Microsoft Word - DL045-2015.doc REPUBLIC OF SAN MARINO DECREE - LAW 31 March 2015 45 We the Captains Regent of the Most Serene Republic of San Marino Having seen the need and urgency referred to in Article 2, paragraph 2, point b) Constitutional Law 183 of 15 December 2005 and Article 12 of the Qualified Law 184 of 15 December 2005, namely: - the need to reintroduce the institution of compensatory rest as established in the Order of the Day approved by the Great and General Council on 5 June 2014 and for the reasons expressed therein; - The urgent need to benefit as soon as these rest the staff of Service Member - Board of Health as stipulated in the Agreement signed March 3, 2015, consistent to the vacation plan that each employee must draw up no later than 31 March 2015; Given the decision of the Congress of State # 1 adopted at its meeting on 31 March 2015; Having regard to Article 5, paragraph 2, of the Constitutional Law no. 185/2005 and Article 9 and Article 10, paragraph 2, of the Qualified Law n.186 / 2005; Promulgate and publish the following Decree-Law: COMPENSATORY REST OF STAFF OF SOCIAL HEALTH SERVICE ISS Unique Article 1. With effect from 1 January 2015, the non-administrative employees of the Service Member - Health excluding employees of the UOC Primary care and Territorial Health, are entitled to benefit, for the psychological stress accumulated during the calendar year, the compensatory rest days in addition to annual leave and subject to the same regulations, as usufruirsi to 50% in the first half and the remaining 50% in the second, to the following extent: a) for the staff of the Socio - Health Service which carries out duties of a psychiatrist for help, assistant psychiatrist, psychologist, developmental psychologist, psychotherapist, social worker and sociologist, a compensatory day off every three years of actual service in the same service, up to a maximum of four working days of compensatory rest in the year; b) for the remaining non-administrative employees of the Service Associate - Health, two days of compensatory rest every two years of service actually provided the same service for the first eight years and an additional day to the completion of the tenth year of service, up to a maximum nine working days of compensatory rest in the year; c) they are excluded from compensatory rest in letters a) and b) employees who perform management tasks or solely responsible for the Socio - Health Service. 2. Any new professionals not covered by the Delegate Decree 23 January 2015 3, will be framed in one of the types referred to in subparagraphs a), b) and c) on the recommendation of the Executive Committee of the Institute for Social Security, after comparison with the trade unions.
