each case.

3. In addition, the educational authorities will determine the conditions under which the officials of the teachers ' body may take over the compulsory training modules of a general nature of the vocational qualification programmes. In the case of the specialties of "therapeutic pedagogy" and "Hearing and language", in the secondary education, they will have to perform functions of attention to the diversity related to their specialty.

Article 9. Pedagogical and didactic training.

To exercise teaching in compulsory secondary education, baccalaureate, vocational training and language teaching, it will be necessary to be in possession of an official master's degree certifying teaching and teaching training. In accordance with the requirements of Articles 94, 95 and 97 of Organic Law 2/2006 of 3 May of Education. To this end, it will be necessary for the corresponding master's degree to fulfil the conditions laid down in the Council of Ministers ' Agreement of 14 December 2007 laying down the conditions under which the master's plans are to be adapted. Additional disposition first. Pedagogical and didactic training of teachers who cannot access master's studies.

The pedagogical and didactic training of teachers who, for reasons derived from their qualifications, cannot access the master studies to which this royal decree refers, will be accredited by means of training equivalent to the required by Article 100 of the Organic Law 2/2006 of 3 May, under the conditions laid down by the Ministry of Education, Social Policy and Sport.

Additional provision second. Teachers of bodies declared to be extinct.

The educational authorities will determine, in their respective fields, which subjects and modules of compulsory secondary education, baccalaureate and vocational training of the educational system may be provided by the teachers belonging to the teaching bodies declared to be extinguished by the rules prior to the Organic Law 1/1990, of 3 October, of General Ordination of the Educational System. Such determination shall take into account the areas, materials or modules that are currently being provided.

Additional provision third. Teaching assignment for the subject of audiovisual culture.

The audiovisual culture of the baccalaureate will be carried out by professors and professors who, whatever their specialty, provide an appropriate higher education to teach the curriculum of the subject.

Additional provision fourth. Specialty of "Psychology and Pedagogy."

Officials from the bodies of secondary school teachers and high school teachers in the field of psychology and pedagogy are assigned to the field of "Educational Guidance" which replaces it.

Additional provision fifth. Teaching in a foreign language.

Educational Administrations will regulate the added training requirements that will be required for teachers to teach in a foreign language, an area or subject other than that of the language, in public or private institutions whose Educational projects will involve a bilingual education system. These requirements shall include, from the 2010-2011 academic year, the accreditation of the equivalent foreign language domain of level B2 of the Common European Framework of Reference for Languages.

Additional provision sixth. Specialties without assignment of functions.

The teachers of the specialties of the different bodies referred to by this royal decree for which no correspondence has been established, will continue to perform the same functions as assigned to the entry into force of this royal decree.

Additional provision seventh. Pedagogical and didactic training to practice teaching in the Professional Arts and Sports Teachings.

The official university degrees of masters referred to in Article 9.1 also demonstrate the pedagogical and didactic training provided in Articles 96 and 98, in conjunction with Article 100 of the Organic Law 2/2006, of 3 May, of Education, are required to exercise teaching in professional artistic teachings and in sports teachings. The Ministry of Education, Social Policy and Sport will complete the content of the aforementioned Order ECI/3858/2007, dated December 27, for these purposes.

Additional disposition octave. Faculty of military teaching centers.

Teaching in military teaching centres which have been authorised by the Ministry of Education, Social Policy and Sport, in accordance with the provisions of Article 55 of Law 39/2007 of 19 November of the Military Career, To provide teaching conducive to the achievement of higher technical and technical qualifications, it may be exercised by the teachers of such centres provided that their specialty is related to the assigned module and have the pedagogical training required.

First transient disposition. Faculty of private centers.

1. As long as the requirements for qualifications and specialization for teaching in private institutions are not updated, they are contained in the Order of 24 July 1995 governing the minimum qualifications to be held by the Member States. (a) teachers of the private institutions of compulsory secondary education and baccalaureate, as well as in the Order of 23 February 1998 and in Order ECI/759/2008 of 19 February 2008, who complete the Order of 24 July 1995, will be application of the provisions laid down in those rules for the teaching to which they relate.

2. In the case of the subjects of compulsory secondary education and Baccalaureate not covered by the Order of 24 July 1995 referred to in the previous point, the teachers of the private institutions must meet the requirements of the established qualifications. for the areas or areas listed in that Order, the name of which coincides with that of the specialties of Annexes III, IV and V to which those matters not covered by the said Order are assigned.

Second transient disposition. Specialties from other teaching bodies.

As long as there is no regulation of the specialties and consequent attribution of teaching in the bodies that are in charge of the artistic teachings, the language teachings and the sports teachings, they will continue to be applied rules in force in each case on the date of entry into force of this royal decree.

Transitional provision third. Accreditation of pedagogical and didactic training.

1. In accordance with the provisions of Royal Decree 806/2006 of 30 June 2006 laying down the timetable for the implementation of the new system of education, established by the Organic Law 2/2006 of 3 May, of Education, in its In addition, educational administrations will be able to continue to organise the teaching courses leading to the Certificate of Pedagogical Aptitude until the academic year 2008-2009.

2. Also the professional titles of Didactic Specialization and the Certificate of Pedagogical Qualification organized by the universities in accordance with the provisions of the Organic Law 1/1990, of October 3, of General System Education, obtained before 1 October 2009, shall demonstrate the pedagogical and didactic training referred to in Article 100 of the said Organic Law.

3. As from the date of 1 October 2009, the titles which they enable for the exercise of the regulated professions of Professor of Secondary Education Obligatory and Baccalaureate, Vocational Training and Official Language Schools comply with the Resolution of 17 December 2007, of the Secretariat of State of Universities and Research, for which the Council of Ministers Agreement of 14 December 2007 is published.

Transitional disposition fourth. Equivalence of teaching taught to pedagogical and didactic training.

To those who credit that before the end of the course 2008-2009 they have taught during two full academic courses or, failing that, 12 months in continuous or discontinuous periods, in public or private schools duly authorized, at the levels and teachings whose teaching specialties are regulated in this royal decree, they will be recognized as equivalent to the pedagogical and didactic training established in Article 100.2 of the Law Organic 2/2006, of 3 May, of Education.

Single repeal provision. Regulatory repeal.

The Royal Decree 1701/1991 of 29 November, which establishes specialties of the body of secondary school teachers, is hereby repealed, and the corresponding teachers of that body are assigned to them. determine the areas and subjects to be taught by the respective faculty.

Final disposition first. Competence title.
