On the occasion of the World Health Alert issued by the WHO on 15 March 2003 in the face of the emergence of Severe Acute Respiratory Syndrome (SARS), and under the precautionary principle, the Directorate-General for Public Health adopted the Resolution of 4 April 2003 adopting special measures for health protection in relation to the importation of certain goods from the areas of third countries affected by the acute respiratory syndrome Severe ("BOE" n. 82, April 5).

The document "Information to Member States regarding goods and animals arriving from SARS-affected areas", published by the World Health Organization on 11 April 2003, indicates that there is no epidemiological information suggests that contact with goods, products or animals from areas affected by SARS has been the source of SARS infection in humans, so it cannot be concluded that they may pose a risk to public health. For this reason, it is considered that the Resolution should not be applied since it is not possible to rely on the precautionary principle that gave rise to the resolution.

Therefore, pursuant to Articles 26 and 38 (1) and (2) of Law 14/1986 of 25 April, General of Health, Articles 142 and 145 of the Decree of 7 September 1934 approving the Regulation Organic de Sanidad Exterior; in Article 9 of the Decree of 14 July 1950 approving the Regulation on the External Health of Air Navigation; in Article 10 of Royal Decree 1418/1986 of 13 June 1986 on the functions of the Ministry of Health and Consumer Affairs in the field of external health; and in the seventh provision of the Ministerial Order of 20 January 1994, resolute:

First. Repeal provision.

This Resolution leaves without effect the Resolution of 4 April 2003 adopting special measures for health protection in relation to the importation of certain goods from the countries of the European Union. third parties affected by Severe Acute Respiratory Syndrome.

Second. Communications.

To transfer this adopted measure to the peripheral services of Foreign Health, organically dependent on the Areas and Health Dependencies of the Delegations and Subdelegations of Government.

Third. Final disposition.

This Resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
