Order ARM/2457/2010, of 21 September, establishing a fishing plan for the bottom trawling fishery in the National Gulf of Cadiz, establishes, among other extremes, a temporary ban in its article 2.3. Order ARM/2296/2011, dated July 27, amended that same article, establishing the period of closure for the years 2010 and 2011.

Within the framework of the Sectoral Fisheries Conference, a working group has been set up to study the sector's needs and to adapt its capacity to the fishing opportunities existing in the Gulf of Cadiz. On the other hand, the period of validity of the fishing plan contained in that order was two years since its entry into force. Once that period is about to be met and in the light of the experience gained from the implementation of the fishing plan and the development of the fishery, it is appropriate to extend the same two years more, adapting the temporary closure period to this end. terms similar to the provisions for 2010 and 2011.

Therefore, it is appropriate to modify the aforementioned order.

The procedure for communication to the European Commission provided for in Article 46 of Council Regulation (EC) No 850/2998 of 30 March for the conservation of fishery resources through technical measures has been completed. protection of juveniles of marine organisms.

In the preparation of this order, a report has been requested from the Spanish Institute of Oceanography and has been consulted to the Autonomous Community of Andalusia and the affected fishing sector.

This order is issued in accordance with the provisions of Article 12 of Law 3/2001 of 26 March on the Maritime Fisheries of the State.

In its virtue, I have:

Single item. Amendment of Order ARM/2457/2010 of 21 September establishing a fishing plan for the bottom trawling fishery in the National Gulf of Cadiz.

Order ARM/2457/2010 of 21 September establishing a fishing plan for bottom trawling fishing at the National Gulf of Cadiz, is hereby amended as follows:

One. Article 2 (3) is replaced by the following:

" 3. A temporary closure of 50 days will be established between 24 September and 7 November each of the years 2012 and 2013. The remaining five working days shall be the owner's choice. '

Two. Article 5 (1) is replaced by the following:

" 1. The fishing plan contained in this order shall be valid until 31 December 2013. '

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
