Key Benefits:
The Royal Decree 1599/1997 of 17 October, which regulates cosmetic products, has brought into force all the legislation in force in this field and incorporated into the Spanish legal order Council Directive 76 /768/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to cosmetic products and their subsequent amendments.
This royal decree, in order to incorporate the new Community directives, has subsequently been amended by Royal Decree 2131/2004 of 29 October, and Royal Decree 209/2005 of 25 February and successive orders have also amended its Annexes.
Commission Directive 2008 /88/EC of 23 September 2008 amending Council Directive 76 /768/EEC on cosmetic products for the adaptation of Annexes II and III to technical progress is transposed into the internal legal order through the approval of this provision, which introduces further changes to the Annexes to Royal Decree 1599/1997 of 17 October.
This order is issued in accordance with the provisions of the final provision of Royal Decree 1599/1997 of 17 October 1997.

Article two. Time limit for sale or disposal
From October 14, 2009, cosmetic products that do not comply with the requirements of Article 1 cannot be sold or transferred to the final consumer.
Final disposition first. Incorporation of European Union law.
By this order, Commission Directive 2008 /88/EC of 23 September 2008 amending Council Directive 76 /768/EEC on cosmetic products to adapt to the internal legal order is incorporated into national law. its Annexes II and III to technical progress.
Final disposition second. Entry into force.
This order shall enter into force on the day following that of its publication in the Official Gazette of the State.
