Regulation (EC) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on the common fisheries policy, amending Council Regulations (EC) No 1954/2003 and (EC) No 1224/2009, and repeal Council Regulations (EC) No 2371/2002 and (EC) No 639/2004 and Council Decision 2004 /585/EC as a fundamental objective to ensure that fisheries and aquaculture activities are environmentally sustainable in the long term and are managed in a manner consistent with the objectives of generating economic, social and economic benefits (i) employment, and to contribute to the availability of food products. To this end, it has management tools such as the fixing of fishing opportunities allocated to the Member States, which will ensure the relative stability of each of them in relation to each fish or fishery population.

In particular, Article 16 lays down the procedure for limiting the allocation of fishing opportunities, leaving the Member States ' power to use the method of allocating the fishing opportunities which have been granted to it. allocated and which are not subject to a system of transferable fishing concessions, between vessels flying their flag.

Similarly, Regulation (EU) No 1380/2013 sets out the conservation and sustainable exploitation measures of marine biological resources that may be established to achieve the fundamental objective of the Common Fisheries Policy. In particular, Article 7 (1) (b) provides for the establishment of objectives for the conservation and sustainable exploitation of stocks and related measures to minimise the impact of fishing on the marine environment, while the 7.1.j) allows for the adoption of various technical measures, including zonal or temporary vedas, for conservation purposes.

Law 3/2001, of 26 March, of Maritime Fisheries of the State, states in its article 8 that the holder of the Department may adopt measures of regulation of the fishing effort, finding among themselves the limitation of the time of fishing activity. In addition, Article 27 provides for the option of distribution of fishing opportunities on the basis of catch or quota volumes and enables the holder of the Department to distribute them in order to improve the management and control of the activity. fishing.

The overall share awarded to Spain for each species is initially divided between the different fishing grounds, Cantabrian and North West and Gulf of Cadiz, as well as the share of the quota for the vessels in the Bottom trawling fishing in the waters of Portugal. Also in the allocation of the mackerel quota it has to be taken into account that part of this quota is captured in ICES zone VIIIb by the vessels of the fleet of height, high altitude and longline vessels larger than 100 GRT.

The allocation of fishing opportunities for species subject to the TAC and quota arrangements provided for in this order has been carried out in accordance with the historical catch data available to the Commission. General Secretariat for Fisheries. In turn, this data has been modulated to take into account the socio-economic aspects of the fleets affected in the different fisheries and the dependence of the different fleets on each species, in accordance with the Article 27 of Law 3/2001 of 26 March.

In fact, the aforementioned Article determines the historically developed fishing activity, its technical characteristics and the other parameters of the vessel and other fishing opportunities available to it as distribution criteria. optimizes the activity of the fleet as a whole. In order to take account of the peculiarities of each fishery and in order to share in the most balanced way the quotas which are the subject of this order, the socio-economic, dependency and historicity criteria will be weighted with different values for each fishery.

To improve the management of the quotas allocated to Spain within the VIIIc and IXa zones of the International Council for the Exploration of the Sea (ICES) and to ensure the activity of the fishing fleet throughout the year, it is appropriate the vessels censured in the fishing grounds of the Cantabrian and Northwest in the form of bottom trawl continue to have their fishing opportunities on an individual basis. In addition, the vessels of certain fleets which use very selective gears for a particular species, such as the case of the censates in the form of bottom longline and fly-tipping for hake, will also have an individualised form of their own. possibilities of this species. This is without prejudice to the fact that in all these cases the management of fishing opportunities can be carried out by the associations in which vessels are included collectively.

On the other hand, the management of the mackerel fishery for the purse seine fleet and for the fleet of other gear other than trawling and encirclement is improvable, as it is an explosive fishery, of which Spain has a very large quota. In order to avoid an accumulation of supply on the market which would lead to the return of business, it is necessary to distribute the quota at the disposal of the fleet so that each vessel can manage its own quota. Notwithstanding the above, and taking into account the reasons for the unification of business and commercial measures, the possibility of joint management of the quota of vessels by associations or federations at provincial level is considered. For this individualised distribution per vessel, the transmission of fishing opportunities is not allowed to avoid a accumulation of quota and business dominance in few hands. The same may be indicated for the horse mackerel fishery whose quota should be managed more rigorously by the limitation of the existing TAC, even if it does not have the same seasonal character.

For the fleet of other arts other than trawl and encirclement, also because of the meagre of the quota, it is required that the management of its quota, both of mackerel and horse mackerel, be carried out collectively by the different associations and Provincial cofradias federations, which will allow each of them to plan the management of their quota in the most convenient way. In particular, in the case of the mackerel fishery, the situations that have occurred in the past with the quota managed in a global way, in which the more western and the smaller fleets had to be transferred to the start of the fishery to the East at the beginning of the year to have the opportunity to capture mackerel before the exhaustion of the same. These displacements caused serious safety problems at sea.

According to the regulations in force, particularly Articles 5 and 27 of Law 3/2001, of March 26, the criterion for the distribution of the fishing possibilities of each year for the ships belonging to the modalities of The Commission shall, in accordance with the conditions laid down in Article 1 (1) of Regulation (EEC) No No 1, of the European Parliament and of the Council of the European Parliament and of the Council of the European Parliament and of the Council of the European Parliament and of the Council of the European Parliament, the year in progress, fixed by the corresponding resolution of the General Secretariat for Fisheries.

The allocation of fishing opportunities for the catch of the species referred to in this order is without prejudice to the fishing opportunities for catches of other species attributed to Spain whose quotas are so low. entity that does not advise individual allocation to each vessel or census.

In order to speed up the management of fisheries and to allow for business planning, the procedure for the transmission of fishing opportunities between bottom trawlers is developed in this ministerial order. only for the hake fishery for bottom longline vessels and fly-censates in the Cantabrian and Northwest fishing grounds.

On the other hand, proper management of fisheries requires the adoption of technical measures. This order seeks to put an end to the regulatory dispersion that existed, grouping together the different technical measures that affect the different segments of the fleet that operate in the waters of the Cantabrian and Northwest fishing grounds.

This is without prejudice to what is established by Royal Decree 1441/1999 of 10 September 1999, which regulates the exercise of fishing with bottom trawling gear in the fishing grounds of the North West Cantabrian, the Royal Decree 410/2001 of 20 April 2001 regulating fishing with fixed gear in the National Caladero del Cantabrian and Northwest; and Royal Decree 429/2004 of 12 March establishing measures for the management of the fishing fleet of encirclement, and without prejudice to the provisions of Order ARM/2017/2011 of 11 July 2011 establishing the control of the landings of more than 10 tonnes of herring, mackerel and horse mackerel and their subsequent modifications.

For the rest, Royal Decree 410/2001 of 20 April, provides for its additional second provision that in the framework of a fishing plan, in the case of local fishery, and taking into account traditional uses and customs, today Ministry of Agriculture, Food and the Environment, the Autonomous Community concerned and the professional organizations may grant authorization for the use of gear, gear or other fishing tools of dimensions and characteristics techniques which do not comply with those referred to in that royal decree.

Order AAA/130 7/2013, of 1 July 2013, condense the precepts included in the preceding orders in respect of bottom trawl, fly, scratch, bottom line, purse seine and minor Caladero Nacional del Cantabrian and Northwest, based on the principle of administrative simplification. In view of the successive amendments made to that order later, as well as the introduction of certain changes in the text of this text, while maintaining its structure and structure, it is considered appropriate to approve the a new standard whose essential motivation brings together both the simplified and unifying vocation, and the need to provide the sector with the greatest possible legal certainty, safeguarding and guaranteeing the rights and situations regulatively acquired by operators since 1 July 2013, in particular in the on the transmission of fishing opportunities.

The procedure for communication to the European Commission provided for in Article 46 of Council Regulation (EC) No 850/1998 of 30 March 1998 for the conservation of fishery resources through measures has been carried out. techniques for the protection of juveniles of marine organisms.

In the preparation of this order the fishing sector and the Autonomous Communities of Galicia, Principado de Asturias, Cantabria and País Vasco, as well as the Spanish Institute of Oceanography, have been consulted.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, according to the State Council, I have:

Article 1. Object and scope of application.

1. The purpose of this order is to regulate the fishing of the Cantabrian and Northwest fishing grounds in external waters and to distribute the fishing opportunities allocated to Spain within ICES divisions VIIIc and IXa, as well as the possibilities of fishing for horse mackerel for the encirclement mode in ICES division VIIIb.

2. It shall apply to the Spanish flag vessels censured in the form of bottom trawling, flying, scraping, bottom line, encirclement and minor gear in the Cantabrian and North West.

3. This is without prejudice to the provisions of Royal Decree 560/1995 of 7 April 1995 laying down the minimum sizes of certain fishing species, Royal Decree 1441/1999 of 10 September 1999 laying down the rules for the fishing exercise with bottom trawling gear in the fishing grounds of the North West Cantabrian; Royal Decree 410/2001 of 20 April, regulating fishing with fixed gear in the National Caladero del Cantabrian and Northwest; the Royal Decree 560/1995 of 7 April 1995 laying down minimum sizes for certain fishing species and the Royal Decree 429/2004 of 12 March laying down measures for the management of the fishing fleet for purse seines, and without prejudice to the provisions of Order ARM/2017/2011 of 11 July 2011 establishing the control of landings of more than 10 tons of herring, mackerel and horse mackerel.

Article 2. Distribution of fishing possibilities by fishing grounds and fishing modalities.

1. The corresponding percentage of the Spanish quota for the fishing opportunities for snuff (Lophiidae spp), horse mackerel (Trachurus spp), hake (Merluccius merluccius) shall be allocated to the fishing grounds of Cantabrian and North West (Lepidorhombus spp), blue whiting (Micromesistius poutassou), Norway lobster (Nephrops norvegicus), anchovy IXa (Engraulis encrascolus) and mackerel (Scomber scombrus) referred to in the previous article.

2. The total quotas allocated to the Cantabrian and Northwest shall be distributed among the fleet segments concerned, in accordance with the criteria referred to in Article 27 of Law 3/2001 of 26 March of Maritime Fisheries of the State, and as specified in Article 1 and Annexes V and VII to this order.

3. Each year, at the beginning of the fishing season, the General Secretariat for Fisheries shall, by means of a resolution published in the "Official State Gazette", communicate the available quotas, by modality or census, of the different species indicated in the present Article.

If on 1 October there was a surplus of quota for a species and a census or modality representing a quantity greater than the consumption that this census or modality could carry out, it will be possible to spread the excess quota to the censuses or modalities which may be used in proportion, in accordance with the fishing opportunities of those censuses on 1 January of the year in question.

By quantity greater than the consumption that a census or modality can perform is understood any amount greater than the landings of the months of October to December for that census or modality in any of the last three years.

Notwithstanding the above two paragraphs, this surplus quota management will not be applied to the back end of the Cantabrian and Northwest bottom trawl mode, which will be applied to the flexibility. 10% of the individual quota, as indicated in Council Regulation (EEC) No 847/96, except that, upon acceptance of the sector, the excess quota may be redistributed to ensure a maximisation of consumption of the fishing.

4. Distribution of fishing opportunities by bottom trawlers.

(a) The percentage of fishing opportunities allocated to the bottom trawling mode of the Cantabrian and Northwest shall be distributed on an individual basis in accordance with the provisions of this Article.

(b) This distribution shall be made in the first year of the order in accordance with the percentages set out in Annex X. From the second year of application of the order, the distribution shall be made on the basis of the fishing opportunities available to each vessel as at 1 January of the year in question, on the basis of the final transfers made.

(c) Only vessels listed on the list of the bottom trawling fleet and which are on the high and with the Electronic Journal on Board may make use of their fishing opportunities, as well as transfer the same fishing opportunities. temporary or definitively as laid down in Articles 4 and 5. On 1 October, it is noted that ships which have not been able to use their quota allocated that year for not being on the high and with the Electronic Journal on Board of operation, that quota will be distributed among the other vessels of the trawl census if they are high and with the Electronic Journal on Board, according to the fishing percentages each vessel has.

In the event that a ship that is on the census list of the bottom trawl fleet and that, being high and with the Electronic Journal on board operating, suffer a disaster that will cause the sinking or inactivity final, its fishing opportunities may be transferred to another vessel which is on the census list of the bottom trawl fleet and which is discharged and with the Electronic Journal on Board of operation, to a new construction vessel contributed by the the vessel owner of the vessel which has suffered the disaster or those from imports and modernisation of vessels.

Without prejudice to the above paragraphs, those vessels which are on the census list of the bottom trawl fleet and which are on the ground, may only make final transfer of their fishing opportunities to a new ship built if they are provided as low in a new construction file, and provided that they comply with the conditions set out in the current regulations. Otherwise, these vessels will be definitively eliminated from the census and their fishing opportunities will be spread linearly among the remaining vessels on the bottom trawl's census list.

d) The individual allocation of each quota in the following years shall be reviewed and updated annually on 1 January by resolution of the General Secretariat of Fisheries published in the "Official State Gazette", individual and up-to-date fishing opportunities, and the association to which each vessel belongs, taking into account the modifications made in accordance with this order during the previous year.

5. Distribution of fishing possibilities in a global way by modality.

For vessels censured in the modalities of scratch, volanta, bottom line, purse seine and minor arts of the Cantabrian and Northwest the management of the corresponding percentage of fishing possibilities will be done in a global way, being linearly repaired by natural quarters, as set out in Annexes V and VII to this order.

The fishing opportunities for hake for the bottom-line and fly-over arrangements, the fishing opportunities for horse mackerel and mackerel for the arrangements for encircling and other gear other than trawl, are exempted from the above. fence.

6. Distribution of the fishing opportunities for hake by vessels, for the modalities of bottom longline and background fly:

(a) By way of derogation from the above paragraph, the percentage of the fishing opportunities for hake allocated to the arrangements for volanta and bottom longline shall be distributed on an individual basis per vessel.

(b) Among the longline vessels authorized to fish in the waters of the Cantabrian and Northwest fishing grounds, this distribution shall be made by means of a decision of the Secretary-General for Fisheries published in the "Official State Gazette", linear mode, starting from the overall hake fishing opportunities fixed for this mode according to the percentage set out in Annex VII.

(c) Among the vessels authorized to fish in waters of the Cantabrian fishing grounds and Northwest, such distribution shall be made by means of a resolution of the Secretary General of Fisheries published in the "Official State Gazette", based on the following criteria:

1. 50% linear distribution between vessels.

2. º 25% cast depending on the number of crew members.

3. º 25% on the basis of historical catches (2002-2011).

This shall be based on the overall hake fishing opportunities set for this modality in accordance with the percentage set out in Annex VII. However, the quota of the vessels shall be fixed in accordance with the preceding paragraph and the difference in quota between vessels shall in no case exceed 4 tonnes.

(d) Only vessels on the list of stocks of bottom longline, flying and high-bottom longline fleet and with the Electronic Journal on Board of operation may make use of their fishing opportunities for hake, as well as transfer the same temporarily as set out in Article 4.

In the event that a vessel that is on the census list of the bottom line fleet of volanta and that, being discharged and with the Electronic Journal on board operating, suffer a disaster that will cause the sinking or Finally, their fishing opportunities may be definitively transferred only if it is provided in a new construction dossier for a vessel of the same census by the ship owner of the vessel which has suffered the disaster. In this case and as soon as the new vessel is built, the owner or owner of the vessel may temporarily transfer its fishing opportunities to other vessels which are on the list of the fleet of bottom longline vessels. or from volanta and which is high and with the Electronic Journal on Board of operation.

Those flying vessels or bottom longlines that are to be scrapped will lose their share of the quota, which will be redistributed to the next year among the remaining vessels remaining active in the fly or longline census. e) The individual allocation of each quota in the following years shall be updated annually by resolution of the General Secretariat of Fisheries published in the "Official Gazette of the State", contemplating the individualized relationship and up-to-date fishing opportunities for hake, and the association to which each vessel belongs, taking into account the modifications made in accordance with this order.

7. Mackerel fishery.

The beginning of this fishery for the modality of other different gears of drag and encirclement and for the different provinces will be established each year, heard the sector and by resolution of the Secretary General of Fisheries, respecting in any case of the Total Allowable Catches (TACs) and established quotas.

8. Distribution of mackerel and horse mackerel quotas for the Cantabrian and Northwest encirclement fleet.

(a) The percentage of mackerel and horse mackerel fishing opportunities allocated to the Cantabrian and Northwest encirclement mode shall be distributed on an individual basis for each vessel.

b) This individual percentage is initially calculated as follows:

1. º Caballa: the percentage of individual quota will be the arithmetic mean of the percentage obtained from applying to each vessel the following two scenarios:

-70% historical catches based on landing declarations and 30% of GTs.

-70% of historical catches based on landing declarations, 10% of GTs, 10% of crew numbers and 10% linear.

2. Jürel: the percentage of individual quota is obtained by taking into account 70% of historical catches on the basis of sales notes and 30% of GTs.

(c) The initial allocation of the quota resulting from the application of the above criteria shall be carried out in accordance with the percentages per vessel set out in Annex IX.

d) The individual allocation of each quota in the following years shall be updated annually by resolution of the General Secretariat of Fisheries published in the "Official State Gazette", contemplating the individualized relationship and up-to-date fishing opportunities for horse mackerel in VIIIC, IXA and VIIIB, and the association to which each vessel belongs, taking into account the modifications made in accordance with this order.

Those vessels that are to be scrapped will lose their share of the quota that will be redistributed the following year among the remaining vessels that remain active in the Cantabrian and Northwest encirclement census, unless they are provided in a new construction of a vessel of the same census.

9. Distribution of mackerel and horse mackerel quotas for the fleet of other gears other than bottom trawls and encirclement of the Cantabrian and Northwest.

The resulting percentages for the sum of each province's vessels are as follows:

a) For mackerel:

Cantabria: 25.745%.

A Coruña: 6,899%.

Lugo: 5.789%.

Pontevedra: 4,769%.

Guipuzcoa: 12,347%.

Vizcaya: 29,714%.

Asturias: 14,737%.

b) For horse mackerel:

ICES zone VIIIc:

Cantabria: 10,899%.

A Coruña: 66.153%.

Lugo: 4.070%.

Pontevedra: 0%.

Guipuzcoa: 4,490%.

Vizcaya: 7,039%.

Asturias: 7,349%.

ICES zone IXa:

Cantabria: 0%.

A Coruña: 56,216%.

Lugo: 1,490%.

Pontevedra: 40,294%.

Guipuzcoa: 0.320%.

Vizcaya: 0,450%.

Asturias: 1,230%.

10. The fishing opportunities shall not generate any kind of indemnable right in the future in the event of alteration of their conditions or reduction of their amounts by decision of any public authorities.

Article 3. Management of the fishing opportunities allocated individually.

1. The fishing opportunities allocated individually in accordance with the provisions of Article 2 may be managed either individually by each shipowning undertaking or collectively by the associative entities in which they are incorporated. the undertakings which own the vessels, provided that the appropriate application is made to the General Secretariat for Fisheries.

2. The management of a vessel by an associative entity shall involve the control of its fishing opportunities by that association.

3. When a vessel changes its association, it shall transfer to the association the fishing opportunities available in the state in which it is located. This change will be effective at the beginning of the year.

4. Management of the fishing opportunities for mackerel and horse mackerel, individually divided by vessel of the Cantabrian and Northwest encirclement.

(a) In order to manage the quotas that correspond to the vessels of the census census of the Cantabrian and Northwest Caladero, they can choose the following:

1. Individual Management. They will be allocated the appropriate share according to the distribution keys.

2. Joint management, vessel quotas shall be added by the relevant provincial associations or federations for their joint management.

Before the beginning of the fishing campaign, the associations or the Provincial Federations must ask the General Secretariat of Fisheries for the type of management they will carry out for their associated vessels, accompanying them, in the case of vessels under the joint management, the commitment and the signed agreement of each shipowner. In the case of no communication, it is understood that an individual management is chosen. The Fisheries Secretary General's Resolution shall publish the quotas corresponding to each provincial vessel or association or federation, if any.

Once the beginning fishery, during the year in question, no new high ships will be allowed to be used for the joint or low management of any already received vessels.

(b) In the event that a vessel makes a change of base port, in the same or different province, the corresponding quotas of horse mackerel and mackerel shall continue to be assigned to that vessel.

(c) Cessions or transfers of mackerel quota are not permitted on a temporary or permanent basis, either between individual vessels or between entities that jointly manage quota. However, the General Secretariat for Fisheries may, by way of exception, make transfers with the aim of maximising the use of quotas.

(d) The purse seines granted a temporary change of mode for the art of hook may continue their activity after their quota has been completed in charge of the quota of vessels of other gear other than trawl and encirclement of the same province, after agreement of the managing organization of the provincial quota.

Article 4. Temporary transfers of fishing opportunities between vessels censured on bottom trawling and fishing opportunities for hake among vessels censured on bottom longline and fly.

1. The individual shipowners or, where appropriate, the associative entities, may assign or transfer on a temporary basis, in part or in full, their fishing opportunities for each other, whether they be of the same or of different associative entities, prior to Communication to the General Secretariat for Fisheries.

2. Communications for the transfer of fishing opportunities shall be addressed to the Director-General of Fisheries Management of the General Secretariat of Fisheries of the Ministry of Agriculture, Food and the Environment and shall submit to the Secretariat General Fisheries or any of the places provided for in Article 38.4 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure. Such communications may also be submitted by electronic means in accordance with Article 6.1 of Law 11/2007 of 22 June 2007 on the electronic access of citizens to public services.

3. The communications shall be carried out in accordance with the model set out in Annex VIII and shall be accompanied by the agreement of the holders of the vessels concerned or their legal representatives relating to the transmission and shall, at least, reflect the following data:

(a) The name and address of the holders of the vessels affected by the transmission.

(b) The name, registration and portfolio of the vessel whose fishing opportunities are transmitted and the receiving vessel.

(c) The fishing opportunities transmitted and the stocks to which the application relates.

4. The General Secretariat for Fisheries shall recognise each vessel the new situation resulting from the annual transfer within two months and may be notified to the person concerned by electronic means. Such transfer shall be temporary and shall end on 31 December of the year in question. In the event of no such recognition, the temporary transfer shall be deemed to be rejected.

Article 5. Final transfers of fishing opportunities between vessels censured on bottom trawl.

1. The holders of the vessels may transfer or transfer their fishing opportunities to each other in a definitive, partial or complete manner.

2. The General Secretariat for Fisheries shall recognise each vessel the new situation resulting from the annual transfer. Such transfer shall be final and shall be reflected in the annual publication of the census, as provided for in Article 2 (5) (d)

3. Such transmission of fishing opportunities shall meet the following requirements:

(a) The vessel whose fishing opportunities are transmitted shall have at least 0,5% of the total of the fishing possibilities of the mode, including all stocks, after the transmission has been carried out. Below this coefficient of fishing opportunities the vessel concerned must leave the fishery.

(b) The fishing opportunities accumulated by a company or groups of related companies shall not exceed 30% of the total fishing opportunities of the modality, including all stocks distributed.

For the determination of the concept of groups of related companies societarily, it will be within the provisions of the applicable commercial law.

4. Applications for authorisation for the final transmission of fishing opportunities shall be addressed to the Director-General of Fisheries and Aquaculture Resources of the General Secretariat for Fisheries of the Ministry of Agriculture, Food and the Environment, and they shall submit to the General Secretariat for Fisheries or any of the places referred to in Article 38.4 of Law No 30/1992 of 26 November. Such applications may also be submitted by electronic means in accordance with Article 6.1 of Law 11/2007 of 22 June 2007 on the electronic access of citizens to public services.

5. Applications shall be completed in accordance with the model in Annex VIII and shall be accompanied by the agreement of the holders of the vessels concerned, or their legal representatives, relating to the transmission, which shall be recorded in a notarial document and shall be reflect at least the following data:

(a) The name and address of the holders of the vessels affected by the transmission.

(b) The name, registration and portfolio of the vessel whose fishing opportunities are transmitted and the receiving vessel.

(c) The fishing opportunities transmitted and the stocks to which the application relates.

6. In order to carry out the transmission, a non-binding report of the autonomous community of the base port of the ceding vessel, which will be requested by the General Secretariat of Fisheries, will be required. If a month has elapsed since the request for a report there is no response, the actions may be continued.

7. By way of derogation from paragraphs 1 and 2, the Director-General of Fisheries and Aquaculture Resources may grant a provisional authorisation for the transmission of fishing opportunities for applications submitted and which are not accompanied by any the requirements referred to in paragraph 4. In order for these provisional authorisations to become final, the applicant shall comply with the requirements laid down in paragraph 4 within 10 days, which may be extended for a further 5 days, as specified in Article 71 of the Law. 30/1992, dated 26 November. Such time limits shall not be granted for the final authorisation without having remedied the deficiencies of the application.

8. The procedure for authorising the final transmission of fishing opportunities shall be decided by a decision of the Director-General of Fisheries and Aquaculture.

9. After three months from the date on which the application has entered the register of the body responsible for processing in accordance with paragraph 3, without the express resolution being notified, it may be understood that, agreement with the sixth provision of Law 3/2001 of 21 March.

10. The decision shall be notified to the persons concerned in accordance with the terms laid down in Article 59 of Law No 30/1992 of 26 November 1992.

11. The decision which recayere does not put an end to the administrative route and against it may be brought before the Secretary-General for Fisheries, in the terms and deadlines referred to in Article 115 of Law 30/1992, of 26 November.

Article 6. Management of collectively managed fishing opportunities.

1. Management of the fishing opportunities for mackerel and horse mackerel, divided by province for the modality of other arts other than trawling and encirclement of the Cantabrian and Northwest.

(a) In the event that a vessel makes a change from the base port to another province, the quotas allocated to each province shall not be modified.

(b) In the case of ships being scrapped, with or without public aid, the provincial share of mackerel and horse mackerel will remain unchanged, in the same way as if the number of vessels in each province is increased by new buildings or substitutations by disaster.

2. For vessels and fisheries which do not individually have the fishing opportunities allocated in accordance with Article 2, the General Secretariat for Fisheries shall carry out the management jointly and in the light of the partnership if appropriate, as set out in Article 7.

Article 7. Monitoring and control of quotas.

1. Monitoring of quotas in the light of the fact that vessels are or are not subject to the obligation to carry Electronic Journal on Board:

(a) Ships Required To Complete The Electronic Journal On Board. The consumption of the quotas covered by this order, corresponding to the vessels required to complete the said journal, in accordance with Article 15 (3) of Regulation (EC) No 1224/2009 of 20 November 2009, establishes a Community control system to ensure compliance with the rules of the common fisheries policy, shall be verified by the Directorate-General for Fisheries Management through the electronic transmissions which they carry out and supplemented by the information obtained through the sales notes.

(b) Ships Not Required To Fill In The Electronic Journal On Board. For vessels which are not required to carry the Electronic Journal on Board as provided for in Article 15.3 of Regulation (EC) No 1224/2009 of 20 November 2009, the Directorate-General for Fisheries Management shall carry out the monitoring of the consumption of quotas on the basis of the entries in the fishing logbook, in the landing declarations and in the sales notes, in the case of vessels of more than 10 metres in length and only on the basis of the data entered in the sales notes, in the case of a length of less than 10 metres in length.

2. Control of the quotas, individually divided, of mackerel and horse mackerel for the vessels censured in the mode of encirclement, of hake for the censates in the modalities of bottom longline and back of bottom, and for the ships censured in the modality Bottom trawl.

(a) Where, in accordance with the activity data available to the General Secretariat of Fisheries from the logbook, declarations of landing and sales notes, as well as of the transmissions of the Electronic Journal On Board, it is verified that consumption-for a given species-of the quantity allocated to a vessel or group of vessels, in accordance with Articles 2 and 3, has been reached or is to be reached, the Directorate General Fisheries Management shall communicate to the associative entity representing the said vessel or vessels the the closure of this fishery for the vessel or group of vessels concerned, having this vessel or vessels prohibited from catching, retaining on board, transhipping or landing the species to which the fishery has been closed. In the event that such vessel or group of vessels obtain additional quota of the closed species, the fishery shall be reopened for the vessel or group of vessels concerned.

(b) Where at the end of each year there is an excess in the consumption of the quota allocated to a vessel, they shall be deducted from the quotas of the same population which are allocated to the vessel concerned in the following year, in accordance with Article 105 of Council Regulation (EC) No 1224/2009 of 20 November 2009. If the deduction of that species is not sufficient to cover the quantity exceeded, quotas shall be deducted from other species associated with the fishery and distributed, until the excess is covered.

3. Control of globally managed quotas:

(a) The control shall be carried out by linearly distribution of the quota between natural quarters in the case of the fisheries covered by Article 2 (2) and (5). In the case of a quarter of a quota, Given species assigned to this mode would have been exceeded, the excess of the same will be stopped from the quota that is assigned to this mode in the following quarter. On the other hand, if the consumption of a quota for the modality in question is lower than that attributed to it during that period, the excess quota will increase the quota for the following quarterly period, for the said modality.

(b) Where, in accordance with the activity data available to the General Secretariat of Fisheries from the log in the logbook, landing declarations and sales notes, as the case may be, of the Electronic Journal On Board, it is verified that the consumption of the quantity allocated to the modalities, fisheries or associations reflected in Article 2 (2) and (5) has been reached or is to be reached, the Directorate-General of Fisheries management shall give a decision, which shall be communicated to the representatives of the modalities, fisheries, provinces or associations concerned, ordering the closure of this fishery for vessels registered in this mode or belonging to that association or province, as the case may be.

However, the Secretariat will assess the reopening of the fishery when the availability of extra quota can be verified in any of the following cases:

1. º When a quota advance can be used for the following quarter, requested by majority consensus in the affected sector.

2. When in application of Article 2.3, excess quota may be redistributed from other modes.

In such cases, the General Secretariat of Fisheries shall proceed to the reopening or to communicate the improvenance of the measure in accordance with the general interest.

(c) Where it is noted that the quota has been exceeded for each modality in the last quarter of the year, the deduction shall be made in accordance with Article 105 of Council Regulation (EC) No 1224/2009 of 20 November 2009, establishing a Community control system to ensure compliance with the rules of the common fisheries policy, and shall be effective on the quota allocated to it in the first quarter of the year next. If the deduction of that species is not sufficient to cover the excess, quotas shall be deducted from other species associated with the fishery and distributed, until the excess is covered.

4. Control of mackerel and horse mackerel quotas of other gear other than trawl and encirclement managed in a comprehensive manner by provinces:

(a) In the case of horse mackerel, the control shall be carried out in line with the quota of each province between natural quarters. In the event that in a quarter it is noted that the quota allocated to a province for this modality would have been exceeded, the excess of the quota will be stopped from the quota allocated to that province in the following quarter. On the other hand, if the consumption of a quota for the province in question was lower than that attributed to it in that period, the excess quota will increase the quota for the following quarterly period, for the province concerned.

(b) For the mackerel fishery control shall be carried out on the annual quota available to each province. The control may be carried out, upon request of the affected provinces, jointly on the sum of the total quota of the provinces that so request.

(c) Where, in accordance with the activity data available to the General Secretariat of Fisheries from the logbook, landing declarations and sales notes, as the case may be, of the Electronic Journal On Board, it is verified that the consumption of the allocated quantity of mackerel and horse mackerel to each of the provinces for the modality of other gear other than drag and encirclement, has been reached or is near to be reached, the Directorate-General for Fisheries Management will deliver a resolution, which will be communicated to the representatives of the affected provinces, ordering the closure of this fishery for vessels registered in this mode belonging to that province.

However, the Secretariat will assess the reopening of the fishery when the availability of extra quota can be verified in any of the following cases:

1. º When a quota advance of the following year can be used according to the year-over-year flexibility mechanism, requested by majority consensus in the affected sector.

2. When in application of Article 2.3, excess quota may be redistributed from other modes.

In such cases, the General Secretariat of Fisheries shall proceed to the reopening or to communicate the improvenance of the measure in accordance with the general interest.

(d) When it is noted that the horse mackerel quota has been exceeded for each province in the last quarter of the year, or the annual provincial mackerel quota, the deduction of mackerel shall be made in accordance with the provisions of the Article 105 of Council Regulation (EC) No 1224/2009 of 20 November 2009 establishing a Community control system to ensure compliance with the rules of the common fisheries policy and shall be effective in the quota to be assigned to the same in the first quarter of the following year. If the deduction of that species is not sufficient to cover the excess, quotas shall be deducted from other species associated with the fishery and distributed, until the excess is covered.

5. The Directorate-General for Fisheries Management will communicate to the Autonomous Communities, the professional associations representatives of the affected fleets and the National Federation of Fishermen's Cofradies, the situation of the consumption of the quotas to Those referred to in this order. In general, it will be communicated once 80% of the consumption of the quota has been reached, although for certain stocks communications will be possible with more periodicity.

Article 8. Mode temporary changes.

1. The Directorate-General for Fisheries Management of the General Secretariat for Fisheries, of the Ministry of Agriculture, Food and Environment, may authorise temporary changes of fishing modality to other modalities.

2. The applications shall be addressed to the Director General of Fisheries Management of the General Secretariat of Fisheries of the Ministry of Agriculture, Food and the Environment and shall be presented in any of the places provided for in Article 38.4 of the Law. 30/1992, of 26 November, of Legal Regime of the Public Administrations and of the Common Administrative Procedure, as well as electronically as established in Law 11/2007, of 22 June, of electronic access of citizens to the public services, and shall at least reflect the name and address of the holder of the vessel; the name, registration and portfolio of the vessel; and the fishing modality requested.

3. Prior and non-binding report of the autonomous community of the base port of the vessel concerned shall be required to be issued within seven days. In the event that no such deadline is received, action may be continued.

4. In accordance with the provisions of Article 5 of Royal Decree 1441/1999 of 10 September 1999, which regulates the exercise of fishing with bottom trawling gear in the national fishing grounds of the Cantabrian and North West, it will be required to Spanish Oceanography Institute for temporary changes of bottom trawling mode to other modes or other modes of bottom trawling, if any.

5. The Director-General for Fisheries Management shall authorise, on the basis of the state of the resources or regulation needs of the fishing vessel, the temporary changes in fishing mode for periods of three months which may be extended by other means. three, always within the calendar year, by means of a decision which shall be issued and notified to the persons concerned in accordance with the terms of Article 59 of Law No 30/1992 of 26 November 1992 within 20 days. After two months from the date on which the application has entered the register of the competent body for processing without the express resolution being notified, it may be understood to be dismissed.

6. The decision which recayere does not put an end to the administrative route, by virtue of Article 115 of Law No 30/1992 of 26 November 1992, before the Secretary-General of Fisheries.

Article 9. Fishing plans.

The fishing plans for the purse-seine arrangements, certain fixed gear, bottom trawling, fly-tipping and scraping of the National Cantabrian and Northwest fishing grounds in the external waters are regulated on the basis of the provisions of Annexes I, II, III and IV of this order.

Article 10. Catch limits or landings.

For species and vessels subject to this order, it may be established, heard by the sector, catch ceilings or daily or weekly landings the quantity of which shall be determined by resolution of the Secretary-General for Fisheries.

Article 11. Infringements and penalties.

Failure to comply with this order shall be punishable in accordance with the provisions of Title V of Law 3/2001 of 26 March and Article 105 of Council Regulation (EC) No 1224/2009 of 20 November 2001. 2009.

Single repeal provision. Regulatory repeal.

The following orders are repealed:

-Order AAA/130 7/2013, of 1 July, establishing a Management Plan for the vessels of the censuses of the National Caladero del Cantabrian and Northwest.

-Order of 28 November 1996 establishing a closed area in a certain area of the Cantabrian coast.

Single transient arrangement. Distribution of mackerel quotas for fleets of other gear other than trawl and encirclement during 2015.

By way of derogation from Article 2.9.a), the percentages shall be as follows for 2015:

a) Cantabria: 25.25%.

b) La Coruna: 7.90%.

c) Lugo: 6.63%.

d) Pontevedra: 5.47%.

e) Guipuzcoa: 11.61%.

f) Vizcaya: 27.92%.

g) Asturias: 15.24%.

Final disposition first. Competence title.

This order is issued pursuant to Article 149.1.19. of the Constitution, which attributes exclusive competence to the State in the matter of Maritime Fisheries.

Final disposition second. Fishing opportunities for mackerel that correspond to the fleet that catches this species and operates exclusively in the waters of NEAFC.

Annex VI includes the percentage of mackerel fishing opportunities that correspond to the fleet that catches this species and operates exclusively in NEAFC waters.

Final disposition third. Transfers of fishing opportunities made under Order AAA/130 7/2013, of 1 July, establishing a Management Plan for the vessels of the censuses of the National Caladero del Cantabrian and Northwest.

The transfers of fishing opportunities made under Order AAA/130 7/2013, of 1 July, establishing a Management Plan for the vessels of the censuses of the National Caladery of the Cantabrian and Northwest, maintain their full validity.

Final disposition fourth. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".

ANNEX I

Fishing Plan for the Encirclement Modality in the Northwest Cantabrian

1. Definition of the art of encirclement.

It is understood by art of encirclement a net of rectangular shape, whose ends end in fists, which surrounds the carduals of pelagic species and is closed down by its bottom by means of a jar, giving rise to the bagging of the fish.

2. Vessels authorised for fishing.

They are authorized to exercise fishing with purse seines in the Caladero del Cantabrian and Northwest in the outer waters of the vessels that, being registered in the Register of Fishing Ships and Shipping Companies, are also included in the The Census of the encirclement mode of the Caladero del Cantabrian and Northwest, are in possession of a fishing license for that modality and fishing grounds and satisfy the conditions laid down in this order, as well as in the Royal Decree 429/2004, of 12 March for the establishment of measures for the management of the purse seine fleet.

3. Dimensions of the arts and meshes.

(a) The length of the ring gear in the Caladero del Cantabrian and Northwest shall not be more than 600 metres, excluding fists, each of which shall not exceed 30 metres.

(b) The height of the ring gear shall not exceed 130 metres.

(c) The minimum opening of the mesh of the ring gear shall not be less than 14 millimetres.

4. Authorised species and catch quotas.

The species authorized for capture with encirclement art are as follows:

a) Aguja (Belone belone).

b) Align (Pagellus acarne).

c) anchovy or boqueron (Engraulis enchrascholus).

d) Arana (Trachinus spp).

e) Boga (Boops boops).

f) Bolo (Ammodytidae).

g) Bonito (Sarda sarda).

h) Breca (Pagellus erythrinus).

i) Heads (Scomber spp).

j) Chopa (Spondyliosoma cantharus).

5. Minimum sizes.

(a) In any case, the sizes of the species may not be lower than those laid down in Royal Decree 560/1995 of 7 April.

Notwithstanding the above, and in accordance with Article 19.4 of Council Regulation (EC) No 850/98 of 30 March 1998 on the conservation of fishery resources through technical measures for the protection of the environment, juveniles of marine organisms, in the case of sardine, anchovy or boqueron, horse mackerel and mackerel shall be permitted to, below minimum sizes, be allowed to be up to a limit of 10% by weight of the total catch of each of these species to be retained on board.

The percentage of sardines, anchovies, herring, jureles and mackerel that do not reach the minimum regulatory size shall be calculated as a proportion of the live weight of all marine organisms on board after classification or at the time of disembarkation. The percentage may be calculated on the basis of one or more representative samples. The limit of 10% shall not be exceeded during landing, transport, storage, exposure or sale.

The derogation provided for in the said Regulation in the preceding paragraphs of this paragraph (a) shall not apply to ICES zone IXa to the east of longitude 7 23 '48' for anchovy, the minimum size of which shall be 12 cm.

(b) However, in accordance with the provisions of the Regulations (EU), establishing, for each year, the fishing opportunities and the corresponding conditions for certain stocks and groups of stocks fish, applicable in Community waters and, in the case of Community vessels in other waters where catch limitations are necessary, in the case of horse mackerel (Trachurus spp.) 5% by weight and total computation shall be permitted, with size between 12 and 15 cm. For the purpose of checking this quantity, the coefficient 1,2 shall be applied to the weight of the landings.

(c) For the purposes of controlling and managing this quota, the corresponding Provincial Federations of Fishermen's Cofradies, shall forward to the General Directorate of Fisheries Management, before the 15th day of each month, the information relating to the to the quantities of horse mackerel between 12 and 15 cm caught during the previous month.

6. Live bait fishery.

The live bait fishery may only be used as an aid for tuna and, therefore, exclusively for vessels authorised to fish for tuna and live bait and shall be subject to the following conditions: rules:

(a) Catches made from live bait may only be used as bait.

b) The minimum mesh size shall not be less than 10 millimetres.

(c) Ships shall be equipped with tanks that allow the bait to be kept alive. In each operation dedicated to the capture of live bait the amount of the same obtained shall in no case exceed the capacity of the tanks mentioned.

(d) Ships may not use more than one auxiliary boat for fishing tasks with artificial light on the catch of live bait or bait.

(e) The fishing activity of live bait shall be exempt from the rules governing the fishing effort in this order, as well as compliance with the minimum requirements laid down in Regulation (EEC) No 850/98 of the European Parliament and of the Council Council of 30 March 1998 not being able to catch or have on board species other than live bait.

(f) Sardines, anchovies, herring, jureles and mackerel which do not reach the minimum regulatory size caught for use as live bait may be retained on board provided that they are kept alive, in accordance with Article 19.5 of that Regulation.

7. Temporary closures: periods of temporary cessation of fishing activities may be established, depending on the development of the fishery in each fishing season. These stops may, where appropriate, be the subject of financing from the European Maritime and Fisheries Fund.

ANNEX II

Fishing plan for certain fixed gears of gillle in the maritime provinces of Gijon, Santander, Guipuzcoa and Vizcaya

1. Object and scope of application.

This Fisheries Plan aims to regulate certain local fisheries in the maritime provinces of Gijon, Santander, Guipuzcoa and Vizcaya.

It shall apply to Spanish flag vessels registered in the Register of Fishing Vessels, which are included in the censuses of fly, scratch or minor gear, as appropriate, of the National Fishing Cantabrian and North West and which exercise fishing in the outer waters of the said fishing vessel between the border sea line with France and the meridian 005º 17.7 ' (Cpl. Lastres) on the 12-mile strip measured from the straight lines base.

The Royal Decree 410/2001, of 20 April, which regulates fishing with fixed gear in the National Caladero del Cantabrian and Northwest, will be applied in all of this, in accordance with the provisions of Regulation (EC) No 410/2001. 850/98 of the Council of 30 March 1998.

2. Gear and gear included in the fishing plan.

It is considered to be included in this fishing plan that it is exercised with the following fixed enmalle gear to the bottom, which locally receive the generic denomination of "seashore nets":

a) Beta (also referred to as volleys or Mallabakarra).

b) Beths.

c) Move it.

d) Minos.

e) Volanta.

f) Rasco.

3. Dimensions of gear and gear.

(a) The size of the gear, the mesh size, the size of the target species and the corresponding percentages shall be in accordance with Council Regulation (EC) No 850/98 of 30 March 1998, for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms.

(b) The maximum dimensions of the gear and minimum mesh sizes shall also be in accordance with those laid down in Royal Decree 410/2001 of 20 April 2001.

c) Notwithstanding the foregoing, as provided for in the second provision of the aforementioned royal decree:

1. º In the waters between the border sea line with France and the meridian 003º 08.8 ' W the minimum mesh authorized for the arts of beta or Mallabakarra shall be 53 mm.

2. In the waters between the meridians 003º 08.8 'W and 005º 17.7' (Cpl. Lastres) the minimum authorised mesh shall be 50 millimetres for the following species: mullet (Mullidae), boga (Boops boops), lablides (Labridae), prawns (Penaeus spp), galera (Squilla mantis), horse mackerel (Trachurus spp), mackerel (Scomber scombrus), pout (Trisopterus luscus), cuttlefish (Sepia spp) and rubes (Triglidae).

4. Standards of heating.

a) Minor arts of gillage (betas, minos, and trammel).

1. Only one haul per day can be performed.

2. º The arts will not be able to remain silent during the night, except for the minos in the maritime provinces of Gijón, Santander, Guipuzcoa and Vizcaya.

3. In the maritime provinces of Gijón and Santander, fishing with betas may be exercised in external waters, with a separation of 100 meters from the straight base lines or 10 meters of depth. In addition, those gears must be removed from their heat for forty-eight hours on a continuous basis per week and transported to port.

4. º In the maritime province of Vizcaya the beta will be heated once a day, starting from 5 hours in the morning in autumn and winter and in spring and in summer from 3 hours of the morning.

5. In the maritime province of Guipuzcoa, the beta will be quiet once a day well at the dawn well in the afternoon.

6. However, in the provinces of Guipúzcoa and Vizcaya, those with a minimum mesh size equal to or greater than 90 mm and less than 120 mm the maximum immersion time may not exceed 24 hours.

b) Volanta and Rasco.

The maximum immersion time of the flying gear shall not exceed 24 hours and, in the case of scratch, this time shall be no more than 72 hours.

5. Specifics of the Fisheries Plan for Guipuzcoa.

(a) These specificities shall apply in the waters between Punta Saturraran, longitude 002º 24.7 ' W and the maritime border with France.

(b) The maximum length of the permitted minor gillage gear measured from fist to fist, according to the length of the vessels shall be as follows:

1. 3,000 meters for vessels less than 10 meters long between perpendiculars.

2. º 4,500 meters, for vessels equal to or greater than 10 meters in length between perpendiculars.

c) The use of volanta and scratch is prohibited within the 12-mile line measured from land or coast, with the exception of the inland water strip.

6. Specificities of the fishing plan for Vizcaya.

(a) These specificities shall apply in the waters between Punta Saturraran, in longitude 002º 24.7 'W and the meridian of longitude 003º 08.8' W.

b) Regulation of fishing by coastal segments:

ANNEX III

Fishing Plan for Background Drag Mode in the Cantabrian and Northwest

1. Scope of application.

This Fishing Plan is applicable to Spanish flag vessels, which have been censured in the form of bottom trawling at the National Caladero del Cantabrian and Northwest.

2. Prohibitions.

The use and possession on board of the following types of fishing gear and gear shall be prohibited:

(a) The towed gear fitted with train systems of bowling or the like designed for use in rocky bottoms.
