Having regard to the text of the minutes of 28 March 2011 in which the Agreements concerning the amendment of Article 2 (functional scope) of the State Metal Sector Agreement (Convention Code No 99003435011900) are collected, the relationship of occupations and jobs affected by electrical risks, which cannot be carried out by temporary work companies in the metal sector, Agreements which have been signed by the Spanish Confederation of Business Organisations of Metal (Confemetal) representing companies in the sector, and another by the Federation of Industry of the Trade Union Confederation of Workers ' Commissions (FI-CC.OO.) and Metal, Construction and Purposes of the General Union of Workers-Federation of Industry (MCA-UGT) on behalf of the workers of the Union Confederation of Workers. in accordance with Article 90 (2) and (3) and Article 83.3 of the Royal Decree of 24 March 1995 on the recast of the Law on the Staff Regulations and on Royal Decree 713/2010 of 28 March 1995 on the of May, on the registration and deposit of collective agreements and agreements of work,

In Madrid, at the headquarters of Confemetal, being 13:00 hours of March 28, 2011, gathered, on the one hand, the Federation of Industry of CC.OO. (FI-CC.OO.) and Metal, Construction and Aends of the UGT-Federation of Industry (MCA-UGT), and of the other, the Spanish Confederation of Business Organizations of Metal (Confemetal), represented by the related persons, on the occasion of the modification and incorporation of certain provisions into the State Metal Sector Agreement, both parties

AGREE

First. -Amend the State Agreement of the Metal Sector, registered and published by Resolution of the Directorate General of Labor, of 7 August 2008, and subsequent Resolutions of that agency, of 3 March, 12 May, 28 October 2009 and October 6, 2010, in the following terms:

a) Article 2, Functional Scope:

" The functional scope of the Industry, Technology and Services of the Metal Sector comprises all the companies and workers that carry out their activity, in processes of manufacturing, processing or transformation, as well as in the assembly, repair, preservation, maintenance, storage or commissioning of industrial equipment and installations, which relate to the Metal Sector.

Thus, the following activities and products are integrated into the field of application of this Convention: metallurgy, steel; automotive and components; shipbuilding and its auxiliary industry; industry aerospace and its components, as well as railway equipment, renewable energy components; robotics, domotics, automatisms and their programming, computers and their peripherals or auxiliary devices; printed and integrated circuits and articles similar; technological infrastructure; telecommunications equipment and technologies; and of the information; and all types of equipment, products and mechanical, electrical or electronic equipment.

The companies involved in engineering, technical engineering services, analysis, inspection and testing, manufacturing, assembly and/or maintenance, which are carried out in the industry and in the power generation, oil, gas and water treatment plants, as well as companies engaged in power lines, cables and telephone, computer, satellite, signalling and electrification railways, electrical and instrumentation facilities, air conditioning and cold industrial, plumbing, heating and other ancillary and complementary activities of the Sector, both for the industry and for the construction.

Also included are welding and bonding technologies, calorifing, tower-cranes, solar panels, and jewelry, watchmaking or jewellery; toys; cutlery and menaje; locksmith; weapons; medical devices; Optical industry and precision mechanics; electric lamps and appliances; storage, cutting and replacement of counters; recovery and recycling of metal secondary raw materials, as well as other specific activities and/or complementary to the Sector.

Also included are the manufacturing, installation, maintenance, or assembly of industrial equipment, metal carpentry, calderry, mechanization and automation, included in the Sector or any other which requires such services, as well as industrial cleaning.

Similarly, the activities of repair of mechanical, electrical or electronic equipment; maintenance and repair of vehicles; ITVs and those of an auxiliary, complementary or related, directly related to the Sector.

It shall also apply to the metalgraphic and manufacturing industry of metal packaging and boterium, when in its manufacture veneer of a thickness exceeding 0,5 mm is used.

Will be outside the scope of the convention, companies engaged in the sale of items in the exclusive marketing process.

The above mentioned activities, which, because of their prevalent performance in the company, are integrated in the field of application of this State Convention are included in Annex I of the same, where the activities of the CNAE for the sector. It is understood by principal activity, the prevalent or preponderant within a unique cycle of doing business, under the same legal form and unitary structure.

This relationship has an enunciative and non-exhaustive character, being capable of being extended or supplemented by those economic activities that in the future may be included in the National Classification of Activities. Economic ".

Second. -The parties agree to approve, for the exclusive use of the Metal Sector Joint Commission, the document of " Explanatory Notes to the Eheadings of the CNAE related to the functional scope of the Metal ".

Third. -The signatory parties also agree to incorporate into the State Metal Sector Agreement, as Annex VI, the " Relationship of occupations and jobs affected by electrical risks that cannot be performed by temporary work enterprises in the Metal Sector. " Similarly, it is agreed to incorporate, for the purposes of the Register, a "reasoned report" on such matters.

Reason exposure

Electrical installations are, in general, a potentially dangerous activity for safety and health at work. Due to this, by means of Royal Decree 614/2001 of 8 June, the minimum requirements for the protection of the health and safety of workers in the face of electrical risk are regulated.

This standard was the subject of special attention by the National Institute of Safety and Hygiene at Work, who drew up a Technical Guide that provides criteria and recommendations for the purpose of facilitating business and responsible for the correct interpretation and application of the Royal Decree, for the assessment and prevention of the electrical risk.

Electrical risks must be comprehensively controlled, both in their use or presence in workplaces, and in terms of the techniques and procedures used to work in the facilities. power or in its vicinity.

Jobs and occupations in this sector of activity involve potentially dangerous risks that must be controlled or minimized as far as possible, in such a way that for business reasons for the organisation of work, as well as For reasons of safety and health, they must be carried out by companies and workers of the highly specialized Metal Sector.

Given the relevance of the electrical risks and the promotion and prevention measures to be taken and the training and information that is specific and appropriate to the job that the workers must possess, in the framework of the Staff Regulations and, in particular, Article 83.3 of the Staff Regulations: Federation of Industry of the Trade Union Confederation of Workers ' Commissions (FI-CC.OO.), Metal, Construction and Purposes of the General Union Workers-Federation of Industry (MCA-UGT) and as association of entrepreneurs the Spanish Confederation of Business Organisations of Metal (Confemetal), as unions and association of more representative entrepreneurs of the Metal Sector, recognizing the necessary legitimization for the formalization of this document, they decide to sign an Agreement on specific matters relating to occupations and jobs affected by electrical risks by restricting temporary work undertakings which may make provision for making available in the field of risk activities High voltage electrical power.

Single disposition.

The relationship of occupations and jobs affected by electrical risks that cannot be performed by temporary work companies in the Metal Sector are as follows:

1. According to Royal Decree 614/01/2001 of June 8, on minimum requirements for the protection of the safety and health of workers in the face of the electrical risk, the types of work performed in electrical installations of Baja Voltage (BT, hereafter) and High Tension (hereinafter referred to as 'AT') are as follows:

Jobs without tension.

Jobs in tension.

Maneuvers.

Measurements.

Tests.

Verifications.

Jobs in proximity.

This rule, in Article 2, provides that the employer must take the necessary measures to ensure that the use or presence of electrical energy in the workplace does not result in risks to health and safety. of the workers or, if this is not possible, so that these risks are reduced to a minimum. The adoption of these measures shall be based on the assessment of the risks referred to in Article 16 of the Occupational Risk Prevention Act and the first section of Chapter 2 of the Prevention Services Regulation.

Taking into account that activities are usually carried out in electrical installations of external ownership and that they have their own procedures for work and discharge is essential the knowledge and coordination of the and owner authority to perform the jobs.

2. According to Royal Decree 614/2001, the jobs and professionals who carry out these activities are the officers, installers or maintainers who carry out the following posts:

(A) Authorized worker.

(B) Qualified worker.

(C + AE) Qualified and Authorized Worker in writing.

Authorized worker. -Worker who has been authorized by the employer to perform certain work at electrical risk, based on his ability to do so correctly according to the procedures mentioned above. Decree.

Risks: The most characteristic and inherent risks to the work performed in electrical installations are:

Electrical shock by contact with elements in voltage (direct electrical contact), or with masses accidentally put into stress (indirect electrical contact).

Burn by electric shock or electric arc.

Falls or strokes as a result of shock or electric arc.

Fire or explosions caused by electricity.

In addition to the specific risks are considered the generals of all work.

The responsibility of authorizing these workers falls on the company that directs the works, not on the one that puts the "worker at the disposal", since the one who directs is the one that possesses the capacity, human and media technique suitable for the performance of the work. As well as professional competence to elaborate the procedures required by this Decree. Therefore, it does not seem appropriate for this worker to be able to perform these tasks authorized by the "making available" company which does not possess the technical qualification or training, to authorize them.

These works are developed by teams that are informed and adiestra in a theoretical-practical way in the procedure, checking their ability to understand and execute it. Therefore, it also does not seem advisable in this that these responsibilities are carried out by the company "made available".

The completion of the procedures and instructions of the authorized persons must be carried out by qualified technicians or engineers, who will be responsible for the technical adequacy of the same; conditions other than the object and the company's competence to "make it available".

In this way, following the arguments above and taking into account the seriousness of the consequences, which can be derived, from the high risks inherent in the works that the authorized workers can carry out, not it seems logical that these jobs can be performed by "making available" workers.

Qualified worker. -Authorized worker who has expertise in electrical installations, due to his or her accredited professional or university background, or certified experience of 2 or more.

This definition encompasses the above: A "Qualified" worker must always be an "Authorized" worker. This means that a worker is unable to perform an electrical risk, even if he has knowledge or training in electrical installations, if he has not previously been authorized to do so by the employer.

In terms of "certified experience" it must be the company or companies in which the worker has developed the works with electrical installations that issue the corresponding certificates

Tasks that you can do:

Tension jobs in BT Installations.

1) The security measures to be taken.

2) The material and means of protection to be used and, if necessary, the instructions for use and for the verification of their good condition.

3) The circumstances that might require the interruption of the job.

The authorization will need to be renewed, after a further verification of the worker's ability to correctly follow the established work procedure, when the worker changes significantly or when the worker has no longer performing the type of work in question for a period of more than one year.

In addition, the authorization must be withdrawn, when the worker is observed to be in breach of the safety standards, or when the health surveillance shows that the state to the temporary situation of the worker does not conform to the psycho-physical requirements required by the type of work to be developed.

Tasks. -Tension jobs in AT power installations.
