The Royal Decree 200/2012, of 23 January, for which the basic organic structure of the Ministry of Health, Social Services and Equality is developed and the Royal Decree 1887/2011 of 30 December 2011 is amended, establishes the basic organic structure of the ministerial departments, provides that the Advisory Board of Health is the advisory and assistance body to the person in charge of the Department in the formulation of the health policy.

For its part, Order SCO/2024/2003, of 15 July, for which the composition and operating system of the Advisory Council for Health is developed, was the update of the composition and functioning of the Council. This order increased the number of vowels and created a Permanent Commission to deal more quickly with current issues that had an impact on the formulation of health policy and that were required by the person in question. Department.

The functions that this Council is developing recommend making changes in its structure and composition so as to facilitate the adoption of agreements within the Council itself, its Commissions and its job.

Thus, in the composition of the Council it is incorporated, together with the presidency, a vice presidency which, in accordance with Article 23.2 of Law 30/1992, of 26 November, of the Legal Regime of the Public and the Common Administrative Procedure, shall replace that in the case of vacancy, absence or disease.

Therefore, by this order, Order SCO/2024/2003, of July 15, is repealed to adapt the composition and functioning of the Advisory Council of Health to the current situation in which the health policy in our country develops country, marked by the necessary agility in decision-making and by containment in spending items.

This order is issued in accordance with Article 1.4 of Royal Decree 200/2012 of 23 January, which determines that the composition and operating arrangements of the Health Advisory Board are governed by their specific regulations.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, I have:

Article 1. Object.

The Health Advisory Board, in accordance with Article 1.4 of Royal Decree 200/2012 of 23 January, developing the basic organic structure of the Ministry of Health, Social Services and Equality and amending the Royal Decree 1887/2011, of December 30, establishing the basic organic structure of the ministerial departments, is the advisory and assistance organ to the person holder of the Department in the formulation of the policy health.

Article 2. Functions.

It is the role of the Advisory Board of Health to advise and inform the head of the Ministry of Health, Social Services and Equality on the scientific, ethical, professional and social aspects that may have an impact on the formulation of health policy and how many issues relate to it.

Article 3. Composition.

1. The Health Advisory Board shall be composed of the following members:

a) The President.

b) The Vice President.

c) The Secretary.

d) The Vocals, which will be as follows:

1. The Presidents of the General Councils of the Official Colleges of the professions in the health sector.

2. º Other Vocals in number not greater than thirty.

2. The President and the Vocals referred to in paragraph 1 (d) 2. shall be appointed by the person holding the Ministry of Health, Social Services and Equality, among professionals of recognized prestige in the field of Health, Medicine, Health Sciences and Social and Economic Sciences and Discipline. Among these Vocals, the head of the Ministry of Health, Social Services and Equality shall appoint the Vice-President and the Secretary of the Council, the latter on a proposal from the President.

In addition to the members mentioned in the previous paragraph, the person holding the Ministry of Health, Social Services and Equality may appoint an honorary President.

3. The appointment of the members of the Council may be freely revoked by the person holding the Ministry of Health, Social Services and Equality, except those of the Vocals referred to in paragraph 1 (d) 1. ostentan.

Article 4. Of the President, the Vice-President and the Secretary.

1. It is for the President of the Council:

(a) The general representation of the Council in its field of competence.

b) The convening of the ordinary meetings of the Council.

c) Maintaining the continuity of the Council among its meetings.

2. It is for the Vice-President of the Council:

a) Replace the President in case of vacancy, absence or illness.

b) The other functions attributed to him by the President.

3. It is for the Secretary of the Council:

a) The preparation of the Order of the day of the calls.

b) Support to the President in the maintenance and coordination of operation.

c) The coordination of the different commissions.

Article 5. Operation.

1. The Health Advisory Board shall operate in full and in permanent commission, and shall also constitute working groups which shall have the composition and functions to be determined in each case.

2. The Council Plenary shall meet at least twice a year in conjunction with natural semesters and shall be convened by the holder of the Ministry of Health, Social Services and Equality.

The Standing Committee shall be composed of the Vice-President of the Council, the Secretary and twelve members appointed by the President.

The Permanent Commission will prepare plenary meetings and prepare reports that are relevant to the advice and information to the Department Holder on the issues that are required.

The Working Groups will meet when necessary for the development of specific tasks.

3. The Advisory Board shall draw up its own Rules of Procedure without other limitations than those mentioned in the preceding numbers and, in any case, adjusting its operation to the provisions of the bodies of the institutions of Law 30/1992, 26 November, the Legal Regime of Public Administrations and the Common Administrative Procedure.

4. The Ministry of Health, Social Services and Equality shall provide the personal and material means necessary for the functioning of the Council.

Article 6. Economic regime.

1. Members of the Council shall not receive any remuneration for the performance of their duties.

2. The cost of running the Health Advisory Board will be met by the existing appropriations in the Ministry of Health, Social Services and Equality, without any increase in its overall allocation.

Single repeal provision. Regulatory repeal.

Order SCO/2024/2003, dated July 15, for which the composition and operating system of the Health Advisory Board is developed.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
