LAW 27 January 2006 LAW No. 21 of 27 January 2006 REPUBLIC OF SAN MARINO ORGANIZATION OF CIVIL PROTECTION We the Captains Regent of the Most Serene Republic of San Marino Promulgate and publish the following law approved by the Great and General Council at its meeting on 27 January 2006. article 1 (Purpose) the Civil Protection is designed to protect the integrity of life, assets, settlements and the environment from harm or risk of harm caused by human activity, natural disasters, catastrophes and events harmful nature of each exceptional. Civil Protection, through its organization, coordinates and manages all the necessary interventions. Compete for Civil Protection activities aimed at forecasting and prevention of the risk hypotheses with the implementation of measures to minimize such cases, to help the population and any other activity deemed useful for the purpose intended. The forecast involves direct activities to the study and determination of the causes of the disastrous phenomena, the identification of risks and the identification of the territory subject to the same risks. Prevention involves useful activities to prevent the risk or limit the damage feared event. The aid involves early intervention activities to ensure the population the necessary assistance to the event causing the damage, not only first aid but also the actions of logistical assistance and health care by providing the administrative and technical structures necessary. Art.2 (Coordination for Civil Protection) The Coordination for Civil Protection is a proactive and deliberative body on all activities aimed at the prediction and prevention of the possible risk and the subsequent activities to the occurrence of the feared event. The Coordinating Committee shall be convened and chaired by the Secretary of State for Internal Affairs as Deputy to the Civil Defence and is as follows: - the Secretary of State for Territory, the Environment and Agriculture can play in case of absence or impediment functions of the Home Secretary; - Secretary of State for Health and Social Security; - Secretary of State for Industry, Crafts and Commerce; - The Head of the Civil Protection Service. They may attend the meetings, if there is a need: - Commander of the Corps of the Civil Police; - Commander of the Gendarmerie Corps; - Commander of the Corps of Fortress Guard - Uniformed Unit; - The Company's Director of Production Autonomous State (AASP); - The Company's Independent Director of State for Public Services (AASS); - The Director of Health Services and Social and Health; - The Environmental Health Service Executive (SIA); - The Managing Director of the Agricultural and Environmental Resources (UGRAA); - The Head of the Fire Service and Civil Defence; - The Prevention and Protection Service; - The Office Planning Manager; - The President of the Red Cross of San Marino. Art.4 (The Head of the Civil Protection Service) E 'established the Cape figure of the Civil Protection Service, responsible for the service, which

The appointment of the Head of the Civil Protection Service is carried out by the Great and General Council at the proposal of the State Congress priority among staff employed in public administration who meet the following requirements: 1) degree in civil engineering - construction - mechanical - electrical engineering - Environmental - chemistry or degree in architecture or degree in geological sciences or bachelor's degree in environmental science, with five-year experience, professionalism and adequate attitude to the function being performed (for graduation means that the five-year old system or master the new system); 2) registered residence and effective in the territory. The post of Head of the Civil Protection Service is conferred with a private contract, for a period of three years which may be renewed. The emoluments of the Civil Protection Service Chief is defined by the State Congress, taking as a basis of the economic treatment of managerial qualifications of the public sector. This remuneration is approved by the Great and General Council. The appointment as Head of the Civil Protection Service involves detachment for those that are organic and the termination of the previous mandate for those who have been hired on contract. The Head of the Civil Protection Service, providing the Offices of the operating structures of Civil Protection, must be a data collection regularly updated on: 3 1) to identify the area of: a) public and private buildings for public use; b) industrial buildings that deal or trade flammable materials, explosives, toxic and harmful, corrosive, radiant; c) forest areas; d) power lines, gas pipelines, water and the drainage system and any other technological services; e) risk landslide areas and landslides and landslide risk. 2) the quantity of meteorological precipitation in real time and in the census of other climatic events; 3) the seismic risk. a) to the financial resources of the operating structures of the Civil Protection suitable for planned interventions; b) persons capable of maneuvering the means mentioned above; c) to the financial resources of the private companies in San Marino suitable for planned interventions; d) persons capable of maneuvering the means above. The Head of the Civil Protection Department coordinates all organs and structures referred to in Article 7 in the execution of civil protection activities. The Head of Service or, in case of his absence or severe impediment, the substitute as directed by the Coordination of Civil Protection, will implement the civil protection plans based on the evaluation of the calls received by the operations center located at the Command of the Civil Police and will inform President of the Coordination. They may also be called, and then become part of the operating structures of Civil Protection, the standardized Volunteer Corps of the Republic. The operating structures take place at the request of the activities provided for in this Law of the Civil Protection Service, as well as the tasks of support and advice to the Service. Article 8 (Types of intervention of Civil Protection) The interventions of Civil Protection are of two types: ordinary and extraordinary. Art.10 (Section Fire and Civil Protection) The Fire and Civil Defence Corps is a section of the Civil Police with the task of working with the Civil Protection Service to prevent and extinguish fires, to intervene to render assistance at fire and other damaging events that could impair or adversely affect the integrity of life, property, settlements and the environment; Section can perform urgent technical service tasks. In special cases and complex event, Section Fire and Civil Protection may require external assistance on the basis of existing conventions. Normally it has the presidium of the Central Office of the Civil Police and management of firefighting equipment and assigned civil protection. When they are put into effect the plans of action for the occurrence of a major harmful event or in danger of occurring, the Commander of the Civil Section and Fire Protection and Civil Defence Police are directly under the Head of the Civil Protection Service. Section Fire and Civil Protection cooperates with the Head of the Civil Protection Service to: - training of volunteers; - The inspections, inspections and investigation activities required by law within the province of opinions. Art.11 (Staff of the Civil Protection Service and Fire and Civil Protection Section) The budget of the Civil Protection Service staff and the section Fire and Civil Protection will be governed by a special law. All components of the Police Department Bodies are required to cooperate with the Civil Protection Service and Fire and Civil Protection Section of the disposal of the Civil Protection Service Chief. Art.12 (Permanent Unit and Emergency Response) On the proposal of the Coordination for Civil Protection will consist of the Permanent Unit and Emergency Service to be set up within the Office, and the State Services referred to in Article 7. Art . 13 (volunteer) for the purpose of wider participation in the activity of Civil Protection for citizens for both organized groups, there is the figure of the volunteer of the Civil Protection, whose functions and operations will be defined by the Coordination for Civil Protection . Art.14 (Financial rules) For the financial charges arising from the activities of the Civil Protection Department and Section Fire and Civil Protection will by creating specific items of expenditure in the context of the State Budget. The costs which are necessary for extraordinary measures are approved by the Coordination of Civil Protection, without prejudice to compliance with administrative procedures. Art.15 (and Provisional Rules) Within six months of the appointment of the Head of the Civil Protection Service, will have to be
prepared the regulations mentioned in point 1 of Article 3 of this Act, including those necessary to adjust the measures and precautions to be taken in the design and execution of construction works useful to minimize the risks of fire and ensure the safety of people and things. The Head of the Civil Protection Service, in agreement with the Managers of the Civil Protection structures, offers the Coordination of Civil Protection a standard action plan to immediately faced with damaging events. The Head of the Civil Protection Service cooperates in case of emergencies related to snowfall the snow route service, of Law 24 July 1992 n. 59. Pending the adoption of the laws referred to in paragraph one of Article 11, to be proposed within ninety days of the entry into force of this Act, the Commander of the Civil Police, as part of the body's internal organization, communicate the Coordination for Civil Protection personnel and means assigned to the section Fire and Civil Protection. 7 For the current XXV ^ Legislature attribution of the delegation of Civil Protection is assigned in accordance with current provisions. Art.16 (Repeals and Entry into force) are hereby repealed the law 1 March 1983 and 24 of the Decree 44 of April 25, 1984 and any other provisions contrary to the present law.
