Expired-the Federal law dated 07.07.2003 N 109-FZ of the RUSSIAN FEDERATION FEDERAL LAW on the improvement of the pension schemes of the great patriotic war and widows of soldiers killed in the great patriotic war, receiving pensions under the law of the RSFSR "on State pensions in the RSFSR passed by the State Duma April 14, 1995 year Article 1. In order to improve pension provision for the participants of the great patriotic war and members of their families and with the imminent 50-th anniversary of victory in the Great Patriotic War: 1. The participants of the great patriotic war ("a"-"w" item 1 of part 2 of article 2 of the Federal law "about veterans"), not receiving simultaneously with the old-age pension (for longevity) disability pension, the pension premium to install in the following sizes : and) have reached the age 80 years or non-disabled persons in groups I and II-two times the minimum old-age pension;
b) other participants of great patriotic war-one of the minimum oldage pension.
2. The widows of soldiers killed in the great patriotic war, not entered into a new marriage with simultaneously entitled to various pension in accordance with the Act of the RSFSR "on State pensions in the RSFSR", pay two pensions, one of which-the survivor's pension due to the deceased husband.
Article 2. In accordance with article 1 of the present Federal Act to amend the Act of the RSFSR "on State pensions in the RSFSR" (records of the RSFSR Congress of people's deputies and the Supreme Soviet of the RSFSR, 1990, no. 27, p. 351; 1991, no. 17, p. 509; Gazette of the Congress of people's deputies of the Russian Federation and the Supreme Soviet of the Russian Federation, 1992, N 11, art. 531; Collection of laws of the Russian Federation, 1994, no. 15, St. 1680) the following amendments and supplements: 1. Article 5 shall be amended as follows: "article 5. The right choice of pensions for persons with simultaneously entitled to various public pension is awarded and paid one of their choice.
Entitled to two pensions: a) citizens who have become disabled as a result of military injuries (article 41 of the Act), the participants of the great patriotic war, disabled as a result of ordinary illness, industrial injury and other causes (excluding persons whose disability occurred as a result of their wrongful acts). They can be installed in old-age pension (or seniority) and disability pension;
b) widows of soldiers killed in the great patriotic war, not entered into a new marriage. They can be installed in old-age pension (or disability pensions, seniority, social) and survivor's pension due to the deceased husband. ".
2. Article 21 shall be amended as follows: "article 21. Allowances to pensions pensions are payable: a) care for a pensioner if he is a disabled person in Group I requires constant outside care (assistance, supervision) on the opinion of a medical establishment, or has reached the age of 80 years old;
b) for disabled dependants (article 50-53 of the Act), if they do not receive any pension. Disabled dependants allowance is paid to non-working pensioners;
in the) participants of the great patriotic war ("a"-"w" item 1 of part 2 of article 2 of the Federal law "about veterans"), not receiving simultaneously with the old-age pension invalidity pension.
The amount of the allowance to care for a pensioner if he is a disabled person in Group I or has reached the age of 80 years, equal to the size of the assistance (social) pension specified in paragraph "a" of article 114 of the Act.
The amount of the allowance to care for a pensioner if he is below the age of 80 years and requires constant outside care (assistance, supervision) on the opinion of a medical establishment, as well as allowances for each disabled dependant pensioner is the size of the assistance (social) pension specified in paragraph "b" of article 114 of the law, and the disabled dependant with a disability group III-specified in paragraph "b" of this article.
Participants of great patriotic war allowance specified in paragraph "b" of the first part of this article, is established as follows: a) have reached the age 80 years or non-disabled persons in groups I and II-two times the minimum old-age pension (part 1 of article 17 of the law);
b) other participants of great patriotic war-one of the minimum oldage pension (part one of article 17 of the law). "
3. Article 38 shall be amended as follows: "article 38. Pension allowance disability pensions in groups I and II are established allowances under "a", "b" and "b" of the first paragraph of article 21 of the Act.
To group III disability pension is fixed allowance provided for under paragraph "b" of the first paragraph of article 21 of the law ".
4. Add the Law Article 86-1 as follows: "article 86-1. Allowances to pensions for retirement pensions set allowance provided for under paragraph "b" of the first paragraph of article 21 of the law ".

Article 3. This federal law enters in force from May 1, 1995 year.
