The Ministry of Defense has an exceptional set of furniture of a historical character, either in museum institutions or in military installations of different nature. These goods, generated by the activity of the Armed Forces over time, are part of the Spanish Historical Heritage, understood as the historical contribution of the Spanish to the universal culture and element of cultural identity, constituting the protection and enrichment of the goods that are part of the fundamental obligations that bind all the public authorities, according to the mandate given to them by Article 46 of the constitutional standard, as it provides for in The preamble of Law 16/1985 of 25 June of the Spanish Historical Heritage.

The process of inventory and value of the furniture of the Spanish Historical Heritage attached to the Ministry of Defense, as well as the growing interest and social repercussions that the museums raise, make it convenient to regulatory development to establish common operating criteria.

It is also necessary to promote instruments of cooperation and participation with the rest of the Public Administrations and the various social agents in the management of museums, in order to facilitate the access of (a) citizens to culture and to disseminate the values which these institutions represent in society as a whole, in accordance with the provisions of the exhibition and in Article 2 of Royal Decree 1305/2009 of 31 July 2009 establishing the Network of Museums in Spain, a network in which museums attached to the Ministry of Defense are integrated.

In development of the above and in accordance with the provisions of Article 6 of Royal Decree 1305/2009 of 31 July 2009, it has been considered appropriate to create, by means of this ministerial order, the Network of Defence Museums, as well as establishing common criteria and standards for the management and delivery of services that serve, both to ensure better protection and dissemination of the movable property of the Spanish Historical Heritage attached to the Ministry of Defense and to to promote cooperation between its various museums and museum collections.

This ministerial order was informed, during its processing, by the Ministry of Education, Culture and Sport.

In its virtue, with the prior approval of the Minister of Finance and Public Administrations, I have:

CHAPTER I

General provisions

Article 1. Object.

This ministerial order aims to create the Network of Defense Museums (RMD), understood as the coordination structure of the museum centers of the Ministry of Defense, as well as to define the procedures to be followed in the management of the movable property of the Spanish Historical Heritage attached to this ministerial department, with the ultimate aim of ensuring its protection, diffusion and enrichment.

Article 2. Scope.

This ministerial order applies to all state owned museums attached to the Ministry of Defense, to the museum collections of this ministerial department and to the Units, Centers and Organisms (UCO, S) of the Ministry of Defense. Department that guards furniture of the Spanish Historical Heritage.

The references to the Ministry of Defense will also be understood to be made to their self-governing bodies.

Article 3. Applicable legal regime.

The contents of this ministerial order are in accordance with the provisions of Law 16/1985 of 25 June of the Spanish Historical Heritage, in Royal Decree 111/1986 of 10 January, of partial development of Law 16/1985 of 25 June, of the Spanish Historical Heritage, in Royal Decree 620/1987 of 10 April, approving the Regulation of Museums of State Entitlement and of the Spanish System of Museums, and in Royal Decree 1305/2009, of 31 July, for which the Network is created from Museums of Spain.

Article 4. Definitions.

1. Museums are the cultural institutions of a permanent nature and open to the public that, without profit and at the service of society and its development, acquire, preserve, document, research, communicate and exhibit, for study purposes, interpretation, education and contemplation, goods and collections of historical, artistic, scientific, technical or any other cultural nature.

State-owned museums attached to the Ministry of Defense will in general comply with the functions set out above as open and society-related centers for the dissemination of the culture of defense and of the History of the Armed Forces.

It is understood by matrix museum the center from which another or other subsidiary museums, peripheral museums or delegated sections and by subsidiary museum, peripheral museum or delegated section, that museum which is coordinated by a museum, is coordinated. array.

2. Museum collections of the Ministry of Defense are the sets of cultural objects that, without gathering all the necessary requirements to develop the functions of the museums, are organized with museological criteria, have a regime of established visits and have conservation and security measures.

3. Are movable property of the Spanish Historical Heritage attached to the Ministry of Defensals objects of technical, artistic, scientific, historical or military interest that, for its intrinsic value or for its historical significance, general or limited to the sphere of a certain UCO, they are significant exponent of the activity of the Armed Forces over time and their participation in the society. The documentary and bibliographic funds which form part of the collections of the museum centres of the Ministry of Defence and take part in the features described above in this section will have the same consideration.

4. For the purposes of this ministerial order, any museum or museum collection of the RMD is understood by museum center.

CHAPTER II

Defense Museum Network

Article 5. Concept, purpose and composition of the Defense Museum Network.

1. The RMD is configured as the structure for the coordination and cooperation of the museum centers of the Ministry of Defense, as well as the promotion and improvement of the same.

2. The aim of the RMD is to promote excellence through the mutual exchange of projects and ideas, promoting their relationship with society, promoting their national and international projection and strengthening their important role in the access of citizens to culture.

3. They constitute the RMD:

(a) State owned museums attached to the Ministry of Defense, listed in Annex I of this Ministerial Order, in accordance with Annexes I and II to Royal Decree 1305/2009 of 31 July 2009, and with the established in Articles 3, 4 and 5 of the State and Spanish Museum of Museums Regulations, and those that may be created in accordance with Article 9.1 of this same order.

b) The museum collections of the Ministry of Defense, which are listed in Annex II of this ministerial order, and those that can be created in accordance with Article 9.1 of this same order.

Article 6. Organs with responsibilities in the Defense Museum Network.

1. The Directorate-General for Publications and Cultural Heritage (SDGPPC) shall be the management body responsible for coordinating the RMD, pursuant to Article 8 (2) (l) and (3) (c) of Royal Decree 454/2012 of 5 March 2012, for which it is develops the basic organic structure of the Ministry of Defense.

For the exercise of this competence, you will be able to organize meetings in order to accomplish tasks of coordination and cooperation between museum centers. To these meetings you will call:

(a) Representatives of the State-owned museums attached to the Ministry of Defense.

b) Representatives of the military's history and military culture organs.

(c) Representatives of the UCO, s and the autonomous agencies of the Ministry of Defence of which the museum centres are dependent.

The bodies referred to in points (a), (b) and (c) above, where they consider it necessary, may propose to the SDGPPC the call for such meetings.

2. The military's history and military culture organs will coordinate the activity of the museum centers and the UCO, which have furniture of the Spanish Historical Heritage and which are within its own structure. organizational.

3. The autonomous agencies of the Ministry of Defense shall be responsible for their own museum centers and for the movable property of the Spanish Historical Heritage.

Article 7. Census of museum centers of the Defense Museum Network.

1. The census of the RMD's museum centres will be kept up to date, which will serve as a reference tool for the planning and monitoring of their activities and will include data relating to the funds, staff, services and facilities of the RMD. same.

2. It will be the responsibility of the SDGPPC to keep the census of the RMD's museum centers up to date, incorporating at any time the modifications that occur. The military history and culture organs of the Armed Forces, the UCO's and the autonomous agencies of the Ministry of Defense of which the museum centers depend will provide the SDGPPC with the precise data and the possible variations in these data. museum centres.

Article 8. Creation, deletion and transfer of museum centres from the Ministry of Defence.

1. For the creation or deletion of a museum centre of the Ministry of Defence, the UCO or autonomous body of which the museum is to depend on or depend on the museum must raise a supporting memory of the initiative to the SDGPPC through its a corresponding organ of military history and culture, if any. Given this memory, the SDGPPC will elevate it to the Technical General Secretary along with a report on the proposal. The creation of State-owned museums shall, in any event, require the favourable report of the Ministry of Education, Culture and Sport, in accordance with Article 3.2 of that Regulation.

2. Where a museum of the Ministry of Defence is moved as a result of a change in the location of the UCO on which it depends, it shall inform the SDGPPC accordingly.

CHAPTER III

Management of the furniture of the Spanish Historical Heritage attached to the Ministry of Defense

Article 9. IT system for inventory, control and management of the Ministry of Defense's Furniture Historical Heritage.

1. All movable property which may be considered as part of the Spanish Historical Heritage attached to the Ministry of Defense in accordance with the definition provided for in Article 4.3, must be discharged into the computer system of inventory, control and management of the Ministry of Defense's Historical Heritage Site, hereinafter the System, which constitutes the main instrument for its control and protection.

2. Museums of the Ministry of Defense may use, in addition to this system, other systems for museum management.

3. The inclusion of a good piece of furniture in the System will be promoted by any museum center, UCO or competent autonomous body. To discharge a fund into the stable collection of a museum is necessary the corresponding ministerial assignment order.

4. The military history and culture organs of the Armed Forces and the UCO's and autonomous agencies of the Ministry of Defense will validate the proposals for the discharge of the movable property, which may be motivated by the following causes:

a) That the fund has not previously been inventoried.

b) That the fund has acquired the character of the Spanish Historical Heritage property for change of use or other reasons.

c) That is a new income by purchase, donation or any other mode of acquisition.

5. The low in the System of a good furniture of the Spanish Historical Heritage attached to the Ministry of Defense will require detailed report of the military history and culture organ of the Armed Forces, the UCO or the autonomous agency of the Ministry of Defence to which the movable property is attached. This report will be forwarded to the SDGPPC, which will study its approval.

Article 10. Departure, outside their facilities, from funds allocated to museums, museum collections and UCO.s.

1. The exit, outside its premises, of funds allocated to a museum, except where an imminent danger requires emergency measures, must be previously authorized by ministerial order. This shall indicate, in addition to the basic data for identification of the fund, the reason for the departure, the place of destination, the maximum length of stay, the obligation to comply with the requirements deemed necessary for conservation and security of the same and, where applicable, the assessment for the purposes of insurance.

When the place of destination of the funds does not belong to the Ministry of Defense, the entity that receives them will be obliged to hire an insurance policy that covers the risks of transportation, stay at destination and returned to its usual location, being a beneficiary of the same State, through the Ministry of Defense. In any case, it is necessary to sign the minutes of the delivery and receipt of the funds by the management of the center of the funds and the person responsible for the entity that receives them.

For the processing of the ministerial order of exit of funds, the holder center of the same shall forward the request for authorization of the exit of the funds to the SDGPPC, with a minimum of forty-five days in advance exits within the national territory and with at least five months ' notice for exits outside the national territory.

In the outflows of funds as a deposit, the maximum period for which the deposit may be constituted shall be five years. To extend it, it will be necessary to review the funds in deposit and to authorize the corresponding extension through a new ministerial order. The authorization of deposits of goods assigned to state owned museums in non-museum facilities will require the prior reasoned report of the Board of Museums, pursuant to the provisions of Article 8.1 of the Museums of State Entitlement and the Spanish System of Museums.

2. The exit, outside its premises, of funds allocated to a museum collection or to a UCO shall be governed by the same procedure laid down for the exit of funds allocated to museums, unless the place of destination of the same belongs to the The Ministry of Defence's own sphere. In this case, prior to the occurrence, an authorization of exit of the funds will be necessary from the military history and culture organ of the Armed Forces, the UCO or the autonomous agency of the Ministry of Defense depends on the museographic collection, which will determine the origin or not of the collection and will dictate, where appropriate, the conditions for the correct transfer and receipt of the funds.

Article 11. Obligations of the UCO, s that have a museographic collection or have assigned movable property of the Spanish Historical Heritage.

1. The UCO, s that have a museum collection or have assigned movable property of the Spanish Historical Heritage will take care of its proper conservation and control its location and movements. To this end, they may request technical assistance and necessary means from the bodies and entities from which they are dependent. In addition, they shall ensure the integrity of these funds by providing, if necessary, their transfer to a museum to facilitate their conservation and contemplation when their intrinsic value or general interest so advises.

2. It will be the obligation of the UCO, s to propose the discharge, as movable property of the Spanish Historical Heritage attached to the Ministry of Defense, of those funds that consider worthy to hold such qualification according to the definition given in the article 4.3 and in accordance with the procedure laid down in Article 9.

3. The SDGPPC will develop the appropriate procedure to determine if the goods that, to end their service life will be destroyed or stored, deserve to be included in the System.

Article 12. Request for a declaration of Good of Cultural Interest.

Requests for a declaration of Good of Cultural Interest referred to in Article 10 of Law 16/1985 of 25 June shall be processed by the Technical General Secretariat of the Department through the SDGPPC.

Additional disposition first. Update of the relations of state owned museums attached to the Ministry of Defense and museum collections of the Ministry of Defense.

The Assistant Secretary of Defense will keep updated the relations of state owned museums attached to the Ministry of Defense and the Ministry of Defense's museum collections, respectively, in the annexes. I and II.

Additional provision second. No increase in public or template expenditure.

The implementation of this ministerial order will be carried out without an increase in the cost of operation and will not increase public or personal expenditure.

Final disposition first. Application faculty.

The Assistant Secretary of Defense, the Army of Land, Navy, and the Air Force Chiefs of Staff, in the field of their respective powers, are empowered to dictate how many provisions the application of this ministerial order.

Final disposition second. Entry into force.

This ministerial order shall enter into force on the day following that of its publication in the "Official State Gazette".
