Animal genetic resources are the root of modern livestock innovation, being the source of which breeders depend to obtain improved varieties and breeds that provide quality products, contribute to to maintain the systems of exploitation that are respectful of the environment and to preserve the traditions, while allowing to respond to the new demands of the society, to face the unforeseen situations, to favor the development and to satisfy the human needs; they are therefore an example of the multifunctionality of the Agricultural activity and its strategic value must be used and maintained for future generations.

In the last few decades many indigenous cattle breeds have been endangered, including the disappearance of some of them, mainly due to the introduction of foreign breeds that offer greater production to its exploitation in intensive or semi-intensive systems, with the consequent impacts on traditional ecosystems.

In the framework of the Food and Agriculture Organization of the United Nations (FAO), the Global Strategy for the Genetic Resources of Farm Animals, aimed at conservation, is being developed. and sustainable use of the genetic resources of the agri-food interest, channeled through various agreements and there is a firm commitment to the achievement of these objectives, a commitment made by several countries, including Spain, after the signing of the Instrument for Ratification of 16 November 1993 of the Convention on Diversity Biologica de Rio de Janeiro, 5 June 1992.

addition, within the framework of the European Union, the basis for guiding the lines of work in the maintenance of these resources has already been addressed, while at the same time Community legislation is available to ensure the free trade of goods. the animals of breed and their genetic material, and the criteria for the recognition of breeders ' associations, the registration of breeding animals in the herd-books, their admission for breeding and the guidelines for the breeding performance control and assessment of the genetic value of different species.

The particularities of our country and the varied geographical, climatic and even cultural characteristics make Spain maintain a high degree of genetic diversity and there is a wide range of resources. Fundamental zoogenetics for the maintenance of an adequate socio-economic, cultural and environmental balance. The actions carried out to date by the Public Administrations have made it possible to identify the species and livestock breeds that form part of this biodiversity, and during the last few years some mechanisms have been put in place. necessary to ensure that the real architects of their maintenance and use, the cattlemen, are constituted in associations capable of dealing with their management. While the need to characterise and conserve animal genetic resources has become a priority, this conservation must be linked to the selection of those races that have a better census and productive situation, and, in any case, Case, to its sustainable use.

Thus, the preservation of indigenous livestock breeds is part of the Convention on Biological Diversity and the policy of defense of these races is integrated into the Spanish Strategy of Conservation and Sustainable Use of the Biological diversity, adopted in December 1998 pursuant to the aforementioned Convention. Within this framework, the third final provision of Law 42/2007, of December 13, of Natural Heritage and Biodiversity, excluded animal genetic resources from their scope, so they are regulated through this real decree.

It is the responsibility and responsibility of the Public Administrations to carry out effective regulation and management of the genetic heritage, and this circumstance reinforces the need to establish in Spain a national programme of conservation, improvement and promotion of livestock breeds, which is, together with the updating and systematization of the existing zootechnical regulations in our country, the fundamental objective of this royal decree.

The national programme should identify and cover all lines of work, develop actions for improvement and conservation of breeds, and complement the measures applicable in the traditional breeding environment (in situ). or out of this (ex situ), with the tools necessary for the future preservation of the resources in the approved centres.

For its part, the updating and systematization of the zootechnical regulations that are intended with this royal decree is based on the objectives of improvement and simplification of the legislation proposed by the European Council in its Conclusions, inter alia, of the Presidency of the European Council in Brussels on 15 and 16 June 2006. As a result, this royal decree replaces the rules that have incorporated the European zootechnical regulations that exist for the various species into the internal legal order.

Standards all based on common criteria for the official recognition of the management entities of the genealogical books, which allow the performance of the books at Community level, in such a way that the animals of a State Member States shall be able to be entered in the herd-books managed by an entity recognised by another Member State.

Likewise, the purpose of updating and systematization of the zootechnical regulations, advises the repeal of several norms that regulate certain aspects of the program here contemplated.

Logically, the genealogical books are a very important part in the conservation and improvement of the cattle breeds, hence the Spanish and European Union regulations, the concepts of the European Union as tools of unquestionable interest general, in particular as regards the endangered breeds, within a broad concept, in the exercise of an activity which pursues the preservation of the animal genetic heritage, beyond what is a mere record of the data of the animals. This means that the Public Administrations have a clear responsibility for the control of the genealogical books, which is reflected in the need for official recognition for their creation or management, in the supervision of their operation and in the the possibility of revoking official recognition, if an incorrect operation is found, all within the framework of the administration's obligation to serve the general interests objectively.

With this objective, and according to the competencies of the autonomous communities, by means of this royal decree certain zootechnical actions of an executive nature are decentralized, the coordination measures are reinforced by part of the Ministry of the Environment, and the Rural and Marine Environment, and establish criteria that guarantee the homogeneity necessary for the uniform and standardized implementation of the national program throughout our territory, providing for farmers, through breeders ' associations, the information needed for development by integrating all administrations, institutions and entities that can contribute to its correct implementation. All this with a determined will to promote this sector, whose lines of help for the indigenous races are currently contained in various norms, as are the Royal Decree 1724/2007, of 21 December, for which the bases are established Regulation (EC) No 1366/2007 of the European Union and of the Council of 16 December 2013 on the promotion of indigenous livestock farming systems in extensive schemes and Royal Decree 1366/2007 of 19 October 2007 laying down the regulatory basis for grants intended for the promotion of indigenous breeds in danger of extinction.

On the other hand, the circumstances justifying the range of this provision are in accordance with the doctrine of the Constitutional Court since the STC 69/1988 of 19 April, FJ 5, given the eminently technical nature of its content.

In the handling of this royal decree, the autonomous communities and the entities representing the interests of the sectors concerned have been consulted.

In its virtue, on the proposal of the Minister of the Environment, and the Rural and Marine Environment, with the prior approval of the Minister of Public Administrations, in agreement with the State Council, and after deliberation of the Council of Ministers at their meeting on 26 December 2008,

D I S P O N G O:

CHAPTER I

General provisions

Article 1. Object.

This royal decree aims to establish the basic norms and coordination of the national program for the conservation, improvement and promotion of livestock breeds (the national program), and the regulation of the zootechnical regulations of the registered animals of breed and equidae.

Article 2. Definitions.

For the purposes of this royal decree, it is understood by:

(a) Animal of breed: any animal belonging to any breed of livestock and productive interest which is catalogued, registered or which can be entered in a herd book managed by an officially recognised association or by an official service, in order to be able to participate in an improvement program. It shall be considered as pure-bred animal whose parents and grandparents are registered or registered in the herd book of the same breed.

For each breed, encestes, strains or varieties may be established.

(b) Registered Equid: the domestic animal of the equine or asnal species, or the animal obtained from the crossing thereof, registered or registered in a breeding book or which may be identified by the document provided for in the Community rules in force. Registered equidae shall be considered, for the purposes of this royal decree, as breed animals.

(c) Enchestnut, stretch or variety: closed population of animals of a breed, which has been created on the basis of reproductive isolation, always with certain individuals of that breed, without the introduction of different genetic material, at least for a minimum of five generations.

(d) Official Catalogue of Cattle Traces of Spain: the one containing the official relationship and the classification of all livestock breeds recognised in Spain as being of economic, productive or social interest and listed in the Annex I of this royal decree according to the following classification:

1. Spanish indigenous Races: those that have originated in Spain, cataloging as breeds of promotion, those that for their census and organization are in expansion and as endangered breeds, those that are they are in severe regression or in a disappearance, according to the criteria established at national or international level.

2. Integrated Races in Spain: those that have been fully incorporated into the Spanish cattle heritage, with over twenty years in our country, with genealogy and known performance controls and which have a number of Census breeders that allow an improvement program to be developed.

3. Races of the European Union: those breeds recognised by the competent authorities of one or more Member States, which have animals registered in a herd-book, carry out performance checks for the genetic evaluation of the players and have sufficient numbers of pure-bred animals for the development of an improvement program in Spain.

4. Races from third countries: those from the same and settled in Spain which, in order to be included in the Spanish Races Catalogue, need to be sufficiently contrasted with their adaptation to the Spanish ecosystem and their productive and economic interest, after a period of observation and follow-up, in addition to having in our country a sufficient census of pure-bred animals inscribed in a genealogical book for the development of an improvement program.

5. Spanish synthetic Races: those that have been characterized and developed in Spain from crosses planned between different races, which have a functional or production objective defined in an improvement program, with sufficient census to develop it and which do not meet the requirements to be incorporated into the rest of the categories set out in the Official Races Catalogue.

6. º Other registered equidae: Those who do not belong to any of the races of the above categories.

e) Associations of breeders of livestock breeds: those officially recognized in the framework of the rules in force for the creation or management of the genealogical books and the development of the improvement.

(f) Genealogical Book: any book, file, register or computer system managed by an officially recognized association of cattlemen or an official service, in which animals of a breed are registered or registered determined, making mention of their ancestors.

g) Improvement programme: a set of systematised actions, designed and developed by a breed association officially recognised or by an official service, aimed at the conservation, improvement and/or promotion of the corresponding race, with a unique character for each breed and which must be endorsed by a qualified centre of animal genetics. Depending on the census, characteristics and cataloging of the breed may be:

1. Programme of selection: any improvement programme which aims at the choice of the best players of a breed, or, where appropriate, encasté, stretch or variety, in order to ensure that the desirable characteristics defined in the objectives are transmitted to the offspring.

2. Conservation Program: any improvement program that aims to maintain genetic diversity to ensure the conservation of a breed, encastate, stretch or variety and to avoid extinction or to increase its censuses.

(h) individual assessment or testing centre: any livestock holding, whether public or private, authorised or officially recognised for the purpose of carrying out individual or offspring assessment tests on the the framework of an improvement programme, ensuring common environmental and management conditions for all copies and a collection of homogeneous information.

i) Performance control: the set of actions aimed at systematically checking the production and functional skills of the animals and collecting any other valid information for the determination of the value genetic of the players, according to established model, according to the officially approved improvement programs for the different races and the current regulations for the regulation of the same.

(j) Individual assessment test: the set of operations performed on a given animal, a candidate for the future reproductive system, allowing individual phenotypic measures to be obtained, of the variables under control; with a given chronology, aimed at obtaining a genetic index.

k) Genetic assessment: the set of operations performed on the population in the control of yields and the registration of genealogies, which allow the obtaining of individual genetic values for the target characters established in the improvement programme, together with the accuracy of the improvement programme. The genetic evaluation of the players allows them to be classified by their genetic merits, in order to select the best ones as progenitors of the following generations.

l) morphological rating: the assignment of a numerical value to an individual of a given breed, obtained by the sum of the scores given to the different body regions, performed by judges or technicians in duly accredited morphology, or other professionals designated in the improvement program, and based on the comparison with the racial prototype established in the specific regulation of the genealogical book of each race.

m) Linear rating: a morphological rating system in which different anatomical regions or characters of the animal of zootechnical interest are scored, according to a scale of values whose extremes are occupied by the values phenotypic boundaries of that region or character.

n) Reproduction centre: any officially approved animal grouping centre, dedicated to the collection and collection of genetic material for use in the various livestock breeding techniques or for the creation and maintenance of germplasm banks.

n) Storage centre: installation on a self-employed basis or dependent on a reproduction centre, consisting for the maintenance and preservation of semen, ova, embryos, cells in optimum conditions undifferentiated or other genetic material, primarily for commercial purposes.

o) Germplasm bank: installation on an autonomous basis or dependent on a reproduction centre or storage centre, consisting of the purpose of storing genetic material indefinitely, for the purpose of preserving the national genetic heritage. The genetic material will come from specimens entered in the herd book of their breed, it will have been obtained with the consent of the owner of the animal and will allow to extract DNA in quantity and quality sufficient to guarantee the performances that they are intended, even after the life of the individual. When the biological material to be used is exclusively DNA, the DNA bank will be talked about.

p) Dissemination of the Improvement: Any activity developed for the spread in the rest of the population, of the genetic progress obtained in the improvement programs.

q) Select livestock cerpare: any concentration of breed animals that are intended to be sold in any form, their participation in a contest, their mere exposure, or a combination of the previous alternatives for to spread the improvement. Certamenes may exist with a virtual or telematic character, without the physical presence of the animals.

r) Technical control of a breed: activity whose objective is the verification, by means of the competent authority, of the proper management of the breed by the officially recognized associations or of the responsible official services, as well as, where appropriate, verifying the proper management and implementation of the public subsidies that such associations receive. In the case of associations recognised by the Ministry of the Environment, and the Rural and Marine Environment, the technical control of the breed shall be carried out by the race inspector, who shall develop the functions defined in Article 14.

(s) Animal improvers: the one who has undergone a genetic evaluation under the improvement programme, and who has a proven quality and a genetic value above the thresholds laid down in that programme and with the minimum reliability to be defined in this definition.

t) "cooperative exploitation" means any livestock holding, other than the breeding centres defined in paragraph (n), which has animals registered in the herd-book of a given breed and which participates in the breeding program to improve the program.

u) Official animal genetics centre: the qualified centre of animal genetics, officially recognised by the competent authority, as well as the university centres and the dependent public administrations, which counts with sufficient material and personal resources, experience and technical training in the field of genetic improvement.

Article 3. Scope of application.

This royal decree will apply:

(a) To all associations of breeders officially recognized for the creation or management of genealogical books and the development of programs for the improvement of the breeds of the Official Catalogue of the Cattle Races of Spain and of the registered equidae, to official services having the same functions and to livestock farmers who have animals registered or registered in those books or registers.

(b) To animals of breeds of the Official Catalogue and registered equidae, entered in the herd-books.

(c) To the centres, holdings and facilities defined in Article 2.

Article 4. Powers for the national programme.

1. The autonomous communities shall be the competent authorities for the implementation and regulatory development of all the lines covered by the national programme, in their respective areas of competence.

2. By way of derogation from the previous paragraph, the Ministry of the Environment and the Rural and Marine Environment shall exercise the functions provided for in this royal decree in respect of associations whose official recognition is appropriate, as well as those of coordination, publicity, registration and imports from third countries.

CHAPTER II

National conservation, improvement and promotion of livestock breeds program

Article 5. Content.

The national programme includes at least the following actions:

(a) Characterization and classification of the breeds for inclusion in the Official Catalogue of Cattle Traces of Spain, as well as of their different enchestes, strains or varieties.

b) Recognition of animal breeders ' associations of livestock breeds.

c) Approval of the specific regulations of genealogical books and their modifications.

d) Approval of the improvement programs and their modifications.

e) Control of yields.

f) Valuation of breeding and genetic evaluation.

g) Development of a national information system and databases for the management and dissemination of races.

h) Creation and registration of reproduction centres, storage centres, germplasm banks and embryo collection or production teams.

i) Approval and development of programmes for the dissemination of improvement and the celebration of cattlemen.

j) Establishment and designation of the analysis and coordination bodies in which the representatives of the various administrations, entities and sectors concerned are integrated.

k) Designation of approved centres and reference centres for reproduction and animal genetics.

(l) Impulse of measures to stimulate research in the field of conservation, improvement and promotion of livestock breeds and the creation of national work networks on any of the lines of the programme to promote coordination and the exchange of experience and knowledge.

m) Support lines for the national programme, to be established by the competent authorities for their development.

Section 1, Spain's Official Catalogue of Gearn Races

Article 6. Official catalogue of Spanish cattle Races and their modification.

1. The list of races in the official catalogue is set out in Annex I to this royal decree.

2. The recognition, classification and incorporation of breeds in the official catalogue shall be carried out in accordance with the procedures laid down for these purposes by the National Coordination Commission provided for in Article 34, which shall in any case include: the presentation and analysis of the documentation of the corresponding race, as well as the required report of the breed.

Section 2. Associations of animal breeders of livestock breeds

Article 7. Recognition of breeders ' associations who believe or manage genealogical books.

1. The official recognition of any association of breeders for the creation or management of the relevant breeding book shall be carried out at the request of the competent authority by the competent authority.

2. Associations may only manage the books of the races they represent.

Article 8. Requirements for the official recognition of breeders ' associations who believe or manage genealogical books.

Associations shall be recognised if they comply with at least the following general requirements, without prejudice to the fulfilment of specific requirements for the species or race, by the rules applicable in each Case:

a) Having legal personality.

b) Profit for profit.

c) Dispose of the following media:

1. A sufficient and qualified staff to assist in the proper development of the functions of the genealogical book and the improvement programme, which shall include a Technical Director of the genealogical book, which shall exercise coordination and monitoring of the improvement programme and which should be a university-based with knowledge and training in zootechnical matters.

2. Equipment and hardware or mechanical equipment suitable for the functions to be developed, especially for data processing.

3. Standard printed models for data reporting and processing within the various registers, or the detailed description, in the event that the rules of the herd book permit the transmission of such data. data via telematics.

4. º Acreditar that has means to perform the analytic controls of parentage, that includes the availability of laboratory services to these effects, own or others, through techniques approved by the National Center of Reference for Animal Genetics.

d) Have sufficient economic resources for the management of the genealogical book and the development of the improvement program, according to the census of the breed and the territorial distribution thereof.

e) Poseer minimum numbers of animals and breeders to develop the improvement program.

(f) To carry, for approval by the competent authority, the proposal for specific regulation of the herd-book, and that of the improvement programme, or, where appropriate, adaptation to the pre-existing regulations and programme, endorsed by a qualified centre of genetics, including at least the mandatory contents referred to in Articles 16 and 21.2. When its approval corresponds to the Ministry of the Environment, and the Rural and Marine Environment, the Director-General of Agricultural and Livestock Resources will be competent.

(g) to have a statute or an internal operating regulation established in a statutory manner, which specifically provides for the absence of discrimination in the performance of its duties, in respect of the management of the family book between its partners, and between them and the rest of the livestock farmers, and make it possible for the integration as a partner to any livestock farmer who wishes to do so and meets the requirements.

Article 9. Competencies for the recognition of associations.

1. The competent authority for the recognition of animal breeders ' associations of livestock breeds for the creation or management of breeding books is:

(a) The Ministry of the Environment, and the Rural and Marine Environment, when the association is at national level and refers to a race whose census of animals is distributed in at least three autonomous communities, provided that the census in the predominant autonomous community does not exceed 60% of the total breeding population.

b) In the rest of the cases, the autonomous community in which it radiuses the largest census of animals.

2. Where the official recognition of the association corresponds to the Ministry of the Environment, and the Rural and Marine Environment, the competent body shall be the Director-General of Agricultural and Livestock Resources of that Ministry, and the maximum period in which it must The express resolution shall be issued and notified shall be six months from the date on which the application has entered the register of the competent body.

After that period without receiving the relevant notification, the application for recognition shall be deemed to be estimated and the applicant recognised, unless it lacks the essential requirements for that purpose, as provided for in the Article 62.1.f of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure.

Article 10. Concurrency of associations.

1. Where there is already one or more officially recognized breeders ' associations for the management of the herd-book of a breed, any other association applying for official recognition must prove that it represents at least the 25 per cent of the breed's farmers and which includes at least 30 per cent of the breeding census entered in the main section of the herd book, without prejudice to the fulfilment of other requirements required by the implementing rules, and in particular the obligations laid down in Article 11.

2. In any event, the second or successive associations applying for official recognition for the management of the herd-book of a breed shall comply with the specific rules of the officially approved book and improvement programme. for that race.

3. However, compliance with the above requirements shall be refused by the competent authority where the recognition may jeopardise the programme for the improvement of the breed, either because of the lack of connections to the breed database or the insufficiency, in absolute terms, of the minimum census required to ensure its viability, or for other reasons that compromise the improvement programme, in accordance with the officially approved regulations and the status of each race.

Article 11. Obligations of the associations.

The recognised associations must meet at least the following obligations:

a) Set the goals of conservation, improvement and promotion of your race.

b) Maintain and manage the genealogical book of your race by issuing documents relating to the functions of the genealogical books, in particular certifications and genealogical letters.

c) Develop the officially approved improvement program for each race.

d) where appropriate, submit proposals for amendments to the specific rules of the herd-book or improvement programmes for the approval of the competent authority, the latter being endorsed by a qualified center of genetics.

(e) to inform, at the request of the competent authority, and at least annually, of the operation of the book in question and of the improvement programme, as well as of the incidents of interest occurring in relation to the breed; in particular with regard to its census, national and international expansion, qualification and selection tests, certamenes and, where applicable, the implementing regulations.

f) Ensuring access to their databases, as well as committing to establish telematic communication mechanisms, in the form and conditions that the competent authority determines, to facilitate the data of the genealogical book and of the improvement programme, necessary to form the single database for each breed, as provided for in Article 27.

g) Carry out the programme of dissemination of the improvement defined in Article 30.

(h) To provide the services of the breeding book without discrimination to any holder of the exploitation of pure-bred animals who so requests, whether or not they are a partner, and regardless of their location, under the conditions laid down in the specific regulation of the breed book.

i) To ensure the consistency of the actions in the conservation, improvement and promotion of the breed for the management of whose family book is officially recognized, and to establish the mechanisms necessary to achieve a sustainable use of the same.

Article 12. Extinction of recognition.

The competent authority may declare the recognition of an association to be extinguished when at least one of the following conditions is present:

(a) If the association ceases to meet, on an ongoing basis, the recognition requirements set out in Article 8.

(b) If the association repeatedly fails to comply with any of the obligations under Article 11.

Article 13. Second-degree partnerships.

1. Associations of breeders of livestock breeds may constitute federations, confederations or groupings which integrate the various entities which exist for the various breeds, and are generally designated as second associations. (a) degree, for the defence and representation of the interests of its partners to the Public Administrations, as well as for establishing the mechanisms to facilitate the proper and homogeneous management of such races for their promotion, conservation and improvement.

2. Public Administrations may promote the formation of second-degree associations which integrate associations which exist of breeders of the same or of different races, for the management and coordination of the book or of the genealogical books, as well as the development of the program or improvement programs.

3. In the event that some or some of the associations which are integrated is already recognised for the management of genealogical books, this recognition shall be maintained, unless the competent authority authorises the management of the book corresponding to the second-degree entity to be formed upon request for the same and express waiver of the entity that was recognized in the first instance for the management of the book.

4. Official recognition shall be carried out by the autonomous community in which it radiate its registered office when it is confined to the field of a single autonomous community, and by the Ministry of the Environment, and the Rural and Marine Environment, provided that the Second-degree partnership activities take place in more than one autonomous community.

Article 14. Technical control of the breed.

The technical control of the breed shall be carried out by the competent authority by the means determined by it, in the case of the General Administration of the State, through the inspector of race, and shall collect at least the following functions:

(a) Carry out technical control of the application of the standards established for each breed, checking their correct application and verifying the fulfilment of the criteria of the herd book, the control of yields and the improvement program.

b) Monitor compliance with the zootechnical and genealogical requirements of animals presented to select cattle certamenes.

c) Report on the situation of race and association and propose actions in the management of genealogical books and improvement programmes to be reviewed.

d) Collaborate on the verification of the correct application of public subsidies, as well as the justification of the actions financed.

e) If appropriate, be part of the management committee for the improvement program.

Section 3. Collaborating Holdings

Article 15. Register of collaborating farms.

1. Each recognised breeders 'association shall manage a register in which it shall register' collaborating holdings '.

2. All farms that collaborate with the improvement programme must be registered in this register, and their holders must participate in all that this programme has.

3. Each of the collaborating holdings shall be associated with the code or codes assigned to it in the General Register of Livestock Holdings referred to in Royal Decree 479/2004 of 26 March 2004 establishing and regulates the General Register of livestock holdings.

4. Without prejudice to the above, or to the specific rules of each race, the recognised association may, for internal functioning, assign one or more acronyms to each 'contributing exploitation'.

5. The specific regulations shall lay down the requirements to be met by the cooperating farms, including the need for a minimum number of players to be available. This requirement may also be required in the case of breeds classified as being endangered, although in accordance with a quantitative criterion according to the census of such breeds.

Section 4. Ms Specific regulations of the genealogical books

Article 16. Minimum content of the specific rules of the herd book.

The minimum content of the specific rules of the genealogical book are:

a) Determination of the characteristics of the breed, including its name, the racial prototype and the rating system.

(b) Specific methods used in the identification of animals, where appropriate.

c) Division of the family book, if there are different conditions for the registration of the animals in the book or different procedures for the classification of the animals entered in the book.

d) Requirements for the registration of animals in the herd book.

f) In case of requesting recognition for the management of the genealogical book of a new breed, indication of the length of the period of time during which the registration of animals in the foundational register is possible.

Article 17. Methods for identification.

1. All animals of the breed that are registered in a herd book must be individually identified, in accordance with the regulations in force for each species, and the code of this identification shall be the used for the registration in the book, as well as in the rest of the zootechnical documentation referring to the animal.

2. In addition to this identification, other specific identification systems may be used for each species or breed, such as crotals, tattoos, electronic identification methods, genetic markers or other scientifically appropriate methods, always in accordance with the legally established criteria and the specific rules of that breed.

3. In the event that there is no official regulation for the individual identification of a species, specific identification systems shall be used for each breed of the species referred to in the previous paragraph.

Article 18. Division of the genealogical book.

1. Any genealogical book shall be composed of at least one main section, which may consist of the following records:

(a) Registration of Births: for those animals of both sexes that meet the conditions of Article 19 and the specific regulations for each species or breed.

(b) Definitive Registration: for breeding specimens that come from the birth register and meet the conditions of Article 19 and the specific regulation for each species or breed.

Within this registry may exist, provided that the current regulations, one or more records of players in which the animals have successfully passed the exclaimable assessment tests are not prevented. in each case.

2. In addition, except in cases where, in accordance with international law, the following records or annexed sections may be established, which shall conform to the technical criteria of each breed:

a) The Foundation Register: for new-creation genealogical books or which have few registered copies, in which they will be included, always referred to a deadline from the creation of the book or record, those animals which fulfil the minimum characteristics for the recovery of the breed or the conditions laid down in regulation for the opening of that new registration, or, in cases where it is expressed and in particular by the competent authority, for re-opening, if necessary for the maintenance or recovery of the breed.

(b) Auxiliary Register (annege section): for those animals or their descendants, or only for females, if any, which either have an unknown genealogy, or were not registered at the time, but which exceed the assessment or qualification test for each livestock breed and demonstrate-for themselves or through their descendants-significant morphological, productive or functional qualities, in accordance with Community rules for each species.

(c) Registration of Merit: in which the breeding animals belonging to the main section which have been shown to have demonstrated an outstanding morphological, productive, reproductive or functional genetic qualities, agreement with the specific rules of each race.

Article 19. Registration of the animals in the genealogical book.

1. Only the copies in which the circumstances specified in this royal decree, in the regulations of the autonomous communities and in the specific regulations of the autonomous communities, may be registered in their respective genealogical books. each race, without prejudice to other implementing rules.

2. In the Main Section of the herd-book for each breed, the animals which satisfy at least the following requirements shall be entered:

a) Provening of parents and grandparents registered or registered in the genealogical book of the same breed. However, the above:

1. In species whose specific legislation provides that the registration of parents and grandparents has been carried out in the main section of the family book, the foundation register shall be considered as part of the main section of the family book.

2. In registered equidae, registration may be carried out, as products for the purposes of ancestry, of the specimens from progenitors entered in the herd book of the breed, or of progenitors admitted in cross to produce such a breed. In addition, the offspring of animals registered in the auxiliary register may access the birth register if the animals in the auxiliary register are reproduced with the final registration players, under the conditions to be determined for each race.

(b) Habsber has been declared a cover, artificial insemination or embryo implantation, by the farmer or the optional veterinarian responsible for them, and the birth has been declared by the procedure established for these purposes by the managing association of the family book, or by telematics, where appropriate. c) To have been identified according to what was foreseen in this royal decree, as well as in its case, in the regulations of the autonomous communities.

(d) Having established a filiation, in accordance with the rules of the genealogical book of each breed and the provisions of Article 20 of this standard.

3. In the Auxiliary Register (Aneja Section) of the genealogical book, copies may be registered or registered in any of the following cases:

(a) Where a female does not meet the requirements to be registered in the Main Section (Registration of Birth and Definitive Registration), the breeders ' association which manages the herd book may decide that the female is entered in the Auxiliary Register (Annex) of the said book, provided that it meets the following requirements:

1. º To be identified according to the rules set forth in the genealogical book.

2. º Adjusting to the breed standard.

3. º Respond, if any, to the criteria of minimum yields fixed, according to the standards established in the improvement program.

(b) The last two requirements referred to in the preceding paragraph may be differentiated according to whether the female belongs to that breed, even if she does not have a known origin, or who comes from an approved improvement programme for the association of breeders managing the genealogical book.

(c) Exclusively in species or breeds in which Community legislation so permits, males who meet the requirements to be approved by the competent authority.

4. Without prejudice to the above:

(a) The female whose mother and grandmother are enrolled in the Annex to the book (Auxiliary Register) in accordance with the criteria referred to in point 3 (a), and whose father and two grandparents are enrolled in the Section Principal (Registration of Births or Definitive), shall be considered as pure-bred female and shall be entered in the aforementioned Main Section, in accordance with Community legislation.

(b) Those animals entered in the Auxiliary Register of which the genealogical ancestry necessary for access to the Main Section may be demonstrated by genetic markers or, where appropriate, by other means or mechanisms valid and internationally recognised, which shall be determined, may be entered in that Main Section.

5. Copies from another Member State which satisfy the Community zootechnical rules may be entered in the register of a herd-book whose criteria are applicable, provided they are accompanied by the documentation contained therein. the data necessary for the practice of such registration, in accordance with the specific rules of each species and breed. No officially recognized association may object to such an inscription in his genealogical book.

Article 20. Lineage.

1. Officially recognized breeders ' associations and official services must establish mechanisms for the control of the filiation to ensure the genealogies of the animals entered in the genealogical books, by the analysis of the markers genetic or, where appropriate, other valid and internationally recognised means or mechanisms, which shall be determined in the specific rules of the breed and be in accordance with the indications of the National Genetic Reference Centre Animal.

2. The control of the parentage of the animals entered in the herd-books shall be carried out by random sampling and compulsory inspection. Random sampling shall be carried out on the specimens existing in the gangries of that breed, and as a priority on those obtained by the application of assisted reproductive techniques, and the compulsory check shall be carried out on the Following cases:

a) For males participating in individual assessment tests.

b) For animals that are better, as defined in Article 2.

(c) For males intended for breeding, either by artificial insemination or by natural mount, in the case of ganaderies of different holders sharing localisation, even in a temporary manner.

3. In any case, the associations of breeders officially recognised for the conduct of the herd-book may provide that, on a compulsory basis, the control of parentage in the stocks deemed necessary is carried out.

Section 5. Improvement Programs

Article 21. Improvement programs.

1. Depending on the classification of the breed, its degree of development, census, zootechnical interest and productive fitness, the improvement programs may be differentiated in selection programs and conservation programs.

2. The improvement programmes shall include the specific actions set out in Annex II and, in any case, the following minimum content:

a) The description of the starting situation.

b) Selection or conservation objectives and criteria.

c) The stages that are considered in the improvement program and its chronology.

(d) The relationship of the collaborating holdings, reproduction centres, storage centres, testing centres, germplasm banks or embryo collection or production teams, which are expected to be involved in the programme improvement.

e) The actions planned to avoid consanguinity, genetic drift, loss of genetic variability, loss of effective or loss of productive characters.

f) The designation of a qualified gene center that endorses the improvement program.

g) The forecast and mechanisms for the diffusion of genetic improvement and the sustainable use of the breed.

h) The designation of a managing Commission to facilitate the coordination and monitoring of improvement programmes.

3. The implementation of the improvement programmes shall be the responsibility of the breeders ' association officially recognised for the conduct of the herd book or, where appropriate, the responsible official service.

4. The competent authority shall, where appropriate, approve the improvement programmes or the proposals for amendments to those already officially approved. In any case, the approval of a qualified genetic centre will be required.

Article 22. Participation in the improvement program.

1. The programme for the improvement of each breed will establish the methods of collaboration and integration of livestock farmers, as well as the participation of breeding centres, storage centres, testing centres, germplasm banks or equipment. embryo collection and/or production.

2. For those breeds, enchestes, strains or varieties approved by a conservation programme, participation in this programme shall be compulsory for all livestock farmers who belong to the association at the disposal of the authorities. competent.

3. Public administrations and breeders ' associations will be able to establish mechanisms to facilitate the incorporation of livestock farmers into improvement programmes and to define priorities to support collaborative farms that comply with the guidance that the improvement program itself determines for the dissemination of the improvement.

Article 23. Performance control.

1. The official control of milk yield shall be carried out in accordance with the provisions of Royal Decree 368/2005 of 8 April 2005 governing the official control of milk yield for the genetic evaluation of bovine, ovine and caprine species. caprine, and any other rules that apply.

2. The methods used for the control of meat performance are described in Annex III, without prejudice to the provisions of Community decisions.

In order for data resulting from the official meat performance control of animals of a breed to be published as such data from an official control, at least the guidelines and methods used for monitoring shall be required. the performance is included in the improvement programmes, which have been approved by the competent authority and that there is an effective census of animals in the national territory which allows such a programme to be carried out.

3. In the case of bovine animals intended for fighting, checks shall be carried out at least on the basis of the general criteria for the genetic evaluation of other products, but adapted to their specific characteristics, to their aptitudes deals, the behavior characters, and their selection goals.

4. In equidae, at least the following means may be made through the following means:

a) Testing of young horse selection for the various disciplines and skills.

(b) Testing tests performed at individual assessment centres and approved training centres to approve the conditions of the animals and the environment in which they are developed.

c) Individual assessment tests of the players.

d) Field tests.

e) Tests for linear morphological qualification.

f) Morphological and functional concourses.

g) Competitions in the various equestrian disciplines.

h) Laboratories or locomotion centers.

5. The competent authority may define and approve other arrangements for the control of additional yields in other productions.

Article 24. Assessment of breeding and genetic evaluation.

1. The assessment of the breeding stock shall be the responsibility of the officially recognised associations for the conduct of genealogical books, except in the case of breeds managed by official services, in which case it shall be the responsibility of the latter. services, through the qualification systems established in the specific regulation of the herd book of each breed and through the assessment tests defined in the improvement programme.

2. The assessment of the players must be carried out in accordance with all or any of the following:

(a) Ancestry assessment: valid for both the parents to be used in the targeted mating and for the choice of the animals to be considered as a stallion in the subsequent individual assessment of the animal. Account may be taken of a greater or lesser number of generations preceding them, and the information shall contain genetic values (maternal and paternal), and phenotypic and genealogical characteristics.

b) Individual assessment of the animal: it is carried out directly on the individual, through the verification of their characteristics and the control of their yields. It may be carried out in the field, at station or in other places supported by the improvement programme. The individual assessment of animals belonging to difficult-to-manage breeds may be carried out only on the holding itself.

c) Valuation for offspring and collaterals: it is the one that is done on an individual through the controls of the progeny and the related animals, distributed in the various livestock.

3. Genetic evaluation will be carried out on the basis of genealogical and phenotypic information. The results will be expressed in the form of genetic values, in the genealogical documentation and in the catalogues of stallions and females improving the breed for the different selection objectives. When publishing the results of the assessment, the data on the reliability and the assessment date shall be included.

4. Genetic evaluation may be complemented by the calculation of specific synthetic indices for each target.

5. The statistical methods applied in the genetic evaluation of the animals and the accuracy of the animals must comply with the Community rules and the principles laid down by the International Committee for the verification of livestock yields. (ICAR).

Section 6. National System of Information and Database of Races

Article 25. National Race Information System.

The National Information System for the knowledge and management of the races depends on the Ministry of the Environment, and the Rural and Marine Environment, with the collaboration and participation of the autonomous communities and the associations of breeders, for shared use and is constituted in an IT application with internet/intranet technology that includes a computerised database, containing at least the data relating to:

(a) Associations of officially recognized breeders, as well as any modification or extinction of recognition thereof.

b) Headings of the ganaderies, REGA code and initials, if any.

c) System users.

d) Information about the genealogical book, including the number of animals in the different records.

e) Improvement program data and genetic evaluation.

(f) Updated relation of reproduction centres, storage centres, germplasm banks and embryo collection or production equipment, including, as appropriate, the operating registration number (REGA), the code Zootechnical referred to in Article 28.3 or both.

g) Information on existing genetic material in breeding centers, storage centers, germplasm banks and DNA banks, especially information from the National Reference Center for Reproduction Animal and Bank of Animal Germplasm, as provided for in Article 29.

Article 26. Location and access to the information.

1. The central server of the Ministry of the Environment, and the Rural and Marine Environment shall have all the information referred to in the previous article.

2. The competent authorities shall allow access to this information by telematic means to other users by establishing different levels of access, without prejudice to the limits that are legally appropriate for the protection of data. personal character, if any, and of the provisions of Chapter IV.

3. The competent authorities shall record in the respective Data Protection Agencies, the files which, by the nature of their content, are covered by the scope of the Organic Law 15/1999 of 13 December Protection of Personal Data.

Article 27. Databases of the races.

1. Each recognized association must have a database that brings together the following information:

a) The book or genealogical books you manage, with animal data.

b) The results of the player rating and improvement program.

c) The results of the performance controls.

d) The ratio of breeders to their staff.

e) The relationship of the collaborating farms.

f) Any other data of interest for the conservation and promotion of the breed.

2. Associations shall give access to their databases to the Public Administrations, to each breeder or to the owner and to other citizens who credit a legitimate right or interest, without prejudice to the proper protection of the data of a given character. personnel in accordance with the Organic Law 15/1999, of December 13, for the protection of personal data.

3. Where there are different associations recognised for the same breed, they must integrate the data corresponding to the herd book and the improvement programme into a single database managed by one of them, by an association of second grade as provided for in Article 13 or by a public or private agent designated by them and in agreement with the competent authority.

4. For different breeds which share the same selection objective, common IT bases which integrate the information of the animals involved in the approved improvement programmes may be set up. The associations involved will collaborate in the maintenance and updating of the data necessary for the operation of these bases.

Section 7. Reproduction and germplasm banks

Article 28. Reproduction centres, storage centres, germplasm banks and embryo collection or production equipment.

1. The breeding centres may only maintain in their chosen animal facilities the criteria contained in the officially approved improvement programmes for each breed.

2. Germplasm banks, of an autonomous nature or dependent on reproduction and storage centres, shall be set up, in which the genetic material described in the relevant improvement programme (semen, ova, embryos, cells) shall be kept. somatic, DNA or any other authorised material). Such genetic material may be obtained even after the individual's own life, and shall preferably proceed from:

(a) Animals of breeds classified as endangered, to ensure their conservation in the future.

b) High-quality, improved animals for the diffusion of the improvement of the breed.

c) Animals of breeds in which it is necessary to ensure the maintenance of their genetic variability.

3. Reproduction centres, storage centres and germplasm banks, as well as embryo collection or production teams, must be authorised by the competent bodies of the autonomous communities, according to the rules applicable in each case, and they must provide for a registration code or zootechnical code and be communicated to the Ministry of the Environment, and the Rural and Marine Environment, which shall, where appropriate, give the notification to the European Commission, in accordance with the Community rules.

Article 29. National Reference Center for Animal Reproduction and Animal Germplasm Bank.

1. The Animal Reproduction and Selection Center of Colmenar Viejo, of the Autonomous Community of Madrid, is designated as the National Reference Center for Animal Reproduction and the Bank of Animal Germplasm.

2. The breeders ' associations and the autonomous communities shall send to the National Reference Centre for Animal Reproduction and Animal Germplasm Animal a sample of the specimens stored in their territory for the existence of a duality of samples, to prevent risks and to ensure the conservation of genetic material.

3. The characteristics and functions of the Centre are set out in Annex IV.

Section 8. Enhancement Diffusion and Select Livestock Certams

Article 30. Program for the diffusion of the improvement and select cattle.

1. Each breeders ' association shall establish and submit for approval by the competent authority, a programme for the dissemination of the improvement of its breed, which shall include at least the intended actions and the data available to them concerning:

a) Technical advice to holdings.

b) Training for livestock farmers.

c) Publications and programs for the dissemination of race and its products and utilities.

(d) Programs for the distribution of seminal doses for the testing of offspring, or, where appropriate, of natural mounting, or transfer of breeding.

e) Select cattle Certamenes.

f) Organization and sale of select players and genetic material.

g) Promotion and export plans.

2. Second-degree associations may carry out programmes for dissemination and improvement involving one or more of the breeds whose family book officially manages the associations which are part of them, under the conditions laid down in Article 1 (2) of the determine by the competent authorities.

Article 31. Types of select cattle certamenes.

1. Depending on their purpose, select livestock certams may be of the following modes, independent or combined:

(a) Race contest: the one who, with a monographic character, gathers animals of a race, to qualify and, where appropriate, to reward the specimens according to their morphology or performance controls, according to the regulations established for these purposes.

c) Race exhibition: the one in which copies are included in the genealogical book of their race, different species and races may be present, their main objective being the exhibition of the same or their functional features.

2. Depending on the territorial scope or origin of the participating races, which may belong to one or more species, the certamenes may be autonomous, national or international.

Article 32. Requirements.

1. Without prejudice to the health requirements laid down in Articles 54 and 55 of Law No 8/2003 of 24 April of animal health, select livestock certams shall also be authorised before their conclusion by the competent body. of the Autonomous Community, in accordance with the legislation in force, for which, at least, the following requirements must be met:

(a) Dispose of appropriate facilities and facilities for their function, especially livestock exhibition and livestock exhibition tracks, livestock handling facilities and independent and properly equipped offices, to enable duly comply with the applicable rules.

b) Admit only animals registered in breeding books, provided that these animals and the holdings of origin comply with the legally established animal health, animal welfare and animal welfare conditions, without discrimination on the basis of origin.

(c) In the case of national livestock auctions, only allow animals that are positively valued or are descendants of improved animals.

2. The competent authority shall supervise the holding of the event by appropriate means, which may include, where appropriate, the appointment of a Technical Director.

3. In the case of virtual auctions, the breeders ' association shall define in a regulation the conditions for its conclusion and shall be responsible for its communication to the competent authority.

Article 33. Calendar.

1. The official calendar of the national select cattle certamenes will be approved by the Director General of Agricultural and Livestock Resources of the Ministry of the Environment, and the Rural and Marine Environment.

2. Officially recognised breeders ' associations, second-degree associations and, where appropriate, the autonomous communities and other public entities, shall submit to the said Directorate-General before 30 November of the preceding year, the Proposal for national certams to be held in the following year, indicating dates, places, species and races involved.

Section 9. Coordinating Organs

Article 34. National Coordination Commission for the conservation, improvement and promotion of livestock breeds.

1. The National Coordination Commission is hereby established for the conservation, improvement and promotion of livestock breeds (hereinafter the National Coordination Commission), as a collegiate body of an interadministrative nature, attached to the Ministry of the Environment, and Rural and Marine Environment, through the Directorate General of Agricultural and Livestock Resources.

2. They are functions of the National Commission:

(a) Serve as permanent organ of relationship between the General Administration of the State and the Autonomous Communities in the field of zootechnical and, where appropriate, exercise of study, analysis and proposal of zootechnical actions on races and their associations.

b) The monitoring and coordination with the autonomous communities of the implementation of the current regulations, in the field of livestock breeds that are the subject of the national programme.

c) The periodic review of the evolution of such execution, proposing the precise modifications for an effective fulfillment of the objectives or raising, where appropriate, normative proposals.

(d) Raise the competent authorities with proposals to enable better implementation of such legislation and to advise on zootechnical matters, when requested to do so.

e) To inform, with a mandatory nature, the proposals for modifications of the Official Catalogue of the Races of Ganado in Spain, carrying out the monitoring and control, according to the procedures established by the Commission itself.

(f) Propose the conduct of studies and the request for reports deemed necessary by scientific and representative entities in the field of animal, ethnozoological and genetic reproduction.

g) Analyze the proposal for the timing of the certamenes referred to in Article 33.

(h) Coordinate, know and, where appropriate, report requests for official recognition of breeders ' associations and the extinction files thereof, or propose measures or actions to ensure adequate operation of such entities, as well as to expose and analyse any type of doubt or to resolve any discrepancies that may arise in this respect.

i) To know and, where appropriate, to analyze the specific regulations of the genealogical books and the improvement programs, as well as the proposals of modification of the officially approved ones.

j) Coordinate, evaluate and report on animal reproduction, storage centres and germplasm banks, promoting cooperation between the various centres, and proposing specific actions and regulations.

k) Know, evaluate, report, and analyze the situation of performance controls.

l) Update periodically the relationship of the competent authorities referred to in Article 9.1, in view of the evolution of the distribution of the census of the various livestock breeds.

3. The National Commission shall be composed of the following members:

(a) President: the Director General of Agricultural and Livestock Resources of the Ministry of the Environment, and Rural and Marine Environment.

b) First Vice President: The Assistant Director-General for Animal Resources and Food Conservation.

c) Second Vice President: a representative of a stand-alone community.

(d) Vocals: representing the General Administration of the State, an official of the General Subdirectorate of the Conservation of Animal Resources and Resources designated by the President. Representing the Autonomous Communities, a representative of each of them who agree to be integrated into this body, appointed by the regional authority responsible for the matter.

e) Secretary: An official of the General Directorate of Agricultural Resources and Cattlemen appointed by the President, with a voice but without a vote.

In cases of vacancy, absence or illness, the President will be replaced by the First Vice President.

In addition, they will be able to attend the meetings of the National Commission, as advisers, with a voice but without a vote, those persons who, in consideration of their professional competence, are expressly called by the President to own initiative or on the proposal of any other member of the Commission.

4. The Commission shall adopt its own rules of operation and, in all cases expressly not provided for in those rules and in this Article, shall apply the provisions laid down in Chapter II of Title II of Law No 30/1992 of 26 November 1992. Legal of public administrations and of the common administrative procedure, in the field of collegiate bodies and may agree to the formation of specific working groups.

5. In any case, the National Commission will meet at least once every six months, and as many times as the situation requires, by convening its President. The Commission may set up specific work groups or committees for the study and proposal of specific questions.

Section 10. th Laboratories and genetics centers.

Article 35. National Animal Genetics Reference Center.

1. The Central Veterinary Laboratory of the Ministry of the Environment, and the Rural and Marine Environment, located in Algete, is designated as the National Center of Reference for Animal Genetics for the approval of the techniques for the analysis of genetic markers. for the identification and control of the parentage of animals and, where appropriate, the determination of genes linked to the improvement of animal production and the transmission of diseases, as well as the detection of chromosomal abnormalities of interest productive.

2. The functions of the National Reference Centre are those set out in Annex V.

Article 36. Official genetic centers of the autonomous communities.

1. The competent bodies of the autonomous communities may establish the centres of public genetics or, where appropriate, recognise those of a private nature, which are competent to carry out the analysis of genes and genetic markers with and official validity, and designate that or those centres, which may carry out, within the framework of the national programme, analyses of the genotypes of animals belonging to holdings within their scope of action.

2. The genotyping of livestock breeds, for the purposes of the national programme, may be carried out only in the National Reference Centre or in the official centres referred to in this Article.

CHAPTER III

intra-Community trade and imports from third countries

Article 37. Intra-Community trade.

For the intra-Community trade in live animals, semen, ova and embryos, and without prejudice to the Community zootechnical rules of application, included in the Directives referred to in the final provision, or of the In the case of animal health legislation in force, trade in breeding animals or their genetic material may not be prohibited, restricted or impeded. In addition, the following shall be provided for each of the following species:

1. Cattle:

(a) Without prejudice to paragraph (f), it shall not be prohibited, restricted or impeded:

1. The admission to breeding of female bovine animals of pure breed,

2. The admission to the natural covering of pure-bred bulls, and

3. The use of the ova and embryos of pure-bred female bovine animals.

(b) The official assessment of a pure-bred stallion by the use of his semen shall be conditional on a quantitative limitation of the doses to be used and the official proposal by the breeders ' associations. officially recognised. In the event that this application results in disputes, in particular with regard to the interpretation of the results of the tests, the interested parties have the right to request the opinion from an expert, in accordance with the provisions of Article 8. of Directive 77 /504/EEC.

c) The admission to the artificial insemination of pure-bred bulls or the use of their semen, when these bulls have been admitted to artificial insemination in a Member State, shall be based on the positive results and updated of the tests carried out in accordance with the applicable specific legislation.

(d) The use of pure-bred bulls and their semen referred to in paragraphs (b) and (c) shall be subject to the identification of such bulls by means of blood tests or any other appropriate method to be adopted. in accordance with the procedure laid down in Community legislation.

(e) The semen referred to in paragraphs (b) and (c), where it is the subject of an intra-Community exchange, shall be collected, processed and stored in a collection centre or, where appropriate, stored in a centre of (a) in accordance with Royal Decree No 2256/1994 of 25 November 1994 laying down the animal health requirements applicable to intra-Community trade in and imports of semen of animals of the species bovine.

(f) The competent bodies of the autonomous communities shall require that pure-bred breeding animals, as well as semen, ova and embryos thereof, be accompanied in intra-Community trade. by a genealogical certificate which complies with the requirements laid down by Community legislation.

2. Sheep and goats: Community legislation will apply.

3. Pigs:

(a) Cannot be prohibited, restricted or impeded:

1. Admission for the artificial insemination of purebred breeding males and the use of their semen, when these animals have been admitted for this purpose in another Member State, in the light of the checks carried out the performance and assessment of the genetic value of the animals, carried out in accordance with the provisions of the applicable Community legislation.

2. The admission of pure-bred breeding males for official testing and the use of their semen within the quantitative limits necessary to carry out performance control and value assessment genetic material, carried out in accordance with the provisions of the applicable Community legislation, by officially recognised associations or, where appropriate, by the official service of the competent administration.

3. The admission for breeding of breeding females of pure breed.

4. The admission for natural covering of pure-bred breeding males.

5. The use of eggs and embryos from breeding females of pure breed.

b) Where the application of points 1 and 2 of the previous paragraph gives rise to disputes, in particular with regard to the interpretation of the results of the tests, the parties concerned may request the opinion of an expert. In the light of this opinion, the Ministry of the Environment and the Rural and Marine Environment may request, through the appropriate course, the adoption of measures by the Community bodies in accordance with the provisions of Article 11 of the Directive. 88 /661/EEC.

(c) The semen referred to in points 1 and 2 (a), as well as ova and embryos, when they are to be placed on the market, shall be collected, processed and stored by the competent authority of the autonomous community or by the personnel authorized by such administration.

4. Equidae.

(a) Live animals.-Registered equidae must be accompanied, for movement, by an identification document in accordance with the model provided for in Community legislation.

When a registered equine from another European Union country is transferred to Spain, he/she must be registered in a family book of his or her managed race in Spain, except for the mutual agreement between the two officially recognised associations in question, or between the officially recognised Spanish association and the official service of the other country of the European Union.

If the statutes of the associations permit, the name of origin of the equine may be preceded or followed by another name, even on a provisional basis, provided that the name of origin is maintained in parentheses, during the life of the equine concerned, and to indicate his country of birth by means of the initials recognised in the international agreements.

(b) Intra-Community trade in semen, ova and embryos.-The semen, ova and embryos of pure-bred equidae placed on the market shall be accompanied by a zootechnical certificate of origin and identification, issued by the officially recognised association concerned, to be drawn up at least in Spanish and in the language of the country of destination, and in accordance with the model established by Community legislation.

Article 38. Imports from third countries.

1. For the importation of live animals, semen, ova and embryos from third countries, and without prejudice to the existing health legislation, the provisions of Royal Decree 52/1995 on the principles relating to zootechnical conditions shall be laid down. and genealogics applicable to the importation of third-country animals, semen, ova and embryos, which transpose Council Directive 94 /28/EC of 23 June 1994 laying down the principles relating to zootechnical conditions and genealogics applicable to the importation of animals, semen, ova and embryos from third countries and amending Directive 77 /504/EEC on animals of the bovine species of selected breed for breeding purposes. Community legislation is also applicable.

2. Without prejudice to the provisions of the preceding paragraph, for the importation and registration of equidae in the herd-book concerned, the following requirements shall be met:

a) Communication of the import to the officially recognized association for the carrying out of the genealogical book where they are to be registered.

(b) Contribution of the accompanying document provided for in the applicable European Union legislation or, where appropriate, the export certificate issued by the officially recognised association for the conduct of genealogical books to manage the herd-book of origin or, where appropriate, the corresponding official service.

c) Verification of the identity of the equine imported by the officially recognized association for the carrying of genealogical books that the family book of origin manages.

d) Compliance with the conditions for enrollment in the genealogical book of that breed.

3. The competent bodies for the external control of products of animal origin shall carry out a random check on the seminal doses from third countries and shall forward it to the National Reference Centre for Animal Reproduction and Bank of Animal Germplasm or other approved centres.

CHAPTER IV

Information and records

Article 39. Interadministrative information.

The autonomous communities will refer to the Ministry of the Environment, and the Rural and Marine Environment, the following information, for incorporation into the National Information System and, if necessary, to communicate to the Ministry of the Environment. European Commission:

(a) The list of breeders ' associations of livestock breeds which have officially recognised for the conduct of the herd-book and, where appropriate, the resolutions of dismissal or extinction of such breeding recognition, as regulated in this royal decree, as well as the appointments of inspectors of race or other means that they have determined for the technical control of the races.

b) The specific regulations of genealogical books and approved improvement programs.

(c) The listing of reproduction centres, storage centres, germplasm banks, embryo collection and/or production equipment and approved centres or their modifications.

Article 40. Advertising.

By resolution of the Director General of Agricultural and Livestock Resources, which will be published in the Official Gazette of the State, publicity will be given to the official recognition of the associations for the management or the conduct of the books State-level genealogics, as well as the approval of the specific rules of the herd-book, and of the improvement programme for each official recognition within its scope and, where appropriate, its amendments and adaptations, applicable to the respective race and entity, with a view to their due knowledge by the breeders, owners and other stakeholders.

Article 41. Entity Registration.

1. The Ministry of the Environment, and the Rural and Marine Environment will have a general, public and informative register of the breeders ' associations, and, where appropriate, official services, where all those who have obtained the official recognition in accordance with the provisions of this royal decree, or prior to it, both by the Ministry itself, and by the Autonomous Communities.

2. The constitution and operation of the same will be attended with the personal and material resources of the Ministry of the Environment, and the Rural and Marine Environment.

Additional disposition first. Implementation of Directive 2006 /123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market.

The competent authorities shall take the necessary measures to ensure the implementation of Directive 2006 /123/EC of the European Parliament and of the Council of 12 December 2006 on services in the market within the scope of this royal decree.

First transient disposition. Adaptation to this legislation.

1. The associations officially recognized under the regulations in force before the entry into force of this royal decree that do not meet all the requirements laid down in it, except those laid down in Article 10, for the case of associations, they shall have a maximum period of three years in order to prove their compliance. In the event that such accreditation does not occur, the official recognition shall be extinguished, subject to a file being processed by the competent authority which granted the recognition, with a hearing of the association concerned.

2. By way of derogation from the single derogation provision, the specific rules of the herd-book of each breed, as set out in that provision, and the improvement programmes, shall remain in force until, by the competent authority, approve the relevant specific regulations and programmes, in application of this royal decree.

Second transient disposition. Laboratories and centers of genetics.

Animal genetics centers will have two years to meet the requirements of this royal decree, to be counted from its entry into force.

Single repeal provision. Regulatory repeal.

Without prejudice to the provisions of the first transitional provision, any rules of equal or lower rank shall be repealed as provided for in this royal decree, and specifically the following:

1. Decree 733/1973 of 29 March (Agriculture) approving the rules governing the breeding books and checking of livestock yields.

2. Royal Decree 420/1987 of 20 February on the selection and reproduction of bovine animals of pure breeds.

3. Royal Decree 723/1990 of 8 June 1990 on the selection and reproduction of pigs of pure breeds.

4. Royal Decree 286/1991 of 8 March 1991 on the selection and reproduction of sheep and goats of pure breeds.

5. Royal Decree 1682/1997 of 7 November, for which the Official Catalogue of the Cattle Races of Spain is updated.

6. Royal Decree 1866/1998 of 28 August, recognizing the Animal Reproduction and Selection Center of Colmenar Viejo, of the Autonomous Community of Madrid, as the Reference Center for Reproduction and the Bank of Animal Germplasm.

7. Royal Decree 662/2007 of 25 May 2007 on the selection and reproduction of equine animals of pure breeds.

8. Order of 30 May 1981 laying down the technical conditions for the importation of animal genetic material.

9. Order of 30 September 1982 to update the application of grants to the collaborating entities of the genealogical books.

10. Order of 25 April 1985 approving the rules governing the herd-book and checking of cattle yields of the Asturian breed of the valleys.

By this royal decree the rules for which they have been incorporated into the national legal order are replaced by Council Directive 77 /504/EEC of 25 July 1977 on animals of the bovine species selected for reproduction, Council Directive 88 /661/EEC of 19 December 1988 on the zootechnical rules applicable to breeding animals of the porcine species, Council Directive 89 /361/EEC of 30 May 1989 on animals pure-bred breeding animals of the ovine and caprine species, Council Directive 87 /328/EEC, of the 18 June 1987 on the admission of pure-bred breeding animals of the bovine species to the breeding of bovine animals, Council Directive 90 /118/EEC of 5 March 1990 on the admission of pure-bred breeding pigs for breeding purposes; and Council Directive 90 /427/EEC of 26 June 1990 on the zootechnical and genealogical conditions governing intra-Community trade in equidae.

Final disposition second. Amendment of Royal Decree 391/1992 of 21 April 1992 regulating the official recognition of breeders ' organisations or associations of breed animals which carry or create herd-books.

Article 1 of Royal Decree 391/1992 of 21 April 1992 governing the official recognition of breeders ' organizations or associations of breed animals which carry or create genealogical books, is hereby amended as follows: follows:

" For the purposes of this royal decree, any breeding animal referred to in Annex II to the Treaty establishing the European Economic Community, whose trade has not yet been the subject of a regulation, shall be understood as more specific zootechnical Community and does not belong to any breed referred to in the Official Catalogue of Cattle Traces of Spain, nor is it registered, and which is registered or registered in a genealogical book or register carried by a officially recognised breeders 'organisation or association.'

Final disposition third. Amendment of Royal Decree 558/2001 of 25 May 2001 regulating the official recognition of pure breed dog breeders ' organisations or associations.

The reference made in the final provision (Faculty of Development) of Royal Decree 558/2001 of 25 May 2001 on the official recognition of the organisations or associations of breed dog breeders pure, to the Committee of the Races of Ganado of Spain, established by Royal Decree 1682/1997, by which the Official Catalogue of the Races of Ganado of Spain is updated, will be understood to be done to the National Commission of Coordination, regulated in article 34 of this royal decree.

Final disposition fourth. Competence title.

This royal decree constitutes basic rules, except for Articles 26, 40 and 41, and is issued under the provisions of Article 149.1.13. of the Constitution, which gives the State exclusive competence in the field of bases and coordination of the overall planning of economic activity.

Furthermore, Article 38, which is issued pursuant to Articles 149.1.10. and 16. of the Constitution, for which exclusive competence in the field of trade is conferred on the State, is also exempted from the basic regulation. external health and external health, respectively.

Final disposition fifth. Development and application faculty.

The Minister of the Environment, and the Rural and Marine Environment are empowered to modify the contents of the annexes of this royal decree, for adaptation to the Community or international regulations, as well as to modify, prior to the the National Coordination Commission, the Official Catalogue of Gearn Races as provided for in Annex I.

Final disposition sixth. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".

Specific content of improvement programs

1. Selection program.

a) Defining the selection objectives and specific selection criteria to be taken into account, with description of the desirable characters as to:

1. º Heedability and Reliability.

2. The associated Economic Value.

3. Effective control capability.

4. º Non-incompatibility with other equally important characters.

b) Detailed description of each stage of the program.

(c) The obligations and, where appropriate, the rights, of the breeders of the collaborating holdings to participate in the selection programme, in particular as regards the use of the breeding animals of the with the recommendation of the program itself, in order to facilitate the connections between different ganaderies to carry out the genetic evaluation and the diffusion of the improvement.

(d) The conditions for the participation of the animals in the assessment tests and assessment centres.

e) The guidelines and methods used for the control of yields and the methods of assessment used (ascending, individual, descendant and collateral) for the genetic evaluation of the players, including the method statistical analysis and the parameters used by the qualified gene centre to endorse the programme.

(f) The actions to be carried out and timetables to achieve the intended objectives, both in the collaborating farms and in the breeding centres, storage centres, testing centres and germplasm banks, including directed mating, the use of artificial insemination or other assisted reproduction techniques and the type of genetic material to be used.

g) In the absence of specific legislation, selection programmes may include:

1. Incorporation to criteria selection goals such as:

I. Product quality.

II. Production efficiency.

III. Bookmarks associated with characters of productive interest.

IV. Increase of genotypes resistant to certain diseases.

V. Detection of genetic or chromosomal alterations and strategies to prevent, control or eradicate their incidence.

2. The carrying out of technical studies to include in the genetic evaluations, where appropriate, the economic value of the different production parameters that are the object of performance control.

2. Conservation program.

a) Documentation demonstrating the presence in the programme of the social, economic and environmental implications of the race in question, in line with the principles that sustainable development requires.

b) Defining conservation objectives and criteria.

(c) The obligations and, where appropriate, the rights, of the breeders of the collaborating holdings to participate in the conservation programme.

d) Description of the conservation method, by means of one or more of the following mechanisms:

1. Conservation on farms and in the natural environment of animals (in situ conservation).

2. Conservation of genetic material by cryopreservation (semen, ova, embryos, somatic cells, DNA) in breeding or storage centers and germplasm (ex situ conservation) banks, providing for a copy of safety, which would be sent to the National Reference Centre for Animal Reproduction and Animal Germplasm Bank.

3. Conservation ex situ in vivo: maintenance of live animals outside their habitat.

4. On the basis of the race situation a phase of characterization of the race will be necessary in its genetic, morphological, productive and/or functional aspects.

e) Forecasts about the genetic material to be used.

ANNEX III

Meat performance control

1. Control of meat yield on farms. -It may have different objectives according to the phase of the improvement program in which it is carried out, although two fundamental ones, that carry out some control parameters:

a) Checking the yields of all animals to genetically value the players for their offspring and collateral.

1. Number of numerical productivity based on the control of the profficiity.

2. Individual Productivity based on the control of weights and growths of each individual.

b) Checking the individual performance of the animals candidates for future stallions resulting from the targeted mating. The mandatory parameters according to the specific regulations and those that collect the corresponding improvement program will be checked.

2. Control of carnal performance in the assessment or testing centres.-A protocol to be submitted for approval as part of the improvement programme shall be submitted at least:

a) Conditions of admission to the center.

(b) zootechnical, health and age requirements for the admission of animals.

c) Where appropriate, performance on the holding of the animals tested before their entry into the centre.

d) Identity of the owner of each of the analyzed animals.

e) Maximum age of the tested animals entering the centre and range of ages of the animals already in the centre.

f) Characteristics of the tests, schedule, and controlled parameters.

g) Duration of the adaptation period and, specifically, the test.

h) The handling and power system.

3. Control in processing centres, slaughterhouses or cutting rooms to consider the meat characteristics to be taken into account.

ANNEX IV

National Reference Center for Animal Reproduction and Animal Germplasm Bank

1. The Centre shall have at least the following facilities:

a) Laboratory adequately equipped to carry out the analysis and contrast of the genetic material, as well as for the study of its viability.

(b) Facilities for the storage of genetic material (semen, ova, embryos, somatic cells or DNA), with sufficient tanks available for different breeds, species and sanitary conditions.

c) Computer equipment for the processing of information.

d) Infrastructure required to obtain genetic material outside the facility of the Center.

2. The functions entrusted to the National Reference Centre for Animal Reproduction and Animal Germplasm Bank are:

a) Custody of the genetic material owned by the Bank of Animal Germplasm, transmitted by the various bodies involved.

(b) Obtaining, transporting, storing and using the genetic material obtained outside the facility of the Centre, coordinating with the competent authorities.

c) Support and collaboration in improvement programs.

d) Management of information on the marketing of genetic material, linked to the analytical results performed on it.

e) Analysis of samples of genetic material that are referred to you.

f) Realization of comparative tests with other approved laboratories and proposal for approval guidelines for techniques at national level.

g) Organization of meetings with other authorized laboratories to homogenize analytical methods.

ANNEX V

National Animal Genetic Reference Center

The functions of the National Reference Center are as follows:

1. Coordinate the necessary actions with the laboratories of all the Public Administrations, or authorized private ones, in order to ensure that the laboratory techniques are homogeneous in all of them and to approve the use of the methods to use it.

2. To establish the necessary collaboration with the research centres, both public and private, be autonomous, national, community, third-country or international organizations, when these centers work on issues related to the functions of the National Reference Centre.

3. Transfer to the official centres of the Autonomous Communities and the General Administration of the State the information and new techniques developed by the European Union reference centres.

4. Carry out the tests or tests which, for the purposes of the purposes or for other purposes, are requested.

5. Confirm the result obtained by the approved official or private institutions of the Autonomous Communities, when this is not final.

6. Organise comparative tests and collaborative trials with the official or private centres approved by the Autonomous Communities.

7. To intervene in the tests that are carried out at international level in order to internationally approve the methods to be used.

8. Send to the National Reference Center for Animal Reproduction and Animal Germplasm the samples of genetic material that for their special interest are susceptible to conservation.
