In Law 9/2010 of 14 April, which regulates the provision of air traffic services, the obligations of the civil service providers of such services are laid down and certain working conditions are fixed for civil air traffic controllers, undertake a structural reform of air traffic services by establishing a new model for the provision of these services which, in the framework of the European Single Sky, ensures their safe delivery, effective, sustained and sustainable economically and financially.

In this context, this law reserves to the business public entity Spanish Airports and Air Navigation (AENA) the provision of air traffic services of area control and approach control, opening the possibility that the aerodrome air traffic services are provided by other providers certified by a national supervisory authority of the European Union.

With this same objective, the second provision of Law 9/2010, of 14 April, provides that in aerodromes managed by AENA the air traffic services can be provided by the said entity or by any another air traffic service provider duly certified, stating that, for aerodromes which are determined by order of the Ministry of Public Works and within the time limit set out therein, AENA shall initiate the procedures for the selection of new civilian air traffic service providers at aerodrome.

On the other hand, Royal Decree 931/2010, of July 23, which regulates the procedure of certification of civil service providers of air navigation services and their regulatory control, establishes the regulatory framework necessary to undertake the structural measures introduced by the Law in order to regulate, inter alia, the procedure for obtaining the certificate of air traffic service provider and to establish the conditions for the change of the designated provider for the provision of such services.

Finally, Order FOM/1841/2010, of 5 July, for which the requirements for the certification of civil service providers of air traffic controllers are developed, completes the precise legal framework for the access to the provision of air traffic control services by those concerned.

Completed the regulatory framework, it is appropriate to determine the initial group of AENA-managed airports in which the business public entity should proceed to select other providers for the provision of services. air traffic of aerodrome. The determination of these airports has taken into account the analysis carried out by the business public entity.

In this analysis AENA has valued, among other criteria, those related to the type and volume of traffic; the complexity of the dependence and the process of transition in relation to the objectives pursued, characteristics of the service provided in the ATS unit in each case as well as the needs of the AENA itself and the air navigation network, as well as those arising from the management of the selected airports, all always taking into account the need guarantee of the safety, continuity, efficiency, quality and sustainability of the service. In accordance with this analysis, in all selected airports air traffic services shall be provided in the aerodrome air traffic control mode.

Without prejudice to the foregoing, in accordance with those provided for in Law 9/2010 of 14 April, following the selection made by AENA and the proposal raised by that entity, it is for the Ministry of Public Works to designate, within specific airspace blocks, from the civil aviation air traffic control provider for each airport.

In its virtue, according to the analysis and proposal made by AENA and in accordance with the provisions of the second paragraph 3 of Law 9/2010 of 14 April, I have:

Article 1. Airports where the selection of new aerodrome air traffic control service providers is to be carried out.

1. The business public entity Airports Spanish and Air Navigation (AENA) shall initiate the procedure for the selection of new air traffic control service providers at aerodrome, in accordance with the provisions of Law 31/2007, On 30 October, on procurement procedures in the water, energy, transport and postal services sectors, for the provision of these air traffic services at the following airports:

A Coruña Airport.

Alicante Airport.

Fuerteventura Airport.

Ibiza Airport.

Jerez de la Frontera Airport.

La Palma Airport.

Lanzarote Airport.

Madrid Airport-Four Winds.

Melilla Airport.

Sabadell Airport.

Seville Airport.

Valencia Airport.

Vigo Airport.

2. The procedure provided for in the preceding paragraph shall be initiated within a period not exceeding one month from the date of publication of this Order.

Article 2. CNS systems attached to the airport.

AENA shall determine the set of CNS equipment and systems, such as ILS, VOR/DME landing systems and any other necessary for the provision of aerodrome air traffic control services, which shall be airport attached to the airport and those that will remain on the route and approach network dependent on that entity

Article 3. Continuity of service.

In accordance with the provisions of the second provision of Law 9/2010 of 14 April 2010, AENA will continue to provide air traffic control services at the airports referred to in Article 1, until, prior to the supervision and favourable reporting by the State Aviation Safety Agency, the effective start of the provision by the certified supplier designated by the competent authority on the proposal of that public entity shall occur.

Single end disposition. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
