The Royal Decree 551/2006 of 5 May on the operation of the transport of dangerous goods by road in Spanish territory, in Annex III, entitled 'Current regulations', sets out the provisions which The invention relates to an application for packaging and packaging, vehicles, tanks and tank containers. For the changes indicated in the previous paragraph, Annexes A and B to the ADR (Europe Agreement concerning the international transport of dangerous goods by road) are applicable in the European Union, taking into account the the entry into force of its transitional measures.

In the same way, there have also been changes in the national provisions relating to packaging, packaging, vehicles, tanks and tank containers, which are applicable to the transport of dangerous goods by road. In particular, the following provisions have been published:

a) Additional technical instruction ITC EP-6, transportable pressure vessels.

(b) Royal Decree 750/2010 of 4 June 2010 governing the procedures for the approval of motor vehicles and their trailers, self-propelled or towed machinery, agricultural vehicles, systems, parts and parts thereof of such vehicles.

(c) Order ITC/2816/2009 of 16 October updating Annexes I and II to Royal Decree 2028/1986 of 6 June 1986 on the rules for the application of certain EC Directives concerning the approval of the type of motor vehicles, trailers, semi-trailers, motorcycles, mopeds and agricultural vehicles, as well as parts and parts of such vehicles.

(d) Royal Decree 340/2010 of 19 March 2010 amending Royal Decree 948/2003 of 18 July 2003 laying down the minimum conditions to be met by indoor washing or degassing facilities; and depressurisation, as well as repair and modification, of dangerous goods tankers.

(e) Order ITC/2765/2005 of 2 September 2005 amending Annexes I, II and IV to Royal Decree 948/2003 of 18 July 2003 laying down the minimum conditions to be met by indoor washing facilities or degassing and depressurisation, as well as repair and modification, of dangerous goods tankers.

All of the above advises updating the content of Annex III and amending several paragraphs and Appendices to Annexes V and VI to Royal Decree 551/2006 of 5 May.

The second paragraph 2 of Royal Decree 551/2006 itself of 5 May empowers the Minister for Industry, Tourism and Trade to update Annex III and to amend Annexes II, IV, V and VI to that royal decree.

This order has the favorable report of the Ministry of Public Works and has been subject to a hearing of the affected sectors and of consultations with the Autonomous Communities. It has also been favourably informed by the Commission on the coordination of the transport of dangerous goods by the National Land Transport Council and other bodies of the General Administration of the State concerned.

In its virtue, according to the State Council, I have:

Single item. Amendment of Royal Decree 551/2006 of 5 May on the operation of the transport of dangerous goods by road on Spanish territory.

Royal Decree 551/2006 of 5 May on the operation of the transport of dangerous goods by road on Spanish territory is amended as follows:

One. Annex III is replaced by the following:

" ANNEX III

General provisions that remain in force as soon as they are not opposed to what is established in the ADR or in this royal decree

1. Packaging and packaging:

(a) Order of the Ministry of Industry and Energy of 17 March 1986 laying down rules for the approval of packaging and packaging intended for the transport of dangerous goods.

(b) Order of the Ministry of Industry and Energy of 28 February 1989 amending the Order of 17 March 1986 laying down rules for the approval of packaging and packaging for the carriage of goods dangerous.

(c) Royal Decree 222/2001 of 2 March 2001 laying down detailed rules for the application of Council Directive 1999 /36/EC of 29 April on pressure transportable equipment.

(d) Royal Decree 769/1999 of 7 May 1999 laying down detailed rules for the application of the Directive of the European Parliament and of the Council 97 /23/EC on pressure equipment and amending Royal Decree 1244/1979 of 4 June 1979 April, which approved the regulation of pressure equipment.

e) Technical instruction complementary ITC EP-6, transportable pressure vessels.

2. Vehicles:

(a) Royal Decree 750/2010 of 4 June 2010 governing the procedures for the approval of motor vehicles and their trailers, self-propelled or towed machinery, agricultural vehicles as well as systems, parts and parts of such vehicles.

(b) Royal Decree No 2028/86 of 6 June 1986 laying down rules for the application of certain EEC Directives relating to the type-approval of types of motor vehicles, trailers and semi-trailers, and parts thereof and parts of such vehicles.

(c) Order ITC/2816/2009 of 16 October updating Annexes I and II to Royal Decree 2028/1986 of 6 June 1986 on the rules for the application of certain EC Directives concerning the approval of the type of motor vehicles, trailers, semi-trailers, motorcycles, mopeds and agricultural vehicles, as well as parts and parts of such vehicles.

3. Cisterns and tank containers:

(a) Order of the Ministry of Industry and Energy of 20 September 1985 on standards of construction, type approval, testing and inspection of tanks for the transport of dangerous goods.

(b) Order of the Ministry of Industry and Energy of 30 December 1994 amending that of 20 September 1985 on rules for the construction, type approval, testing and inspection of tanks for transport of dangerous goods.

(c) Order of the Ministry of Industry and Energy of 16 October 1996 amending on 20 September 1985 laying down rules for the construction, type approval, testing and inspection of tanks for the transport of dangerous goods dangerous goods.

(d) Royal Decree 749/2001 of 29 June laying down the minimum characteristics to be met by the mouths of man and the inspection of fuel tanks (gasolines, gasoils and light oils) and domestic heating fuels or other fuels for industrial use which are classified in the ADR as class 3 materials and which also have a tank calculation pressure of less than 0,75 Kg/cm2 of manometric pressure.

e) Royal Decree 1437/2002 of 27 December on the adjustment of petrol tankers to Royal Decree 2102/1996 of 20 September 1996 on the control of emissions of volatile organic compounds (VOCs).

(f) Royal Decree 948/2003 of 18 July 2003 laying down minimum conditions to be met by facilities for internal washing or degassing and depressurisation, as well as for repair and modification, of Dangerous goods tanks.

(g) Royal Decree 340/2010 of 19 March 2010 amending Royal Decree 948/2003 of 18 July 2003 laying down the minimum conditions to be met by indoor washing or degassing facilities; and depressurisation, as well as repair and modification, of dangerous goods tankers.

(h) Order ITC/2765/2005 of 2 September 2005 amending Annexes I, II and IV to Royal Decree 948/2003 of 18 July 2003 laying down minimum conditions for the collection of washing facilities internal or degassing and depressurisation, as well as repair and modification, of dangerous goods tankers.

(i) Royal Decree 222/2001 of 2 March 2001 laying down detailed rules for the application of Council Directive 1999 /36/EC of 29 April on pressure transportable equipment. '

Two. In Annex V, paragraph VI.i) is worded as follows:

" i) Documents V1 and V2 and regulatory compliance record of vehicle inspection, complete or completed vehicle EX/II, EX/III or MEMU, tank vehicle, battery vehicle, vehicle for removable tanks, vehicle for tank containers, vehicle for portable tanks or CGEM (Appendix E15). '

Three. In Annex V, paragraph VII.h. is worded as follows:

" (h) Documents V1 and V2 and regulatory compliance record of the inspection of a vehicle, complete or completed vehicle EX/II, EX/III or MEMU, tank vehicle, battery vehicle, vehicle for removable tanks, vehicle for tank containers, vehicle for portable tanks or CGEM (Appendix E15). '

Four. In Annex V, paragraph VIII.j. is worded as follows:

" j) Documents V1 and V2 and regulatory compliance record of vehicle inspection, complete or completed vehicle EX/II, EX/III or MEMU, tank vehicle, battery vehicle, vehicle for removable tanks, vehicle for tank containers, vehicle for portable tanks or CGEM (Appendix E15). '

Five. In Annex V, paragraph X is worded as follows:

" X. Documents to be generated during the initial and periodic inspection of vehicle tractors, vehicles carrying detachable tanks, vehicles carrying containers and vehicles for the transport of explosives EX/II and EX/III and MEMU types.

V1 and v2 documents and regulatory compliance record of vehicle inspection, complete or completed vehicle EX/II, EX/III or MEMU, tank vehicle, battery vehicle, vehicle for detachable tanks, vehicle for tank containers, vehicle for portable tanks or CGEM '(Appendix E15).'

Six. In Annex VI, Appendix E7, paragraph E Remarks, 'Royal Decree 2115/1998' is replaced by 'Royal Decree 551/2006 of 5 May'.

Seven. In Annex VI, Appendix E11, 'Carrier vehicle (excluding tank containers and C.G.E.M.)' is replaced by 'Carrier vehicle (except tank containers, portable tanks and CGEM)'.

Eight. In Annex VI, Appendix E12, 'Vehicle Type 1' is replaced by 'Type 1'.

Nine. In Annex VI, Appendix E13, 'Vehicle Type 1' is replaced by 'Type 1'.

Ten. In Annex VI, Appendix E16, 'Carrier vehicle, except tank containers' is replaced by 'Carrier vehicle (except tank containers, portable tanks and CGEM)'.

Once. In Annex VI, Appendix E19, 'Carrier vehicle (excluding tank containers or CGEM)' is replaced by 'Carrier vehicle (except tank containers, portable tanks and CGEM)'.

Twelve. In Annex VI, Appendix E7, sheets HA2 and HA3, paragraphs 6.8.4.b), 6.8.4.c) and 6.8.4.d) are worded as follows:

The special equipment requirements set out in the Tex codes in the 6.8.4.b) of the ADR, applicable to the materials authorized to be transported according to the code and type of approval of the tank, (6.8.2.3.1)

6.8.4.c)

The special approval requirements set in the TAx tags of the 6.8.4.c) of the ADR, applicable to the materials authorized to be transported according to the cistern code and type of approval, (6.8.2.3.1)

6.8.4.d)

The special requirements for tests set out in the TTx codes in paragraph 6.8.4.d) of the ADR, applicable to the materials to be carried according to the cistern code and type of approval, are met (6.8.2.3.1). "

Thirteen. In Annex VI, Appendix E14, sheets GA2 and GA3, the wording of paragraphs 6.8.4.b), 6.8.4.c) and 6.8.4.d) shall be as follows:

Final disposition first. Competence title.

This order is issued under the terms of Article 149.1.13. of the Constitution, which attributes to the State exclusive competence on the basis and coordination of the general planning of economic activity.

Final disposition second. Application of European Union law.

This order brings the cause of Commission Directive 2006 /89/EC of 30 November 2006 adapting for the sixth time to technical progress Council Directive 94 /55/EC on the approximation of the laws of the Member States relating to the Member States with regard to the transport of dangerous goods by road, as well as Directive 2008 /68/EC of the European Parliament and of the Council of 24 September 2008 on the inland transport of dangerous goods.

Final disposition third. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
