In accordance with the provisions of the articles 17.1. k) and 17.1. t) of the Statute of the Agency State of air safety (AESA), approved by Royal Decree 184/2008, of 14 February, are functions that correspond to the governing body «the appointment and dismissal, on a proposal from the Director, of the holders of the organs of the Agency and the rest of management» as well as «the adoption of the inventory of assets and rights assigned to the Agency in accordance with» What is established in law 33/2003 of November 3, the heritage of the public administrations', respectively.
On the other hand, article 25 of the mentioned Statute establishes that the Director is the highest executive organ of the Agency and is responsible for the direction and day-to-day management of the same. In addition, article 26.1 lists functions that correspond with the letter t) of that article which is function of the Director, the «play the other powers and functions which attributed you this Statute and any other applicable regulations, as well as those delegated, in his case, the President or the Executive Council».
In order to streamline the operation of the Agency, it has become clear the advisability of proceeding to the delegation, the Director of the Agency, of some powers that are attributed to the Executive Council, which will result in a more quickly in its operation as well as an improvement in the efficiency of administrative procedures underpinning it.
Consequently, in accordance with the provisions of article 13 of law 30/1992, of 26 November, legal regime of public administrations and common administrative procedure, in relation to the provisions of additional provision of law 6/1997, of 14 December 13th, of organization and functioning of the General Administration of the State , and article 26 of the Statute of the Agency State of aviation security, approved by Royal Decree 184/2008, of 8 February, the Governing Council of EFSA.
Delegation of powers. Exercise the following powers conferred by the statute from AESA to its Executive Council is delegated to the Director of EFSA: the EESC at his own request or by pass to another destination of the managerial personnel, as well as his appointment by temporary assignment or secondment, without prejudice to the immediate call to free designation of such positions to his final appointment by the governing body.
The adoption of the inventory of assets and rights assigned to the Agency, in accordance with provisions of law 33/2003, 3 November, of the heritage of the public administrations.
The scheme of delegation established is understood without prejudice to the powers of direction and certiorari which correspond to the President and to the Executive Council.
The delegation of powers contained in the present resolution shall enter into force the day following its publication in the "Official Gazette".
