Resolution Of 16 December 2015, Of The Consortium Of Biomedical Research Support Network In Liquidation, Whereby Personal Data Files Are Deleted.

In the "Official State Gazette" of 9 February 2010 (correction of errors, "BOE" of 3 August 2010), the agreements for the creation of personal data files called "Personal CAIBER" were made public, "Representatives", "Researchers", and "Providers", whose responsibility is the Network Biomedical Research Support Consortium (CAIBER).

The Governing Council of the CAIBER, the highest governing body of the Consortium, at an extraordinary meeting held on 25 May 2012, approved the dissolution of the same as provided for in Article 44 of its Statute, so it is public entity is in a liquidation period appointing to this effect a Liquidator Commission that assumes from this date all the actions intended to end its activity. Among them is the deletion of the personal data files whose responsibility is the aforementioned consortium, which can be carried out once it has been agreed by its Board of Rector.

Article 20 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, as well as Article 52 of Royal Decree 1720/2007 of 21 December, approving the Implementing Regulation, provide that the creation, modification or deletion of the files of public ownership may be made only by means of a general provision published on the basis of the "Official State Gazette" or the corresponding Official Journal.

According to the above, the Chairman of the Board of the Board of the CIBER in liquidation resolves:

First.

Delete personal data files called "Personal CAIBER", "Representatives", "Researchers", and "Providers", whose responsibility is the Network Biomedical Research Support Consortium in liquidation, as well how to proceed to the total elimination of the data contained in these files, in compliance with articles 20 of the Organic Law 15/1999, of 13 December, of Protection of Personal Data, and 54.3 of the Regulation of the Development of the same.

Second.

Notify the deletion of the files to the Spanish Data Protection Agency for the purpose of the cancellation of the registration in the General Register of Data Protection, as provided for in the article 58 of the Implementing Regulation of Organic Law 15/1999.
