Key Benefits:
Law 17/2007 of 4 July amended Law 54/1997 of 27 November of the Electrical Sector to bring it into line with the provisions of Directive 2003 /54/EC of 26 June 2003 of the European Parliament and of the Council on rules common to the internal market in electricity and repealing Directive 96 /92/EC.
Article 17.1 of the Law 54/1997, of 27 November, of the Electricity Sector, states that the Minister of Industry, Tourism and Trade, after the Agreement of the Government Delegation for Economic Affairs, will dictate the provisions necessary for the establishment of tolls for access to networks, which shall be established on the basis of the costs of the regulated activities of the system concerned, including the permanent costs and costs of diversification and security of supply.
The second transitional provision of Law 17/2007, of July 4, determines that the Minister of Industry, Tourism and Trade will establish the mechanism for the transfer of customers from the system to the tariff system of the last tariff the appropriate resource.
Thus, in Royal Decree 485/2009 of April 3, the implementation of the supply of last resort in the electricity sector is regulated. Article 7 of the same royal decree lays down the methodology for calculating and reviewing the rates of last resort, in which the Minister for Industry, Tourism and Trade will make the necessary arrangements for the establishment of these last resort tariffs by determining their structure in a manner consistent with the access tolls. For these purposes, the Minister of Industry, Tourism and Trade may review the structure of the low voltage access tolls to adapt them to the last resort rates and ensure their additivity. It is also established that the Minister for Industry, Tourism and Trade may review access charges for the maximum rate of access to the last resort.
Royal Decree-Law 6/2009 of 30 April 2009 adopting certain measures in the energy sector and approving the social bond amends, in Article 1, the additional twenty-first provision of Law 54/1997, of 27 In November, the Electricity Sector, in such a way that from 1 January 2013, the access tolls will be sufficient to satisfy all the costs of the regulated activities without the possibility of appearing ex ante deficit, regulating the period Until that date, the deficit of income in the liquidations of the activities is limited In the case of the electricity sector, the electricity sector has been regulated in the electricity sector, providing for the ceding of the deficit recovery rights to the Electricity System Deficit. Furthermore, the first provision and the first transitional provision respectively set out the system of financing for the extraction of generation in the island and extra-island regime and the transitional mechanism for financing the deficit.
In this order, the provisions of Article 7 of Royal Decree 485/2009 of 3 April 2009 are developed, taking into account the provisions of Order ITC/1659/2009 of 22 June, in which access tolls are refers.
Royal Decree 2819/1998 of 23 December 1998 regulating the activities of transport and distribution of electricity and Royal Decree 325/2008 of 29 February establishing the remuneration of the activity of the European Union for the transport of electrical energy for installations put into service as from 1 January 2008, define the elements which make up the transport networks and develop the remuneration system applicable to them by establishing the methodology for the calculation and review of the remuneration of the electric energy transport activity.
For its part, Royal Decree 222/2008 of 15 February establishing the remuneration scheme for the activity of the distribution of electrical energy determines the method of calculation and the revision of the remuneration of the activity.
On 3 December 2009, the Board of Directors of the National Energy Commission, in relation to the remuneration of the electricity distribution activity, has approved the following reports: Proposal for a definitive remuneration for 2009 and provisional remuneration for 2010 of the electricity distribution activity of the distribution companies subject to liquidations prior to 1 January 2009; and Report and proposal for remuneration of the distribution activity for 2010. Distributors with fewer than 100,000 customers.
Royal Decree 1955/2000 of 1 December 2000 regulating the activities of transport, distribution, marketing, supply and authorisation procedures of electrical energy installations, establishes in its Article 44 the concept of the right of access. Subsequently, with the approval of Royal Decree 222/2008 of 15 February laying down the remuneration scheme for the distribution of electricity, the provisions of Articles 9 and 10 of the Regulation on the rules governing the rights of connection. The most significant changes which directly involve a modification of the scales are the application of the rights of the affected under stress (in which cases it applies) from 50 kW to 100 kW and the definition of rights. (a) the supervision of transferred facilities which are included within the rights of the affected persons. The latter will be satisfied by those applicants who perform the direct execution and subsequent disposal of the facilities.
Also, according to Article 10 of Royal Decree 222/2008 of 15 February, it is stated that the economic regime of the rights of the affected and other actions necessary to meet the requirements of supply of the users will be established by ministerial order, prior to the report of the National Energy Commission and prior agreement of the Government Delegation for Economic Affairs by the application of a power scale and level of tension in euros kW of requested power in extension and contracted in access. This report (Report 9/2009) has already been issued by the National Energy Commission.
Therefore, by this order, the costs are revised and the rates of access to the electricity transmission and distribution networks that the companies apply from 1 January 2010 and are fixed are adjusted. amounts to be met by the rights of the undertaking comprising the rights of extension, the access rights and the supervision rights of the facilities transferred and the amounts to be met by the rights of connection, verification and actions in the measurement and control teams.
On the other hand, according to the provisions of Article 44.1 and the second transitional provision of Royal Decree 661/2007 of 25 May 2007, which regulates the activity of energy production under special conditions, it is necessary to to quarterly updates for the fourth quarter of 2009 and the first quarter of 2010, of the tariffs and premiums for sub-group installations a.1.1 and a.1.2 (co-generations using natural gas, diesel, fuel-oil or LPG) of the group c.2 (waste facilities) and those covered by the second transitional provision of the said royal decree (cogeneration facilities for the treatment and reduction of waste).
The annual updates of the remaining facilities of category a) and c) and of the facilities of category b) are to be carried out in accordance with Article 44.1, as well as of the facilities covered by the Additional provision 6 (installed power plants greater than 50 MW and not more than 100 MW) and the transitional provision (installations using cogeneration for the drying of by-products of the production of oil) (olive) of that Royal Decree 661/2007 of 25 May 2007.
Similarly, the methodology for updating the remuneration values for natural gas cogeneration installations, as set out in Annex VII to Royal Decree 661/2007 of 25 May 2007, is amended as follows: replace it with the methodology for calculating the rate of last natural gas resource, eliminating the term corresponding to the weight of the winter gas supply cost, much more transparent than the previous one, based on the the result of the auction of the basic gas held annually and in the prices of the price of Brent international markets.
Finally, the Order ITC/1659/2009 of 22 June is amended so that in the calculation of the estimated cost of energy in the daily market corresponding to the rate of last resort without any time discrimination is considered only the consumption profile corresponding to this category of consumers, since at the present time the calculation takes into account the profile of the rates with time discrimination for what is distorted when considering values which refer to how to consume different types of clients.
On 17 December 2009, this order has been the subject of a report by the National Energy Commission, a report for which the arguments put forward have been taken into account in the process of hearing of the Electricity Advisory Board.
By agreement of 23 December 2009, the Government Delegation for Economic Affairs has authorised the Minister of Industry, Tourism and Trade to issue this order.

Article 1. Forecast transport costs for 2010.
In accordance with the provisions of Royal Decree 325/2008 of 29 February establishing the remuneration of the activity of transport of electrical energy for installations put into service as from 1 January 2008 and Royal Decree 2819/1998 of 23 December 1998 on the transport and distribution activities of electricity, is hereby established as a forecast of the remuneration of the transport activity as from 1 January 2010, the figure in the attached table:

Article 2. Forecast of distribution and commercial management costs for 2010.
1. The provisional costs for 2009 for the distribution companies with more than 100,000 customers and FEVASA and SOLANAR, deducted the other income derived from the rights of connection, hooks, verification and rental of measure, they have been calculated by applying the fourth transitional provision of Royal Decree 222/2008 of 15 February. These costs shall not be final until the validation of the Reference Network Model referred to in Article 8 of Royal Decree 222/2008 of 15 February establishing the remuneration scheme for the distribution activity of electric power, for the calculation of Y2008. According to the above the provisional costs for 2009 result:

This cost estimate has been calculated by applying the Reference Network Model referred to in Article 8 of Royal Decree 222/2008 of 15 February establishing the remuneration scheme for the activity for the distribution of electrical energy, for the calculation of the Y2009. As a result of the integration of the distribution companies Saltos del Nansa, S.L., and Electra Camijanes, S.L., in E. On Distribution, S.L., and once the report has been viewed by the National Energy Commission, the Saltos del Nansa, S.L., and Electra Camijanes, S.L., which amounts to EUR 92,548, corresponding to 2010, is added to the remuneration corresponding to E. ON Distribution, S.L., for the year 2010.
3. For distributors with less than 100,000 customers, the expected cost of the remuneration of the distribution and commercial management activity in compliance with the provisions of Article 8 (1) of Royal Decree 222/2008, EUR 350,541,941 for the year 2010 shall be EUR 350,541,941 for the purpose of establishing the remuneration scheme for the electricity distribution activity, in accordance with the breakdown set out in Annex VI.
4. At these distribution costs, 10,000 thousand euros will be incorporated as costs for plans to clean up the vegetation of the margins where the electrical lines of distribution, referred to by the Article 10 of this order.
5. The costs recognised from 1 January 2010 for the remuneration of the commercial management carried out by the distribution companies with more than 100,000 customers and FEVASA and SOLANAR, amount to EUR 226,591 thousand, broken down by distribution companies as set out in the attached table:

Article 3. Income mismatch annuities for 2010.
1. Under the terms of the additional twenty-first provision of Law 54/1997 of 27 November 1997, of the Electricity Sector and without prejudice to the annuities corresponding to the payment entitlements of the pending electricity system at the entry into force of this order, the amounts intended to satisfy those duties are as follows:

For the purposes of its settlement and recovery, these costs shall be considered as costs of the regulated activities.
2. In accordance with the provisions of paragraph 2 of the additional twenty-first provision of Law 54/1997 of 27 November 1997 on the Electricity Sector, a revenue shortfall is provided for in the liquidations of regulated activities in the sector from 1 January until 31 December 2010, both inclusive, amounting to EUR 3 billion.
Article 4. Forecast of the costs of the Feasibility Plan of Elcogas, S.A.
According to the provisions of paragraph 1 of the additional 20th of Law 54/1997, of 27 November, of the Electrical Sector, it is provisionally foreseen for the calculation of the 2010 access tolls a cost of 66,919 thousand euros, in concept of viability plan for Elcogas, S.A. This amount is provisional and conditional upon its approval by the European Commission. The Directorate-General for Energy Policy and Mines, after reporting by the National Energy Commission, shall, if necessary, approve the final amount corresponding to that year.
For the purposes of its settlement and recovery, these costs shall be considered an income of the regulated activities.
Article 5. Forecast of the service costs of the management of the interruptibility demand for 2010.
A consignment of 450,000 thousand euros is provided for the service of management of the demand for interruptibility for consumers who acquire their energy in the production market regulated in Order ITC/2370/2007, of 26 of The Commission also took the view that

2. The percentages to be allocated to costs with specific destinations as set out in the preceding paragraphs may be updated throughout 2010 at the time the last resort fee is reviewed.
3. Without prejudice to the provisions of the preceding paragraph, the remuneration of the System Operator for the year 2010 shall be EUR 38,267 thousand. The National Energy Commission shall include in settlement 14 of 2010 the positive or negative differences between the amounts received by the System Operator for the application of the quotas set out in paragraph 1 and the quantities cited.
4. The island and extra-island compensation planned for 2010 amounts to 1,359,460 thousand euros. 34% of this amount, EUR 462,220 thousand, will be financed from the general budget of the State and the remaining 66%, EUR 897,240 thousand, from the access charges through the corresponding percentage to which the paragraph 1.
The National Energy Commission shall include in settlement 14 of 2010 the positive or negative difference between the amounts received for the application of the quota set out in paragraph 1 and the amount of the compensation The island and the extra-island will be provided with access fees for 2010. In any event, the deviations from the island and extra-island compensation that occur between the total amount provided for in the preceding paragraph and the final amount to be approved in accordance with Article 18 of the Royal Decree 1747/2003, of December 19, which regulates the island and extra-island electrical systems, will be included in charge of the access fees and will have the consideration of permanent costs of the system, according to the Royal Decree-Law 6/2009, 30 April.
Article 7. Review of the remuneration of the Spanish Energy Market Operator, Polo Español for 2010.
1. In accordance with the provisions of Article 16.9 of the Law of the Electrical Sector, and in the fourth provision of Royal Decree 485/2009 of 3 April 2009, the amount established for the remuneration of the Operator of the Iberian Energy Market, Polo Spanish, S.A. corresponding to the year 2010 will be 12,140 thousand euros and will be financed from the prices that copper to the market generators, both the ordinary regime and the special regime, that act in the field of the Iberian Market of the Electricity.
The difference, positive or negative, that occurs between the amount resulting from the collection of the generating subjects and the one set out in the preceding paragraph shall be considered as income or liquidable cost, and shall be included in the settlement process of the National Energy Commission, in the settlement to be carried out in the month of March 2011.
2. The market-generating subjects of both the ordinary and special arrangements operating in the field of the Iberian Electricity Market shall pay the Market Operator for each of the net power plants or installed in the market. the case of the special scheme exceeding 1MW a fixed monthly amount of EUR 15,30/MW of available power. Payments shall be made on a monthly basis from 1 January 2010. This amount may be reviewed throughout 2010 at the time the last resort fee is reviewed to bring it into line with the remuneration set out in paragraph 1.
For the calculation of the power available in 2010 it shall apply to the net power or installed in the case of the special scheme of each installation the value of the coefficient of availability applicable to the scheme and technology corresponds, as set out in the following table:

3. For subjects who sell and buy energy on the market, the market operator may, in whole or in part, make up for the monthly payment of the month to be paid by such persons or their representatives with the charges from the market not earlier of the first day of collection after the third working day of the month n + 1. To this end, the subjects or their representatives shall send to the Market Operator the data necessary for the billing, relating to the facilities of which they hold the ownership or to those they represent.
4. The market operator and the subjects referred to in paragraph 1, by mutual agreement, may establish a billing period other than the monthly one.
Article 8. Revision of regulated rates and prices.
1. The rates of access to the transport and distribution networks defined in Royal Decree 1164/2001 of 26 October 2001 establishing tariffs for access to electricity transmission and distribution networks and in Article 20 of the Treaty Order ITC/1659/2009 of 22 June establishing the mechanism for the transfer of customers from the market at tariff to the supply of the last electricity resource and the procedure for the calculation and structure of the tariffs for the last resort Electricity, as from 1 January 2010, are those set out in Annex I of this order, which are detailed in the basic rates to be applied with the prices of their terms of power and energy, active and reactive, in each tariff period.
2. In accordance with the provisions of Article 44.1 and the second transitional provision of Royal Decree 661/2007 of 25 May 2007, which regulates the activity of the production of electrical energy under special arrangements, the following updates are to be made: quarterly for the fourth quarter of 2009 and the first quarter of 2010, of the tariffs and premiums, of the facilities of the sub-groups a.1.1 and a.1.2 of the group c.2 and of the facilities under the second transitional provision. The tariffs and premiums set out in Annex II to this order are set out in Annex II for the above two quarters.
The quarterly changes in the benchmark indices used for the update have been an increase of 138.6 basis points for the CPI as of October 1 and a decrease of 74.2 basis points from the previous year. On January 1, a total of 19.438 percent for the price of natural gas and an increase of 26.476 percent for the price of diesel, LPG and fuel oil as of October 1, and an additional increase of 8,342 percent and a year-on-year increase of 8.342 percent. 13,430 percent respectively from January 1.
3. In accordance with the provisions of Article 44.1 and the transitional provision of Royal Decree 661/2007 of 25 May 2007, which regulates the activity of the production of electrical energy in a special scheme, the updating of the the annual rates, premiums and, where applicable, upper and lower limits, for their implementation from 1 January 2010, from the premises of the sub-groups a.1.3 and a.1.4 of the group a.2, from the facilities of category b), of the the transitional provision of the 10th and the installations of groups c.1, c.3 and c.4. In Annex III to this order, the tariffs, premiums and, where applicable, upper and lower limits, which are fixed for the said installations, are set out in Annex III.
Annual variations of the benchmark indices used have been, a CPI decrease of 66.1 basis points and a coal price decrease of 16.01 percent.
4. In accordance with the provisions of paragraph 2 of the additional provision, sixth of Royal Decree 661/2007 of 25 May 2007, the annual update of the premium for installed power plants of greater than 50 MW and not exceeding 100 MW is to be carried out. under paragraph 2 of that additional provision, taking as a reference the increase in the CPI, which is fixed at EUR 2,5189 /kWh, for its implementation as from 1 January 2010.
Likewise, in accordance with the provisions of paragraph 3 of the sixth provision of the aforementioned royal decree, the annual update of the premium of installed power plants of greater than 50 MW and not higher is carried out. 100 MW covered by paragraph 3 of the said additional provision, with the same increase as those applicable to the installations of category a.1.1, and shall be fixed at 2,4884 c€/kWh for its application as from 1 January 2010.
5. The value of the complement for reactive energy is revised, being fixed at 8,2954 c€/kWh, for application as from 1 January 2010, in the terms set out in Article 29.1 of Royal Decree 661/2007, of 25 May.
Also, according to the provisions of the additional seventh provision of the aforementioned royal decree, the value of the complement for continuity of supply is revised in front of voltage gaps, being fixed at 0.4020 c€/kWh, for its application from 1 January 2010.
6. The coefficients for the calculation of transport and distribution losses, homogeneous for each supply and/or access tariff, to transfer the energy supplied to consumers at the rate of last resort and to consumers on the market In the case of their energy meters supplied in central bars, for the purposes of the liquidations provided for in Royal Decree 2017/1997 of 26 December and in Royal Decree 2019/1997 of 26 December 2010, they are those contained in Annex IV to the this order.
Article 9. Quantities to be met by the rights of connection, coupling and verification and actions in the measurement and control equipment.
The amounts to be met by the rights of the undertaking comprising the rights of extension, the rights of access and the rights of supervision of facilities transferred and the amounts to be met by rights of engagement, verification and action in the measuring and control equipment defined in Articles 44 and 50 of Royal Decree 1955/2000 of 1 December 2000 governing the transport, distribution, marketing, supply and procedures for the authorisation of electrical energy installations and in Article 10 of the Royal Decree 222/2008, for which the remuneration scheme for the electrical energy distribution activity is established, for new installations shall be fixed in the amounts set out in Annex V to this order.
Article 10. Plans to clean up the vegetation of the margins where distribution power lines run.
According to Article 48.2 of Law 54/1997 of 27 November of the Electrical Sector, and its implementing rules, it is included in this order, within the recognised costs for the remuneration of the distribution, a This item specifies that it will not be able to exceed 10,000 thousand euros in order to carry out plans to clean the vegetation of the margins where distribution power lines run.
This amount will be distributed among the companies distributing by the Ministry of Energy of the Ministry of Industry, Tourism and Commerce with objective character and will be liquidated after verification of the realization of the plans for each company.
The National Energy Commission will open a deposit account for these purposes and will communicate it by means of a circular published in the "Official State Gazette", where it will enter into each settlement the part that will for this purpose. This account shall be wound up to the distribution companies after authorization from the Directorate-General for Energy Policy and Mines after the plans have been made.
Article 11. Energy saving and efficiency strategy in Spain 2004-2012: Action Plan 2008-2012.
The amount charged to the electricity tariff for the financing of the 2008-2012 Action Plan, approved by the Council of Ministers Agreement of 8 July 2005, which sets out the measures of the "Strategy for Action" savings and energy efficiency in Spain 2004-2012 " approved by the Council of Ministers Agreement of 28 November 2003, will not exceed for the year 2010 of 308,900 thousand euros. This amount shall be distributed by the Ministry of Industry, Tourism and Trade with an objective character in accordance with that plan and shall be cleared after verification of the achievement of the intended objectives.
The National Energy Commission will open a deposit account for these purposes and will communicate it by means of a circular published in the "Official State Gazette", where it will enter into each settlement the part that will corresponds to this purpose.
Additional disposition first. Closure of surplus balances of certain accounts opened in deposit by the National Energy Commission.
1. The balances of the deposit account opened by the National Energy Commission for the incentive of indigenous coal consumption in the years 2007 and 2008 will be incorporated as revenue from regulated activities. corresponding to the year 2009 and will therefore reduce the revenue shortfall of that year.
2. The balances of the deposit account opened by the National Energy Commission for the return of CO2 rights for the years 2007 and 2009 shall be incorporated as revenue from regulated activities for the year 2009 and therefore reduce the revenue shortfall of that year.
3. It will have exceptional event consideration that authorized as such by the Directorate General of Energy and Mines Policy, which has natural causes and that happens with a general character in at least 10 percent of the municipalities of the peninsula or in at least 50% of the municipalities of each of the island and extra-island systems and which, in accordance with the technical regulations applicable to the facilities, are not intended for the design of the same.
The affected distribution companies will be able to request the General Direction of Energy Policy and Mines to consider an event as an exceptional event, for which they will have to provide at least the documentation that justifies which municipalities have been affected and the technical reports reflecting the exceptionality of the event. The Directorate-General for Energy Policy and Mines will resolve the request, after the National Energy Commission has submitted an explicit indication of the municipalities and the period that are excluded for the purpose of calculating the quality indices.
Additional provision fifth. Substitution of the variable of the unit cost of the natural gas raw material for the calculation of the efficiency supplement as set out in Article 28 of Royal Decree 661/2007 of 25 May 2007.

The values of Cn will be published by resolution of the Secretary of State of Energy, in the "Official State Gazette", during the first month of the calendar quarter in which it will be applicable.
Additional provision sixth. Values of the C variablen for the purposes of the calculation of the efficiency supplement as set out in Article 28 of Royal Decree 661/2007 of 25 May 2007.
For the purposes of the calculation of the efficiency supplement set out in Article 28.1 of Royal Decree 661/2007 of 25 May 2007, in its wording given by the additional sixth provision of this order, it will be taken, as of 1 July 2008 through June 30, 2009, as the value of βSB, zero, so the values of the Cn in the period from July 1, 2008 to December 31, 2009 will be as follows:

The value of the variable CbmpGN, the base cost of the raw material of the natural gas used for the updating of the tariffs and premiums of the facilities of sub-group a.1.1 of Article 2, of the additional provision sixth and of the Second transitional arrangement which they use as natural gas fuel, from Royal Decree 661/2007 of 25 May 2007 shall be EUR 2,0727 c€/kWh PCS, in the fourth quarter of 2009.

2. The remuneration to be paid by the companies referred to in the preceding paragraph for the year 2009 shall be the proportional share established from their final registration in the Administrative Registry of Distributors, Traders and Direct Consumers. in Mercado del Ministerio de Industria, Turismo y Comercio.
Additional provision ninth. Electricity supply price comparison system.
1. The National Energy Commission will manage a system of comparison of electricity supply prices on the basis of offers which, for collectives or consumer groups, will be carried out by the marketing companies. Such a system will be accessible to consumers via the Internet.
2. In order to articulate the operation of the price comparison system, the marketing companies will have to submit to the National Energy Commission the information on the abovementioned offers and the modifications to them, according to the with the standard model to be approved by the National Energy Commission, and which must be available on its website. The referral of the information to the National Energy Commission shall be made at least ten days in advance of the date of effectiveness or publication of the relevant tender. The National Energy Commission shall ensure the confidentiality of that information until its public release.
3. The National Energy Commission shall draw up a report to the Directorate-General for Energy Policy and Mines where the comparison and evolution of electricity supply prices shall be carried out on the basis of the tenders which, for collective or consumer groups, make the marketing companies.
Additional provision 10th. Mandate to the National Energy Commission.
The National Energy Commission shall forward to the Secretary of State Energy the results of the implementation of the Reference Network Model referred to in Article 8 of Royal Decree 222/2008 of 15 February, establishing the remuneration scheme for the electricity distribution activity for the year 2009 and following, once validated and contrasted with the distribution power companies, as set out in the aforementioned Royal Decree.
First transient disposition. Using consumer profiles.
Those supplies that since the entry into force of Royal Decree 1110/2007, of 24 August, approving the unified regulation of points of measurement of the electrical system, have changed their classification of type of point of Measure 4 to be of a type 3 measure of measure 3, and which do not have a time-consuming recording, may use consumption profiles for the clearance of energy up to the time when the measuring equipment is replaced to adapt it to the requirements of Royal Decree 1110/2007 of 24 August 2007.
Second transient disposition. Transitional period for the application of the rights of connection, engagement and verification.
The amounts set out in Article 9 of this order for the various rights of connection, coupling and verification and actions in the measurement and control equipment shall not apply, for a period of six months, to applications made prior to the entry into force of this order, to whom they shall apply the rights in force until the entry into force of this order, except as regards extension rights and access rights of low voltage requests between 50 and 100 kW power.
Transitional provision third. Consumers who, without having the right to avail themselves of the last resort fee, are temporarily lacking a supply contract in force with a marketer and continue to consume electricity.
1. Consumers connected in high voltage as at 31 December 2009 are being supplied by a last resort trader and on 1 January 2010 do not have a supply contract on the free market, provided they are not included in the derogation provided for in Article 3.3 of Royal Decree 485/2009 of 3 April 2009, may continue to be provided by that marketer of last resort until 31 December 2010.
The price to be paid by these customers for the electricity consumed to the marketer of last resort during this period will be the one corresponding to the application of the billing of the rate of last resort, TUR without application of the time discrimination mode, increased its terms by 20 percent.
2. Consumers connected in low tension without the right to a last resort tariff which at 30 September 2010 are being supplied by a trader of last resort and on 1 October 2010 do not have a supply contract in the free market, provided that they are not included in the derogation provided for in Article 3.3 of Royal Decree 485/2009 of 3 April 2009, may continue to be provided by that marketer of last resort until 31 December 2010.
The price to be paid by these customers for the electricity consumed to the marketer of last resort during this period will be the one corresponding to the application of the billing of the rate of last resort, TUR without application of the time discrimination mode, increased its terms by 20 percent.
3. If, on 1 January 2011, the consumers referred to in the preceding paragraphs have failed to contract their supply on the free market, the contract between the consumer and the marketer of last resort shall be deemed to be terminated. (a) the application of Article 86.2 of Royal Decree 1955/2000 of 1 December 2000 on the activities of transport, distribution, marketing, supplies and procedures for the authorisation of installations of electrical energy.
The provisions of Article 21.3 of Order ITC/1659/2009 of 22 June establishing the mechanism for the transfer of customers from the market to the supply of the last energy resource will also apply. electrical power and the method of calculation and structure of the rates of last resort of electrical energy.
Single repeal provision. Regulatory repeal.
Article 9.2 of Order ITC/1659/2009 of 22 June establishing the mechanism for the transfer of customers from the market to the tariff for the supply of the last electric energy resource and the calculation procedure is hereby repealed. the structure of the tariffs for the last resort of electricity, and also how many provisions of the same or lower range are contrary to the provisions of this order.

2. The General Directorate for Energy Policy and Mines will resolve the request, following a report from the National Energy Commission.
