in the year 2004-the Federal law dated 23.12.2003 N 186-FL has lost force since January 1, 2005 year-Federal Act of 22/08/2004, no. 122-FZ of the RUSSIAN FEDERATION FEDERAL LAW on the financing of the State Defence order for the strategic nuclear forces of the Russian Federation adopted by the State Duma on June 23, 1999 the year approved by the Federation Council July 2, 1999 years this federal law establishes the legal norms defining the composition of the State Defence order for the strategic nuclear forces of the Russian Federation, as well as the minimum necessary volume and order of its financing for the period from 2000 to 2010 year, inclusive.
Article 1. The basic concepts used for the purposes of this federal law, for the purposes of this federal law uses the following concepts: strategic nuclear forces of the Russian Federation (hereinafter referred to as the STRATEGIC NUCLEAR FORCES)-functionally combined command and control system of military associations, connections, and part of the strategic rocket forces, Navy and air force, having armed with drums a nuclear strategic missile defences, as well as to ensure the functioning and application of information and control systems;
the State Defence order for the STRATEGIC NUCLEAR FORCES (hereinafter referred to as the defence order)-part of the Government's defence order.
Article 2. The composition of the defence order 1. Defence order, minimum required levels of funding which are established by this federal law, includes: designing, delivery (purchasing), repair and modernization of armament and military equipment of missile complexes with intercontinental ballistic missiles; strategic cruise missiles; missile defence assets; the other missiles of the STRATEGIC NUCLEAR FORCES; space systems and complexes of liaison and command and control of the STRATEGIC NUCLEAR FORCES, missile warning and space monitoring; aviation equipment aviation STRATEGIC NUCLEAR FORCES; missile submarine cruisers strategic goods; communications and command and control of the STRATEGIC NUCLEAR FORCES);
capital construction, modernization and repair of special STRATEGIC objects;
preparation of serial production systems and complexes of the STRATEGIC NUCLEAR FORCES.
2. Not specified in paragraph 1 of this article, the supply of products (works, services) of Defence order, including recycling and elimination of weapons and military equipment, the volumes of financing shall be determined in accordance with the building plans (development) STRATEGIC NUCLEAR FORCES, as well as in accordance with international treaties of the Russian Federation in the manner prescribed by the Federal law "on State Defense order" and other laws and regulations.
Article 3. Minimum funding Defence order. (Secret.)
Article 4. Arrangements for funding the Defense order Funding defence order is carried out in accordance with the budgetary legislation of the Russian Federation, as well as, subject to the following provisions: 1) the Government of the Russian Federation in the draft federal law on the federal budget for the next financial year provides for the financing of the costs referred to in paragraph 1 of article 2 of this federal law, the supply of products (works, services) by defence order in amounts not less than the article 3 of this federal law, given by the Government of the Russian Federation to install the inflation index for the relevant period to ensure the actual funding need defence order;
2) in the basic indicators of the State Defense order, the cost of Defence order for referred to in paragraph 1 of article 2 of this federal law, the supply of products (works, services) should be disclosed separately. The most important (priority) delivery of goods (works, services) and amounts of funding may be indicated in the basic indicators of the State Defense order individual lines. Preliminary approval their list and funding takes place prior to consideration by the State Duma of the Federal Assembly of the Russian Federation draft federal law on the federal budget for the next fiscal year;
3) when addressing the State Duma a draft federal law on the federal budget for the next fiscal year or the draft federal law on amendments and additions to the Federal Act on the federal budget for the current financial year expenditure for defence contracts are not subject to reduction or redistribution without the concurrence of the Government of the Russian Federation;
4) established by the Federal law on the federal budget for the current fiscal year funding referred to in paragraph 1 of article 2 of this federal law, the supply of products (works, services) by defence order cannot be used for other purposes, as well as the repayment of financing defense order for previous years;

5) if due to objective circumstances defense in the current fiscal year is not fully implemented and funding relevant supply of goods (works, services) has been carried out, not spent for this reason funds must be sent in the next financial year to finance outstanding deliveries of goods (works, services) if they are stored;
6) in the case of non-entry into force by the beginning of the financial year, the Federal law on the federal budget for the next fiscal year funding Defence order is carried out in funding levels of Defence order for the corresponding period of the previous fiscal year, taking into account the inflation index for the past year.
Within two weeks from the date of entry into force of the Federal law on the federal budget for the next fiscal year, the Ministry of Finance of the Russian Federation shall pay the difference between the amount of financing of Defence order, which must be held within this period in accordance with the Federal law on the federal budget for the next financial year and the amount actually carried out financing. Ministry of defence of the Russian Federation in accordance with the established procedure within one week from the date of repayment of such difference distributes the funds.
Article 5. Changes and additions in this Federal Act amending and supplementing the present Federal law on the composition and terms of funding Defence order is carried out in the year 2005 after the State program development, creation and production of weapons and military equipment for the period from 2006 to 2010 year, inclusive, as well as, if necessary, in the following cases: 1) clarification to 2005 year State programme for the development of creation and production of weapons and military equipment;
2) changes in the composition of the STRATEGIC NUCLEAR FORCES;
3) conclusion of the Russian Federation, international treaties, suspending or terminating their actions;
4) established by article 3 of this federal law defense order funding in accordance with the index of inflation during the period.
Article 6. Monitoring the financing of Defence order control over the financing of Defence order is carried out in accordance with the budgetary legislation of the Russian Federation.
On the State Defense order funding, the Government of the Russian Federation shall inform the quarterly Federal Assembly of the Russian Federation.
Article 7. The entry into force of this federal law this federal law shall enter into force on the day of its official publication.
