We the Captains Regent of the Most Serene Republic of San Marino
Hereby promulgate and publish the following law approved by the Great and General Council
its meeting on 2 March 1972.
Art. 1
The relevant articles of the Law of 13 July 1962 n. 18 are deleted and replaced by the following:
"Art. 7 - Booklet"
The hunting license is issued on a special form school record:
a) a cover and attached leaflets containing the photograph and signature
the owner as well as the indication of the generalities and connotations;
B) bill from the Office of the Register stating the payment of the annual fee;
C) the receipts, issued by the Federation of hunting, which shall include the payment of the shares
for restocking, for entry to the Federation itself, for accident insurance and liability
. (* )
the annual fee for restocking is set by San Marino Federation of Hunting.
The capital and thresholds for accident warranty and liability are established by decree
reggenziale.
The holder must affix the signature on the cover and on the same license before the official that the

"Art. 8 - Minor"
The license may also be granted to persons under twenty-one years, when making use of

"Art. 9 - Eligibility Examination"
In order to obtain the release of the hunting license, or the return of the same in the event that either of
revocation of official suspension, must take an exam fitness exercise of hunting
front of a special commission.
The exam covers knowledge of the main Device laws regarding hunting,
zoology elements with particular reference to the recognition of the game, and the handling of weapons

In the opinion of the Committee on the examination it may be supplemented by a shooting practice test.
The candidate, to be eligible for examination, must prs nt to the Commission a medical certificate of fitness
psychophysics.
The Commission is appointed by the Home Secretary and comprises:
a) a Chairman appointed by the Home Secretary;
B) by the Director of the Agricultural or dl the same person in charge;
C) by the Commander of the Gendarmerie and an NCO of this;
D) by an expert in natural sciences (Zoology);
S) by the President or Vice President or the Secretary of the Federation of San Marino
Hunting, serving as Vice President of the Commission;
F) by two hunters appointed by the Federation of Hunting.
The Commission, which has a term of one year and elegg among its members the Secretary, shall meet when
convened by the President, after consultation with the Federation of Hunting.
Between an exam taken with an unfavorable outcome and the subsequent examination must spend at least six months
.
"Art. 10 - Requirement of good conduct"
The Command of the Gendarmerie may refuse to grant the license to those who are not
able to prove good conduct or do not give Reliable + ment not to abuse the weapons.

"Art. 11 - Term of license"

"Art. 15 - Application for license of type" B "
To obtain a license of type" B "the person must submit an application on stamped paper from L. 300 to

a) birth certificate;
b) certificate of residence;
c) citizenship certificate (for citizens of San Marino residents that certificate in Italy

d) criminal record certificate issued not more than one month;

"Art. 17 - Possession and presentation of the license"
Those who practice hunting must have with them the required license and is bound to show it to every request
of supervisory agents.
The offender is liable to a fine of L. 5,000 to L. 20.0000.
"Art. 18 - Port of pointe tools or cutting"

"Art. 20 - Periods of hunting license. Hunting season"

Every act constituting exercise of hunting, made in closed time, shall be punished with fine from

"Art. 21 - Vehicles hunt"
The hunt can be exercised with small arms, with dogs, with ferrets and falcons.
Any form of trapping is prohibited.
During the exercise of hunting are prohibited:
1) the use of support weapons;
2) the use of a short firearm;
3) the use of compressed air rifles, of any type and dimension;
4) the use of weapons equipped with silencers;
5) the use of firearms set, with snap caused by game;
6) the use of networks of all kinds, except by the Federation of Hunting for the purpose of restocking
or improvement of the species;
7) the soprerba, the strascino or strusa;
8) the limes or tense water (drinkable) for passer cei;
9) the poisons even if used for agricultural protection, if they can manage to lethal
game, and those intoxicating or explosives;
10) electric vehicles, lanterns and night pitfalls;
11) cages, baskets, snap stones, traps and all sorts of traps and pitfalls;
12) laces of any kind;
13) in the operation of electromechanical or acoustic calls, whether or not the sound amplifier;

The offender is liable to a fine of L. 10.00 per L. 60,000.
Art. 2
The relevant articles of the law 13 July 1962 n. 18 are deleted and replaced by the following
provisions:

"Art. 22 - Stalking hunting"
The stalking hunting is divided into fixed and temporary stalking.
They are fixed blinds those built in muratur or other solid matter, with site preparation and
intended durabilmente the shooting rules. They are surrounded by a clear zone of
for the purposes of security and protection.
All other ambushes are considered temporary.
"Art. 24 - Permissions"
The system must be fixed blinds preventi amente authorized by the Federation of Hunting

authorization.

"Art. 25 - Prohibitions plant"

Art. 3
The relevant articles of the law 13 July 1962 n. 18 are deleted and replaced by the following:
"Art. 35 - Hunting prohibited in cultivation in current land"

Violators are punished with a fine of L. 5,000 to L. 60,000.
"Art. 37 - the year of the hunt limitation"
The exercise of hunting is subject to the following limitations: a) prohibition of the use blinded calls;
B) prohibition of use as decoy partridge, the red partridge, the Sardinian partridge, rock partridge;
C) prohibition on hunting to rake in vacant land in more 'than four persons;
D) prohibition on hunting shooting from vehicles to animal or mechanical traction;
E) ban on partridges, partridges, quails and pheasants catches for skeet shooting.

The use of catch quail is limited exclusively to training and training of dogs and
to the tests on the ground.

"Art. 40 - Night Hunting

night hunting is exercised with the use of high beam.
"Art. 42 - prohibited game Hunting "
It 'always forbidden to kill and capture:
a) bats, porcupine, the hawk of any species and the goldfinch;
b) the bearded vulture (Gypaetus barbatus), cranes, flamingos, storks and swans;
c) owls. This provision shall not apply to the capture of owls and barn owls
intended to serve as a laughingstock;
d) female capercaillie and black grouse;
e) the swallows and swifts of any species;
f) the nightingale, the robin, the warbler of any kind, the ruler, the fioraccino, the wren, the cin ie, the
long-tailed tits and woodpeckers of all kinds;
g) the pigeons rock pigeon (Columbia livia), both of which colmbaia wild, domestic pigeons of any breed
including pigeons although in places far from the town, the pigeons that
escape the skeet shooting. the prohibition does not apply to the owners of the pigeons. the capture of
pigeons rock pigeon to be granted to the shooting ranges is allowed only to the Federation Hunting

H) game introduced by the Federation of Hunting during the acclimatization period.
The Regency, on the proposal of the Hunting Federation, will extend the prohibition to other
game species.
The offender is liable to a fine of L. 5,000 to L. 60,000.
"Art. 46 - Banish, restocking and capture areas, or"
The banned, restocking and capture areas and the oases are intended to increase the
of game play, even to favor the radiation in the surrounding lands, and
facilitate the parking of migratory species.

by any means, it is prohibited.
The construction of banned, oases and restocking and capture areas shall be established by Regency Decree
hearing the opinion of the Hunting Federation.

"Art. 50 - Gamekeeper and security guards hunting"
The Hunting Federation has the right to ask the Secretary of State for Internal Affairs the
recognition of gamekeepers and also voluntary security guards from among sciegliersi members who
give safe custody of seriousness and capacity and who wish voluntarily perform services
hunting supervision.
The warden and volunteer guards are allowed to perform their duties only after having taken the oath of
forward rite of the State Secretary for Internal Affairs.
The quality of volunteer security guard does not give rise to any tax advantage in the issuance of hunting license
.
"Art. 51 - Hunting is prohibited in a number of supervisory officers"
For the gamekeeper and the forest guards is forbidden to exercise hunting in the territory of the Republic
. The same, however, are authorized to catch vermin under the previous
Article 31; to this end they have the right to bring, ven in Prohibition time, shotgun ammunition on
broken or the rifles provided they are equipped with a special gun license issued
by the Command of the Gendarmerie at the request of the Federation Hunting.
The provisions of this Article shall not apply to voluntary security guards.
"Art. 54 - Capture of dogs"
Dogs of any breed, found wandering unattended in the countryside, must possibly be
captured by surveillance agents. Are considered unattended dogs that are not under the
surveillance, constant and effective, the owner or possessor.

Art. 55 - Case (*) of guard dogs, and followed by burrowing "

"Art. 56 - Concurrent offenses. Cases of increase in the sentence"
Conviction for infringement of the provisions contained in this Act
does not exclude the application of penalties for the same acts to be imposed by force criminal laws.
If not (*) it was possible, for the fact of the offender, perform the seizure of arms
or hunting tools, the penalty is doubled.
The punishment is likewise doubled if the offense is committed by a supervisory agent.
"Art. 59 - Additional penalties"
The sentence for violation of this law involves the forfeiture of the game. With the pronunciation of condemnation
the judicial authority it may also order the confiscation of the means of hunting;
the confiscation does not extend to the dog.
If convicted the judicial authority may also order the suspension of six months
license to two years and in particularly serious cases, dismissal.
The above mentioned measures are immediately enforceable notwithstanding any appeals against
of them according to the law.
In the case of suspension or revocation of the license the Gendarmerie they retire the book referred
art. 7.
The revoked license may only be granted again after two years after the revocation;
The term is three years in respect of repeat offenders.
The judicial authority shall transmit to the Command of the Gendarmerie and the Federation of Hunting
copy of any measure of conviction for violation of this law.
"Art. 63 - Fees for hunting licenses"
The licenses for hunting is subject to payment of the following annual fees:
1) - TYPE "A"
a) hunting license with use of rifle

b) hunting license even with use of

2) - TYPE "B"
a) hunting license even with use of

b) hunting license even with use of rifle

the supervisory agents admitted to the exercise of hunting and those belonging to the uniformed bodies
are entitled to a discount of 50% on all types of license .

Items 23, 26, 28, 30, 39, 57, and 58 of Legg July 13, 1962 n. 18 are hereby repealed.

This Act shall enter into force immediately after its legal publication.
