Draft Decree Law DECREE REPUBLIC OF SAN MARINO - LAW 21 January 2014 7 We the Captains Regent of the Most Serene Republic of San Marino Having seen the need and urgency conditions laid down in Article 2, paragraph 2, point b) of the Constitutional Law of 15 December 2005 no. 183 and Article 12 of the Qualified Law 15 December 2005 n. 184 and more specifically: - the need to identify a figure to replace the Rector of the University of the Republic studies of San Marino given the current vacatio Rector; - The urgent need to appoint such a figure to ensure the management bodies of the University normal operation and the mandatory compliance of all acts provided by law; - The necessity and the urgency to extend the President and members of the Board of Auditing Committee of the University until the appointment of the new board of auditors; Given the decision of the Congress of State no. 21 adopted at its meeting of 14 January 2014; Having regard to Article 5, paragraph 2, of the Constitutional Law no. 185/2005 and Article 9 and Article 10, paragraph 2, of the Qualified Law n.186 / 2005; Promulgate and publish the following decree-law: URGENT PROVISIONS REGARDING THE UNIVERSITY OF STUDIES OF THE REPUBLIC OF SAN MARINO Single Article 1. The State Congress, pending the appointment of the Rector by the Great and General Council, with its resolution can make the appointment of a vicar chosen among full professors, the first band, with greater seniority in the University which will temporarily be vested with all the powers and functions of the Rector. 2. The validity of the resolution of the Congress of State referred to in paragraph 1 shall not exceed six months. To wholly exceptional circumstances such resolution may be extended for a further period not exceeding three months. 3. It is understood that with the appointment of the Rector of the University by the Great and General Council, the Vicar cease his duties immediately. 4. The President and the members of the Board of Auditors refers to extended and in full its powers, until the appointment of the new College.
