Regulation of Traffic Police Corps.

We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and
General Council at its meeting on 5 November 1963:
TITLE I. || | Purpose organic dependence.
Art.
1. Purpose.
The Corps of traffic police is set up for the supervision of road traffic across the
territory of the Republic and also, under the direction of Police Inspectorate, carries out disciplinary functions
civil, industrial, commercial, tax, tax, ration, toilet, social security, and monitors
compliance with the laws, decrees and regulations of the State as well as the orders by
Authority.
If necessary, with the approval of the Home Secretary, assists the
Gendarmerie for the public order policing.

Art. 2.
Office Relocation of Command.

Art. 3.
of traffic police stations.
The Brigade, prior authorization of the Congress of State on the proposal of the Secretary of State

Art. 4.
Organic.
The staff belonging to the Body of Traffic Police has the status of civil servant off organic

- Four graduates with the following qualifications:
a) a graduated 1st with duties of Deputy Commander (Marshall);
B) two graduated 2nd (Brigadier);
C) a graduated of 3rd (Vice Brigadier);

- Fifteen brigades;
- A traffic officer to the Office of Health and Hygiene.
The distinctions to the above qualifications are formed to annex n.

Art. 5.
Powers of Commander.

Art.
8. Duties of the traffic police.

Art. 9. Admission
in Traffic Police Corps.

Art. 10.
requirements.
Applicants must meet the following requirements:
a) not younger than 18 years and not more than to 30 years;

G) San Marino citizenship.
The candidates, who may be celibate or married, will undergo rigorous medical examination by a health
designated by the State Congress.
The winners are hired with QUALIFIED of Vigilant on probation for one year.
Art. 11.
Trial period.
During the trial period the Department are required to attend educational courses and training,

Art. 12.

Art. 13.
Qualification graduate.

Art. 14.
Selection Committee.

Art. 15.
Hiring and requirements of the Commander.
The Commander of the Municipal Police force was appointed by the Great and General Council and,

Art. 16.
Oath.

:
"I, member of the Body of the traffic police of the Republic of San Marino, admitted to the

Art. 17. Each

Art. 18.
Marriage.

Art. 19.

TITLE II.
Specific Duties.
Art. 20. Uniform
in service.

Art. 21.

Art. 22.
Service.

Art. 23.

Art. 24.

Art. 25.

TITLE III.
Rights.
Art. 27.

Art. 28.

Art. 29.

Art. 31.
Liquidation.
The members of the Municipal Police force have been entitled if the service ends, if they have no
entitled to a pension, a severance pay equal to many of the last monthly base pay with increases

The severance pay is not paid to the member who made less than one year of service
or was deposed.
At the end of service the employee is entitled to the payment of any compensation

Art. 32.

Art. 33.
Right to retirement.

Family allowances.
The members of the Corps are entitled to receive child benefit according to the criteria established by
existing rules for state employees.
Art. 35.
Transfers.

Art. 36.
Weekly rest.

Art. 37.
Licenses.

Art. 38.

Art. 39.
Granting and assignment of licenses.

Art. 40.

Art. 45.

TITLE IV.
In-service stability.
Art. 46. ​​

Art. 47.
Resignation.

Art. 48.

Art. 49.
Diseases.

Art. 51.

Art. 52.

TITLE VI. Punishments
.
Art. 53.
Species punishment.

a) warning;

55. Application of the punishment referred to in point b) of art. 53.
The punishment applies to:

Art.
56. Application of the punishment referred to in subparagraph c) of art. 53.

The punishment applies to:
- recurrence of the offenses mentioned in the previous article is about;
- Acts or facts that tend to create discontent or unrest among the apartments to the Body;
- Alteration of the truth in the compilation of reports or records, unless it constitutes a crime;
- Serious abuse of authority;
- Drunk on duty;
- Sale, alteration or loan of Administration garments;
- Declaration of physical ailment, recognized afterwards, visiting from tax, non-existent.
Art.
60. Application of the punishment referred to in subparagraph g) of art. 53.
The punishment applies to:
- constant recurrence of the offenses referred to in articles Prev nti;
- Loss of the excellent moral conduct and civil;
- Having brought in at the end characteristic features of the first year of service the
ranking "mediocre";
- Have shown, in the known characteristics, for the first two consecutive years, the
classification "sufficient";
- Participate in uniform in the event policies;
- Offenses related art. 24 of these Regulations.
Art.
61. Application of the punishment referred to in point h) of art. 53.
The punishment applies to:
- any willful or negligent act against the State or against smmarinese friendly states;
- Any conviction for intentional crimes;
- Strike demonstrations or incitement to strike;
- Any act not serious nature prejudicial against property of the State;
- Failure to live up to the oath;
- Insubordination to addiction.
Art. 62.
punitive Faculty.
The punishments by the letter a) to c) it will be inflicted by the Commander.
The punishments by the letter d) to f) it will be imposed by the Secretary of State for Interior Affairs
behind hierarchical proposal.
The punishments of the letter g), and the letter h) will be inflicted by the State Congress behind proposals hierarchical
.
Art. 63.
First appeal.
Against punitive measures by the letter a) to f) may be submitted in writing to the Authority
immediately superior to the one he inflicted punishment.
If the decision was not to the liking punished, they can submit another appeal in
ten days the Congress of State that sanctions definitively.
The applicant, however, it is responsible for the deficiencies that he, commit with the appeal.
Art. 64.
According appeal.
Against the decision of the Congress of State involving the dismissal, also ranking
on known characteristics, or the dismissal, the employee may appeal to the Ordinary Judge
Appeals constituted for civil cases as Administrative Judge. The appeal must be presented
forward to the Registrar of the Commissioner's Court within ten days of notification of
measure of the State Congress.
It 'faculties given to the Administrative Judge of opening terms of testing and double check in order to
appeal filed.
The ruling of the Administrative Judge's decision is final.
Art. 65.
Temporary suspension.
At any time the Corps Command can proceed, pending the decisions of the Congress of State
or pending criminal proceedings, suspension of the employee from service.
The suspension pending judgment can be extended for the duration of judgment
same.
The temporary suspension will result in the loss of salary, unless the reintegration of
same in case of acquittal of any charge.
TITLE VII.
Special rules.
Art. 66.
Official Banner of the Body.
The official banner of the traffic police ècomposto of three body colors: antique yellow, white, purple.
Art. 67.
Uniforms.
To the members of the body is forbidden to make changes to the forms supplied uniforms,

That will be of the following form:
winter Uniform: black cloth to the Department, cordellino bleu for Graduated and for the Commander.
Jacket to a chest with two pockets and two breast pockets of t Military bit; sleeves without cuffs; straps profiled rigid
white and blue; buttons imprinted with "three feathers" and badges of rank-colored gold
; of gold award plaque with the number, to be asked under the right breast pocket;
insignia depicting the coat of arms of the Republic to the lapels of his jacket, and waterproof coat, gold;
Trousers without cuffs; black helmet and on the title page the coat of arms of the Republic gold;
white shirt and black tie; black double-breasted coat with belt and buttons in gold; high black shoes;
Cloth cap to the Commander, the Graduated and chosen Brigade;
Summer Uniform: white cloth for the Brigade, Graduated and Commanders, in the same manner and using the same
straps of the winter uniform; white helmet with the same coat of arms above,
white shirt and black tie; low white shoes; white cloth cap to the Commander, the Graduated
and the chosen Brigade.
Art. 68.
Clothing.
The clothing shown in the attached table no. 5 and at the expense of the Public Administration, which also
renewal according to the table.
Art. 69.
Personal cards.
The members of the body will be provided with personal badge of recognition. The card is issued
Commander Inspector of Police and the Graduated, chosen by
Brigade and Brigade Commander.
Art. 70.
Service States.
The Traffic Police Command must be kept for each employee, even temporarily, a state
unit registration, with personal data and information regarding the acquisition, to trial periods, punishment,
awards and all that relation to the service provided in the body.
TITLE VIII.
Final provisions.
Art. 71.
Transitional rule.
Upon entry into force of this Regulation the current members of the body, as long as no temporary
or older than that provided for by art. 48, enter the Corp of appointment right
maintaining the status they have in their possession, as long as such qualification is not in conflict with
this Regulation.
Art. 72.
Final provision.
Any law or provision contrary to this Regulation is repealed.
