Law No. 2016-09 March 14, 2016 Act No. 2016-09 of March 14, 2016, establishing a biometric ID card ECOWAS explanatory memorandum the institution of a national biometric identification card is the major decision adopted by the forty-sixth (46th) regular session of the conference of Heads of State and Government of the economic community of the African States of the West (ECOWAS) held in Abuja December 15, 2014.
This Summit recommendation was also made to the States members of the community to put into circulation from 2016 this biometric ID card that will also serve as travel within the ECOWAS document.
Purpose, through the introduction of the biometric ID card common to all the Member States of ECOWAS is to facilitate intra-regional mobility through a secure title to fight trafficking and migration and at the same time meet the current challenges of fight against the terrorist threat.
It is to be in harmony with this community decision that it is necessary to proceed to the replacement of the national identity card Senegalese scanned currently underway in our countries and established by Act No. 2005-28 September 06, 2005 and Decree n ° 2005-787, September 06, 2005 and whose most produced in 2006 due to expire in 2016.
This electronic chip ID card can serve at the same time to multiple applications, and where appropriate, serve as other cards.
Such is the economy of the present Bill.
The National Assembly adopted in its session of Friday, March 04, 2016, the President of the Republic enacts the law whose content follows: Article 1. -There is hereby established an ECOWAS biometric ID card biometric data.
S. 2. - this identity card is issued to Senegalese citizens.
It is compulsory for all citizens aged at least fifteen (15) years and may be issued to any citizen aged five (05) years of age.
S. 3. - this card is valid for a period of ten (10) years. At the end of this period, it must be renewed.
S. 4. - the above identity card is a smart card electronic multi application.
It can also be used for other purposes, on terms laid down by Decree.
S. 5. - the conditions of issuance and renewal of the said map as well as the elements affected by biometrics and its date of effect, as well as the deadline for validity of the old identity card shall be fixed by Decree.
S. 6 - provisions contrary to this law are hereby repealed and especially those contained in Act No. 2005 - 28 of September 06, 2005 establishing the national Senegalese identity scanned card.
This Act will be enforced as law of the State.
