RUSSIAN FEDERATION FEDERAL LAW on amendments to certain legislative acts of the Russian Federation changes and additions aimed at development of the system of mortgage loan (borrowing) adopted by the State Duma November 27, 2002 year approved by the Federation Council December 11, 2002 onwards (as amended by the Federal law dated 29.12.2004 N 189-FZ), Article 1. (Repealed-the Federal law dated 29.12.2004 N 189-FZ), Article 2. (Repealed-the Federal law dated 29.12.2004 N 189-FZ), Article 3. To amend the Federal law dated July 16, 1998 N 102-ФЗ "about mortgages (mortgage)" (collection of laws of the Russian Federation, 1998, no. 29, article 3400; 2002, no. 7, p. 629) the following changes and additions: 1. Article 76, after the words "in granting the loan" add the words "or targeted loan".
2. paragraph 1 of article 77 shall be amended as follows: ' 1. Unless otherwise provided by federal law or treaty, a house or apartment, purchased or built using credit means of the Bank or other crediting organization or trust loan provided by a legal entity for the purchase or construction of residential house or apartment, considered a pledge from the moment of State registration of the ownership right of the borrower on a house or apartment.
The mortgagee under this mortgage is Bank or other credit institution or legal person providing credit or trust loan for the acquisition or construction of a residential building or apartment.
3. In article 78: in the name of the word "stuffy" replaced by "enshrined";
paragraph 1 shall be amended as follows: "1. the treatment of mortgagee foreclosure on pledged dwelling house or apartment and the implementation of this property is grounds for the termination of right to use living together in such a dwelling-house or apartment Pledger and his family (former family members), provided that such a dwelling house or apartment were laid under the mortgage or mortgage under the law in providing a loan or trust loan provided by the Bank or other crediting organization or legal entity for the purchase or construction of such House or apartment.
The release of such House or apartment is effected in the manner laid down by federal law. ";
in paragraphs 2 and 3, the word "stuffy" in appropriate cases "should be replaced with the word" embodied "in appropriate cases.
Article 4. This federal law shall enter into force on the expiry of three months from the day of its official publication.
