Regulation of Traffic Police Corps.

We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and
General Council at its meeting on 5 November 1963:
TITLE I. || | Purpose organic dependence.
Art.
1. Purpose.
The Corps of traffic police is set up for the supervision of road traffic across the
territory of the Republic and also, under the direction of Police Inspectorate, carries out disciplinary functions
civil, industrial, commercial, tax, tax, ration, toilet, social security, and monitors
compliance with the laws, decrees and regulations of the State as well as the orders by
Authority.
If necessary, with the approval of the Home Secretary, assists the
Gendarmerie for the public order policing.
The Corps of traffic wardens through disposizion Commander must ensure continuity of
uninterrupted service day and night.
The State Congress at all times has the right attr ute certain tasks also extraordinary
they are, however, compatible with the prerogatives and functions of the body.
Art. 2.
Office Relocation of Command.
The Office of the Command of the Municipal Police force is headquartered in the San Marino City.
The Office must hold:
a daily memorial service;

Art. 3.
of traffic police stations.
The Brigade, prior authorization of the Congress of State on the proposal of the Secretary of State
for Internal Affairs, will establish local police stations in the Castelli if any complex industrial

Art. 4.
Organic.
The staff belonging to the Body of Traffic Police has the status of civil servant off organic
, governed by these Regulations.
The Corps of traffic police is composed hierarchically, as follows:
- a Commander (Warrant Officer);
- Four graduates with the following qualifications:
a) a graduated 1st with duties of Deputy Commander (Marshall);
B) two graduated 2nd (Brigadier);
C) a graduated of 3rd (Vice Brigadier);
- Three chosen fighters, including one guy on duty;
- Fifteen brigades;
- A traffic officer to the Office of Health and Hygiene.
The distinctions to the above qualifications are formed to annex n.
1. During the summer period will be provided to take into service, as needed, Brigade
temporary approval of the State Congress.

Art. 5.
Powers of Commander.
The Commander of the Municipal Police force has completed the internal and external of the organization's management body

Art. 6. Duties of the

Art.
8. Duties of the traffic police.
The members of the Body has imposed observance of the duties inherent in general to their office,
position and qualification. Facilities should also:
1) maintain a proper demeanor in service and an irreproachable conduct in private life and
entrust their morality, inspires confidence in any respect and always be in tune with the decor of the uniform and all
' burden of the Body;
2) wait for the disengagement of its task with zeal and diligence in accordance with the provisions of these Regulations
for the various services and in accordance with the instructions and orders issued by the bodies

3rd) prove always polite to everyone and especially to those who request them news, information or support

4th) regularly observe the hours of service;

6th) to keep around the service business, which are not of public reason, the most 'absolute secrecy

7th) and cooperate as supplirsi each other in case of absence or inability, the
ready and regular dispatch of service, regardless or the capacity and responsibility of granting;
8th) pay his own work in the service of the State ven outside of the ordinary duties in all
contingencies and functions that are delegated by reason of their office, especially in the case of public or private
magnet;
9th) always and at all times avoid uttering inappropriate words and act calmly and thoughtfully
to avoid rebellions, especially when tempers are excited;
10th) reside permanently in the territory of San Marino, for those who are part of stations detached
, reside permanently in the Castle which houses the station.

Art. 9. Admission
in Traffic Police Corps.
The admission to the Traffic Police Corps, as a Police Officer, takes place through public competition

Art. 10.
requirements.
Applicants must meet the following requirements:
a) not younger than 18 years and not more than to 30 years;
B) license 5th grade (provided they are in possession of a good general education);
C) minimum height of 1.70 and visual acuity not less than 8/10 ds;
D) Minimum chest m. 0.90;
E) adequate physical presence, and exemption from disease and imperfections that reduce the ability to pay
unconditional service;
F) good moral and civil;
G) San Marino citizenship.
The candidates, who may be celibate or married, will undergo rigorous medical examination by a health
designated by the State Congress.
The winners are hired with QUALIFIED of Vigilant on probation for one year.
Art. 11.
Trial period.
During the trial period the Department are required to attend educational courses and training,

After the trial period, on a proposal from the Commander, the State Congress sanctions the

On opinion of the Brigade, the Congress of State has the power to extend the probationary period

Art. 12.

Art. 13.
Qualification graduate.

Art. 14.
Selection Committee.
The Selection Committee for the appointment of traffic wardens comprises:

Art. 15.
Hiring and requirements of the Commander.
The Commander of the Municipal Police force was appointed by the Great and General Council and,
after a trial period of one year, to reference the Secretary of State for Internal Affairs and the Police Inspector

The commander must have:
a) the requirements referred to in letters c), d), e), f) of art. 10;
B) the minimum lower level secondary education;
C) minimum age of 25 years and maximum of 40 years;

Art. 16.
Oath.
When the transition to the actual member of the Body must take an oath according to the following formula
:
"I, member of the Body of the traffic police of the Republic of San Marino, admitted to the
Body predicted, swear before God's faithfulness and obedience to the Republic itself, to exert
fairly and as an honest man use that is confided to me forcing me to recognize
for my one and only higher than the Great and General Council and its representatives ".
Art. 17. Each

Art. 18.
Marriage.

Art. 19.

TITLE II.
Specific Duties.
Art. 20. Uniform
in service.
The members of the Body shall always dress du ante service uniform and from time to time
accessories prescribed by the Commander, in accordance with the requirements of the service itself and in accordance with Article

Art. 21.
legal status.
All members of the body, in the interior of the Republic, must be considered always
exercise of their functions and fall under the provisions of Art. 8 of the Law of 13 January 1897.

Art. 22.
Service.
The rosters are established by the Commander, with the observance of weekly rest, and
are marked on a special memorial by a graduate.
The daily service is for a minimum of eight hours. At its conclusion Corps personnel
shall report to the graduate officer to de service control to make an exact account of their work and to report back
any relevant news.
All services begins and ends at the office of belonging.
It is not permissible, when the time expires, go elsewhere without first being passed at the office

Art. 23.
Wave.
The members of the Body, as well as to their superiors when they are in uniform, must salute the
Captains Regent of the members of the State Congress, the Secretaries of State, the Commissioners of

Art. 24.

Art. 25.

26. Relations between the members of the Body.

TITLE III.
Rights.
Art. 27.

Art. 28.
periodic increases.
The base pay is susceptible to periodic increases based on the following biannual:
- from I to IV: 10%;
- From the V to the VIII: 5%;
- From IX to XVI: 2.5%.
The service in military corps, provided on an ongoing basis and excluding the service intermittent
served in the Guard of the Great and General Council, Uniformed Militia, Concerto
Military and Fortress Guard, and his service in other state employment of the Republic is

Art. 29.
Departures salary.
The body belonging to the traffic police may assign up to a fifth of their salary monthly

Art. 30. Withholding

The basic pay and any periodic increases of fighters are subject to a deduction equal to 7%
to the pension fund with a right to reimbursement of the retained if the service does not exceed a

Art. 31.
Liquidation.
The members of the Municipal Police force have been entitled if the service ends, if they have no
entitled to a pension, a severance pay equal to many of the last monthly base pay with increases
periodic accrued and its thirteenth month salary, how many years of service
or deemed to be in accordance with the provisions of this Regulation.
The severance pay is not paid to the member who made less than one year of service
or was deposed.
At the end of service the employee is entitled to the payment of any compensation
liquidated, calculated on the basis of their last amount, including the part of afferent
thirteenth month salary, multiplied by many years corresponding to those in which the component has actually received
.
The fractions of a year are awarded to twelfths.
Art. 32.

Art. 33.
Right to retirement.
The body belonging to the local police has the right to a pension in the amount provided by

Art. 34.
Family allowances.
The members of the Corps are entitled to receive child benefit according to the criteria established by
existing rules for state employees.
Art. 35.
Transfers.
The member of the Body is expected to go away every time for particular situations of office

Art. 36.
Weekly rest.

Art. 37.
Licenses.
The members of the body is up an annual license to the following extent:
a) no licensed day in the calendar year in which they were taking.
B) 15 days leave during the second year of service;

D) 25 days license in the fourth year of service;
E) 30-day license from the fifth year of service onwards.
The license can be enjoyed in one or more 'periods consistent with the needs of the service and, in
any case, in the period from 15 September to May inclusive.
It may also be granted the following extraordinary licenses:
- 10 days in case of marriage;
- 5 days for serious family bereavement.
Art. 38.
waiver of licenses.
The licenses referred to in the preceding Article may not be waived.

Art. 39.
Granting and assignment of licenses.

during the year, except in exceptional cases under art. 40.

Art. 40.

Art. 42.
Awards.

Art. 43.

Art. 44.
Leave on personal grounds.

Art. 45.
Death of the Body component.
If the component Body dies during the employment relationship, leaving family people

the severance pay if payable to the deceased.

The funeral of the body component, if passed away through injury or disease due to employee service
, are the responsibility of the State.
TITLE IV.
In-service stability.
Art. 46. ​​

retirement, dismissal, removal from office.
Art. 47.
Resignation.

Art. 48.
Placing at rest.

Art. 49.
Diseases.

If the disease belonging to the Body shall immediately give notice to the Command and within

Art. 50. Disability
.

not exceed six months.

Art. 51.

Art. 52.
Recognition of diseases because of service.
The awards of the diseases mentioned in the previous article shall be obtained by interested parties

The Congress of State recognizes the disease because of service upon advice of a medical committee composed
by the examining doctor, a doctor of confidence of Congress and by a doctor

TITLE VI. Punishments
.
Art. 53.
Species punishment.
The disciplinary punishments, which shall be entered on the personal folder of each alert are:
a) warning;
B) fine from L. 200 to L. 2,000;
C) fine from L. 3,000 to L. 10,000;
D) censorship, consisting of a letter of reprimand;
E) the reduction of the basic salary up to a fifth and suspension from duty for 15 days;

G) dismissal;

Art.
54. Application of the punishment referred to in subparagraph a) of Art. 53.
The punishment applies to:
- negligence on duty;
- Deficiency of the accessories of the uniform;
- Carelessness in personal cleanliness;
- Omission of greeting to the superiors and civilians and failure to return the greeting itself.
Art.
55. Application of the punishment referred to in point b) of art. 53.
The punishment applies to:
- unaccustomed delay to undertake the service;
- Sprawl and undignified in service;
- Conversation in the civil service for things not related to the service itself;

- Delay or unintentional omission of communications related to the service.
Art.
56. Application of the punishment referred to in subparagraph c) of art. 53.
The punishment applies to:

- Removal from the place of service, for a period not exceeding 10 minutes;

- Delay in handing over the duty to found or seized objects;

Art.
57. Application of the punishment referred to in subparagraph d) of Art. 53.
The punishment applies to:
- recurrence of the offenses mentioned in the previous article is about;

- Breach of professional secrecy, unless it constitutes a crime;

- Any breaches of the duties under this Regulation;
- Removal from the place of service for more 'than 10 minutes;
- Non-observance of any internal provisions, enacted by the Commander for discipline
or organization, even if not included in these Regulations, unless it falls

Art.
58. Application of the punishment of those referred to in point e) d ll'art. 53.
The punishment applies to:
- recurrence of the offenses mentioned in the previous article is about;
- Immoral conduct both in service and in private life;
- Tolerance of irregularities in the service;

- Receiving gifts or remuneration from any person for reasons of service.
Art.
59. Application of the punishment referred to in subparagraph f) of art. 53.
The punishment applies to:
- recurrence of the offenses mentioned in the previous article is about;
- Acts or facts that tend to create discontent or unrest among the apartments to the Body;
- Alteration of the truth in the compilation of reports or records, unless it constitutes a crime;
- Serious abuse of authority;
- Drunk on duty;
- Sale, alteration or loan of Administration garments;
- Declaration of physical ailment, recognized afterwards, visiting from tax, non-existent.
Art.
60. Application of the punishment referred to in subparagraph g) of art. 53.
The punishment applies to:
- constant recurrence of the offenses referred to in articles Prev nti;
- Loss of the excellent moral conduct and civil;
- Having brought in at the end characteristic features of the first year of service the
ranking "mediocre";
- Have shown, in the known characteristics, for the first two consecutive years, the
classification "sufficient";
- Participate in uniform in the event policies;
- Offenses related art. 24 of these Regulations.
Art.
61. Application of the punishment referred to in point h) of art. 53.
The punishment applies to:
- any willful or negligent act against the State or against smmarinese friendly states;
- Any conviction for intentional crimes;
- Strike demonstrations or incitement to strike;
- Any act not serious nature prejudicial against property of the State;
- Failure to live up to the oath;
- Insubordination to addiction.
Art. 62.
punitive Faculty.
The punishments by the letter a) to c) it will be inflicted by the Commander.
The punishments by the letter d) to f) it will be imposed by the Secretary of State for Interior Affairs
behind hierarchical proposal.
The punishments of the letter g), and the letter h) will be inflicted by the State Congress behind proposals hierarchical
.
Art. 63.
First appeal.
Against punitive measures by the letter a) to f) may be submitted in writing to the Authority
immediately superior to the one he inflicted punishment.
If the decision was not to the liking punished, they can submit another appeal in
ten days the Congress of State that sanctions definitively.
The applicant, however, it is responsible for the deficiencies that he, commit with the appeal.
Art. 64.
According appeal.
Against the decision of the Congress of State involving the dismissal, also ranking
on known characteristics, or the dismissal, the employee may appeal to the Ordinary Judge
Appeals constituted for civil cases as Administrative Judge. The appeal must be presented
forward to the Registrar of the Commissioner's Court within ten days of notification of
measure of the State Congress.
It 'faculties given to the Administrative Judge of opening terms of testing and double check in order to
appeal filed.
The ruling of the Administrative Judge's decision is final.
Art. 65.
Temporary suspension.
At any time the Corps Command can proceed, pending the decisions of the Congress of State
or pending criminal proceedings, suspension of the employee from service.
The suspension pending judgment can be extended for the duration of judgment
same.
The temporary suspension will result in the loss of salary, unless the reintegration of
same in case of acquittal of any charge.
TITLE VII.
Special rules.
Art. 66.
Official Banner of the Body.
The official banner of the traffic police ècomposto of three body colors: antique yellow, white, purple.
Art. 67.
Uniforms.
To the members of the body is forbidden to make changes to the forms supplied uniforms,

That will be of the following form:
winter Uniform: black cloth to the Department, cordellino bleu for Graduated and for the Commander.
Jacket to a chest with two pockets and two breast pockets of t Military bit; sleeves without cuffs; straps profiled rigid
white and blue; buttons imprinted with "three feathers" and badges of rank-colored gold
; of gold award plaque with the number, to be asked under the right breast pocket;
insignia depicting the coat of arms of the Republic to the lapels of his jacket, and waterproof coat, gold;
Trousers without cuffs; black helmet and on the title page the coat of arms of the Republic gold;
white shirt and black tie; black double-breasted coat with belt and buttons in gold; high black shoes;
Cloth cap to the Commander, the Graduated and chosen Brigade;
Summer Uniform: white cloth for the Brigade, Graduated and Commanders, in the same manner and using the same
straps of the winter uniform; white helmet with the same coat of arms above,
white shirt and black tie; low white shoes; white cloth cap to the Commander, the Graduated
and the chosen Brigade.
Art. 68.
Clothing.
The clothing shown in the attached table no. 5 and at the expense of the Public Administration, which also
renewal according to the table.
Art. 69.
Personal cards.
The members of the body will be provided with personal badge of recognition. The card is issued
Commander Inspector of Police and the Graduated, chosen by
Brigade and Brigade Commander.
Art. 70.
Service States.
The Traffic Police Command must be kept for each employee, even temporarily, a state
unit registration, with personal data and information regarding the acquisition, to trial periods, punishment,
awards and all that relation to the service provided in the body.
TITLE VIII.
Final provisions.
Art. 71.
Transitional rule.
Upon entry into force of this Regulation the current members of the body, as long as no temporary
or older than that provided for by art. 48, enter the Corp of appointment right
maintaining the status they have in their possession, as long as such qualification is not in conflict with
this Regulation.
Art. 72.
Final provision.
Any law or provision contrary to this Regulation is repealed.
