REPUBLIC OF SAN MARINO LAW 26 May 2004 72 REPUBLIC OF SAN MARINO Additions and changes to the law 17 July 1979 n. 41 (Discipline of the contributions of tasks and supply teachers for teaching positions in schools of all levels in the Republic of San Marino) We the Captains Regent of the Most Serene Republic of San Marino Promulgate and publish the following law passed by the Council Great and general during the meeting of May 26, 2004 Art. 1 1.1 teaching posts in full or part-time for support and integration of the Chairs in the general Plan prepared annually by the Joint Commission in accordance with Article 15 of the law 17 July 1979 n. 41, are assigned to those entitled by way of a fixed term contract for a maximum period of one school year. 1.2 The holder of a particular time position with part-time is entitled to complete the organization of teaching, on the basis of the position in the ranking according to Law 17 July 1979 n. 41. 1.3 The fixed-term appointments are to cease: a) when it ceases to hold the reason why the appointment was made; b) when the charge has lost one of the requirements referred to in subparagraphs d) and e) of Article 7 of Law July 17, 1979 n. 41. Art. 2 2.1 The teaching and educational continuity on custom projects for inclusion of carriers of deficit or pupils with special needs situations, referred to in Article 3 of Law 30 July 1980 n. 60, is ensured according to the procedures and criteria laid down by Article 11 of Law 21 of February 12, 1998, through the rational use of teaching staff and in compliance with current regulations. Art. 3 3.1 In the course of the school year, the holder of substitute teacher retains ownership of the replacement until the actual return to the jobholder service desk to which the substitute was granted, even if the absence ause varies in time. 3.2 The substitution is reconfirmed to the same holder, subject to the requirement of registration with the rankings, although in later school years, when the following concurrent conditions: a) when the absence of the chair holder is protracted over several school years; b) when its substitute has been granted since the beginning of the previous school; c) when the substitution is to be performed in the same or in the same classes or sections of the previous school year; d) when the reconfirmation does not affect the right to substitute the same maturity and the same weekly schedule or completion time, if payable, whose precedence in the classification. 3.3 it does not give rise to an extension of the substitution of primary school teacher when the substitute teacher has finished the cycle of elementary school. 3.4 The Teacher of Elementary School engaged in a substitution of several years, which is to mature the right to a commission for an indefinite period under the conditions referred to in paragraph 3.2 the upper., Has the power to proseguir the replacement until the end of the cycle school in the meantime acquiring ownership and All rights in the assignment he is entitled. The third and fourth paragraphs of Article 23 of Law 17 July 1979 n. 41 are amended and replaced: "The representatives or alternates who have held a full-time teaching position at the beginning of the school year until the end of the course and, if required, until the end of the examinations, or a total of at least 270 days
calendar during the same school year, are entitled to the enjoyment of annual leave as laid down in the third paragraph of Article 8 of the Law 1 December 1982 n. 108. The representatives or alternate who held a teaching position part time from the beginning of the school year until the end of the course and, if required, until the end of the examinations, or for a total of at least 270 calendar days during the same school year, are entitled to the enjoyment of paid annual leave as laid down in the third paragraph of Article 8 of the law of 1 December 1982, n. 108. In this case, the compensation is proportionate to the weighted average number of weekly teaching hours worked. "6.2 The representatives or alternate who held a teaching post at full or part-time, for a total of at least 200 days, become entitled to annual leave for a total of days proportionate to the period of leave laid down by the third paragraph of Article 8 of the Law of 1 December 1982 n. 108. in cases where the service has been carried out part time remuneration is in proportion to the weighted average hours per week of teaching activities. 3. After the fourth paragraph of Article 23 of the Law of 17 July 1979 n. 41, is added the following paragraph: "the representatives or alternates who, during the school year, have held a teaching post to full or part-time for a total period of less 200 days become entitled to annual leave on the basis of the service provided, as required by current Organic law, considering how "month" minimum assessable period for the purpose of service score. Art . 7 7.1. paragraph 1), point "B" Table "C" attached to the law 17 July 1979 n. 41 is amended as follows: "1) to teach in state schools of secondary education and evening classes for adults for obtaining the license Middle School of the Republic of San Marino, after the achievement of the title required for admission to the same teaching for each year or period usually evaluated as such points = 6. any service scores obtained for teaching previously provided on the basis of other academic qualifications are not cumulative. "Art. 8 1. For the aspirants to positions and supply teachers who enroll in the ranking on the basis of qualifications referred to in Article 3 of the Decree n. 49 of 25 May 1994 are applied Tables "A" and "B" attached to this law. 2. Tables "A" and "B" attached to the law 17 July 1979 n. 41 are only valid for those who enroll in graduatori on the basis of the securities referred to in paragraph 1 of the next Article 9. Art. 9 9.1. Aspirants to assignments and supply teachers in nursery school and elementary school, possess the specific professional degree for teaching in the aforementioned school levels achieved within the school year 1997-1998 and the joint educational qualifications equivalent to degree or conjunct the two-year training course organized by the Department of Education of the University of San Marino studies, as required by articles 3 and 4 of Decree 25 May 1994 n. 49, are enrolled in special lists on the basis of Tables "A" and "B" attached to the Law 41 of July 17, 1979. 9.2. Aspirants to assignments and supply teachers, who join the rankings based on the degree qualifying for teaching in nursery school or on the basis of qualifying undergraduate teaching in elementary school, keep score for any service rendered to the year 2002-2003 school year based on enrollment on the list by virtue of the specific professional diploma in teaching, the joint registration to the degree course in Primary Education or an equivalent degree program, referred to in paragraphs 2 and 3 of Article 3 Decree 49 of May 25, 1994. 3. For the aspiring to positions and supply teachers, who join the rankings based on the degree qualifying for teaching in nursery school or on the basis of qualifying undergraduate teaching in elementary school, achieved over the years
academic 2001-2002, 2002-2003, 2003-2004, 2004-205, in addition to the score for graduation according to the progression specified at point 1), as per above Tables "A" and "B", is awarded extra score points 2 for the possession of a degree, as required by sections 5) and 2) of the respective Tables "a" and "B". This score does not affect the allocation of possible scores for others to qualifications. To them it is given the score of any service rendered up to the school year 2002-2003 on the basis of membership in the ranking, by virtue of the specific professional degree for joint teaching to enrollment in the degree course in Primary Education or course degree equivalent, referred to in paragraphs 2 and 3 of Article 3 of Decree 49 of May 25, 1994. 9.4. Non-graduates who enroll on the list and who have gained the service on the basis of enrollment on the list by virtue of the specific professional diploma in teaching, the joint registration to the degree course in Primary Education or an equivalent degree program, have the priority over other non-graduates in the order of service points accrued up to the school year 2002-2003. Art. 10 10.1. Article 6 of this law takes effect from the school year 2004-2005. 2. The application of Article 7 of this Act shall begin with the formulation of the rankings for the 2004/2005 school year; They are subject to the service marks and rights acquired under the previous legislation. 10.3. The rules which contravene this Act are repealed. Art. 11 1. This Law shall enter into force on the fifth day following that of its legal publication.
