Draft Decree Law REPUBLIC OF SAN MARINO DECREE - LAW July 23, 2014 115 We the Captains Regent of the Most Serene Republic of San Marino Having seen the need and urgency referred to in Article 2, paragraph 2, point b) of the Constitutional Law of 15 December 2005 no. 183 and Article 12 of the Qualified Law 184 of 15 December 2005, namely: - the need and urgency to limit certain effects of the arrangements made with the common aim of supporting the revival of the image of a lively and historic center vital that may qualify as a point of attraction and meeting place, and - the urgent need to promote, in the summer tourist season, regular and successful continuation of the fixed assets and retail trade and administration of foods and drinks also on time night view of the resolution of the 12 State Congress adopted in the sitting of 22 July 2014; Having regard to Article 5, paragraph 2, of the Constitutional Law no.185 / 2005 and Articles 9 and 10, paragraph 2, of the Qualified Law n.186 / 2005; We promulgate and publish the following Decree-Law: AMENDMENT OF ARTICLE 9 OF THE DECREE OFFICER May 19, 2014 N. 78 - OPENING EVENING FOR THE BUSINESS OF DOWNTOWN Single Article 1. Article 9 of the Chief Executive Decree 19 May 2014 n .78 is replaced by: "Art.9 (Nighttime for commercial activities of the Historical Center) 1. the operators of fixed assets and retail trade and those carrying out the activities of administration of foods and drinks located within the walls boundary of the City of San Marino, are required, in accordance with the terms and procedures set out in this Article, the opening of their businesses in the presence of events and tourist events that take place in the historical center of the capital, organized by the State or from this subsidized or sponsored. 2. The Office's Director of Tourism at the beginning of each calendar year and in any case as soon as received the resolution of the State Congress of adoption of the annual program referred to in Article 8, is required to notify the associations for dissemination among its members a list of events and events of interest in the annual program for which there is an indication of evening opening of shops. 3. Trade associations of the commercial tourism sector should support the opening of shops for every evening planned by the annual programming provided for in Article 8, propose the opening of at least half of these exercises. 4. The events and events with an indication of opening night included in the annual program after the period provided for in Article 8 are determined, at least 30 days in advance, by the State Secretariat for Tourism in accordance with the interested trade associations, which still need to foster openness in the terms and with the goals expressed in the preceding paragraph also for events and demonstrations included later in the annual program. 5. For the purposes of this Article the opening night is to be considered indicative until 23:00 and in any case, according to the provisions of Article 35 of the Detailed Plan A1 03 of the Historical Center of the City of San Marino, for the main showcase of the stores is mandatory the use of a lighting system in the evening hours.
