Law 11/2007, of June 22, of electronic access of citizens to Public Services, created the concept of "electronic headquarters", defining it in article 10.1 as " that electronic address available to the public (a) citizens through telecommunications networks whose ownership, management and administration is a matter for a public administration, body or administrative entity in the exercise of its powers. " Furthermore, in paragraph 2 of the same article, it determines that the establishment of an electronic seat carries the responsibility of the holder with respect to the integrity, truthfulness and updating of the information and services to which it can access through it.

Therefore, with the establishment of the Headquarters, it is intended to create a space in which the Administration and the citizen relate by electronic means in the framework of the administrative management with the due guarantees of full certainty and security.

On the other hand, Royal Decree 1671/2009, of 6 November, for which the Law 11/2007, of 22 June, of electronic access of citizens to Public Services is partially developed, in addition to regulating this figure in its Articles 3 to 9 specifically determine in article 3.2 that "the electronic venues shall be created by order of the corresponding Minister or resolution of the holder of the Public Body, which shall be published in the" Official State Gazette "", determining the minimum content of this approval rule.

According to the competition that Article 28.4.b) of Law 27/1992, of 24 November, of Ports of the State and the Merchant Navy, attributes to the Council Rector of the Public Body Ports of the State, this governing body has approved the creation of the Electronic Headquarters at the session held on 6 April 2010.

In its virtue, I resolve:

Article 1. Object.

This resolution aims at the creation of the Electronic Headquarters of the Public Body Ports of the State, in order to comply with the provisions of Article 3 of Royal Decree 1671/2009 of 6 November 2009. that the Law 11/2007, of 22 June, of electronic access of citizens to Public Services is partially developed.

Article 2. Features of the Electronic Headquarters of the Public Body Ports of the State.

1. The Electronic Headquarters of the Public Body Ports of the State is created with the following characteristics:

a) The scope of the Headquarters is the totality of the administrative units that make up the Public Body Ports of the State.

b) All actions, procedures and services that require the authentication of citizens or the Public Administration in their relations with these by electronic means shall be carried out through the Electronic Headquarters, as for those other than those who decide to be included in the Headquarters for reasons of effectiveness and quality in the provision of services to citizens.

c) The reference electronic address of the Headquarters shall be https://sede.puertos.gob.es.

d) The ownership of the Electronic Headquarters corresponds to the Public Body Ports of the State.

e) The technological management of the Headquarters corresponds to the Subdirection of Administration and Audit, dependent on the Management Coordination of Management, Human Resources and External Relations.

f) The management of the common contents of the Electronic Headquarters and the coordination of the various Directorates of the Public Body Ports of the State that incorporate contents and services to it, corresponds to the Institutional Relations and Technological Innovation.

g) They shall be responsible for the management of the content and services made available to citizens at the Headquarters responsible for the addresses to which such content or services correspond.

(h) The Electronic Headquarters shall include at least the content related to Article 3 of this resolution.

i) They will be channels of access to the services available at the Headquarters:

1. For electronic access, through the Internet, with the characteristics defined in this article and the following.

2. For in-person care, in the General Registry of the Public Body Ports of the State.

3. For telephone attention, on phone 91 5245500.

j) The information and services included in the Electronic Headquarters will comply with the principles of accessibility and usability established in Law 11/2007, of June 22, of electronic access of citizens to the Services Public, in the terms that are established in this matter by the regulations in force at any time.

k) The contents published in the Electronic Headquarters will respond to the criteria of safety and interoperability arising from Law 11/2007, of June 22, of electronic access of citizens to Public Services, and of the Royal Decree 1671/2009, as well as Royal Decree 3/2010 of 8 January, which regulates the National Security Scheme and Royal Decree 4/2010 of 8 January, which regulates the National Interoperability Scheme.

2. The identification of the Electronic Headquarters shall be carried out by means of a recognised certificate of venue, consisting of the certificate of the server in accordance with the provisions of Royal Decree 1671/2009 of 6 November 2009.

Article 3. Contents of the Electronic Headquarters of the Public Body Ports of the State.

The minimum contents to include the Electronic Headquarters are:

(a) Identification of the seat, as well as of the titular body and those responsible for the management of the contents made available to it.

b) Information necessary for the proper use of the site including the map of the Electronic Headquarters, as well as the related to the intellectual property.

c) Electronic Headquarters certificate verification system.

d) System of verification of the electronic seal certificates used at the Electronic Headquarters.

e) Services of electronic advice to the user for the correct use of the Electronic Headquarters.

f) Relationship of electronic signature systems that are admitted or used in the Electronic Headquarters.

g) Catalog of Procedures and Services available at the Electronic Headquarters.

h) Letter of Electronic Services Electronic Services.

i) Official date and time, and days officially declared as non-working.

j) Link to the "Official State Bulletin".

k) General suggestions and complaints.

l) Report on compliance with the conditions of confidentiality, integrity and availability of information and communications that are made through the Electronic Headquarters.

m) Information related to the protection of personal data.

n) Link to the Spanish Data Protection Agency.

o) Resolution of Creation of the Electronic Headquarters.

p) Electronic Record Creation Resolution.

q) Link to the General Access Point of the General Administration of the State.

r) Links to the Electronic Sites of the Ministry of Development and each of the Port Authorities.

s) The Electronic Headquarters will allow access to its contents and services in the co-official languages in the Spanish State.

Article 4. Means for formulating suggestions and complaints.

1. The means available for the formulation of suggestions and complaints regarding the content, management and services offered at the Headquarters created by this resolution shall be as follows:

a) Electronic presentation through the general mailbox of suggestions and complaints of the Electronic Registry of the Public Body Ports of the State available at the Agency's Electronic Headquarters.

b) In-person or post-office presentation to the General Register of this Public Body, in accordance with the procedure laid down in Article 15 of Royal Decree 951/2005 of 29 July 2005 establishing the general framework for quality improvement in the General Administration of the State.

2. No means shall be considered for the formulation of suggestions and complaints of the electronic advice services to the user for the correct use of the Headquarters, without prejudice to their obligation, when it exists, to attend to the problems arising from them. citizens.

Final disposition first. Commissioning of the Headquarters.

The Electronic Headquarters created by this resolution will begin to operate within a maximum of two months from its publication in the "Official State Gazette".

Final disposition second. New procedures and content modification.

By resolution of the President of this Public Body, in the exercise of the functions granted to him by Law 27/1992, of 24 November, of Ports of the State and of the Merchant Navy, in his article 29.2.c), new services, procedures and contents to the Electronic Headquarters, in the framework of what is available in article 6 of Royal Decree 1671/2009, of November 6.

Final disposition third. Entry into force.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
