The Ministry of Defense custody an exceptional set of movable property of a historical nature, either in museums or at military installations of different nature. These goods, generated by the activity of the armed forces over time, part of the Spanish historical heritage, understood as the Spanish historical contribution to universal culture and element of cultural identity, protection and enrichment of the assets that comprise it fundamental obligations that are binding on all public authorities, according to the mandate that directs the article 46 of the constitutional standard to them how well it provides in its preamble law 16/1985, of 25 June, on Spanish historical heritage.

The process of inventory and value of the collateral of the Spanish historical heritage attached to the Ministry of defence, as well as growing interest and social impact which are museums, make it suitable to a normative development to establish common performance criteria.

Also, it is necessary to promote instruments of cooperation and participation with the rest of the public administrations and the different social agents in the management of museums, in order to facilitate the access of citizens to culture and disseminate the values that these institutions represent in the whole of society, in accordance with the provisions in the descriptive part, and in article 2 of the Royal Decree 1305 / 2009 , July 31, which is created the network of museums of Spain, which, in turn, is made up of the museums under the Ministry of defence.

In development of the foregoing and in accordance with provisions of article 6 of the Royal Decree 1305 / 2009, of 31 July, has seen fit to create, through this ministerial order, the defence network of museums, as well as establish criteria and standards of management and delivery of services that serve both to ensure better protection and diffusion of the movable property of the Spanish historical heritage attached to the Ministry of defence and to promote the cooperation between its different museums and Museum Collections.

This ministerial order was informed, during its processing, by the Ministry of education, culture and sport.

By virtue, with the prior approval of the Minister of finance and public administration, have: chapter I General provisions article 1. Object.

This ministerial order aims to create the Defense museums network (WDN), understood as the Museum centers of the Ministry of defence coordination structure, as well as define the procedures to be followed in the management of the property of the Spanish historical heritage attached to this ministerial department, with the ultimate aim of ensuring their protection, diffusion and enrichment.

Article 2. Scope of application.

This ministerial order is applicable to all State-owned museums attached to the Ministry of defence, the museum collections of this ministerial department and units, centers and organizations (UCO, s) Department that guarded property of the Spanish historical heritage.

References to the Ministry of defence is construed as references also to his self-regulatory bodies attached.

Article 3. Applicable legal regime.

The content of this ministerial order conforms to the provisions of law 16/1985, of 25 June, the Spanish historical heritage, in the Royal Decree 111/1986, of 10 January, development part of law 16/1985, of 25 June, the Spanish historical heritage, in Royal Decree 620/1987 of 10 April, which approves the regulation of museums of State ownership and of the Spanish system of museums , and in the Royal Decree 1305 / 2009, of 31 July, which is created the network of museums in Spain.

Article 4. Definitions.

1 museums are cultural institutions permanent and open to the public, without spirit of profit and at the service of society and its development, acquire, preserved, documented, research, communicate and exhibit, for purposes of study, interpretation, education and contemplation, goods and collections of historical value, artistic, scientific, technical or any other cultural nature.

The State-owned museums under the Ministry of Defense will comply with General functions formerly referred to as open and centers related to the society for the diffusion of the culture of defence and of the history of the armed forces.

Means parent Museum Center from which coordinates is another or other subsidiaries museums, peripheral museums or delegated and sections by subsidiary Museum, Museum peripheral or associate section, that Museum which is coordinated by a parent Museum.

2 sets of cultural property that not fulfil all the necessary requirements to develop the functions of the museums, are organized with museological criteria, have an established regime of visits, and have conservation and security measures are museum collections of the Ministry of defence.

3 are movable property attached to the Ministry of Defenseministries of the Spanish historical heritage objects of technical, artistic, scientific, historical or military interest which, by their intrinsic value or its significance historical, general or limited to the sphere of a certain UCO, significant exponent of the activity of the armed forces over time and their participation in society. The documentary and bibliographic funds that are part of the collections of the Museum centers of the Ministry of defence and participate of the features described above in this section will have the same consideration.

4. for the purpose of this ministerial order Centre means any Museum or Museum collection of WDN.

Chapter II article 5 defense museums network. Concept, purpose and composition of the network of museums in defense.

1. the RMD is configured as the structure for the coordination and cooperation of the Museum centers of the Ministry of defence, as well as the promotion and improvement of the same.

2. the purpose of the RMD is promote excellence through the mutual exchange of ideas, and projects promoting its relationship with society, promoting its national and international projection and reinforcing its important role in the access of citizens to culture.

3 constitute the WDN: to) State-owned museums under the Ministry of defence, listed in annex I of this ministerial order, in accordance with annexes I and II of the Royal Decree 1305 / 2009, July 31, and with the provisions of articles 3, 4 and 5 of the regulation of museums of State ownership and of the Spanish system of museums , and which can create in accordance with article 9(1) of the same order.

(b) the museum collections of the Ministry of defence, listed in annex II of this ministerial order, and that you can create in accordance with article 9(1) of the same order.

Article 6. Bodies with responsibilities in the defence network of museums.

1 the General Sub-Directorate of publications and Cultural Heritage (SDGPPC) is the governing body responsible for coordinating the WDN, pursuant to article 8, paragraphs 2.l) and 3.c), the Royal Decree 454/2012, 5 March, whereby the basic organizational structure of the Ministry of defence develops.

For the exercise of this jurisdiction can arrange meetings in order to realize tasks of coordination and cooperation between Museum centers. These meetings shall convene a: to) representatives of State-owned museums under the Ministry of defence.

(b) representatives of the bodies of history and military culture of the armed forces.

(c) representatives of the UCO, s and autonomous bodies of the Ministry of defence, which depend on the Museum centers.

The bodies referred to in the lyrics to), b), c) above, whenever they deem it necessary, may propose to the SDGPPC the call for this type of meeting.

2. the bodies of history and military culture of the armed forces will coordinate the activity of the Museum centers and the UCO, s that have movable property of the Spanish historical heritage and are situated within the same organizational structure.

3 autonomous bodies of the Ministry of defence will be responsible for their own Museum centers and the movable property of the Spanish historical heritage, having attached.

Article 7. Census Museum centers of the defense network of museums.

1. will remain updated census Museum centers of WDN, which will serve as a reference tool for the planning and monitoring of their activities and will include data relating to the funds, personnel, services and installations of the same.

2 is the responsibility of the SDGPPC keep updated census Museum centers of WDN, incorporating modifications that occur in every moment. The history and military culture of the armed forces, the UCO's bodies and autonomous bodies of the Ministry of defence, which depend on the Museum centers shall provide the SDGPPC the details and possible changes in these Museum centers.

Article 8. Creation, deletion and transfer from Museum centers of the Ministry of defence.


1. for the creation or deletion of a Museum Center of the Ministry of defence, the UCO or autonomous body which is dependent on or depend on the Museum Center must raise a report justifying of the initiative to the SDGPPC through its corresponding body of history and military culture, in its case. View this memory, the SDGPPC rise to the Technical Secretary General along with a report on the proposal. The final resolution will take the form of ministerial order, except in the national museums, which are created by Royal Decree pursuant to the provisions of article 4(2) of the regulation of museums of State ownership and of the Spanish system of museums. The creation of State-owned museums will require, in any case, the favourable report from the Ministry of education, culture and sport, in accordance with the provisions of article 3(2) of that regulation.

2. When is a Museum Center of the Ministry of defence moved as a result of a change of location of the UCO that depend on, it shall inform the SDGPPC.

Chapter III management of the collateral of the Spanish historical heritage attached to the Ministry of defence article 9. Computer system of inventory, control and management of the heritage historical unit of the Ministry of defence.

1. all movable property that can be considered as part of the Spanish historical heritage, attached to the Ministry of defence in accordance with the definition provided for in article 4.3, must be discharged in the computer system of inventory, control and management of the heritage historical unit of the Ministry of defence, on the system, which is the main instrument for the control and protection.

2. the museums of the Ministry of defence may use, in addition to this system, other systems for museum management.

3. the inclusion of a movable property in the system will be driven by any Museum Center, UCO, or autonomous authority. To register a Fund in the stable collection of a museum the corresponding ministerial order of assignment is required.

4 bodies of history and military culture of the armed forces and the UCO's and autonomous bodies of the Ministry of defence will validate the proposals of high of the property, which may be motivated by the following reasons: to) that the Fund has not been inventoried prior.

(b) that the Fund purchased good furniture of the Spanish historical heritage character by change of use or other reasons.

(c) it is a new entry by purchase, donation or any other mode of acquisition.

5. the decrease in the system of a movable property of the Spanish historical heritage, attached to the Ministry of defence will require reasoned organ history report and culture military armed forces, uco, or by the autonomous body of the Ministry of defence, to which they are attached the collateral. This report shall be sent to the SDGPPC, which will consider its adoption.

Article 10. Out, out of its facilities, funds allocated to museums, museum collections and UCO, s.

1 exit, outside its facilities, funds allocated to a Museum, except when imminent danger requires you to take emergency measures, must be previously authorised by ministerial order. This be designated, as well as basic identification data of the Fund, the reason for the departure, destination, the maximum period of stay, the obligation to comply with the requirements that may be necessary for the conservation and safety and, in his case, the valuation for the purposes of the insurance.

When the place of destination of the funds do not belong to the scope of the Ministry of defence, the entity which receives them shall be obliged to contract an insurance policy covering the risks of transportation, stay in destination and return to its usual location, being beneficiary of the same State, through the Ministry of defence. In any case, is prescriptive pending the signing of the minutes of delivery and receipt of funds by the location of the holder thereof and of the person in charge of the entity that receives them.

To the ministerial order of Fund processing, the titular Center of them will send authorization of funds out to the SDGPPC, with a minimum of forty-five days in advance for departures within the national territory and, at least, five months in advance for departures outside the national territory.

Outlets of funds as a deposit, the maximum term which may constitute the same shall be five years. To extend this time it will be necessary to review the funds on deposit and authorize the corresponding extension through new ministerial order. The authorization of deposits of assets assigned to the museums of State ownership in not Museum installations will require the prior reasoned report of the higher Board of museums, pursuant to article 8(1) of the regulation of museums of State ownership and of the Spanish system of museums.

2. output, out of its facilities, funds allocated to a museum collection or a UCO will be governed by the same procedure established for the exit of funds allocated to museums, except that the place of destination of them belong to the own field of the Ministry of defence. In this case, previously to this occurs, will require an authorization of exit of the funds by the organ's history and culture military armed forces, uco, or by the autonomous body of the Ministry of defence, which depend on the Museum collection, which will determine the origin or not of the same and shall adopt, where appropriate , the conditions for the correct transfer and receipt of funds.

Article 11. Obligations of the UCO, s covered Museum collection or have attached property of the Spanish historical heritage.

1. the UCO, s covered Museum collection or have attached property of the Spanish historical heritage shall ensure adequate conservation and control its location and movements. To this end they may request technical assistance and necessary means to authorities and entities that rely on. In addition, they must ensure the integrity of these funds provided, if necessary, their transfer to a museum to facilitate their conservation and contemplation when their intrinsic value or general interest so advise it.

2 shall be duty of the UCO, s propose discharge, as movable property of the Spanish historical heritage attached to the Ministry of Defense, of those funds deemed worthy of flaunting such qualification in accordance with the definition given in article 4.3 and according to the procedure laid down in article 9.

3. the SDGPPC will develop the appropriate procedure to determine if the goods that, by the end of its useful service life will be destroyed or stored, deserve to be included in the system.

Article 12. Application for a declaration of assets of Cultural interest.

Applications for declaration of assets of Cultural interest which referred to article 10 of the law 16/1985, of 25 June, will be processed by the Secretariat-General Technical Department through the SDGPPC.

First additional provision. Update of the relations of State-owned museums under the Ministry of Defense and of museum collections of the Ministry of defence.

Undersecretary of Defense will keep updated the relations of State-owned museums under the Ministry of Defense and of museum collections of the Ministry of defence, which contained, respectively, in annexes I and II.

Second additional provision. Not increase public expenditure or template.

Enforcement of this ministerial order will take place without increasing operating costs and will not pose increased public spending or staff.

First final provision. School of application.

It empowers the Undersecretary of Defense, heads of State most of the army, the Navy and the air force, in the field of their respective competencies, to dictate how many provisions require the application of this ministerial order.

Second final provision. Entry into force.

This ministerial order shall enter into force the day following its publication in the "Official Gazette".
