The Council of Ministers adopted at its meeting on 30 April 2010 an Agreement which decided to amend the rules governing the organic structure of the ministerial departments, with a view to to achieve maximum efficiency and rationality in the action of the General Administration of the State, in the framework of the austerity plan for public spending. This Agreement was immediately developed by Royal Decree 495/2010 of the same date, approving the basic organic structure of the ministerial departments, as amended, with regard to the Ministry of Foreign Affairs and Cooperation, by Royal Decree 940/2010, of 23 July.

Later, by means of Royal Decree 1313/2010 of 20 October, by which the ministerial departments are restructured, the Department is assigned the direction of foreign policy and international cooperation for the development, in accordance with the guidelines of the Government and in application of the principle of unity of action abroad. This royal decree is developed through Royal Decree 1366/2010, of October 29, which approves the basic organic structure of the ministerial departments.

In accordance with Article 18.2 of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, it is considered appropriate to derogating from the official reserve the appointment of the holder of the Directorate General of Foreign Communication, as already done by Royal Decree 1366/2010 mentioned above. The core of the activity of the Directorate-General for External Communication, which translates into the role of information, coordination and assistance provided to the Ministry's head in the field of its relations with the media communication, both national and foreign, provide the position of a specific profile, with conditions such as experience in the information work and relations at both national and international institutional level and extensive knowledge of training as with media, which requires special features that make It is advisable that the holder should not necessarily have the status of a public servant.

In the framework established by the actual decrees cited, it is necessary to develop the structure of the higher organs and directors of the Ministry of Foreign Affairs and Cooperation, up to the level of Subdirección General or equivalent, in order to achieve the objectives of rationality and improvement of efficiency in the fields of competence and management of the Department, which is carried out by the present royal decree.

In its virtue, on the initiative of the Minister for Foreign Affairs and Cooperation, on the proposal of the Third Vice President and Minister of Territorial Policy and Public Administration and after deliberation of the Council of Ministers in its Meeting of the day 23 December 2010,

DISPONGO:

Article 1. General organization of the Department.

1. The Ministry of Foreign Affairs and Cooperation is the Department of the General Administration of the State to which it corresponds, in accordance with the guidelines of the Government and in application of the principle of unity of action abroad, to plan, direct, execute and evaluate the foreign policy of the State; to defend the interests of Spain and to carry out an adequate and effective policy of protection of Spanish citizens abroad; to establish and strengthen their relations with other States and international organisations, with particular attention to those related to the Union European and Latin American countries; to design and implement Spanish policy within the European Union and to coordinate all actions which, within the framework of their powers, carry out the remaining Departments and Public Administrations in the field of Union; to direct the policy of international cooperation for development and to coordinate the organs of the General Administration of the State which, in the field of their competences, carry out actions in this field; international scientific and cultural cooperation and action abroad, and coordinate the other bodies of the State Administration which, in the field of their powers, carry out action in this field; promote the economic, cultural and scientific relations of Spain; participate in the sphere of action which it is of its own; in the proposal and implementation of migration and foreign policies; to promote cross-border and interterritorial cooperation and to carry out monitoring and collaboration with other public administrations in relation to their projection or external activity; preparing, negotiating and processing the International Treaties; Spain is a party.

2. The powers conferred on this royal decree shall be understood in coordination and without prejudice to those corresponding to other ministerial departments.

3. The Ministry of Foreign Affairs and Cooperation, under the direction of the head of the Department, is structured in the following senior and managerial bodies:

(a) The Secretariat of State for Foreign and Ibero-American Affairs, on which the following management bodies depend:

1. The Directorate-General for Foreign Policy, Europe and Security.

2. The Directorate-General for the Mediterranean, Maghreb and the Middle East.

3. The Directorate General for North America, Asia and the Pacific.

4. The Directorate-General for Africa.

5. The Directorate-General for Latin America.

6. The Directorate-General for Multilateral Affairs.

(b) The Secretariat of State for the European Union, on which the Directorate-General for General Affairs and Policy Coordination of the Treaty on the Functioning of the European Union depends.

c) The Secretariat of State for International Cooperation, on which the Directorate-General for Development Policy Planning and Evaluation depends.

(d) The Secretariat for Foreign Affairs and Cooperation, on which the following management bodies depend:

1. The Technical General Secretariat.

2. The Directorate General of the Foreign Service.

3. The Directorate-General for Consular and Migration Affairs.

e) Depend directly from the Department holder:

1. The Directorate-General for Foreign Communication.

2. The Directorate-General for International Economic Relations and Energy Affairs.

f) As an immediate assistance body to the holder of the Ministry of Foreign Affairs and Cooperation, there is a Cabinet, with an organic level of Directorate General, with the structure set out in Article 16.2 of the Royal Decree 1366/2010 of 29 October.

g) The holder of the Ministry of Foreign Affairs and Cooperation is assisted by the High Council for Foreign Affairs and Cooperation, whose composition and functions are governed by specific provisions and whose activities are coordinated by a Unit with an organic level of General Subdirection.

h) Corresponds to the holder of the Department of Chair of the Sectoral Conference on International Cooperation for Development.

Article 2. Secretariat of State for Foreign and Ibero-American Affairs.

1. The Secretariat of State for Foreign and Ibero-American Affairs, without prejudice to the powers of the other upper organs of the Ministry, assists the holder of the Ministry of Foreign Affairs and Cooperation in the formulation and implementation of the of foreign policy in its global approaches and objectives, as well as its concreteness for the various geographical areas.

In particular, it is up to him, under the direct dependence of the head of the Department, to coordinate and monitor the participation of Spain in the Common Foreign and Security Policy of the European Union, including the Common Security and Defence Policy; the formulation and implementation of the foreign policy corresponding to the United Nations system and international bodies; the promotion of the Ibero-American Community of Nations; support for the functions of the Ibero-American General Secretariat; the preparation and coordination of the Summits Ibero-Americans; international affairs of terrorism; international security and peace building and peacekeeping operations; nuclear non-proliferation and disarmament; human rights.

In addition, it assists the holder of the Ministry of Foreign Affairs and Cooperation in the formulation and implementation of the foreign policy of Spain in the geographical areas of Europe, the Mediterranean, the Maghreb, the Middle East, North, Asia, Pacific, Africa and Latin America.

The Secretariat of State for Foreign and Ibero-American Affairs manages, coordinates and monitors, in the field of its competence, the mandatory contributions to international agencies and maintenance operations of peace. Similarly, in the field of its competences, it executes its budget for voluntary contributions to international bodies and institutions and other contributions to entities and activities linked to foreign policy.

2. As an immediate assistance body to the head of the Secretariat of State, there is a Cabinet, with an organic level of Subdirección General, with the structure set out in Article 16.3 of Royal Decree 1366/2010 of 29 October.

3. It is also up to the head of the Secretariat of State to the Office of Analysis and Forecast, with an organic level of Subdirectorate General, to which the study and assessment of issues related to foreign policy correspond.

4. Ambassadors on a special mission to be appointed in the fields of competence of the Secretariat of State for Foreign and Ibero-American Affairs shall be directly responsible for the Directorates-General responsible for these matters.

Article 3. Directorate-General for Foreign Policy, Europe and Security.

1. It corresponds to the Directorate-General for Foreign Policy, Europe and Security, under the responsibility of the head of the Secretariat of State for Foreign and Ibero-American Affairs, the formulation and implementation of foreign policy in its proposals and global targets.

2. It also corresponds to the Directorate-General for Foreign Policy, Europe and Security, the elaboration, proposal and implementation of Spain's foreign policy in its corresponding geographical area.

3. It is also up to the Directorate-General for Foreign Affairs, Europe and Security to draw up, propose and implement Spain's foreign policy in the strategic field and, in particular, in the field of international security and the building peace, peacekeeping operations, and nuclear non-proliferation and disarmament.

4. The Director-General for Foreign Policy, Europe and Security exercises coordination on the Directorate-General for the Mediterranean, the Maghreb and the Middle East; the Directorate-General for North America, Asia and the Pacific; the Directorate-General for Africa; the Directorate-General for Latin America; and the Directorate-General for Multilateral Affairs.

5. In his capacity as Political Director, the head of the Directorate-General for Foreign Policy, Europe and Security ensures the coordination and monitoring of Spain's participation in the Common Foreign and Security Policy, including the Common for Security and Defence, prepares and monitors the meetings of the European Union's Foreign Affairs Council and represents Spain at the meetings of the Political and Security Committee of the European Union when it meets in formation of Political Directors.

6. It is the responsibility of the head of the Directorate-General for Foreign Policy, Europe and Security to prepare for the meetings of the European Union's Foreign Affairs Council.

7. The following bodies are directly dependent on the head of the Directorate-General for Foreign Policy, Europe and Security:

(a) The Subdirectorate General for Foreign Policy, which will manage the coordination and monitoring of issues related to Spanish foreign policy, as well as any other matter entrusted to it by the head of the Directorate General, in the field of their competence.

(b) The European Union's Subdirectorate-General for Common Foreign and Security Policy, which is responsible for assisting the head of the Directorate-General in the coordination and monitoring of Spain's participation in the policy External and Common Security of the European Union and in the preparation and follow-up of the meetings of the Council of Foreign Affairs of the European Union. It is also for the preparation and follow-up of the meetings of the European Union's Political and Security Committee.

(c) The General Security Subdirectorate, which corresponds to the definition of Spain's position on international security and defence issues, at both the multilateral and bilateral levels.

(d) The Subdirectorate-General for Non-Proliferation and Disarmament, to which it corresponds, within the competence of the Ministry of Foreign Affairs and Cooperation and in collaboration with the competent departments: coordination of the institutional representation of Spain in the multilateral fora in which these matters are addressed; the political and legal activities related to these matters, both of the main organs of the United Nations and its subsidiary bodies, committees and working groups which are dependent on them; general coordination of the action of the Department, in the field of its competences, in initiatives and monitoring of international issues in strategic matters relating to non-proliferation, disarmament and new threats; monitoring of the activities and negotiations on disarmament and arms control within the framework of the United Nations and other specific fora in which Spain participates; monitoring of the general verification of the disarmament and arms control of which Spain is a party.

8. The following bodies also depend on the Directorate-General for Foreign Policy, Europe and Security:

(a) The General Subdirectorate of the European Union.

b) The General Subdirectorate of Candidate Countries, European Economic Area and other European Countries.

c) The Eastern European and Central Asian General Subdirectorate.

To these Subdirectorates General it is the definition and promotion of the interests of the foreign policy of Spain in its area of responsibility, and the impulse of the bilateral relations with the countries that encompass.

9. The following Units are also under the responsibility of the Directorate-General for Foreign Policy, Europe and Security:

(a) The Office of Gibraltar, with an organic level of Subdirección General, which corresponds to the definition and monitoring of the position of Spain in respect of the dispute of Gibraltar. To this end, it shall carry out the necessary coordination with the various units of the Ministry of Foreign Affairs and Cooperation and other ministerial departments, as well as with the corresponding bodies of other public administrations. in the matters relating to the dispute in Gibraltar.

(b) The Division of Multilateral Affairs and the OSCE, which will have the level to be determined in the employment relationship, which is responsible for the elaboration, proposal and implementation of the Spanish policy with regard to the Security and Cooperation in Europe, and the Council of Europe, in coordination with other Units of the Ministry and other Departments with competence in the activities of these organizations.

10. It also depends on this Directorate General the Ambassador in Special Mission for Peacekeeping Operations, with the functions of assistance in the design and execution of the participation of Spain in these operations, and in the coordination of the various Units of the Ministry of Foreign Affairs and Cooperation, and with other Government Departments relevant to this effect, especially in the field of peace-building.

Article 4. Directorate-General for the Mediterranean, Maghreb and the Middle East.

1. It is up to the Directorate-General for the Mediterranean, the Maghreb and the Middle East to draw up, propose and implement Spain's foreign policy in its geographical area.

2. For compliance with the above mentioned functions, the Directorate-General is structured in the following bodies:

a) The General Subdirectorate of the Maghreb.

b) The General Subdirection of the Middle East.

These Subdirectorates General are responsible for the definition and promotion of the interests of Spain's foreign policy in its area of responsibility, and the promotion of bilateral relations with the countries that comprise.

3. It is also up to this Directorate-General to prepare and monitor diplomatic initiatives in the Mediterranean, in particular the issues relating to the Union for the Mediterranean. It is also responsible for monitoring the activities of the League of Arab States and other Arab and Islamic multilateral fora.

Article 5. Directorate General for North America, Asia and Pacific.

1. It is up to the Directorate-General for North America, Asia and the Pacific to draw up, propose and implement Spain's foreign policy in its corresponding geographical area.

2. For compliance with the above mentioned functions, the Directorate-General is structured in the following bodies:

a) The General Subdirection of North America.

b) The General Subdirectorate of South and East Asia.

c) The Pacific, Southeast Asia, and the Philippines General Subdirectorate.

To these Subdirectorates General it is the definition and promotion of the interests of the foreign policy of Spain in its area of responsibility, and the impulse of the bilateral relations with the countries that encompass.

Article 6. Directorate General for Africa.

1. It is up to the Directorate-General for Africa to draw up, propose and implement Spain's foreign policy in its geographical area.

2. For the purposes of the above mentioned functions, it is up to the General Directorate of the Sub-Saharan Africa General Directorate, which corresponds to the definition and promotion of the interests of the foreign policy of Spain in its area of responsibility, and the momentum of bilateral relations with the countries it encompasses as well as with the African integration agencies.

Article 7. Directorate General for Latin America.

1. It is up to the Directorate-General for Latin America to draw up, propose and implement Spain's foreign policy in its corresponding geographical area.

2. It is also responsible for the preparation and coordination of the Ibero-American Summits; the design and promotion of the activities of the Ibero-American Community of Nations; collaboration and support for the functions of the Ibero-American General Secretariat; promotion and coordination of the presence of Spain in the Organization of American States (OAS) and in the various multilateral organizations and entities of the Ibero-American scope, without prejudice to the powers of the Ministry of Economy and Hacienda.

3. For compliance with the above mentioned functions, the Directorate-General is structured in the following bodies:

a) The General Subdirectorate of Mexico, Central America and the Caribbean.

b) The General Subdirectorate of Countries of the Andean Community.

c) The General Subdirectorate of the MERCOSUR and Chile Countries.

To these Subdirectorates General it is the definition and promotion of the interests of the foreign policy of Spain in its area of responsibility, and the impulse of the bilateral relations with the countries that encompass.

4. It also depends on the General Directorate for Ibero-America the Subdirectorate General of Latin American Multilateral Organizations, which corresponds to the preparation and coordination of the Ibero-American Summits; the design and promotion of the activities of the Ibero-American Community of Nations; the collaboration and support of the functions of the Ibero-American General Secretariat; and the promotion and coordination of the presence of Spain in the Organization of American States (OAS) and in the various Multilateral institutions and bodies at the Ibero-American level.

Article 8. Directorate-General for Multilateral Affairs.

1. It is for the Directorate-General for Multilateral Affairs to draw up, propose and implement Spain's foreign policy at the level of the United Nations and international bodies, as well as in the field of human rights, global affairs, the Alliance of Civilizations and international terrorism. In particular, it is for the exercise of the following functions:

(a) The political and legal activities related to the performance of both the main organs of the United Nations and the subsidiary bodies, committees and working groups that are dependent on them.

b) The monitoring and analysis of issues of a global nature, affecting the international community as a whole and requiring a concerted response from it, and the definition of the corresponding position of Spain, together with with the ministerial departments concerned.

c) The promotion and international development of the United Nations Alliance of Civilizations, and the coordination between this initiative and the National Plan for Alliance of Civilizations (PNAC).

d) The coordination of the Spanish position in the international technical agencies and their subsidiary bodies, in the specialized agencies of the United Nations system and in the economic and social sector of the organization.

e) The coordination, together with the relevant Directorates-General, of Spain's foreign policy in the field of the protection and promotion of human rights.

(f) The coordination of the institutional representation of Spain in the multilateral fora in which the issues of terrorism are addressed; the political and legal activities related to these matters, both The main bodies of the United Nations and its subsidiary bodies, committees and working groups which are dependent on them; the overall coordination of the Department's action, in the field of its powers, in the initiatives and in the monitoring of international terrorism issues; and the continued analysis of terrorism as a strategic element in the definition of the actions of the Ministry of Foreign Affairs and Cooperation.

2. For the performance of the functions identified, the Directorate-General is structured in the following organs, with an organic level of Subdirection General:

(a) The United Nations Subdirectorate-General and Global Affairs, which corresponds to the exercise of the functions set out in paragraphs (a) and (b) of the previous paragraph.

(b) The General Subdirectorate of Technical International Organizations, to which the exercise of the function set out in paragraph (d) of the previous paragraph corresponds.

(c) The Subdirectorate-General for International Affairs on Terrorism, which corresponds to the function set out in paragraph (f) of the previous paragraph in the field of the powers of the Ministry of Foreign Affairs and Cooperation and in collaboration with the competent departments.

(d) The Office of Human Rights, which corresponds to the exercise of the function set out in paragraph (e) of the previous paragraph.

Article 9. Secretary of State for the European Union.

1. The Secretariat of State for the European Union assists the holder of the Department in the formulation and implementation of the policy of Spain in the field of the European Union.

2. The Secretariat of State for the European Union coordinates all actions which, within the framework of its powers, are carried out by public administrations in the European Union. To this end, through the normally established channels, it maintains the necessary relations with the competent organs and agencies of the General Administration of the State, and with the autonomous and local administrations.

In accordance with the provisions of Royal Decree 260/1986 of 17 January establishing the permanent representation of Spain to the European Communities, the head of the Secretariat of State gives instructions to the Ambassador Permanent Representative of Spain to the European Union.

3. As an immediate assistance body to the head of the Secretariat of State, there is a Cabinet, with an organic level of Subdirección General, with the structure set out in Article 16.3 of Royal Decree 1366/2010 of 29 October.

4. The Secretariat of State for the European Union depends on the Secretariat of State for Institutional Affairs, which is responsible for monitoring and coordinating the institutional issues of the European Union and, in particular, for the reforms of the European Union. European Union, relations with the European institutions and the participation of the Autonomous Communities in European affairs, without prejudice to the latter case of the powers conferred on the Ministry of Territorial Policy and Administration Publishes on the provisions in force.

5. It is attached to the Secretariat of State for the European Union, without prejudice to its dependence on the Ministry of Justice, the State Advocate before the Court of Justice of the European Union, with the functions conferred on it by the rules in force.

Article 10. Directorate-General for General Affairs and Policy Coordination of the Treaty on the Functioning of the European Union.

1. Under the responsibility of the head of the Secretariat of State for the European Union, the Directorate-General for General Affairs and Policy Coordination of the Treaty on the Functioning of the European Union is responsible for monitoring the actions of the European Union. European Union in the various policies of the Treaty on the Functioning of the European Union; monitoring and coordination of the actions of the Ministries in these policies, as well as the coordination of the process of establishing the Spanish position to the European Union in the same way; the preparation of the Competitiveness Council of the European Union; and the preparation of the meetings of the General Affairs Council of the European Union.

It also corresponds to the monitoring function of the process of transposition of directives in Spanish legislation, and of the notifications of the proposals for State aid to the European Commission; the instruction of the infringement proceedings initiated by the European Commission before the Kingdom of Spain, and general advice on the legal issues of the European Union.

2. For compliance with the above mentioned functions, the Directorate-General is structured in the following bodies:

(a) The General Secretariat for General Affairs, which is responsible for the preparation of the meetings of the General Affairs Council, the follow-up of the European Union's external relations, without prejudice to the powers conferred on the Directorate-General for Foreign Policy, Europe and Security, as well as any other matter entrusted to it by the head of the Directorate-General in the field of its powers.

(b) The Subdirectorate-General for Economic and Financial Affairs, which corresponds to the follow-up of the European Union's economic and financial actions, as well as the collaboration in the process of establishing the European Union. Spanish position in the European Union in this field, without prejudice to the powers of the Ministry of Economic Affairs and Finance in the committees directly preparing the Council of Ministers for Economic and Financial Affairs of the European Union and, in particular, collaboration with the National Audit Office of the General Intervention of the State in the role of control of financial relations with the European Union.

(c) The Subdirectorate-General for Customs and Commercial Affairs, which is responsible for coordinating the process of establishing the Spanish position in the European Union in the field of trade, tariff and customs policy and matters related prosecutors.

(d) The Subdirectorate-General for Agricultural and Fisheries Affairs, which is responsible for coordinating the process of establishing the Spanish position in the European Union's Agriculture and Fisheries Councils, on the subject of agri-food from the Internal Market Council and the various committees on agriculture and fisheries, as well as from the process of submitting applications for EU aid in these areas.

e) The Subdirectorate-General for Industrial, Energy, Transport and Communications, and the Environment, which is responsible for coordinating the process of establishing the Spanish position in the European Union in matters of industrial, energy, transport and communications, and the environment, as well as the coordination of the rest of the General Directorate-General for the preparation of the Internal Market Council of the European Union.

(f) The Subdirectorate-General for Social, Educational, Cultural, and Health and Consumer Affairs, which is responsible for coordinating the process of setting up the Spanish position in the European Union on social, educational, (a) cultural and health and consumer affairs, as well as the process of submitting aid from the European Union in these areas.

(g) The Subdirectorate-General for Legal Affairs, to which the legal advice to the public authorities of the European Union corresponds, without prejudice to the powers of the Subdirección General de European Union and International Affairs of the State Advocate General; management before the institutions of the European Union in the notification of State aid; the elaboration and coordination of the Public Administrations interested in the responses to the infringement proceedings against Spain in its stages In the light of the Commission's proposal, the Commission has been able to take the necessary measures to ensure that the Commission's proposals are implemented in accordance with the Treaty on European Union. The European Union, as well as the preparation, monitoring and coordination of actions before the Court of Justice of the European Union, without prejudice to the powers of the Deputy Directorate-General for European and International Union Affairs Advocate General of the State; and the coordination of the process of fixing the Spanish position in the working groups of the Council on Legal Content and the Advisory Committee on the Internal Market.

(h) The Subdirectorate-General for Justice and Home Affairs, which is responsible for the coordination of initiatives and the monitoring of matters arising in the field of the European Union in the field of police cooperation, judicial cooperation, asylum, immigration and borders, terrorism and drugs.

Article 11. Secretary of State for International Cooperation.

1. The Secretariat of State for International Cooperation assists the head of the Department in the direction, formulation and implementation of the international cooperation policy for development; and in the coordination of external cultural action.

To this effect, as established by Law 23/1998, of July 7, of International Cooperation for Development, it exercises the powers conferred on the holder of the Department in the direction, formulation and execution of the policy of cooperation for development, planning and coordination; managing the cooperation resources managed by the Ministry of Foreign Affairs and Cooperation; ensuring Spanish participation in international organizations of development aid and defines the position of Spain in the formulation of the policy Community development. It also evaluates development cooperation policy, and programs and projects funded by state funds.

2. As an immediate assistance body to the head of the Secretariat of State, there is a Cabinet, with an organic level of Subdirección General, with the structure set out in Article 16.3 of Royal Decree 1366/2010 of 29 October.

3. They are attached to the Ministry of Foreign Affairs and Cooperation, through the Secretariat of the State of International Cooperation, the Spanish Agency for International Cooperation for Development, whose presidency is the responsibility of the Minister of Foreign Affairs. Secretary of State, and Instituto Cervantes, both regulated by their specific provisions.

4. It is functional and organically dependent of the Ministry of Foreign Affairs and Cooperation, through the Secretariat of State for International Cooperation for Development, the Academy of Spain in Rome, which is regulated by its provisions specific.

Article 12. Directorate-General for Planning and Evaluation of Policy for Development.

1. It is the responsibility of the Directorate-General for Planning and Evaluation of Policy for Development, under the Ministry of State of International Cooperation, the formulation, planning, monitoring and evaluation of the policy of international cooperation for development.

The head of the Directorate-General for Planning and Evaluation of Policy for Development is responsible for preparing the issues and implementing the agreements of the Sectoral Conference on Development Cooperation and the performance of the functions of the Secretariat of the Secretariat and its support bodies.

2. In particular, it is for the exercise of the following functions:

a) Develop the Director Plan and the annual plans for international cooperation.

b) Develop and follow up on sectoral and cross-cutting development policies and territorial strategies (country-strategy), in accordance with the principles of effectiveness of internationally accepted aid.

c) Move the main commitments and requirements of the international development agenda and the effectiveness of the aid to the processes and methodologies, to the strategic management of the cycle of the policies and interventions of development, and coordination between actors in the Spanish cooperation, and ensure their compliance.

d) Ensure the active participation of Spain in the international forums related to the effectiveness and quality of the aid.

e) To promote the coherence of development policies in all public administrations, without prejudice to the competences of other ministerial departments.

f) Promote education and research for the development and coordination of actors in this field.

g) Ensure the active participation of Spain in the OECD Development Assistance Committee (CAD).

(h) To participate, in collaboration with the organs of the State Administration that have responsibilities in this field, in the elaboration, coordination and follow-up of the Spanish multilateral policy with the multilateral non-financial development organisations, in particular the United Nations system, the OECD DAC, as well as the development of the EU's development cooperation policy.

i) To analyze and prepare the financing proposals to the multilateral non-financial development agencies, in coordination with other Units of the Ministry of Foreign Affairs and Cooperation, the Spanish Agency of International Cooperation for Development and other ministerial departments with competence in this field.

j) Run the budget of the Secretariat of State for International Cooperation for contributions to multilateral development agencies.

k) Manage and track contributions approved as voluntary contributions, trust funds, and other contributions to multilateral non-financial development agencies.

l) Evaluate, without prejudice to the competences of other ministerial departments, the policies, instruments, interventions, programmes and projects of international cooperation, which entails the programming of the evaluations strategic to carry out, coordinate and monitor them, the issuing of recommendations for the improvement of interventions, the dissemination and return of the results of evaluations and the publication of evaluation reports.

m) Strengthening the system of evaluation of Spanish cooperation and promoting knowledge and culture of evaluation among the actors of the system, ensuring the quality and coherence of the system of evaluation of the interventions in the field of development cooperation.

n) Participate in international development policy assessment networks, in particular the CAD evaluation network.

n) Coordinate, exchange information and manage knowledge on the evaluation of international cooperation with all actors in the Spanish system of international development cooperation.

3. It is also up to the Directorate-General to ensure the implementation and development of Law 23/1998 of 7 July 1998 on International Cooperation for Development, to deal with relations and coordination with the various actors in the system. Spanish international cooperation for the development and development of the tasks of computation, monitoring, coordination and evaluation of the official aid to the Spanish development, as well as the communication of the data to the Committee of Aid to the Development of the OECD.

4. For compliance with the above mentioned functions, the Directorate-General is organized in the following bodies:

(a) Subdirectorate-General for Planning, Policies for the Development and Effectiveness of Aid, which corresponds to the exercise of the functions provided for in points (a), (b), (c), (d), (e), (f), (g), (h), (i), (j) and (k) of paragraph 1 of the Article.

(b) The Division of the Evaluation of Policies for the Development and Management of Knowledge, which corresponds to the exercise of the functions provided for in points (l), (m), (n) and (n) of paragraph 1 of this Article.

Article 13. Deputy Secretary for Foreign Affairs and Cooperation.

1. The Secretariat for Foreign Affairs and Cooperation, under the authority of the holder of the Department, is responsible for the performance of the functions listed in Article 15 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State, as well as the direction, impetus and supervision of the management bodies and units in which the Secretariat is structured.

2. In particular, it is for the Secretariat, provided that they are not expressly attributed to other senior or senior department bodies, the following functions:

(a) The performance of the top leadership of all the personnel of the Ministry of Foreign Affairs and Cooperation, and the management and administration of human resources.

b) The control and inspection of the Department's activity.

c) Institutional relations with other departments and public administrations.

d) The management of general administrative services and the dispatch of matters not attributed to the competence of the Ministry's higher bodies.

e) The elaboration and coordination of the Department's overall budget policy plans.

f) Wealth management, economic and financial management.

g) The elaboration, processing and supervision of draft general provisions, permanent legal advice to those responsible for administrative management, handling of liability files assets, the formulation of proposals for the resolution of administrative resources, as well as the relations with the courts.

(h) The preparation, processing, monitoring and deposit of the International Treaties of which Spain is a party; the promotion of cross-border and interterritorial cooperation and monitoring and collaboration with others General government as far as its external activity or projection is concerned.

i) The elaboration, implementation and monitoring of the strategy and planning of IT and telecommunications, the impetus and development of the electronic administration in the Department, as well as the supervision of the technical advice and assistance in information technology.

j) The selection and training of officials from the Diplomatic Career Corps and the Translator And Interpreter Corps.

k) The Work of the Holy Places of Jerusalem and its Patronate.

(l) Assistance to the Minister of Foreign Affairs and Cooperation in the formulation and implementation of Spain's foreign policy in the fields of foreign affairs, protection of Spaniards abroad and supervision of the actions of the Spanish Consular Offices in the management of the services of the General Administration of the State which are provided abroad.

m) The design, implementation and management of the social issues of international content derived from migration, as well as the communities affected by international migration, including the Spanish communities in abroad.

n) The preparation, negotiation and follow-up of the International Legal Agreements that Spain subscribes to in the areas mentioned in the previous two letters, in coordination with the other departments of the competent Department in the field and with the remaining Ministries concerned.

n) Those expressly attributed by specific provisions.

3. The following units are directly dependent on the Sub-Secretariat, with an organic level of Subdirection General:

(a) The Technical Cabinet, as an organ of support and direct assistance to the Assistant Secretary.

(b) The General Inspection of Services, to which the functions laid down in the corresponding provisions of internal order are responsible.

(c) The Budget Office, which corresponds to the execution of the tasks referred to in Royal Decree 2855/1979 of 21 December 1979 establishing the Budgetary Offices.

d) The Diplomatic School, which is governed by its specific provisions.

e) The International Legal Counsel, as an advisory body to the General Administration of State in matters of international law.

4. They are attached to the Secretariat, with the functions assigned to them by the provisions in force and without prejudice to their dependence on the Ministries of Justice and the Economy and Finance, respectively, the following bodies with the rank of Sub-direction General:

a) State Advocacy in the Department.

b) The Delegated Intervention of the General Intervention of the State Administration.

Article 14. Technical General Secretariat.

1. It is up to the Technical General Secretariat, under the immediate dependence of the Secretariat, to perform the functions attributed to it by Law 50/1997 of 27 November of the Government and Article 17 of Law 6/1997 of 14 April 1997. Organisation and functioning of the General Administration of the State, and in particular the following:

(a) The elaboration, where appropriate, and the processing of the general provisions in the department's own matters, the report of the provisions drawn up by other ministries and the actions related to the publication of provisions and administrative acts of the Department in the Official Gazette of the State.

(b) The study and report of the subjects to be submitted by the various ministerial departments to the deliberations of the General Commission of Secretaries of State and Sub-secretaries, and of the Council of Ministers, in their case, the relevant observations; as well as the preparation and processing of the cases proposed in those instances by the various higher bodies or directors of the Ministry of Foreign Affairs and Cooperation, or by the bodies or bodies; agencies attached to the Department.

c) The elaboration of legal reports, in particular those provided for in Articles 22.2 and 24.2 of Law 50/1997 of 27 November of the Government.

(d) The monitoring and coordination of actions carried out within the Department and the agencies and agencies assigned to it in the area of streamlining procedures and administrative modernization.

e) The processing, monitoring, custody and publication of international treaties of which Spain is a party, as well as the evacuation of consultations and the issuance of reports in relation to them.

f) The monitoring and reporting of non-regulatory agreements that are signed with foreign entities by the higher bodies and directors of the General Administration of the State, by the agencies and agencies that are dependent on the itself, as well as the organs of other public administrations.

g) Collaboration with other public administrations, constitutional bodies, ministerial departments and agencies of the General Administration of the State in the development of the State's external activity, coordinating it, in its case, and track it.

h) The monitoring and reporting of the acts and provisions of the Autonomous Communities that affect the competences of the Department.

i) The monitoring and promotion of cross-border, inter-regional and inter-territorial cooperation, both in the context of the Council of Europe and in the context of the policies of the European Union. In particular, it is up to the Presidency of the committees to follow up on the Treaty of Transfrontier Cooperation with France and Portugal, to report on the agreements and agreements which have been signed in the field of cooperation. (a) the European Regional Cooperation Council (cross-border) and the European Grouping of Territorial Cooperation, as well as the registration of the European Territorial Cooperation Groupings which are set up under Spanish legislation.

j) The management of the overflights and scales of foreign aircraft and military vessels in Spain and Spain abroad, as well as the renewal of the agreements signed in this area.

k) The handling and proposal for the resolution of the administrative resources; the claims of responsibility for the assets of the Administration; of the claims prior to the judicial, civil or labor route; and of the procedures for the ex officio review of the administrative acts of the Department.

l) The direction and coordination of the editorial activity of the Department and the corresponding administrative documentation.

m) The management of library and documentation services; managing the general file, coordinating the remaining archives and libraries of the Department and the agencies and agencies attached to it, and conservation of the documentary heritage of the Department.

n) The exercise of the functions attributed to the Ministry of Foreign Affairs and Cooperation in the translation and interpretation of foreign languages and advice and support to the other organs of the Administration General of the State in this field, as well as those relating to the accreditation of sworn translators and interpreters, in accordance with their regulatory regulations.

2. The Technical General Secretariat, with an organic level of Subdirectorate-General, which is responsible for the exercise of the functions listed in paragraphs (a), (b), (c), (d), (l) and (m) of paragraph 1, is dependent on the Technical General Secretariat.

3. They also depend on the Technical General Secretariat, the following units with the organic level to be determined in the employment relationship:

(a) The Division of Institutional Relations and in collaboration with the Autonomous Communities, which corresponds to the exercise of the functions listed in paragraphs (g), (h), (i) and (j) of paragraph 1.

(b) The Division of International Treaties and Non-Normative Agreements, which corresponds to the exercise of the functions listed in paragraphs (e) and (f) of paragraph 1 above.

(c) The Division of Resources and Relations with the Courts, to which the exercise of the functions listed in paragraph (k) of the previous paragraph 1 corresponds.

4. It is also up to the Technical General Secretariat to the Office of Interpretation of Languages, which corresponds to the exercise of the functions attributed in Royal Decree 2555/1977, of 27 August.

Article 15. Foreign Service General Address.

1. It is for the Directorate-General of the External Service, under the immediate dependence of the Secretariat, to exercise the functions relating to the management of human resources, internal arrangements, economic and financial management, works and (i) the provision of information, management, planning and assistance and communications. In particular, it is for the exercise of the following functions:

a) Lease, maintenance and works of the buildings of the Department in the central services, security of the department in central services and in the representations abroad, acquisition of vehicles in the foreign, internal regime, general registration, office of administrative information, diplomatic mail and works of art.

b) The management of civil servants and employees, both in central and outside services.

(c) The budgetary monitoring of current revenue and expenditure abroad, the acquisition and leasing of buildings of the representations of Spain abroad, the management of credit for supplies, material, including the consular, as well as the compensation for the service.

d) The functions of enabling and paying the Central Paying Fund, managing the bank accounts of income and payments to be justified abroad, as well as the management of the appropriations corresponding to the Department in concept of protocolary and representative attention.

e) The management of the works, rehabilitation, maintenance and furnishing of the buildings of the representations of Spain abroad, as well as the equipment of beings, useful and menaje in the representations in the outside.

f) The impetus, planning, development, implementation and management of: IT and telecommunications plans and infrastructures, voice and data; the Internet portal and the administrative intranet for central and central services external; the electronic administrative services associated with them; the satellite network; international technical networks of visas, consular assistance, regulated information; the security of information; and technical assistance to users.

g) Control of expenditure and revenue of the Ministry and consular collection.

2. The following Units, with an organic level of General Subdirection, depend on the General Directorate of the External Service:

(a) The General Staff, to which the exercise of the function referred to in paragraph (a) of the previous paragraph 1 corresponds.

(b) The General Staff Subdirectorate, which corresponds to the exercise of the function provided for in paragraph (b) of paragraph 1.

(c) The General Sub-Directorate of Financial Management, to which the exercise of the functions referred to in paragraphs (c) and (d) of paragraph 1 is carried out.

(d) The Subdirectorate-General for Works and Furnishing Furniture in the Exterior, which corresponds to the exercise of the function provided for in paragraph (e) of paragraph 1.

(e) The Subdirectorate-General for Informatics, Communications and Networks, which corresponds to the exercise of the function provided for in paragraph (f) of paragraph 1.

3. It also depends on the Directorate-General of the External Service the Division of Management Control, with the organic level to be determined in relation to jobs, which corresponds to the exercise of the function provided for in paragraph (g) of the previous paragraph 1.

Article 16. Directorate-General for Consular and Migration Affairs.

1. It is the responsibility of the Directorate-General for Consular and Migratory Affairs, under the direct dependence of the Secretary-General, the coordination and supervision of all the actions of the Spanish consular offices in the management of the services of the General Administration of the State which are provided abroad.

The proposal, elaboration and implementation of the policy on protection and assistance to Spanish citizens abroad and in the field of immigration and asylum, in the sphere of action of the Ministry (a) Foreign Affairs and Cooperation and without prejudice to the powers conferred on other departments in these matters, with which the Directorate-General maintains the necessary coordination.

2. In particular, it is for the exercise of the following functions:

(a) The proposal and implementation of the policy of protection of Spaniards abroad, with particular attention to matters relating to consular emergencies; the coordination of the action of consular offices in the management of the services that the General Administration of the State provides abroad, and the issuing of passports abroad; as well as the supervision of the honorary consulates of the Nation.

b) Coordination of consular powers in matters of assistance to civil and criminal judicial cooperation, in particular, the processing of extraditions; the negotiation and implementation of international treaties and conventions relating to consular action, and the coordination of consular functions in the fields of public notice and consular civil registration.

(c) The proposal and implementation of the actions in the field of social assistance to Spaniards abroad, in particular in terms of the aid and repatriation; the management of the registry of consular registration; coordination in the consular offices of the electoral census of absent residents, and the electoral participation of Spaniards abroad; as well as the follow-up of the advice of Spanish residents.

d) The coordination of the processing by the consular offices of the uniform visas, as well as the management of national visas, in the terms established in the Spanish legislation, and, in the own field of the powers of the Ministry of Foreign Affairs and Cooperation, the proposal and implementation of immigration and asylum policy.

e) The coordination of migration policy at the multilateral level, in the EU and in bilateral relations with other countries, together with other relevant ministerial departments in the field.

3. The following bodies depend on the Directorate-General for Consular and Migration Affairs:

(a) The General Subdirectorate for Consular Protection and Assistance, which corresponds to the exercise of the function set out in subparagraph (a) and (c) of the previous paragraph.

(b) The Subdirectorate-General for Consular Legal Affairs, which corresponds to the exercise of the function set out in paragraph (b) of the previous paragraph.

(c) The General Subdirectorate for Foreign Affairs, to which the exercise of the function set out in paragraph (d) of the previous paragraph corresponds.

(d) The Subdirectorate General for Migration, which corresponds to the exercise of the function set out in paragraph (e) of the previous paragraph.

4. It is also up to this Directorate-General, with the organic level to be determined in the employment relationship, the Schengen Affairs Division, which is responsible for monitoring the European Union's Schengen Evaluation Groups, as well as the assessment of the management of visas governed by Community legislation by consular offices.

Article 17. General Directorate of Foreign Communication.

1. Under the direct dependence of the Department holder, the Directorate-General for Foreign Communication carries out the functions of dissemination of the information and activities of the Ministry of Foreign Affairs and Cooperation that may be of interest to the for public opinion. In addition, it will facilitate the communication between the head of the Department and other senior positions of the Ministry with the media through press conferences or the appropriate channels of communication in each case. It shall monitor the news and information issued by the major media, providing such information to the Department holder and other ministerial officials. This information will also be provided to the Permanent Missions and Representations of Spain abroad, as well as to the foreign diplomatic missions accredited in Spain.

Coordinate, likewise, the activity of the various State Secretaries and Directorates-General of the Ministry in the field of communication and media relations, promoting cohesion among the different departments with the the aim of strengthening the information work of each of them.

It is also up to you to be responsible for designing, updating, and managing portal content on the Internet.

2. For the purposes of the above tasks, the Directorate-General has a General External Communication Subdirectorate. In addition to the functions assigned to you by the Director General, this Subdirectorate is responsible for the economic management of the Directorate-General, the preparation of its budget and the management of the publications published by it.

3. It also depends on this Directorate-General, with the organic level to be determined in the employment relationship, the Technical Organization Division, which is responsible for coordinating the information, production and distribution of information, and the documentation tasks.

4. The holder of the Directorate-General for Foreign Communication is excluded from the general rule of appointment provided for in Article 18.2 of Law 6/1997 of 14 April.

Article 18. Directorate-General for International Economic Relations and Energy Affairs.

1. Under the direct dependence of the Minister, it is the responsibility of the Directorate-General for International Economic Relations and Energy Affairs within the framework of the general powers of the Ministry of Foreign Affairs and Cooperation. the role of advice, elaboration, proposal and implementation of Spain's foreign policy, in the following areas:

a) Bilateral international economic relations.

(b) Multilateral economic relations, ensuring the institutional representation of Spain vis-à-vis integration systems and other bodies, including the OECD, and the relevant multilateral conventions, without prejudice to the competences of the Ministries of Economy and Finance and Industry, Tourism and Trade in the field. It is also up to him to coordinate, in collaboration with the competent departments, the representation of Spain before the committees and special bodies of these conventions and agencies, ensuring in these the defense of the interests of Spain.

c) International relations in the field of air, sea, land, and space, ocean and polar issues.

d) The international dimension of energy issues, both in bilateral and multilateral aspects.

2. It is also the responsibility of the Directorate-General for the negotiation and internal processing of international, bilateral and multilateral agreements related to the areas of their responsibility.

3. For compliance with the above mentioned functions, the Directorate-General is structured in the following bodies:

(a) The Subdirectorate General for International Economic Relations, which corresponds to the exercise of the function provided for in paragraph (a) above.

(b) The Subdirectorate-General for Energy and Multilateral Affairs, to which the exercise of the functions provided for in paragraphs (b), (c) and (d) of the previous paragraph is required.

Article 19. Ambassador introducer.

It directly depends on the holder of the Department of the Ambassador, who will have the consideration and treatment of Director General, with the rank of Ambassador, and who will coordinate the following protocol units:

(a) The General Subdirectorate of Travel and Official Visits, Ceremonial and Orders, the holder of which receives the name of the Second Ambassador of Ambassadors, to which it corresponds: the preparation, coordination and execution of the acts officers and ceremonies related to the foreign policy of the State, taking place in the national territory and abroad, especially the official trips of His Majesties the Kings of Spain and the visits of the Heads of State without prejudice to the powers to be exercised by other bodies. It is also the responsibility of the processing of the records of decorations of the Orders of Isabel the Catholic and of the Civil Merit.

b) The General Secretariat of the Foreign Ministry, which is responsible for the management and control of all matters related to diplomatic missions accredited in Spain, its consular offices and international organizations with headquarters or office in our country, which are coming in compliance with the Vienna Conventions on diplomatic and consular relations, and other relevant regulations.

Additional disposition first. Removal of organs.

The following Department organs are deleted:

a) The Foreign Policy Analysis and Forecast Cabinet.

b) The Common Foreign and Security Policy Subdirection.

c) The General Subdirectorate of Eastern Europe and other European Non-Community Countries.

d) The Office of Gibraltar Affairs.

e) The General Sub-direction of Continental Asia.

f) The General Sub-Directorate of Bilateral Economic Relations with Europe and OECD Countries.

g) The General Sub-Directorate of Bilateral Economic Relations with Developing Countries.

h) The General Subdirectorate for Multilateral Economic Relations and Air, Maritime and Land Cooperation.

i) The General Subdirection of Candidate Countries and Neighbourhood Policies.

j) The Technical Cabinet of the General Secretariat for the European Union.

k) The European Union's Subdirectorate-General for Institutional Affairs.

l) The General Secretariat for the Coordination of Community Legal Affairs.

m) The General Subdirectorate for the Ibero-American Community of Nations.

n) The General Sub-Directorate of Latin American Multilateral Organizations.

n) The General Subdirectorate of Protection of Spanish Abroad.

or) The Subdirectorate General for Social Affairs.

Additional provision second. Delegation of provisional duties and privileges.

1. The delegations of powers, granted by the various organs of the Department and not revoked until the date of entry into force of this royal decree, will continue to be valid and will be able to make use of them the competent organs for the reason of the matter to replace the delegates, until they are expressly revoked or again granted to the different organs resulting from the application of this royal decree.

2. The units and posts of work in the deleted organs, or whose organic dependence has been modified by this royal decree, shall be provisionally assigned, by means of a decision of the holder of the Secretariat, and after agreement, in their Case, of the Secretary of State concerned, until the new relationship of jobs, to the regulated organs in this royal decree, according to the attributions that they are assigned.

Additional provision third. No increase in public spending.

The application of this royal decree, including the creation and modification of the units without organic level of Subdirection General provided for in their articles, will be done without increase of the operating costs of the respective organs managers and will not increase public expenditure.

Units and jobs with an organic level below the general sub-directorate will continue to remain and will be paid from the same budgetary appropriations until the corresponding relations of the jobs adapted to the organic structure established by this royal decree.

Single transient arrangement. Commission Delegated Commission for the Spanish Presidency of the European Union in 2010.

They are members of the Government's Delegate Commission for the Spanish Presidency of the European Union in 2010, the head of the Department and the head of the Secretariat of State for the European Union, who will also exercise the Secretary functions of the same.

The Commission Delegated Commission for the Spanish Presidency of the European Union in 2010 will be extinguished, with the exception of a specific extension, on 31 December 2010.

Single repeal provision. Regulatory repeal.

The Royal Decree 1124/2008, dated 4 July, is repealed and the basic organic structure of the Ministry of Foreign Affairs and Cooperation is developed, and the provisions of equal or lesser terms will be opposed to the established in this royal decree.

Final disposition first. Powers of development.

The Minister of Foreign Affairs and Cooperation is hereby authorized to adopt the necessary measures for the development and execution of this royal decree, prior to the appropriate legal procedures.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
