The creation of the Directorate-General of the Treasury makes it necessary to establish an adequate distribution of functions between the two bodies in order to discharge the management burden that corresponds to the General Secretariat of the Treasury and Financial.
Therefore, and in accordance with the provisions of Articles 13 and concordant of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and in the Disposition Additional thirteenth of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, prior to the authorization of the Secretary of State for Economic and Support to the Company, I have:
1. The head of the Directorate-General of the Treasury is delegated the responsibility for carrying out the operations that Article 108.2 of Law 47/2003 of 26 November, General Budget, attributes to the General Secretariat of the Treasury and Financial.
2. For the exercise of the powers provided for in the preceding paragraph, the holder of the Directorate-General of the Treasury shall, in the cases of vacancy, absence or sickness, be supplied by the governing bodies which are dependent on him in accordance with the order in question. which are mentioned in Royal Decree 345/2012 of 10 February, for which the basic organic structure of the Ministry of Economy and Competitiveness is developed, as amended by Royal Decree 672/2014 of 1 August.
3. The delegation of powers in this Resolution is without prejudice to the fact that at any time the General Secretariat of the Treasury and Financial Policy may be able to endorse the knowledge and resolution of all matters as appropriate. in relation to the subject matter which is the subject of delegation.
4. Whenever the use of the delegations contained in this Resolution is made, it shall be expressly stated.
5. This Resolution shall enter into force on the day following its publication in the Official Gazette of the State.
