The health situation in relation to foot-and-mouth disease in the countries of North Africa, and its worsening with the declaration to the World Organisation for Animal Health (OIE) of several outbreaks in Morocco, necessary to establish a series of urgent measures to prevent the entry of this disease into our territory.

For this reason, Order AAA/2444/2015 of 19 November 2015 establishing preventive emergency measures against foot-and-mouth disease in the Maghreb is published.

Subsequently, Commission Implementing Decision (EU) 2015/2217 of 27 November 2014 on measures to prevent the introduction into the European Union of the foot-and-mouth disease virus from Libya has been published and Morocco.

This Decision lays down preventive measures against foot-and-mouth disease for livestock vehicles and vessels from Libya and Morocco, but not for those from Tunisia and Algeria.

Taking this into account and, having carried out a detailed analysis of the risk of the entry of the virus into national territory, it is appropriate to maintain the preventive measures in relation to vehicles for the transport of goods. established in the Order of 19 November 2015, making a number of amendments to the prohibition on imports of products of animal origin in order to bring it into line with the actual risk of these products.

In its virtue, I have:

Single item. Amendment of Order AAA/2444/2015 of 19 November 2015 establishing preventive emergency measures against foot-and-mouth disease in the Maghreb.

Articles 2, 3 and 4 of Order AAA/2444/2015 of 19 November 2015 laying down preventive emergency measures against foot-and-mouth disease in the Maghreb are replaced by the following:

" Article 2. Introduction of live animals and products of animal origin in the national territory.

1. All imports of products of animal origin obtained from animals susceptible to foot-and-mouth disease from Algeria, Libya, Morocco and Tunisia shall comply with the following conditions:

(a) The treatment applied to the product must be sufficient to inactivate the foot-and-mouth disease virus, in accordance with the indications of the health code for terrestrial animals of the World Health Organisation. Animal (OIE).

b) The product has been the subject of all necessary precautions to prevent it from becoming contaminated after treatment.

c) The product has been packaged in new packaging or has been cleaned and disinfected with a chemical agent of recognized efficacy against the virus.

When these conditions are not included in the model certificates laid down by European Union legislation, the products shall be accompanied by an additional certificate from the official veterinarian of the European Union. source.

The importation of processed manure from Algeria, Libya, Morocco and Tunisia is prohibited.

2. The introduction into Ceuta and Melilla of personal consignments of meat and meat products, milk and milk products from Algeria, Libya, Morocco and Tunisia shall be prohibited.

3. The entry of equidae from Algeria, Libya, Morocco and Tunisia into the national territory, including Ceuta and Melilla, shall be possible only when:

(a) Together with the certificate in accordance with the model established by the legislation of the European Union, be accompanied by an additional declaration signed by an official veterinarian indicating that the animals are not come from a holding in which animals susceptible to foot-and-mouth disease exist, and the holding is situated in an area where there has been no outbreak of the disease within a radius of 10 km;

(b) The vehicle in which the animals are transported has been cleaned and disinfected with a chemical agent of recognised efficacy against the virus, which shall be credited with the relevant document issued at the premises of cleaning and disinfection of the third country of origin from which the national territory is accessed. This document shall contain at least the date of cleansing and disinfection, the product used, and its concentration;

(c) The helmets of equidae with a chemical agent of recognised efficacy against the virus should be cleaned and disinfected at the Border Inspection Post of entry into the national territory.

Article 3. Prohibition of entry of live animals and animal products and of animal origin from Ceuta and Melilla.

1. The entry to the rest of the national territory of hay, straw and live animals of species susceptible to foot-and-mouth disease from Ceuta and Melilla, as well as animal and animal products, with the exception of re-importation, shall be prohibited. fishery and aquaculture products and without prejudice to the provisions laid down in Commission Regulation (EC) No 206/2009 of 5 March 2009 on the introduction into the Community of personal consignments of products of origin animal and amending Regulation (EC) No 136/2004.

However, the entry into the rest of the national territory of hay or straw may be accepted by accompanying animals from the said cities of Ceuta and Melilla, where the origin of such products is Spain or another Member State of the European Union, and this condition is certified by an official veterinarian of Ceuta or Melilla, as appropriate.

2. The entry of equidae from the cities of Ceuta and Melilla to the rest of Spain shall only be possible where the origin of the equidae is Ceuta or Melilla, and the hulls of the equidae are cleaned and disinfected with a chemical agent of recognised efficacy against to the virus in the Border Inspection Post of entry into the peninsular territory.

However, the cleaning and disinfection of the helmets at the Border Inspection Post shall not be necessary when the animals are accompanied by a certificate issued by an official veterinarian of Ceuta or Melilla, as appropriate, indicating that the hulls of the animals have been cleaned and disinfected with a chemical agent of recognised efficacy against the virus immediately prior to the loading of the animals into the transport vehicle.

Article 4. Disinfection of road transport vehicles.

1. They must be cleaned and disinfected, with a chemical agent of recognised efficacy against the virus, prior to their arrival in the national territory of all road transport vehicles from Algeria, Libya, Morocco and Tunisia which transport or have been transported:

a) Live Unguls.

(b) Feed, with the understanding of any product intended for animal feed, but not including feed intended for aquaculture.

c) Straw or hay.

In particular, this cleaning and disinfection shall be carried out on the livestock compartment and the body of the truck if applicable, the loading ramp, the wheels and the driver's cab, as well as the equipment which has been in contact with animals, clothing and protective boots used during loading or unloading.

The cleaning and disinfection of the vehicle must be done immediately before leaving for Spain, so that once clean and disinfected, no infected areas of foot-and-mouth disease circulate, there is a risk that the vehicle will be Repollute.

2. The cleaning and disinfection shall be accredited with the corresponding document issued in the cleaning and disinfection facilities of the third country of origin from which the national territory is accessed. This document shall contain at least the date of cleansing and disinfection, the registration of the vehicle, the product used and its concentration.

3. These vehicles will be disinfected again at the point of arrival in the national territory with a chemical agent of recognized efficacy against the virus.

4. Only road transport vehicles referred to in paragraph 1, from Algeria, Libya, Morocco and Tunisia, may be introduced into the national territory through ports or points of entry which have facilities, personnel, equipment and equipment. and devices suitable for the disinfection of such vehicles.

5. The port authorities and, where appropriate, the entities or management administration of the ports owned by the autonomous communities, shall make available to the competent authority the existing facilities necessary for disinfection. The cleaning and disinfection will have the consideration of commercial service according to the provisions of the Royal Legislative Decree 2/2011, of 5 September, for which the recast text of the Law of Ports of the State and the Navy is approved Merchant, and will be provided by companies that meet the requirements that the Ministry of Agriculture, Food and Environment will establish for these purposes.

6. The official veterinarian shall establish the procedure for the disinfection of vehicles and the issue of the corresponding certificates.

7. The costs of disinfection shall be on behalf of the economic operator holding the means of transport, and may be required in advance. For this purpose, the driver of the vehicle shall be considered to be an economic operator.

8. Where the official veterinarian of the Animal Health Service considers that a road transport vehicle may be at risk of transmission of the disease, he may refuse entry into the national territory, instead of his/her disinfection. "

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
