The Institute for Diversification and Energy Saving (IDAE) is a body under the Ministry of Industry, Tourism and Commerce, through the Secretariat of State of Energy, which is governed by Law 6/1997, of 14 of (b) April, the Organization and the Functioning of the General Administration of the State, having been set up as a business public entity as provided for in Article 43 (1) (b) of that Law, in accordance with the provisions of the Article 72 of Law 50/1998 of 30 December 1998 on Fiscal, Administrative and Social Order Measures, as well as the additional twenty-first provision of Law 46/1985 of 27 December 1985 on the General Budget of the State for 1986.

The Statutes of the entity were approved by Royal Decree 802/1986 of 11 April and, subsequently, amended by Royal Decree 252/1997 of 21 February, by Royal Decree 2100/1998 of 25 September, and by the Royal Decree of the Decree 1451/2000 of 28 July 2000 and other implementing rules. This entity enjoys a distinct public legal personality, as well as management autonomy for the fulfilment of its purposes, acting under the private legal order.

The Institute for Energy Diversification and Saving (IDAE) has been affected by the Council of Ministers ' Agreement of 30 April 2010 on the rationalization of the business public sector, adopted in the light of the State financial and budgetary adjustments committed by the government in the European framework, which has established, in its third and seventh points, that state public sector enterprises and public enterprises with more of six members in its Board of Directors shall take the necessary measures to, through of its Statutes, reduce the number of members, at least by 15 percent.

In the face of the state mercantile societies affected by the Agreement, whose reform of the Statutes will have to be carried out within the respective General Shareholders ' Boards, the reduction of directors in public entities business demands a statutory reform, by means of the corresponding royal decree amending the existing Statutes.

To these effects, this rule is promoted on the composition of the Council of the IDAE, which must reduce the number of representatives in two, which is carried out by the abolition of the second Vice-Presidency, which holds the Director-General of University Policy of the Ministry of Education, and one of the three Directors of the Ministry of the Environment, and the Rural and Marine Environment, in particular the representation of the Directorate General of Water. Likewise, the names of the other representations are updated in this royal decree, according to the organic structure currently in force in the Ministries, while remaining the remaining aspects of the current regulation.

This provision is dealt with under the provisions of Article 63.3 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State, which provides that the amendments that affect only the organization of the organization, will be carried out by royal decree, at the initiative of the Minister of the organization, and on the proposal of the Ministry of Territorial Policy and Public Administration.

In its virtue, at the initiative of the Minister of Industry, Tourism and Commerce, on the proposal of the Third Vice President of the Government and Minister of Territorial Policy and Public Administration, and after deliberation of the Council of Ministers at their meeting on November 19, 2010,

DISPONGO:

Single item. Amendment to the Statute of the Energy Saving and Diversification Institute (IDAE), approved by Royal Decree 802/1986 of 11 April.

Article 4.Two of the Statute of the Institute for the Diversification and Saving of Energy (IDAE), approved by Royal Decree 802/1986 of 11 April 1986, is hereby reworded as follows:

" Two. The Management Board shall be composed of the following members:

(a) The President, who will be the Secretary of State for Energy of the Ministry of Industry, Tourism and Commerce.

b) The Vice President, who will be the Director General of Energy Policy and Mines of the Ministry of Industry, Tourism and Commerce.

c) Vocals:

1. The Director General of the Institute for Energy Diversification and Saving of the Ministry of Industry, Tourism and Commerce.

2. A representative of the Directorate-General of Industry of the Ministry of Industry, Tourism and Trade.

3. A representative of the Directorate-General for Small and Medium-sized Enterprises in the Ministry of Industry, Tourism and Trade.

4. A representative of the Ministry of Economy and Finance's Directorate-General for Budgets.

5. A representative of the General Directorate of Land Transport of the Ministry of Public Works.

6. A representative of the Ministry of Development's Directorate-General for Architecture and Housing Policy.

7. A representative of the Environmental Quality and Evaluation Directorate of the Ministry of the Environment, and the Rural and Marine Environment.

8. A representative of the Directorate-General for Industry and Food Markets of the Ministry of the Environment, and the Rural and Marine Environment.

9. Two representatives appointed by the Minister of Industry, Tourism and Trade, on the proposal of the Secretary of State for Energy, among persons of recognized prestige in the energy sector.

Directors of the Board of Directors acting as representatives of a ministerial department shall be appointed by the Minister of Industry, Tourism and Trade, on a proposal from the holder of the Department to which they belong.

d) The Secretary, who will be the Secretary-General of the Institute for Energy Diversification and Savings, who will act with voice but without a vote.

Vowels and the Secretary of the Board of Directors shall, in respect of assistance to the meetings of the Council, receive the corresponding economic compensation in accordance with the provisions of the regulatory provisions of compensation for service reason. "

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
