Regulation (EC) No 2160/2003 of the European Parliament and of the Council of 17 November 2003 on the control of salmonella and other specific food-borne zoonotic agents provides that Member States establish national control programmes for each of the zoonoses and zoonotic agents listed in Annex I in order to achieve the Community objectives of reducing the prevalence of zoonoses, including the Salmonella.

With a view to setting the targets for the reduction of prevalence by the European Union, it was necessary to have a number of surveillance measures in order to ensure that the real situation in relation to the serotypes of Salmonella with a higher incidence for public health.

The main objective of the publication of this Order was to establish such measures on holdings of laying birds whose eggs are intended for human consumption, in anticipation of the entry into force of the measures provided for in this Regulation. Community rules and the establishment of the National Control Programmes referred to in the Community Regulation.

The Commission Regulation (EC) No 517/2011 of 25 May 2011 implementing Regulation (EC) No 2160/2003 of the European Parliament and of the Council as regards the objective of the European Parliament and the European Parliament and of the Council [3] has been published. the Union to reduce the prevalence of certain salmonella serotypes in laying hens of the species Gallus gallus and to amend Regulation (EC) No 2160/2003 and Commission Regulation (EU) No 200/2010. In addition, recently, Commission Regulation (EU) No 1086/2011 of 27 October 2011 amending Annex II to Regulation (EC) No 2160/2003 of the European Parliament and of the Council and Annex I has been published. of Commission Regulation (EC) No 2073/2005 as regards salmonella in fresh poultry meat which entered into force on 1 December 2011.

In addition, since 2008, the National Program for the Surveillance and Control of Salmonellosis of Importance to Public Health in Laying Hens, which includes aspects related to the disease, is being applied throughout the Spanish territory. Salmonella control programmes, in line with the Community rules, and therefore it is no longer necessary to maintain this Order, as it can lead to errors in the interpretation of the National Programme. It is therefore necessary, for reasons of legal certainty, to expressly repeal Order PRE/1377/2005 of 16 May 2005.

In the elaboration of this order have been consulted the autonomous communities and the cities of Ceuta and Melilla, as well as the sectors affected, having issued its precept report the Inter-Ministerial Commission for the Management Food.

Under the proposal of the Minister for Agriculture, Food and the Environment, and the Minister for Health, Social Services and Equality, I have:

Order PRE/1377/2005 of 16 May 2005 laying down measures for the surveillance and control of certain salmonellosis in laying hens for the purposes of establishing a programme is hereby repealed. National.

Final disposition first. Competence title.

This order is dictated by the provisions of article 149.1.16. of the Constitution, which attributes to the State exclusive competence in the field of bases and general coordination of health.

Final disposition second. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
