The Resolution of 25 June 2013, of the General Secretariat of the Administration of Justice, on remuneration in cases of temporary incapacity for common contingencies of the members of the Body of Judicial Secretaries, determined the assumptions in which, on an exceptional and duly justified basis, a supplement can be established up to a maximum of one hundred per cent of the remuneration to be enjoyed at any time.

In the time since the adoption of this Resolution, it has been found that there are dysfunctions caused by the existence of various regulations, so it is necessary to modify the resolution. in the sense of including new exceptional circumstances in which one hundred percent of the remuneration that was received is received, in cases of temporary incapacity for common contingencies of the Body of Letters of the Administration of Justice.

In its virtue, and in accordance with the regulation contained in Articles 445.2 and 463 of the Organic Law of the Judiciary, in Article 20 of Royal Decree 1608/2005 of 30 December 2005, for which the Regulation is adopted Organic of the Body of Judicial Secretaries and in Article 3 of RD 453/2012, of March 5, for which the basic organic structure of the Ministry of Justice is developed, this General Secretariat has agreed to dictate the following resolution.

First. Amendment of the resolution of 25 June 2013, of the General Secretariat of the Administration of Justice, on remuneration in cases of temporary incapacity for common contingencies of the members of the Body of Judicial Secretaries.

One. Point 2.4 of the second paragraph of the Resolution is amended, which is worded as follows:

" 2.4 Temporary disability processes initiated during pregnancy, treatment by assisted reproductive technique or breast-feeding period, even if they do not result in a risk situation during the period of pregnancy. pregnancy or breast-feeding. "

Two. Point 2.5 of the second paragraph of the Resolution is amended, which is worded as follows:

" 2.5 Other serious diseases and/or subject to mandatory declaration. Those pathological processes which may be suffered by adults as referred to in Annex I to Royal Decree 1148/2011 of 29 July 2011 for the implementation and development of the social security system shall be understood as such. economic benefit in the care of children affected by cancer or other serious illness.

Also included in this section are the ischemic heart disease and the diseases listed in Annexes I and III of Royal Decree 2210/1995 of 28 December, creating the National Surveillance Network. Three. A new point 2.8 is added to the second paragraph of the Resolution, which is worded as follows:

"2.8 Temporary inability derived from invasive diagnostic scans, such as endoscopies, colonoscopies, gastroscopies, fibrobronchoscopies, catheterisms, and others of a similar entity."

Four. A new point 2.9 is added to the second paragraph of the Resolution, which is worded as follows:

"2.9 Voluntary termination of pregnancy in the first trimester of pregnancy by drug induction."

Second. Entry into force.

This Resolution shall apply to situations of temporary incapacity arising from the day following that of its publication in the "Official State Gazette".
