RUSSIAN FEDERATION FEDERAL LAW on the procedure of making, consideration and adoption of the Federal law on the federal budget for the year 1998 and on the procedure for making changes and additions to the federal budget passed by the State Duma on June 20, 1997 year approved by the Federation Council July 3, 1997 years this federal law defines the terms and procedure for consideration and adoption, the Federal law on the federal budget for the year 1998 " as well as the procedure for introducing amendments and additions to the federal budget.
Chapter i. INTRODUCTION the draft federal law on the federal budget for the YEAR 1998 "in the STATE DUMA, article 1. The Government of the Russian Federation introduced the State Duma of the Federal Assembly of the Russian Federation, a draft federal law on the federal budget for the year 1998 "until August 26, 1997 year simultaneously with: prediction of socio-economic development of the Russian Federation for the year 1998;
the main directions of the fiscal and taxation policy in the year 1998;

the data about entry of changes and additions to the Federal law on the federal budget for the year 1997 ", with explanations of the causes and prognosis of the socio-economic impact of all these changes and additions;
forecast of Consolidated financial balance in the territory of the Russian Federation for the year 1998;
forecast of consolidated budget of the Russian Federation for the year 1998;
proposals on basic principles for the relationship of the federal budget and the budgets of the constituent entities of the Russian Federation in 1998 year and relevant calculations and orchestration protocols (differences) with the subjects of the Russian Federation;
projects of federal targeted programmes and federal regional development programmes envisaged for financing from the federal budget for the year 1998;
draft federal targeted investment program for the year 1998;
draft program of privatization of State enterprises in 1998;
calculations under articles classification of revenues of the federal budget, sections and subsections of the functional classification of expenditures and the federal budget deficit for the year 1998;
list of international treaties of the Russian Federation, containing its financial commitments in the year 1998, including non-ratified international treaties of the Russian Federation on State external loans and government loans, with an indication of the size of the financial obligations of the Russian Federation on each of them;
draft programme public external borrowing of the Russian Federation and the Russian Federation provided public loans for the year 1998 and draft structure of external debt of the Russian Federation in 1998 year by type of debt and by individual States;
draft structure of the State domestic debt of the Russian Federation and the domestic borrowing programme, envisaged in the year 1998 to finance the federal budget deficit;
draft programmes providing guarantees of the Government of the Russian Federation for the year 1998 and the report on the granting of guarantees by the Government of the Russian Federation during the period 1997 onwards;
the basic principles of the formation and expenditure budget of the development of the Russian Federation and relevant calculations;
information about the suspension of the decrees of the President of the Russian Federation, decisions and orders of the Government of the Russian Federation, as well as bills on repealing federal laws or the suspension of federal laws, the implementation of which requires the implementation of expenditure not provided for in the draft federal law on the federal budget for the year 1998 ";
other documents and materials provided by the Federal law "on state forecasting and programmes of socio-economic development of the Russian Federation".
At the same time as the draft federal law on the federal budget for the year 1998 "by the Government of the Russian Federation State Duma made the following draft federal laws on amendments and additions to legislation of the Russian Federation on taxes and fees;
on the budgets of State non-budgetary funds are not consolidated in the federal budget;
on amendments and additions to the Federal Act "on budget classification of the Russian Federation".
The Government of the Russian Federation until August 1, 1997 year introduced the State Duma a draft federal law on pricing of premiums in the State budget funds in the year 1998.
Article 2. If the draft federal law on the federal budget for the year 1998 and the draft federal law "on budget of the Pension Fund of the Russian Federation for the year 1998" provides indexing wages and pensions, the Government of the Russian Federation, concurrently with drafts, specified in the second part of article 1 of this federal law, introduced in the State Duma the draft federal laws on raising the minimum pension and the minimum wage increase as well as suggestions on the manner and timing of wage indexation of public sector employees, indexing and recalculation of State pensions.
Article 3. The Government of the Russian Federation in addition to the documents and materials referred to in article 1 hereof, shall be submitted to the State Duma: October 1, 1997 to the year: an estimate of the expected execution of the federal budget for the year 1997 and the consolidated budget of the Russian Federation for the year 1996;
the draft programmes of the Government of the Russian Federation guarantees in the year 1998 and the report on the granting of guarantees by the Government of the Russian Federation during the period 1997 onwards;
quarterly distribution of revenues and expenditures of the federal budget for the year 1998;
proposals for expenditure on the maintenance of the armed forces of the Russian Federation, other troops, military formations and organs, including expenses on the maintenance of military and civilian personnel of the armed forces of the Russian Federation, other troops, military units and bodies, with an indication of their strength at the beginning and end of the year 1998;
up to November 1, 1997 year-outcome of the execution of the federal budget for the first nine months of the year 1997.
Article 4. The Central Bank of the Russian Federation to the year October 1, 1997 represents in the State Duma the draft fundamental directions of the single State monetary policy in 1998 year. Previously the draft is sent to the President of the Russian Federation and the Government of the Russian Federation.
Article 5. Draft federal law on the federal budget for the year 1998 "is considered to be made in time if it is delivered to the State Duma before August 25, 1997 12:00 am onwards.
Within days of introducing the Bill to the State Duma the State Duma Council or in recess, the Chairman of the State Duma sends it into the State Duma Committee for budget, taxes, banks and finance (hereinafter-the Committee on the budget) for the preparation of the opinion on the compliance of the submitted documents and materials to the requirements of articles 1 and 2 of this federal law.
The Council of the State Duma or in recess, the Chairman of the State Duma on the advice of the Committee on the budget, decides on admission for consideration by the State Duma the Bill or return it to the Government of the Russian Federation for revision. The Bill will be returned back to the Government of the Russian Federation if the presented documents and materials do not meet the requirements of articles 1 and 2 of this federal law. The revised version of the Bill with all the necessary documents and materials must be submitted to the State Duma, the Government of the Russian Federation within 10 days from the date of the return for revision and considered by the Council of the State Duma or in recess by the Chairman of the State Duma in the manner prescribed by this Federal law.
Article 6. Draft federal law on the federal budget for the year 1998 "made in compliance with the requirements of this federal law, within three days from the day of its submission shall be sent to the Council of the State Duma or in recess by the Chairman of the State Duma, the President of the Russian Federation, the Federation Council of the Federal Assembly of the Russian Federation, other subjects of the right of legislative initiative, in the committees of the State Duma to make suggestions and comments, as well as in the Court of audit of the Russian Federation to prepare a report.
Responsible for the examination of the socio-economic development of the Russian Federation for the year 1998 and the concept of the draft federal law on the federal budget for the year 1998 "is the State Duma Committee on economic policy.
Responsible for the examination of the draft federal law on the federal budget for the year 1998 "is the Committee on the budget.

The Board appoints the State Duma the State Duma committees responsible for the consideration of the individual sections and subsections of the functional classification of expenditures of the federal budget and the federal targeted programmes (hereinafter-profile committees). For each section of the functional classification of expenditures of the federal budget is assigned at least two responsible committees of the State Duma, one of which is the Committee on the budget.
Responsible for review of draft federal laws on the budget of the Pension Fund of the Russian Federation, on the budget of the social insurance fund of the Russian Federation, on the budget for the State Employment Fund of the Russian Federation, to raise the minimum pension, indexation and recalculation of State pensions, raising the minimum wage, on the tariffs of insurance contributions into the Pension Fund of the Russian Federation, the social insurance fund of the Russian Federation, the State Employment Fund of the Russian Federation are State Duma Committee for labour and social policy and the Committee on the budget.
Responsible for review of draft federal laws on the budget of the Federal mandatory medical insurance fund, on rates of premiums in the Federal compulsory medical insurance fund and the territorial compulsory medical insurance are the State Duma Committee on health and the Committee on the budget.
Responsible for consideration of issues related to federal targeted programmes are profile committees, State Duma Committee on industry, construction, transport and energy and the Committee on the budget.
To ensure the necessary degree of confidentiality for the examination of individual sections and subsections of the functional classification of expenditures of the federal budget and the sources cover the federal budget deficit, the State Duma approves the composition of the working groups, whose members are responsible for the preservation of State secrets, in accordance with the legislation of the Russian Federation.
Article 7. The State Duma until September 5, 1997 year creates the State Duma Commission on the review of the federal budget and the introduction of changes and amendments to the tax legislation of the Russian Federation (hereinafter referred to as Commission of the State Duma).
The State Duma Commission formed according to the principle of proportional representation Deputy associations in the State Duma.

Article 9. Article 10. Subjects of the right of legislative initiative no later than 30 days from the day of its submission to the State Duma a draft federal law on the federal budget for the year 1998 "referred to the budget committee opinions on specified Bill.
Based on the opinions of the committees of the State Duma, Federation Council committees and entities the right to legislative initiative on the main characteristics of the federal budget for the year 1998 and the recommendations of the Commission of the State Duma and the Federation Council Commission budget Committee prepares a common opinion on the Bill, as well as the draft State Duma "concerning the adoption on first reading of the draft federal law on the federal budget for the year 1998 and the main characteristics of the federal budget for the year 1998" and submits them for consideration by the State Duma.
Based on the opinions of the committees of the State Duma the State Duma Committee on economic policy prepares a generalized conclusion according to socio-economic development of the Russian Federation for the year 1998 and the concept of the draft federal law on the federal budget for the year 1998 "and submit it for consideration by the State Duma in the first reading the draft federal law on the federal budget for the year 1998".
Article 11. Within 40 days from the day of its submission to the State Duma, the Government of the Russian Federation draft federal law on the federal budget for the year 1998, "the State Duma was considering its first reading.
Article 12. The State Duma during the consideration of the draft federal law on the federal budget for the year 1998 "in the first reading examines the forecast of social-economic development of the Russian Federation for the year 1998 and the concept of the draft federal law on the federal budget for the year 1998," the main directions of the fiscal and taxation policy in the year 1998, the basic principles on the relations of the federal budget and the budgets of the constituent entities of the Russian Federation, a draft programme of State external loans of the Russian Federation and the Russian Federation provided public loans for 1998 year in part of the external financing of the federal budget deficit as well as the main characteristics of the federal budget for the year 1998, which include: federal budget revenues by groups, sub-groups and articles classifying income budgets of the Russian Federation;
distribution of income from federal taxes and fees between the federal budget and the budgets of the constituent entities of the Russian Federation;
dimensions imbalance (deficit) federal budget in absolute terms and as a percentage of the expenditures of the federal budget for the year 1998 and the sources cover the Federal deficit;
total costs the federal budget for the year 1998.
Article 13. When considering in plenary at first reading the draft federal law on the federal budget for the year 1998, "the State Duma hears progress report of the Government of the Russian Federation and the sodoklady of the State Duma Committee on economic policy and the Committee on the budget and decides on the acceptance or rejection of the Bill. In the case of adoption in first reading of the Bill, the State Duma approved the main characteristics of the federal budget for the year 1998, defined in article 12 hereof.
Article 14. In case of rejection on first reading the draft federal law on the federal budget for the year 1998, "the State Duma can:

to pass the Bill in a conciliatory Commission to clarify the basic characteristics of the federal budget for the year 1998 (hereinafter referred to as the Conciliation Commission), consisting of members of the Commission of the State Duma, Federation Council representatives and representatives of the Government of the Russian Federation, to develop a coordinated version of the basic characteristics of the federal budget for the year 1998 on the basis of the recommendations of the State Duma, set out in the decision of the State Duma of the draft federal law on the federal budget for the year 1998 "and the main characteristics of the federal budget for the year 1998;
return the Bill to the Government of the Russian Federation for revision;
raise an issue of no confidence in the Government of the Russian Federation.
Article 15. In case of rejection on first reading the draft federal law on the federal budget for the year 1998 "and transfer it to the Conciliation Commission within 10 days from the date of the first reading of the Bill, is developing a harmonized version of the main characteristics of the 1998 federal budget year in accordance with as in the State Duma draft laws on amendments and additions to legislation of the Russian Federation on taxes and fees draft program of State external loans of the Russian Federation and the Russian Federation provided public loans for 1998 year in part of the external financing of the federal budget deficit for the year 1998.
The decision of the Conciliation Commission shall be taken by a vote of members of the Conciliation Commission separate from the State Duma, the Federation Council and the Government of the Russian Federation (hereinafter referred to as the parties). The decision shall be deemed to have been taken by the party if it receives a majority of the Parties present at the meeting of the Conciliation Committee of representatives of the parties. The voting of each party are entitled to one vote. The decision is considered to be consistent if he was supported by the three parties. Article 16. In case of rejection on first reading the draft federal law on the federal budget for the year 1998 "and return it back to the Government of the Russian Federation it within 20 days of finalizing the Bill, taking into account the recommendations and proposals of the State Duma, based on the conclusions of the State Duma Committee on economic policy and the Committee on the budget, and makes a draft federal law on the federal budget for the year 1998" by the State Duma in the first reading again. Article 17. In the case of the resignation of the Government of the Russian Federation in connection with the rejection of the draft federal law on the federal budget for the year 1998 the newly formed Government of the Russian Federation presents the new version of the draft federal law on the federal budget for the year 1998 "no later than 30 days after the appointment of the Chairman of the Government of the Russian Federation.
CHAPTER III. The SECOND READING of the DRAFT federal law on the federal budget for the YEAR 1998 "article 18. The State Duma was considering at second reading a draft federal law on the federal budget for the year 1998 "within 20 days from the date of the adoption of the Bill in the first reading.
The State Duma during the consideration of the second reading of this Bill approves expenditures sections of the functional classification of expenditures of the federal budget within the overall level of spending in the federal budget, approved on first reading, as well as the size of the Federal Fund of financial support of constituent entities of the Russian Federation.
Article 19. Subjects of the right of legislative initiative no later than 10 days from the date of adoption in the first reading the draft federal law on the federal budget for the year 1998 "shall submit to the Committee on budget amendments in accordance with the established form of federal budget expenditure under sections of the functional classification of expenditures of the federal budget.
Budget Committee considering amendments aimed in accordance with paragraph 1 of this article, and develops the project of the decision of the State Duma of the Federal Assembly of the Russian Federation "on the adoption on second reading of the draft federal law on the federal budget for the year 1998 and the apportionment of the expenses of the federal budget for the year 1998 under sections of the functional classification of expenditures of the federal budget."
CHAPTER IV. CONSIDERATION of the third reading of the draft federal law on the federal budget for the YEAR 1998 "article 20. The State Duma was considering a third reading a draft federal law on the federal budget for the year 1998 "within 30 days from the date of the adoption of the Bill on second reading.
The State Duma in the third reading of the Bill considers the following indicators of the federal budget: allocation of the costs of the federal budget on subsections of the functional classification of expenditures of the federal budget and all levels of departmental classification;
distribution of funds from the Federal Fund of financial support of constituent entities of the Russian Federation on the subjects of the Russian Federation;
the costs of federal targeted programmes;
draft federal targeted investment program for year 1998 within the expenditures approved under sections of the functional classification of expenditures of the federal budget on second reading;
list of protected current expenditures of the federal budget;
The budget for the development of the Russian Federation;
the draft programmes of the Government of the Russian Federation guarantees in the year 1998;
the draft programmes of the federal budget on a returnable basis for each type of expenditure;
draft programme of the Government of the Russian Federation and foreign loans provided by the Russian Federation State loans for the year 1998.
Article 21. Subjects of the right of legislative initiative no later than 10 days after the adoption of the second reading of the draft federal law on the federal budget for the year 1998 "shall submit to the Committee on the budget amendment in accordance with the prescribed form to the indicators the federal budget before the third reading.
Budget Committee examines the amendments, prepares summary tables amendments to sections of the functional classification of expenditures of the federal budget and sends them in specialized committees. Further consideration shall be governed exclusively by the amendments that have passed the examination in the Committee on the budget and the Government of the Russian Federation.
Article 22. Consideration of amendments to the relevant subsections of the functional classification of expenditures of the federal budget and all levels of departmental classification of expenditures of the federal budget, the cost of federal targeted programmes, the draft federal targeted investment program for the year 1998, the distribution of funds from the Federal Fund of financial support of constituent entities of the Russian Federation on the subjects of the Russian Federation, a draft program of State external loans of the Russian Federation and the Russian Federation provided government loans in 1998 year, projects, programmes providing guarantees of the Government of the Russian Federation for the year 1998 and draft programmes of the federal budget on a returnable basis for each type of expenditure on meetings of specialized committees which direct the amendments together with the results of their consideration by the Committee on the budget. Thereafter the amendments shall be considered at a meeting of the Committee on the budget, with the participation of representatives of specialized committees.
If the results of the voting on the amendments Committee and Budget Committee are the same, the decision thereon shall be deemed agreed.
The amendments on which the Committee and the Committee on the budget disagreement, are discussed by the Commission of the State Duma and made mandatory in the State Duma. The decision of the Commission of the State Duma is a recommendation to accept or reject the amendments in the State Duma.

If the amount of appropriations under the amendments to subsections of the relevant section of the functional classification of expenditures of the federal budget exceeds the amount of the appropriations approved in the second reading on this topic, conducted rating vote these amendments.
Textual amendments to reduce federal revenues by 1998 year or increase spending budgets at all levels, are not considered.
Committee on the budget, taking into account the decisions of the Commission of the State Duma and the Federation Council Commission for five days, prepares a balanced version of the apportionment of the expenses of the federal budget, as well as the text of the draft federal law on the federal budget for the year 1998 "and brings it together with the draft State Duma of the Federal Assembly of the Russian Federation" on the adoption of the third reading of the draft federal law on the federal budget for the year 1998 "in the State Duma.
Article 23. The total appropriation for each section of the functional classification of expenditures of the federal budget for the year 1998, taking into account the amendments adopted shall not exceed the amount of the expenditure under the relevant section, approved on second reading the draft federal law on the federal budget for the year 1998 ".
Chapter v. consideration in the fourth READING of a DRAFT federal law on the federal budget for the YEAR 1998 "article 24. financial assistance for the subjects of the Russian Federation Federal financial support to the subjects of the Russian Federation are made in shares, approved by article 25 of the Federal law on the federal budget for the year 1997 ";
extended the scope of article 17 of the Federal law on the federal budget for the year 1997 ".
CHAPTER VI. PROCEDURE for INTRODUCING AMENDMENTS and additions to the Federal BUDGET Article 28. Bills not involving changes to the major features of the federal budget for the current year are dealt with in the manner prescribed by regulations of the State Duma of the Federal Assembly-Parliament of the Russian Federation.
Article 29. Subjects of the right of legislative initiative make projects of federal laws to change the basic characteristics of the federal budget for the current year, to the State Duma and at the same time represent the following documents and materials: the opinion of the Government of the Russian Federation on the specified Bill;
financial-economic rationale;
the main characteristics of the federal budget for the current year, taking into account the changes;
calculations and substantiations on all articles of the Bill;
explanatory note on the need for the Bill.
This article does not apply to projects of federal laws on the introduction of sequestration costs the federal budget.
Article 30. The Council of the State Duma sends the draft federal law providing for the modification of the basic characteristics of the federal budget for the current year, as well as the submitted documents and materials in the Budget Committee to prepare an opinion on their compliance with the requirements of article 29 hereof.
The Council of the State Duma on the advice of the Committee on the budget, decides that the draft federal law shall be considered either to be returned to the subject of the right of legislative initiative.
Article 31. A draft federal law providing for the modification of the basic characteristics of the federal budget for the current year, made in compliance with the requirements of this federal law, shall be sent within three days, the Council of the State Duma, the President of the Russian Federation, the Federation Council, other subjects of the right of legislative initiative, in the committees of the State Duma, a Commission of the State Duma, Council of Federation, Deputy associations in the State Duma and the Government of the Russian Federation to make suggestions and comments as well as in the Court of audit of the Russian Federation to prepare a report.
Responsible for consideration of the Bill, the Committee on the budget.
Article 32. Within 20 days from the day of its submission to the State Duma a draft federal law to change the basic characteristics of the federal budget for the current year: the Commission of the State Duma and the Federation Council Commission consider the draft federal law and basic characteristics of the federal budget for the current year, taking into account the changes;
committees of the State Duma is prepared and sent to the Budget Committee of the conclusion on the draft federal law;
The Government of the Russian Federation shall designate an official representative in considering the draft Federal Assembly Federal Act.
Article 33. Based on the opinions of the committees of the State Duma Budget Committee prepares a consolidated opinion on a draft federal law specified in article 31 of this federal law, as well as the draft of the State Duma of the Federal Assembly of the Russian Federation on the Bill and submits them for consideration by the State Duma.
Article 34. The State Duma was considering a draft law providing for the modification of the basic characteristics of the federal budget for the current year, in three readings.
A bill that would change the basic characteristics of the federal budget for the current year, may not be submitted to the State Duma before the entry into force or the Federation Council rejection either by the President of the Russian Federation, the Federal law providing for the modification of the basic characteristics of the federal budget for the current year, a draft of which was submitted earlier and passed by the State Duma in the first reading.
If the State Duma two or more draft laws on making changes and additions to the Federal Act on the federal budget for the current year, these bills are subject to amendment at its first reading at the same time as alternative. In this case, can be adopted only one Bill and the remaining Bills can be considered as amendments adopted on first reading the draft federal law.
Article 35. Within 40 days from the date of introduction of the draft federal law to change the basic characteristics of the federal budget for the current year, the State Duma was considering its first reading.
Article 36. In the first reading a draft federal law to change the basic characteristics of the federal budget for the current year, at the plenary session of the State Duma hears progress report subject right of legislative initiative, makes the Bill, sodoklady the Committee on the budget, State Duma Committee on economic policy and the official spokesman of the Government of the Russian Federation and shall decide on the acceptance or rejection of the Bill.
Article 37. The State Duma was considering the second reading a draft federal law providing for the modification of the basic characteristics of the federal budget for the current year, within 20 days from the date of the adoption of the Bill in the first reading.
Subjects of the right of legislative initiative no later than 10 days after the adoption on first reading of the Bill referred to the Committee on the budget amendment in accordance with the prescribed form.
Budget Committee considering amendments aimed in accordance with part 2 of this article. Taking into account the amendments adopted budget Committee finalizes the Bill and made it to the State Duma in the second reading.

Article 38. The State Duma was considering a third reading a draft federal law providing for the modification of the basic characteristics of the federal budget for the current year, within 10 days from the date of adoption of the second reading of the Bill.
CHAPTER VII. FINAL PROVISIONS Article 39. This federal law shall enter into force on the day of its official publication.
